About this file
This document is Amendment 2 to a Request for Qualifications (RFQ) issued by the Mississippi Department of Archives and History (MDAH), specifically addressing the release of qualifications as a public record. The amendment requires offerors to choose one of two options: either submit a redacted copy of their qualification with confidential information removed in black, or certify that their complete unredacted qualification can be released as a public record. Offerors must carefully select and comply with their chosen option, as failing to do so or selecting both options may result in being deemed non-responsive.
The amendment outlines specific legal considerations related to public records disclosure, referencing Mississippi Code Annotated sections 25-61-9, 75-26-1 through 75-26-19, and 79-23-1. It provides detailed instructions for handling confidential commercial and financial information, with potential consequences for improper redaction, including possible exclusion by MDAH or the Public Procurement Review Board. The document requires the offeror to provide their name, title, signature, and date when selecting their preferred option for qualification disclosure.

Offeror acknowledges that it may be subject to exclusion pursuant to Chapter 15 of the PPRB OPSCR Rules and Regulations if MDAH or the

MDAH may release the redacted copy of the qualification at any time as a public record without further notice to offeror. An offeror who selects this option but fails to submit a redacted copy of its qualification may be deemed non-responsive.
____ Offeror hereby certifies that the complete unredacted copy of its qualification may be released as a public record by MDAH at any time without notice to offeror. The qualification contains no information offeror deems to be confidential commercial and financial information and/or trade secrets in accordance with Mississippi Code Annotated §§ 25-61-9, 75-26-1 through
75-26-19, and/or 79-23-1. Bidder explicitly waives any right to receive notice of a request to inspect, examine, copy, or reproduce its bid as provided in Mississippi Code Annotated § 25-61-
