INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JUN 2008)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.

(ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a single copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained free of charge by submitting a request to the addressee in paragraph (i)(1)(i) of this provision.

Additional copies will be issued for a fee.

(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.

(j) Data Universal Numbering System (DUNS) Number. (Applies to all offers exceeding $3,000, and offers of $3,000 or less if the solicitation requires the Contractor to be registered in the Central Contractor Registration (CCR) database. The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address.

The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. An offeror within the United States may contact Dun and Bradstreet by calling 1- 866-705-5711 or via the internet at http://fedgov.dnb.com/webform. An offeror located outside the United States must contact the local Dun and Bradstreet office for a DUNS number. The offeror should indicate that it is an offeror for a Government contract when contacting the local Dun and Bradstreet office.

(k) Central Contractor Registration. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the CCR database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the Internet at http://www.ccr.gov or by calling 1-888-227- 2423 or 269-961-5757.

(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(1) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.

(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.

(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.

(4) A summary of the rationale for award;

(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.

(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

PROPOSAL PREPARATION INSTRUCTIONS

A. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein.

Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or sub factors. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of three (3) separate parts; Part I - Technical Acceptability, Part II - Price Proposal, and Part III - Past Performance Confidence Assessment. The following table lists number of submittals required and page limitations for each.

B. The contracting officer determined there is a high probability of adequate price competition in this acquisition.

Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.

C. PRE-PROPOSAL CONFERENCE: A pre-proposal conference and site visit will be held 9 Sept. 2010 (agenda is posted to FedBizOps site for this solicitation). All prospective offerors are urged to attend this conference. In order to make the conference as productive as possible, offerors are requested to submit, any questions they may have in writing to A1C Robert Tisdale at email address robert.tisdale@sheppard.af.mil or by fax at (940) 676-1669.

The submission of written questions will not preclude anyone from posing questions during the pre-proposal conference. Failure of a prospective offeror to submit any written questions or to attend the conference will be construed to mean that the offeror fully understands all requirements of the solicitation. Prospective offerors are advised that the pre-proposal conference will be held solely for the purpose of explaining the concepts involved in

the project and the specifications, terms and conditions of the solicitation. Answers to questions raised during the pre-proposal conference will be provided to prospective offerors via an amendment to the solicitation. All prospective offerors are advised that this solicitation will remain unchanged unless it is specifically amended in writing. If an amendment is issued, normal procedures relating to the acknowledgement and receipt of any such amendment as described in contract clause FAR 52.215-1, Instructions to Offerors, Competitive Acquisition, of this RFP shall apply.

D. Those planning to attend the pre-proposal conference shall forward the names of attendees and their company names to A1C Robert Tisdale at email address robert.tisdale@sheppard.af.mil or fax at 940-676-1669, no later than 1 workday prior to the conference. A valid driver’s license, vehicle registration, and proof of insurance are required for base access for all drivers. Passengers must also present Government issued identification to obtain a base pass.

E. JOINT VENTURE OFFERORS: If the offeror is a joint venture, the offeror shall provide all required solicitation information for all parties including a copy of the joint venture agreement. The agreement shall include information that identifies the responsibilities for each entity under the subsequent contract. The agreement shall demonstrate the relationship between the firms; and, identify contractual relationships and authorities to bind each entity of the joint venture. If the joint venture is comprised of 8(a) firms, the Small Business Administration (SBA) must approve the joint venture agreement prior to award.

F. TEAMING/PARTNERING OFFERORS: If the offer is based on a teaming/partnering relationship, the offeror shall provide all required solicitation information for all parties including a copy of the teaming/partnership agreement. The agreement shall include information that identifies the responsibilities for each entity under this contract. The agreement shall demonstrate the relationship between firms and identify contractual relationship and authorities to bind each entity of the teaming/partnering relationship.

G. INCURRED EXPENSES: The Government is not responsible for any costs incurred or associated with preparation and submission of a proposal in response to this solicitation. The offeror is required to submit an offer on all items. Failure to do so may disqualify the proposal.

H. In compliance with FAR Subpart 4.8, the Government will retain one copy of all unsuccessful proposals and will destroy all extra copies. No destruction certificate will be provided.

I. SUBMISSION OF COMPLETE PROPOSALS: All proposals must be complete, self-sufficient, and respond directly to the requirements of this solicitation. Failure to furnish a complete proposal, at the time of proposal submission, may result in the proposal being unacceptable to the Government and elimination from award consideration. Any commitments made in the proposal shall become a part of the resultant contract.

J. MODIFICATIONS PRIOR TO RECEIPT OF PROPOSALS: The Government reserves the right to revise or amend the specifications or drawings, or both, prior to the date of receipt of proposals. If, in the opinion of the Contracting Officer, revisions or amendments require material changes in the quantity or price of items, the date of receipt of proposals will be announced by an amendment to the Request for Proposal.

K. TELEGRAPHIC/TELEFAX OFFERS/AMENDMENTS: Telegraphic and telefax offers/amendments will not be accepted.

L. SPECIFIC PROPOSAL PREPARATION INSTRUCTIONS:

Contractors shall submit a complete proposal IAW the instructions below (including PARTS I – III) for the project entitled MĀ-SASC, “Multiple Award - Security Alarm Surveillance Contract,” no later than 4:00 pm Central Standard Time (CST) on 16 September, 2010. NOTE: Hard copies may be submitted not later than 4:00 pm Central Standard Time (CST) on 17 September, 2010, however, electronic copies must be submitted NLT 4:00 pm Central Standard Time (CST) on 16 September, 2010. Hard copies shall match the information submitted electronically.

(a) North American Industry Classification System (NAICS) codes 561621, 541512, 238210, 334290 and small business size standards, 750 employees, $12.5M, $25M and $14M, respectively. The NAICS code and small

An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(e) Contract award. The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(f) Multiple awards. The Government will award the MĀ-SASC to a minimum of three contractors and reserves the right to award up to six MĀ-SASC contracts. The MĀ-SASC is a multiple award contract. MĀ-SASC awardees will be awarded one or more task order projects at contract award to cover the contract minimum.

PART I – Technical Acceptability - Submit one (1) electronic copy via e-mail or on CD and original hard copy.

Within this factor, the offeror’s proposal shall demonstrate sound management principles to ensure that Performance Work Statement (PWS) requirements are met.

FACTOR A - Technical Acceptability. Initially, the Government technical evaluation team shall evaluate the technical proposals on a pass/fail basis, assigning ratings of “Acceptable,” “Reasonably Susceptible of Being Made Acceptable,” or “Unacceptable.” The technical proposal shall be evaluated against the following subfactors. The technical proposal shall address the following:

Sub Factor 1 – Organizational Plan, Manning Process, and understanding of Sheppard security alarms and surveillance standards.

(1) Provide an organizational chart that clearly identifies the management, security alarm and surveillance design. Include current Vindicator certifications of key security alarm and surveillance technicians.

(2) Identify lines of authority and responsibilities of key personnel in management teams and installation technicians.

(3) Describe the coordination, oversite and design/installation of projects.

(4) Identify how many concurrent task orders each project management team is capable of supporting.

(5) Describe the process and criteria used in selection of subcontractors.

(6) Describe the process by which your firm will meet the Sheppard security alarm and surveillance standards outlined in PWS paragraph 1.7.

Sub Factor 2 - Quality Control Plan (QCP):

(1) Identify qualifications of primary quality control inspector(s) (QCI).

(2) Identify the role and authority of the QCIs, and the role and authority of the site superintendent in ensuring the application of quality control to all projects.

(3) Describe the process for identifying and preventing defects before the performance becomes unacceptable.

(4) Describe the process for ensuring only high quality materials and workmanship are employed.

(5) Describe the procedures/processes used to identify unfavorable performance trends, poor performing subcontractors, and/or in-house workforce and how corrective action is integrated into that process.

(6) Describe the surveillance process and frequency; and, how the Government will interface with this process.

Sub Factor 3 - Design Capability:

(1) The offeror’s provide qualification and work experience information on key design personnel.

Include professional registrations, education, training, relevant experience, and office location.

(2) Provide a list of at least four (4), but no more than (6), projects designed by the offeror or its design team in the last three (3) years. These projects may include commercial designs for security alarm and surveillance systems similar to military installations, industrial complexes, and historical facilities and medical facilities.

PART II –PRICE PROSOSAL – Submit one (1) electronic copy via e-mail or on CD and original hard copy. The contractor shall submit a price proposal for the project entitled MĀ-SASC, “Multiple Award – Security Alarm Surveillance Cameras” which complies with the following instructions:

FACTOR B – Price Information

(a) Offerors shall provide pricing information described on all 6 seed projects listed below:

0001--Dorm 622 0002--Post Office Surveillance 0003--82 TRG Dorms 596, 776, & 862 0004--Courthouse Vindicator Duress Alarms 0005--Public Address Systems; Hangars 1040, 1080, and 1090 0006--Electronic Door Lock Systems Bldgs 280, 527, 530 & 1670

In accordance with MĀ-SASC PWS paragraph 1.8, contractors shall submit the expected number of construction trade hours it expects to perform with each task order. This will determine which wage adjustment applies to each task order (i.e., less than 32 hours of construction trade will require Service Contract Act wage determination; more than 32 hours of construction trade will require Davis Bacon Act wage determination.)

(b) The proposal price for the project, MĀ-SASC “Multiple Award – Security Alarm & Surveillance Contract” will be evaluated using the pricing techniques listed at FAR 15.404-1 (b)(2)(i), (b)(2)(v), and (b)(2)(vi), if applicable. All Offerors should base pricing on a performance period of 45 calendar days for each task order project after receipt of notice to proceed.

(c) Offerors shall price each of the seed projects listed above in the following manner:

1. Offerors shall price each task order project provided in this solicitation IAW the contract line item pricing (CLIN) provided with each of the task order performance work statements (PWS).

2. Offerors shall price all task order CLINs listed in each task order PWS (Base and Option CLINS)

3. Offerors shall also provide a detailed price breakout of these CLIN prices in a format that provides insight into the bill of materials, and pricing proposed for each task order project. This volume shall not exceed 10 pages per task order project (6 seed projects x10 pages = 60 pages maximum).

4. Offerors shall sum the total prices for the six “seed” projects and include the total price in Section SF1449 - Continuation Sheet, Item Number 0001. This information will be used for price evaluation purposes only IAW the evaluation criteria. No information is required on Section SF1449 - Continuation Sheet, Item Number 1001, 2001, 3001, and 4001.

PART III – PAST PERFORMANCE INFORMATION - Limited to no more than one (1) page per contract listed. Only references for same or similar type contracts are desired. Submit original plus electronic copy of attached past performance submittal form.

FACTOR C - Past Performance Information.

(a) Performance Surveys: The government will evaluate the quality and extent of offeror's performance deemed relevant to the requirements of this RFP. Relevant contracts include security alarm and surveillance

contracts on Federal Government installations, municipal/state projects, and other commercial contracts of comparable size and dollar amount; which, include multi-discipline security alarm and surveillance work and design. The government will use information submitted by the offeror and other sources, such as Federal Government operated contractor performance reporting databases, and commercial sources to assess offeror past performance. To assist in the past performance survey, each offeror is required to provide a list of at least three (3), but no more than ten (10), of the most relevant security alarm and surveillance contracts performed for Federal and commercial organizations within the last three (3) years. The evaluation of past performance information will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to this acquisition. Furnish the following information for each contract listed:

(i) Company/Division name

(ii) Product/Service, description of the project

(iii) Contracting Agency/Customer (including name and telephone number of contract administrator, buyer or Contracting Officer.

(iv) Contract number, contract type (i.e. fixed price, time and materials, etc.), indicating whether government or commercial contract, and dollar amount. Include a summary description of any subcontractor and the scope of involvement.

(v) Contract Dollar Value

(vi) Period of Performance

(vii) Verified, up-to-date name, address, FAX & telephone number, and email address of the Contracting Officer, and the Government/Customer Project Engineer.

(viii) Comments regarding compliance with contract terms and conditions.

(ix) Comments regarding any known performance deemed unacceptable to the customer, or not in accordance with the contract terms and conditions.

Offerors should forward past performance questionnaires provided with this RFP to each of the cognizant customer points of contact for the projects the offeror plans to include in its past performance proposal.

(b) Information Regarding Submission of Past Performance Submittal Form : Offeror’s references should be instructed to complete the past performance questionnaire and mail responses directly to the individual listed below no later than 4:00 pm CST on 16 September 2010. GENERAL INFORMATION

Information Regarding Submission of Proposal: Offerors are cautioned that Sheppard, AFB, TX has visitor control procedures requiring individuals not affiliated with the installation to obtain a visitor pass prior to entrance.

Offerors should allow sufficient time to obtain a visitor pass to be able to deliver the proposal on time. Late proposals will be processed in accordance with FAR 52.212-1(f).

EVALUATION FACTORS

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) Technical Acceptability (pass/fail)

(2) Past Performance

(3) Price

Past performance is significantly more important than Price when being evaluated. However, price will contribute substantially to the selection decision.

(b) Task Order Options. The Government will evaluate offers for award purposes by adding the total price for each task order options to the total price for each option. The Government may determine that an offer is unacceptable if any task order option prices are significantly unbalanced. Evaluation of task order options shall not obligate the Government to exercise task order option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

M-1. BASIS FOR CONTRACT AWARD:

This is a competitive best value source selection in which the technical capabilities of the offeror’s proposals will be evaluated on a pass/fail basis. Proposals determined to be technically acceptable will be evaluated for past performance and cost or price where competing offerors' past performance history will be evaluated on a basis significantly more important than cost or price considerations. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. All technically acceptable offers shall be treated equally except for their past performance records and price. Failure to meet a requirement may result in an offer being determined technically unacceptable. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.

PART I – FACTOR A – TECHNICAL ACCEPTABILITY - Initially, the Government technical evaluation team shall evaluate the technical proposals on a pass/fail basis, assigning ratings of “Acceptable,” “Reasonably Susceptible of Being Made Acceptable,” or “Unacceptable.” The technical proposal shall be evaluated against the following subfactors. The technical proposal shall address the following:

Sub Factor 1 – Organizational Plan, Manning Process, and understanding of Sheppard security alarms and surveillance standards. The standard is met when the offeror:

(1) The offeror’s organizational chart identifies the management, security alarm and surveillance design team with a proven track record of successful security alarm and surveillance projects. The offeror has certified Vindicator technicians capable of meeting all MĀ-SASC PWS requirements.

(2) The offeror’s lines of authority and responsibilities of key personnel in management teams and installation technicians are well established and have a proven track record of performance.

(3) The offeror has a proven track record of coordinating, overseeing and designing/installing projects similar to those anticipated under the MĀ-SASC.

(4) The offeror demonstrates that it has a track record of managing at least 5 concurrent task orders each project management team is capable of supporting.

(5) The offeror demonstrates a successful track record of selecting subcontractors that yield highly successful projects.

(6) The offeror demonstrates that it understands and will meet the Sheppard security alarm and surveillance standards outlined in PWS paragraph 1.7.

Sub Factor 2 - Quality Control Plan (QCP) – This sub factor is met when the offeror submits an effective and complete quality control plan and addresses the following:

(1) Identify qualifications of the primary Quality Control Inspector(s) (QCI)

(2) Identify the role and authority of the QCI and the role and authority of the site superintendent in insuring the application of Quality Control to all projects

(3) Describe process for identifying and preventing defects before the performance becomes unacceptable

(4) Describe process for ensuring only high quality materials and workmanship are employed

(5) Describe procedures/processes used to identify unfavorable performance trends, poor performing subcontractors and/or in-house workforce and how corrective action is integrated into that process

(6) Describe the surveillance process and frequency; and how the Government will interface with this process

The standard is met when the offeror: Provides a clear and concise Quality Control Plan which identifies its key Quality Control Inspectors (QCI) and their respective qualifications. Describes the QCI surveillance process and frequency. Additionally, the plan should explain how the offeror will identify defects, unfavorable performance trends, poor performing subcontractors, before performance becomes unacceptable and corrective action (to include documentation and resolution of deficiencies).

Sub Factor 3 - Design Capability:

(1) The offeror’s provide qualification and work experience information on key design personnel. Include professional registrations, education, training, relevant experience, and office location.

The standard is met when the offeror: Provides qualification and work experience information for key design personnel, including information on professional registration, education, training, and other relevant experience. Provides a list of at least three (3), but no more than ten (10), projects designed by the offeror or its design team from the last three (3) years. Failure to meet these minimum standards will result in the proposal being found to be unacceptable.

PART II – FACTOR B – PRICE PROPOSAL -

(a) The proposal price for the project, MĀ-SASC “Multiple Award – Security Alarm

Surveillance Contract” will be evaluated using the pricing techniques listed at FAR 15.404-1 (b)(2)(i), (b)(2)(v), and (b)(2)(vi), if applicable. Offerors’ proposed prices should be based on a standard performance period of 45 calendar days, for each task order project after receipt of notice to proceed. The government will evaluate offerors’ pricing information on all 6 seed projects described in this RFP

(i) Price will be evaluated for reasonableness subject to the procedures outlines above.

Reasonableness will be determined based on prices submitted by the competition, current market conditions, and comparison to the Government estimate. Prices will also be evaluated to determine if they are either excessive or insufficient for the effort to be accomplished. If task

order prices are determined to be 20% under the independent government estimate or the next low offer, the proposal may be eliminated for award.

(ii) The proposed price will be evaluated for reasonableness. A price that is too low or too high may endanger the proposal's opportunity for award of a contract.

(iii) Proposed MĀ-SASC prices will be evaluated individually by task order. The evaluation will consider CLIN pricing and the bill of material price break out for each task order (up to 10-pages per task order). This bill of material listing will be evaluated to ensure compliance with, and understanding of the Sheppard AFB security alarm and surveillance standards described in the MĀ-SASC PWS.

(iv) In addition to evaluating prices at the task order level, each offeror’s prices for all seed projects will be totaled in order to establish a “total evaluated price” (TEP) For the MĀ- SASC. This TEP will be used only for evaluation purposed as described in the Award Evaluation criteria described in para. M-2.

PART III – FACTOR C - PAST PERFORMANCE CONFIDENCE ASSESSMENT - Past Performance Information:

(a) Performance Surveys: The government will evaluate the quality and extent of offeror's past performance deemed relevant to the requirements of this RFP. Relevant contracts include relevant security alarm and surveillance contracts on Federal Government installations, municipal/state projects, and other commercial contracts of comparable size and dollar amount; which, include multi-discipline security alarm and surveillance work and design. The government will use information submitted by the offeror and other sources, such as Federal Government contractor performance reporting databases, and commercial sources to assess offeror past performance. The government will use the completed past performance submittal to contact the offer’s cognizant customers for each offeror’s 3 to 10 previous projects to gather past performance information.

(b) The purpose of the past performance evaluation is to allow the government to assess the offeror’s ability to perform the effort described in this RFP, based on the offeror’s demonstrated present and past performance. The assessment process will result in an overall integrated submittal that needs to ensure this is the latest past performance evaluation criteria. performance confidence assessment of “High Confidence,” “Significant Confidence,” “Satisfactory Confidence,” “Unknown Confidence,” “Little Confidence,” or “No Confidence,” as defined in AFFARS MP5315.3, Table 1 (see below). Past performance regarding predecessor companies will be rated as highly as past performance information for the principal offeror. Offerors with no relevant past or present performance history shall receive the rating "Unknown Confidence," meaning the offeror’s past performance is treated neither favorably nor unfavorably. See Table 1 below for additional clarification.

(c) In evaluating past performance, the Government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this RFP.

(d) Relevancy Ratings: Relevant performance includes performance of efforts involving requirements that are similar or greater in scope and complexity than the effort described in this solicitation. Relevancy will be assigned ratings of Very Relevant, Relevant, Somewhat Relevant, and Not Relevant. The Government will give greater consideration to information on those contracts deemed very relevant to the effort described in this RFP. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, teaming partner, or subcontractor. For this acquisition, past performance will be very relevant when it demonstrates quality performance as a prime contractor delivering security alarm and surveillance system installation and maintenance services within the last three years and the effort is similar or greater in scope and complexity than the effort described in the solicitation. The following relevancy rating definitions will be used in the assessment of relevancy:

M-2 ADDITIONAL INFORMATION (AWARD EVALUATION):

A. If the lowest priced (total evaluated Price = Sum of all 6 seed project prices) evaluated technically acceptable offer is judged to have a “High Confidence” performance confidence assessment, that offer represents the best value for the government and the evaluation process stops at this point. Award shall be made to that offeror. This process will be repeated until 3 to 6 proposals are identified, that represent the best value for contract award. The Government reserves the right to award between 3 and 6 contracts, depending upon the past performance evaluations and prices submitted by the offerors.

B. If the lowest priced three to six offeror are not judged to have a “High Confidence” performance confidence assessment, the next lowest priced offerors will be evaluated and the process will continue (in order by price) until three to six offeror are judged to have a “High Confidence” performance assessment or until all offerors are evaluated. The Source Selection Authority shall then make an integrated best value award decision selecting between 3 and 6 proposals for contract award. The Government reserves the right to unilaterally determine how many contracts will be awarded in this range.

C. Offerors are cautioned to submit sufficient information, in the format specified by Instructions, Conditions and Notices to Offerors.
