About this file

This evaluation document outlines the procurement process and selection results for BPM006797, an On Call Acquisition and Relocation Services contract administered by the Arizona Department of Transportation (ADOT). The solicitation was released on April 4, 2025, with a proposal deadline of April 25, 2025, and notifications were sent to 177 prospective suppliers registered on the Arizona Procurement Portal plus 12 additional suppliers. A pre-offer conference was conducted on April 10, 2025, via Google Meets, attended by six ADOT representatives and representatives from 12 suppliers. Six proposals were received and evaluated by an ADOT committee comprising David Edwards, Sandy Ojeda, and Sonia Munoz from the Right of Way Group. Following the initial evaluation, best and final offers (BAFO) were requested from four firms, with final evaluations completed on June 12, 2025. The contract is structured as an on-call services agreement with labor categories including Administrative Support Personnel, Intermediate Acquisition and Relocation Agents (Licensed), Senior Acquisition and Relocation Agents (Licensed), and Project Manager, with hourly billing rates varying by vendor. The contract includes four renewal periods with maximum escalation rates of 2 percent, 4 percent, 6 percent, and 8 percent respectively.

ADOT recommended awarding the contract to Tierra Right of Way Service Ltd based on the evaluation committee's consensus scoring. Tierra Right of Way Service Ltd achieved the highest overall score of 87.50 out of 100 points, demonstrating superior qualifications with 35+ years of relevant experience, 750 acquisitions and 600 displacements for ADOT, comprehensive staff training through multiple professional organizations, and 18 key personnel with extensive acquisition and relocation expertise. The firm's BAFO pricing totaled $1,100,000 for the initial contract period with a grand total across all renewal periods of $5,632,000. Agent Group LLC was deemed not susceptible for award. All six responding firms submitted required certifications including Non-Collusion Affidavits, ADOT Lobbying Certificates, and compliance documentation. The evaluation weighted organizational qualifications and staffing at 40 percent, key personnel qualifications and experience at 35 percent, and pricing at 25 percent.

MULTIPLE AWARD DETERMINATION

Cc: File Rev. 03/2025

Sections 1 through 3 MUST be completed Use Attachments as Necessary

1) Agency: Arizona Department of Transportation

Name: Bambi Brenden

Title: Procurement Officer

Date: June 18, 2025

Requisition Number: N/A Solicitation Number: BPM006797

Estimated Annual Cost: $3,000,000.00

2) Provide full description of materials or services: On Call Acquisition and Relocation services

3) Provide justification:

The total aggregate expenditures over the 5-year life of the previous contracts were approximately $1.1M, utilizing five (5) contracts. Historically, multiple contractors have been awarded a contract for these services to ensure sufficient coverage. Therefore, the recommendation is to award to a total of 4 suppliers to provide services for both federal and state funded projects. There has been a proven need for licensed real estate agents to provide on call supplemental services to the department’s Right of Way Acquisition and Relocation (ROW/A&R) unit for multiple projects administered concurrently throughout the State. The ROW/A&R unit has an ongoing need for these services and anticipates similar usage during the next contract period. The time and effort it takes to acquire and relocate residents and businesses vary for each project. If not acquired timely, the department could lose federal funding. The recommendation is to award to a total of 4 suppliers in order to provide adequate statewide coverage for the on call acquisition and relocation services from experienced real estate agents and brokers. In order to meet the needs of the Department and allow for the most competitive pricing through task assignment requests, it has been determined to be in the State’s best interest to allow for a multiple award. The Department received 6 proposals to the solicitation BPM006797. After evaluation, the following suppliers were determined responsible and the most advantageous to the state based on the evaluation factors set forth in the solicitation.
