Solicitation FA4479-10-R-0002 SF1442 Block 13.B.; Section H 14.0 Bonding; Section I 52.228-1 Bid Guarantee; & Section L 1.5.2. Bonds
Issue
Proposal Guarantee Requirements
Questions/ Discussion
Referenced RFP provisions indicate conflicting requirements for a Proposal Guarantee. Please clarify if a Bid Bond is required to be submitted for the Seed Project with the Offeror's proposal, or if only a letter from a surety attesting to the Offeror's bonding capability will suffice.
Government Response
Section H paragraph 14 and FAR Clause 52.228-1 will be changed to reflect that the Bid Guarantee is applicable only to the "seed project" at the time of proposal submission. Section L Instructions to Offerors Paragraph 1.5.2: The letter attesting to bonding capability is for the annual estimated value of the contract. Again a Bid Guarantee is only required for the seed project amount. Clarifying language will be included in FAR 52.228-1 stating that the Bid Guarantee is only required for the seed project.

Issue
Form 1442 states that a bid guarantee is required supported by page 35 of 76, 52.228.1 where it states that a 20% bid bond is required. However, page 20 of 76, 20.1 states: “A proposal/bid bond is not required with the proposal. The offeror shall however, provide a letter or other verifiable evidence from the surety asserting offeror’s ability to obtain adequate bonding at the time of contract award with the contractor’s proposal.” These two statements seem to be in conflict relative to the furnishing of a bid guarantee and if it is the intent to provide only a letter from the bonding company to exhibit one’s availability to bond the project, it seems as though it should be provided with the proposal and not at contract award.
Questions/ Discussion
1) Is a bid bond in the amount of 20% required?
2) If a bonding capabilities letter is required does it need to be provided with the proposal?
Government Response
A bid bond shall be submitted for the seed project only. The bonding capabilities letter shall be included in Volume III. (Refer to question 1)

Paragraph 1.4.2 states we shall submit “3 to 5 Past Performance Information Sheets identifying active or completed contracts…”. Further, Paragraph 1.4.4 says to “provide data for up to 5 relevant contracts held within the last five years”. Are we to submit 3 to 5 projects in response to Paragraph 1.4.2 AND up to 5 projects for Paragraph 1.4.4, totaling up to 10 projects?

Section L, Paragraph 1.4.2.
Questions/ Discussion
Can you please clarify if the 3 to 5 projects required in response to Section L, Paragraph 1.4.2 should be similar IDIQ contracts or single projects/individual task orders? Page 62 of 76, Section L, Paragraph 1.4.2 states, “Data presented must include all relevant contracts held within the past five (5) years and demonstrate an ability to handle multiple projects with multiple disciplines.” Which sounds like you are looking for IDIQ contracts; however, Paragraph 1.4.3 says, “…project value between $2,000 and $750,000…” leading me to believe that you are looking for single projects and/or individual task orders.
Government Response
Not all potential contractors hold or have held similar IDIQ contracts. Therefore, multiple relevant contracts, in the range stated, performed simultaneously are deemed the equivalent of a similar IDIQ contract. The intent is for the contractor to demonstrate the capability to successfully perform multiple project at the same time.

Section L, Paragraph 1.4.2.
Questions/ Discussion
Can you please clarify if the 5 projects required in response to Section L, Paragraph 1.4.4 should be similar IDIQ contracts or single projects/individual task orders? It seems that the most relevant type of contracts would be similar IDIQ and/or IDIQ-type contracts rather than individual task orders performed under an IDIQ contract.
Government Response
See the response to Question 25.
Questions/ Discussion
What is the proposal delivery address? Is it the address listed in Block 7 on the SF 1442?

I am unable to locate Section 01000. Can you please direct me to where I can find this and/or provide Section 01000? |
