About this file

This is a Performance Bond form (AMS-Form-024) used by Brookhaven National Laboratory, managed by Brookhaven Science Associates, LLC under contract to the U.S. Department of Energy. The form is a template for contractors to provide performance guaranties on federal contracts.

The bond obligates the Principal (contractor) and Surety(ies) to perform all undertakings, covenants, terms, conditions, and agreements of the identified contract during the original term and any extensions, as well as any authorized modifications. The penal sum of the bond must equal the full contract amount and automatically increases with any change orders or modifications. If the Principal defaults due to material breach or files for bankruptcy, the Obligee may demand that the Surety, within 30 days of written notice, either: (1) obtain and submit qualified replacement contractors acceptable to the Obligee and commence work within 30 days, ensuring full staffing and timely completion; (2) acknowledge that time is of the essence and continue work without interruption while the Surety acts as general contractor until replacement is selected; or (3) provide 100% of costs to complete work, including acceleration and overtime costs, into an escrow account within 30 business days. The Surety's obligations encompass correction of defective work, cleanup and environmental remediation costs, latent defects, legal and engineering costs, delay costs, liquidated damages, and all damages resulting from delayed or non-performance. The form accommodates multiple corporate and individual sureties and requires corporate seals and authorized signatures. Individual sureties must be accompanied by completed Standard Form 28 (Affidavit of Individual Surety), and corporate sureties must appear on the Department of Treasury's approved surety list.
