About this file
This is an Environmental Resource Permit application (Form #62-330.060(1), Section C) submitted to the State of Florida for the design and construction of an extension of Veteran's Memorial Boulevard in Collier County, connecting Livingston Road to U.S. 41. The project involves wetland and surface water impacts requiring state authorization under Florida's 404 Program and use of state-owned submerged lands. The proposed roadway extension will impact 668,210 square feet (15.34 acres) of wetlands and other surface waters, with 18,422 cubic yards to be dredged and 24,290 cubic yards to be filled. The application includes comprehensive environmental assessments across three project segments with seasonal high-water level elevations ranging from 8.5' to 8.78' NAVD88. Supporting documentation includes wetland delineation maps, soil surveys, aerial photographs, natural community vegetation maps, listed species surveys, and a Stormwater Pollution Prevention Plan addressing construction and long-term water quality management.
The applicant proposes to mitigate wetland impacts through the purchase of credits at Panther Island Mitigation Bank rather than implementing onsite mitigation. Environmental considerations detailed in the application address avoidance and minimization measures, wildlife and listed species coordination (including gopher tortoise relocation to Conservation Collier lands and Florida Bonneted Bat acoustic surveys with the U.S. Fish and Wildlife Service), water quality protection during and after construction, and secondary impact mitigation. The project demonstrates public interest through improved traffic flow and school accessibility while maintaining water quality standards through engineered stormwater detention areas and pond systems. Historical resource coordination with the Division of Historical Resources identified two sites (CR00242 and CR00737), with CR00242 already impacted by prior development and CR00737 determined ineligible for state listing. Wetland functional values assessed using the Uniform Mitigation Assessment Method ranged from 30 to 60 percent of potential value due to hydrological obstructions and exotic vegetation dominance.

Part 2: Environmental Considerations
Note: for many questions, a state statute/Applicant’s Handbook Volume I (AH I)/State 404 Program Applicant’s Handbook section is cited to assist the applicant in addressing these questions.
1. Elimination or Reduction of Impacts (Avoidance and Minimization). Describe measures taken to eliminate or reduce impacts to wetlands and other surface waters (Refer to AH I Section 10.2.1).
Because this project is confined to a platted road right-of-way its dimensions are extremely limited to accommodate a road, pedestrian and bicycle access meeting FDOT standards, and stormwater pre-treatment requirements. Every possible square footage of project area is being utilized for all of those previously building constraints, so elimination of impacts is not practicable or feasible.

The pond site was relocated to avoid conservation lands and then redesigned to avoid state listed species in the xeric scrub habitat adjacent to the pond site.
2. Fish, Wildlife, Listed Species, and their Habitats. Provide results of any wildlife assessments that have been conducted on the project site and provide any comments, biological opinions, formal or informal consultation decisions, or recommended actions you have received pertaining to the project from the Florida Fish and Wildlife Conservation Commission, the U.S. Fish and Wildlife Service, and the National Marine Fisheries Service. (Refer to AH I Section 10.2.2). A Listed Species Survey is included in the Environmental Supplement as Appendix 5. Coordination with FWS has occurred on the Florida Bonneted Bat and an acoustical survey is underway currently on the segment 2 pond site with data already collected over the proposed roadway. A report will be forthcoming during the permitting process.
3. Water quantity impacts to wetlands and other surface waters (Refer to AH I Section 10.2.2.4 and AH II).
a. Does the activity include a proposed surface water management system with a control elevation different than the wetland normal pool elevation(s) of existing or proposed created wetlands or other surface waters? No. Adjacent wetlands were used to establish the control elevation.
b. If yes to (a), provide documentation (e.g. drawdown assessment or other methods) that shows the proposed surface water management system will not change the hydroperiod of the existing or created wetland or other surface water. Not Applicable- the only wetlands onsite are to be filled.
4. Public Interest Test. Please describe how the proposed activity will not be contrary to the public interest, OR if such an activity significantly degrades or is located within an Outstanding Florida Water (OFW), that the regulated activity will be clearly in the public interest (Refer to AH I Section 10.2.3).
a. Please describe how the project will be designed to avoid adverse effects to public health, safety, or the welfare or the property of others.
As proposed the project will not influence any rivers, streams, or bays, which eliminates any concerns over fishing or shellfish harvesting impacts. As a road with properly engineered stormwater treatment, it also does not pose any environmental health issues or create any hazardous waste concerns. A Stormwater Pollution Prevention Plan is included in the engineering plans to address pollution and construction waste concerns.
There are pipes, dry detention and pond sites for each minor drainage basin of the roadway proposed to handle stormwater run-off, as well piping under the road if crossing an existing and remaining wetland habitat. No water trespass or water table affects will be imposed on neighboring properties to the project.
In terms of improving traffic flow from western Collier County towards the east and easier school access to a high school, middle school and elementary school, it provides a net public benefit by reducing commutes 5 to 7 miles one way from west Collier.
b. Please describe how the project will be designed to avoid adverse effects to the conservation of fish and wildlife, including endangered or threatened species, or their habitats.
Most of the wetlands onsite are dense with exotics and not utilized by wading birds or bald eagles based on a number of listed species surveys conducted, or they are small depressions which are dependent on summer rain for hydrology. Flows are also impacted by development immediately adjacent, so hydrology is generally not typical.
The one small road segment crossing a wetland in Segment 3 will provide piping to maintain connectivity.
Form #62-330.060(1) - Application for Individual and Conceptual Approval Environmental Resource Permit, State 404 Program

Gopher tortoises identified in various roadway segments and pond sites will be relocated to Conservation Collier lands as much as possible, then the remaining will be sent to a tortoise bank.
New proposed pond sites and their littoral shelves will provide open foraging habitat that does not exist onsite currently. Additionally, underground wildlife crossings are planned between the north and south portions of the Railhead Scrub Preserve.
c. Please describe how the project will be designed to avoid adverse effects to navigation or the flow of water or cause harmful erosion or shoaling.
As previously discussed, this project will not affect any streams, rivers, tributaries, or bays so navigation, erosion or shoaling concerns are not applicable to this project.
Because the eastern project is already bound by development and uplands, direct wetland impacts will not affect sheet flow in the vicinity of the project. Western project impacts will include culverts to allow for any wetland waters to continue exchange from north to south.
d. Please describe how the project will be designed to avoid adverse effects to the fishing or recreational values or marine productivity in the vicinity of the activity.
There is currently no fishing, boating, swimming, hunting, birdwatching, or marine fisheries production on or adjacent to this project which would be affected by the impacts. The project team is working with Conservation Collier to provide future access that is currently lacking for hikers at Railhead Scrub Preserve.
e. Will the project be of a temporary or permanent nature? Permanent
f. Please describe how the project will be designed to avoid adverse impacts to significant historical and archaeological resources, under the provisions of section 267.061, F.S.
Pre-application coordination with the Division of Historical Resources yielded a survey previously done along the high xeric scrub/ palmetto upland interface in Segment 1. The proposed project will cross site CR00737 which was not determined to be eligible for listing by the State Historical Preservation Office (SHPO). Communication is attached as Appendix 3. No current Historical Resource Surveys have been undertaken for the project.
A second resource, CR00242, was eligible for listing with the state Master Site File. Findings included shell scatter, a seasonal campsite, and sand tempered plain ceramics from the Late Archaic- Formative cultural period. The site was found to be in poor condition but recommended for preservation. This site, however, was already impacted by the Triangle Parcel development.
g. Please describe how the project will be designed to avoid adverse effects to the current condition and relative value of functions being performed by areas affected by the proposed regulated activity.
Each wetland value was scored according to the Uniform Mitigation Assessment Method for location and support, water environment and vegetative community structure. The highest functional values determined for onsite wetlands were typically 50 to 60% of their potential value due to hydrological obstructions and vegetation degradation, with scores dropping as low as 30%. Please reference Appendix 4 for UMAM forms.
5. Water Quality.
Provide a description of how water quality will be maintained in wetlands and other surface waters that will be preserved or will remain undisturbed, both on and offsite. Please address both short-term (such as during construction) and long-term water quality considerations (Refer to AH I Section 10.2.4).

(d) Maintaining construction equipment to ensure that oils, greases, gasoline, or other pollutants are not released into wetlands or other surface waters;
Please refer to the SWPPP for Best Management Practices that will be implemented onsite.
(e) Controlling the discharge from spoil disposal sites; and
Please refer to the SWPPP for Best Management Practices that will be implemented onsite.
(f) Preventing any other discharge or release of pollutants during construction or alteration that will cause or contribute to water quality standards being violated.
Please refer to the SWPPP for Best Management Practices that will be implemented onsite.
LONG-TERM
(a) The potential of a constructed or altered water body to cause or contribute to violations of water quality standards due to its depth or configuration. For example, the depth of water bodies must be designed to ensure proper mixing so that the water quality standard for A.H. Volume I December 22, 2020 10-10 dissolved oxygen will not be violated in the lower levels of the water body, but the depth should not be so shallow that the bottom sediments are frequently resuspended by boat activity. Water bodies must be configured to prevent the creation of debris traps or stagnant areas that could result in violations of water quality standards.
Not applicable for an upland project such as this.
(b) Long term erosion, siltation or propeller dredging that will cause turbidity violations.
Not applicable for an upland project such as this.
(c) Prevention of any discharge or release of pollutants from the activity that will cause water quality standards to be violated.
An engineered stormwater system with detention areas and stormwater ponds will be utilized for the road project that will ensure run-off meets the state water quality requirements.
6. Class II Waters; Waters approved for shellfish harvesting (Refer to AH I Section 10.2.5).
Form #62-330.060(1) - Application for Individual and Conceptual Approval Environmental Resource Permit, State 404 Program
Incorporated by reference in subsection 62-330.060(1), F.A.C. (effective date 12/22/2020) Section C, Page 6 of 15
a. Will the project occur in Class II that are NOT approved for shellfish harvesting? If yes, please provide a plan or procedure detailing the measures to be taken to meet the requirements of AH I Section 10.2.5(a). No
b. Is the project located adjacent to or in close proximity to Class II waters? If yes, please provide a plan or procedure detailing the measures to be taken to meet the requirements of AH I Section 10.2.5(b). No
c. Is the project located in Class II or Class III waters that are classified as “approved”, “restricted”, “conditionally approved”, or “conditionally restricted”? If yes, demonstrate that the project meets the requirements of AH I Section 10.2.5(c). No
7. Vertical seawalls. Are vertical seawalls proposed in an estuary or lagoon as part of the project? If yes, please describe how the project meets the requirements of AH I Section 10.2.6. N/A
8. Secondary Impacts (AH I Section 10.2.7).
a. Will an upland buffer, with a minimum width of 15' and an average width of 25', be provided between the proposed activities and existing wetlands or wetlands to be preserved, enhanced, restored, or created? Provide the location and dimension of all buffers on the plans. If not, demonstrate that secondary impacts will not occur or describe how they will be offset. It is assumed that there will be secondary impacts to offsite wetlands which will be mitigated for through the purchase of credits at Panther Island Mitigation Bank (see Appendix 6 Mitigation Plan).
b. If listed species are present or may be present, then coordination with wildlife agencies is needed.
Have you coordinated with the FFWCC and/or USFWS? If so, please provide correspondence from the wildlife agencies indicating concurrence with the species management plan(s). Coordination has not begun with FWC directly on the gopher tortoises, but Conservation Collier is in coordination with them to determine how many tortoises they can accommodate at Railhead Scrub Preserve. We have begun coordination with USFWS (FWS) on the Florida Bonneted Bat in terms of acoustical surveying. A full survey report will be forthcoming.
c. What measures will be taken to avoid impacts to wetland-dependent wildlife and/or listed species that use uplands for nesting or denning?
A detailed and lengthy listed species survey occurred over three years throughout the site and immediately adjacent lands prior to the submittal of this application (see Appendix 5). There is a known bald eagle nest site (CO931) which lies 0.36 miles south of Segment 1 and is situated near a larger offsite lake. This eagle has not been observed within the Phase II boundaries at any time thus far.
Wetland habitats within Segments 1 and 2 vary in function, typically between 30 and 50% of their potential value, due to hydrological flow obstructions, adjacent development and high densities of exotic plant species. There are limited opportunities for water-dependent species to forage within the project boundaries. One white ibis (Eudocimus albus) was observed flying over the site and one green heron (Butorides virescens) was seen flying over the county drainage ditch, but otherwise wading birds were not observed.
d. Describe whether there are any other relevant activities that are very closely linked and causally related to any proposed dredging or filling in wetlands or other surface waters that have the potential to cause impacts to significant historical and archaeological resources. No wetland dredge or fill impacts are proposed to historical resources. Based on coordination with DHR there are
