| Document: | Page | Section | Description | Question/Error | Answer |
| Solicitation | 114 | FAR/DFARS | 52.222-41, Service Contract Labor Standards | For accurate proposal generation, can the Government provide the wage determination that will become part of this contract? | The final solicitation will include Wage Determinations (titled Appendix F)for all Government Main Operating Base (MOB) locations. However, all Offerors are also responsible for proposing rates IAW Wage Determinations applicable to each Depot facility proposed. Wage Determinations for all locations (including MOBs and depot facilities) will become a part of the contract upon contract award. |
| Solicitation | 113 | FAR/DFARS | 52.223-11, Ozone-Depleting Substances and High Global Warming Potential Hydrofluorocarbons | 23.804 requires the insertion of 52.223-11 in contracts for: |
(i) Refrigeration equipment (in product or service code (PSC) 4110);
(ii) Air conditioning equipment (PSC 4120);
(iii) Clean agent fire suppression systems/equipment (e.g., installed room flooding systems, portable fire extinguishers, aircraft/tactical vehicle fire/explosion suppression systems) (in PSC 4210);
(iv) Bulk refrigerants and fire suppressants (in PSC 6830);
(v) Solvents, dusters, freezing compounds, mold release agents, and any other miscellaneous chemical specialty that may contain ozone-depleting substances or high global warming potential hydrofluorocarbons (in PSC 6850);
(vi) Corrosion prevention compounds, foam sealants, aerosol mold release agents, and any other preservative or sealing compound that may contain ozone-depleting substances or high global warming potential hydrofluorocarbons (in PSC 8030);
(vii) Fluorocarbon lubricants (primarily aerosols) (in PSC 9150); and
(viii) Any other manufactured end products that may contain or be manufactured with ozone-depleting substances.
Will the Gov. remove this clause as this solicitation is not for the acquisition of any of the above items?
| The C-20/C-37 CLS contract requires the use of aircraft cooling, refrigeration, and aircraft fire suppression applications that contain Class I Ozone Depleting Substances (ODS), which falls under 23.804(a)(1)(viii) of the clause in question. See also, paragraph 5 of the solicitation preamble, which states, "The contractor is authorized to use a suitable substitute for any Class I ODS which may be required by the specification of the contract with approval of the Contracting Officer. When it is known that a substitute is for a Class I ODS will be used in performance of this contract, the contractor shall identify the substitute to the Contracting Officer for approval before use. | Solicitation | 110 | FAR/DFARS | 52.227-14 Rights in Data-General | If the Government has decided to utilize both 52.227-14 and 252.227-7015, can the Government distinguish the portion of contract performance to which each clause pertains per 27.409(a)? | This clause has been removed IAW 27.400 which states, "This subpart sets forth policies and procedures regarding rights in data and copyrights, and acquisition of data. The policy statement in 27.402 applies to all executive agencies. The remainder of the subpart applies to all executive agencies except the Department of Defense." 52.227-14 Alt II has also been removed |
| Solicitation | 111 | FAR/DFARS | 252.225-7013 Duty-Free Entry. | Per 252.225-7013(i)(i) This clause does not apply to purchases of eligible products or qualifying country supplies in connection with this contract if— |
(1) The supplies are identical in nature to supplies purchased by the Contractor or any subcontractor in connection with its commercial business; and
(2) It is not economical or feasible to account for such supplies so as to ensure that the amount of the supplies for which duty-free entry is claimed does not exceed the amount purchased in connection with this contract
| As this solicitation is for commercial services and goods identical to the commercial businesses offered for Gulfstreams around the world, will the Gov. consider removing this clause? | This clause has been removed IAW 252.225-7013(i)(1) | |||||
| Solicitation | 111 | FAR/DFARS | 252.244-7001 Alternate I Contractor Purchasing System Administration. (Alternate I) | See note below on 252.246-7007. As this solicitation does not contain 52.244-2 and 252.246-7007 is only applicable to contracts that are subjet to the Cost Accounting Standards, this clause should be removed. | This clause has been removed IAW justification below | |
| Solicitation | 111 | FAR/DFARS | 252.246-7007 Contractor Counterfeit Electronic Part Detection and Avoidance System | 246.870-3(b) requires the use of the clause at 252.246-7008 in contracts using FAR part 12 procedures for the acquisition of commercial products and commercial services. The clause at 252.246-7007 is used for FAR part 15 acquisition of goods and services. 252.246-7007 states, "The following paragraphs (a) through (e) of this clause do not apply unless the Contractor is subject to the Cost Accounting Standards under 41 U.S.C. chapter 15, as implemented in regulations found at 48 CFR 9903.201-1." This contract is not subject to the Cost Accounting Standards, which makes 252.246-7007 not applicable to this contract. The solicitation should utilize 252.246-7008. | This clause has been removed IAW 252.246-7007, "The following paragraphs (a) through (e) of this clause do not apply unless the Contractor is subject to the Cost Accounting Standards under 41 U.S.C. chapter 15, as implemented in regulations found at 48 CFR 9903.201-1." | |
| Solicitation | 119 | FAR/DFARS | 52.227-19 Commercial Computer Software License. | As commercial aircraft software license agreements cannot generally be altered without violating copyright and trademark laws, can the Government specifically identify the software it has in mind with the inclusion of this clause and identify what rights it seeks to have with regard to that software? | This clause was previously removed from the solicitation | |
| Solicitation | N/A | I | Request for Incorporation of Economic Price Adjustment Clause | Given the economic uncertainties in the aviation spares market space, it considered high risk for any contractor to lock in a price for an extended period as aircraft spares suppliers are reluctant to lock in prices more than two years out. Will the Government consider including an economic price adjustment clause as part of this effort? | It is not considered in the best interests of the Government to add the Economic Price Adjustment Clause to the follow-on C-20/-37 CLS contract. However, as always, Offerors have the option to adjust out year pricing in accordance with perceived risk. | |
| Solicitation | 103 | Special Contract Requirements | Rights of the Government to Perform functions with its own personnel | Will the Government reconsider the language in Paragraph C? We note that a Contractor will still incur costs associated with staffing and maintaining readiness during the period which the Government assumes performance. We recommend including language that "the Government will equitably compensate the Contractor to maintain readiness to resume performance once the Government's performance of work ends." | The clause cannot be revised at this time. However, in the very unlikely event the Government ever chooses to perform C-20/C-37 CLS functions with its own personnel, the FFP task order affected will be subject to negotiation and bilateral modification. | |
| Appendix I | 6 | Annex 2 | HVA Repair On-time Delivery Incentive (sic) Process | Please clarify that federal holidays and other non-working days are not calculated in the on-time delivery evaluation criteria? | Federal holidays will not be included in the calculation for on-time delivery evaluation criteria. | |
| Appendix D | A025 | Production Manufacturer Approval (PMA) Parts Usage Report | The Government's response did not answer the question. The Government is already aware of the parts usage via CDRL A028 & A029. Can the Gov. remove the requirement for a parts usage report or provide an explanation for this requirement as there is no safety/airworthiness/configuration difference when using PMA parts? | A028 and A029 don't identify whether parts used are PMA or already approved in the IPC. PMA is a certified part for use on the airplane that is not listed in the IPC. If not listed in the IPC, PMA parts usage requires notifying the Government that the part has been installed. Without this notification the Government would not know the part had been installed and would have no way of tracking it. | ||
| Appendix G | x100 – x109 | Subscriptions | The option year template is incorrect. 6 month extension column is not accurate. Should be 6 not 12. | Cell W31 provides the quantity of months for the 6 month extension, and it is populated with a '6'. Cells W32-W41 include the number of aircraft receiving the subscription. Refer to the Calculation Methodology tab for more information. | ||
| 2nd Draft RFP Appendix G Pricing Matrix | C20-C37 CLIN Pricing | Flying Hours- CLINs X500-X599 | Evaluation Quantities (i.e. flying hours) in columns P-W are not provided. | Provided quantities that match chart. However, may need additional clarity. Is Appendix G the cap and the solicitation is the min.? | The Solicitation now matches Appendix G which matches the Projected Flying Hours documents. There is no cap or minimum number of hours. Flying Hours CLINs will be paid based on the actual number of aircraft hours flown on a monthly basis. The Flying Hours quantities included in the solicitation and Appendix G are estimates used to calculate the Total Evaluated Price (TEP). | |
| Appendix G | X900 | Labor | Field Team - Fixed hourly Rate |
Field team - Overtime Rate Field team - Premium Rate
| are all still missing from labor rates. | The omission of Field Team labor rates is intentional. Specific Field Team rates are not necessary. Established Maintenance and Engineering rates shall be used for Contract Field Teams requirements. See CLIN 0900 description within document entitled DRAFT FA813423RB002 CLIN Structure uploaded to SAM on 27 Oct for more information. | |||||
| Appendix G | CLINS X950 | Tuition CLINs | Does the Government intend to pay tuition for MOB sites that are not CONUS? | No, tuition will no longer be paid under a separate CLIN for OCONUS MOB sites. See DRAFT FA813423RB002 CLIN Structure for the most up to date draft CLIN structure. | ||
| Appendix G | CLINS X100 | INDS Subscriptions | Evaluation quantity is reflective of the entire fleet being handled by the successful contractor. However, the USN (AC 657, 5041, 5087, 5087) and USMC (1200 & 1201) currently maintain their own INDS Subscriptions. GAC believes the evaluation quantity should reflect the number 20. | Concur - Appendix G will be updated to 19 (reduction to quantity doesn't include USN AC 1189). | ||
| Appendix G | CLINS X101 | AFIS Subscriptions | The USN Fleet, USAF Fleet and USMC Fleet currently maintain their own AFIS (this should actually read ARINC) Subscriptions. GAC believes the evaluation quantity should reflect the number 0. | USAF quantity remains at 16, and USA confirmed their requirement for 3 subscriptions. | ||
| Appendix G | CLINS X106 | Meggit Wheels & Brakes Manuals Subscriptions | After further research, it has been determined that these sites utilize this subscription: Ramstein Air Force, Joint Base Andrews Army, Hickam Air Force, Pt. Mugu Navy, Kaneohe Bay Marine Corps, Joint Base Andrews Navy. GAC believes the evaluation quantity should reflect the number 15. | Ramstein nor JBA Army utilizes the Meggit Wheels & Brakes Manuals according to our knowledge; therefore, quantity should stay at 7. | ||
| Attachment 9 | 17 | USCG | BSA at DCA | Can the Government provide the BSA for the Coast Guard at DCA to determine what facilities and services are available? | Because the Coast Guard utilizes the CLS contract for supply support only, it does not have a BSA under this contract. The USCG maintains a separate BSA with the FAA which is outside the scope of our contract. This BSA is soley between the USCG, FAA, and Reagan. PWS Section 7 has been updated to remove "BSA - Reagan International." The USCG is mentioned in the JBA BSA for backshop services. | |
| PWS | 2 | 1 | Table 1.1 | The engine hours on the Chart do not match with Appendix G CLINS x400 series. Chart does not include engine cycles. | The Engine and Cycle rates on Appendix G for X400 CLINs are historical averages derived from the document entitled "USAF-Navy-Army Aircraft -Engine 5 Yr Flying Historical Data" uploaded to SAM.gov on 20 Jun 2023. Assuming "the Chart" refers to the document entitled "Projected Flying Hours_Fleet" posted to SAM.gov on 27 Oct 2023. This document was provided to provide more granularity to the numbers used for X500 Flying Hours CLINs. | |
| PWS | 4 | 1.3 | Revision of Services | Per PWS 1.3 and prior questions, the Government indicated price adjustments aren't allowed for short term aircraft reassignments (<90 days for one and <45 days for two). Thus bidders must pick CLINs to include this added cost/risk for any C-20/C-37 to be temporarily reassigned to any other MOB (absorbed by contractor) and still meet PWS 1.8 performance requirements at both sites. This will require temporary staff relocation or addition, travel, reallocation and/or added Parts & GSE (CAP, GFM, GFP). Costs are even higher if a C20 goes to a C37 site or vice versa. Staff quals & training must also be considered. |
Will the gov provide following guidance to help price this:
(A) Which MOB/COMBS CLINS should these added costs should be included in;
(B) approximately how many events per year per service
(C) for JBA, should these be equally distributed across the Army, Navy and USAF CLINS?
(D) Can the Government confirm that performance metrics will be suspended for MOBs with additional short-term transient aircraft are present? The Government does not foresee any additional risk associated with temporarily assigned aircrafts. If temporary staff relocation or addition and/or GSE is required, the Contractor will have the opportunity to submit a request for price adjustment. However, the Government has no expectation that this type of event will occur. The more likely scenario would be a temporary relocation of a single aircraft to an MOB to replace an aircraft down for an extended period of time for repairs and/or extensive depot maintenance.
A) The Govenrment sees no reason to include additional costs to any CLIN B) The Government foresees zero events per year per service C) N/A based on items A and B D) Performance metrics will not be suspended for MOBs with transient aircraft because the transient aircraft is not expected to represent an addition to the MOBs' current fleet size.
PWS 4 1.3 Revision of Services Per PWS 1.3. the Government indicated price adjustments aren't allowed for short term aircraft reassignments. This cost/risk will be significant, especially over the life of the contract.
| As an alternative and to ensure the government does not overpay for this service, would the government consider rolling Short Term Aircraft Reassignments into PWS 4.11.2 as a "Deployment" to be negotiated at the time of occurrence? | Please refer to information provided above. PWS 1.3 has been updated as follows: Price adjustments shall not apply for a single aircraft that is formally reassigned/added/deleted for less than three months in duration but would be considered on a case-by-case basis. | |||||
| PWS | 29 | 3.5.2 | Contractor Furnished Property | Did the Government intend to clarify that requests for special tooling and equipment by third party maintainers will come from and be approved by the PCO on a case by case basis? | Language added to reflect third party request to be reviewed by PO on a case by case basis | |
| PWS | 37 | 4.1 | Maintenance Documentaiton - 2nd Paragraph | Can the Government explain how it expects the Contractor to maintain configuration management if the Contractor does not have a clear picture of the maintenance activities accomplished by third party contractors? | PWS 4.1 paragraph 2 requires Contractor to complete aircraft maintenance forms for the USN/USMC for maintenance it performs. There's no configuration management or third party contractors mentioned in this paragraph. | |
| PWS | 38 | 4.1.1 | Computerized Maintenance Program - 1st Paragraph | Can the Government clarify its response in light of 3rd party maintainers in addition to the maintainer of the USAF aircraft at JBA? | The Contractor, IAW 4.1.2, will extract maintenance and configuration data from IMDS and input into CMP daily. The information gathered in 4.1.2 will allow completion of the requirement in paragraph 1 of 4.1.1. If the Big Safari program performs upgrades/modifications to the MCS, the Program Office will be responsible for providing any data required for configuration management. | |
| PWS | 38 | 4.1.1 | Computerized Maintenance Program - 2nd Paragraph | Can the Government explain how it expects the Contractor to maintain configuration management if the Contractor is not provided clear data for the maintenance activities performed by third party contractors? | As stated above, the Contractor, IAW 4.1.2, will extract maintenance and configuration data from IMDS and input into CMP daily. The information gathered in 4.1.2 will allow completion of the requirement in paragraph 1 of 4.1.1. If the Big Safari program performs upgrades/modifications to the MCS, the Program Office will be responsible for providing any data required for configuration management. | |
| PWS | 54 | 4.17.2 | C-20 Auxiliary Power Unit Maintenance | PWS 4.17.2 states, "The Contractor shall track in the 10-year Depot Maintenance Plan life limited parts and C-20 APU times to avoid expiration of time sensitive parts. The Contractor shall report the effective parts in the monthly C-20 engine status report. (CDRL A009)." CDRL A009 has a quarterly distribution - not a monthly distribution. Would the Government change the language of the PWS to reflect the quarterly distribution requirement of the CDRL? | PWS Language corrected to reflect quarterly instead of monthly | |
| PWS | 56 | 4.22 | Configuration Management | Can the Government explain how it expects the Contractor to maintain configuration management if the Contractor does not have a clear picture of the maintenance activities accomplished by third party contractors? | The Contractor has access to 3rd party maintainers' inputs within IMDS and is required to extract maintenance activities from that system to fulfill requirements listed in 4.22 including SAs, SLs, SIs, SILs, SNs, ACBs, Ads, TCTOs, ASCs, CBs, etc. | |
| Projected Flying Hours | N/A | Projected Flying hours for the fleet | Are the Programmed Hours shown in the Excel file inclusive of the Base year and all option periods? | The Programmed Hours shown in the Excel file are for the 12-mos base period of the contract (1 Feb 2025 to 31 Jan 2026). The remaining option periods are expected to be the same or similar, but are subject to change. |
