SUMMARY OF CHANGES

The purpose of this amendment is to: Block 14 (Description of Amendment/Modification):

1) Extend the RFP due date from 6 Dec 2021 to 7 Dec 2021 at 2 p.m. CST.

2) Update Liquidated Damages Clause to include the rates for the seed project.

3) Update required submission copies to original plus three to align with Section L.

4) Incorporate Spec Section 28 31 76 for the Fire Alarm System (Attach 16).

5) Incorporate Revised Drawings for E-102, ED-102, E-103, and ED-103 (Attach 17).

6) Provide meeting minutes and information from Pre Proposal Conference and Site Visit.

7) Respond to questions received both prior to and as follow-up from the Pre Proposal Conference & Site Visit.

Section I - Contract Clauses

Miscellaneous text in this section has been modified to:

52.211-12 Liquidated Damages-Construction. Sep 2000 As prescribed in 11.503(b), insert the following clause in solicitations and contracts:

LIQUIDATED DAMAGES-CONSTRUCTION (SEPT 2000)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of which equals the combined average hourly rates of the Contracting Officer, Contract Administrator, Contract Managers, Contract Inspectors, and the Staff Judge Advocate responsible for reviewing the action; this average will be chargeable for the first day of delay only, subsequent days will be charged at a rate excluding the Staff Judge Advocate position. In the event the delay will result in substantial charges to the Government, (e.g. lodging, flying operations, etc.,) the additional damage limitations will be calculated and added into the appropriate Delivery/Task Order. Each Delivery/Task Order will have independent liquidated damages assigned depending on applicability, location and magnitude of work.

Seed Project Liquidated damages will be $492.32 for the first day and $421.83 for each day thereafter of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
