About this file
This is a Source Selection Information Justification and Approval document for a non-competitive procurement of power generation equipment for Volk Field Air National Guard Base in Wisconsin.
The contracting activity (W50S9H – Volk Field ANGB) seeks to procure Cummins Inc. manufactured diesel backup generator equipment and installation services to support the Airfield Lighting Electrical Vault project. The contract is structured as a Firm Fixed Price (FFP) Commercial Construction Service contract funded with Sustainment, Restoration and Modernization (SRM) funds, with an estimated cost of $126,172.73. The procurement is justified under 10 United States Code 3204(a)(1) and Federal Acquisition Regulation 6.302-1(a)(2)(iii)(A), citing substantial duplication of costs to the Government that cannot be recovered through competition. The justification identifies that Volk Field's maintenance and training infrastructure is standardized on Cummins equipment, with younger Airmen trained on these units during Technical School. Installing alternative manufacturer equipment would require substantial additional training and third-party repair costs, creating unacceptable airfield downtime and operational delays. Market research was conducted via GSA Advantage, SAM.gov, and commercial websites; a Sources Sought posting on SAM.gov generated four responses. The contracting officer (Zachary R. Tevis) and technical/requirements representative (Maj. Nicholas Crovetti) certified that fair and reasonable pricing will be determined through comparative analysis to an Independent Government Estimate (IGE). The Contracting Officer approved the procurement on an other-than-full-and-open-competition basis subject to funds availability.

Justification and Approval for for Other than full and open Competition due to Highly Specialized Services - RFO FAR
Part 6.302
1. Contracting Activity: W50S9H – Volk Field ANGB
2. Description of Action: This approval is for brand name specified power generation equipment in a Firm Fixed Price (FFP) Commercial Construction Service contract funded with Sustainment, Restoration and Modernization (SRM) funds..
3. Description of Supplies/Services: Cummins Inc. manufactured power generation equipment to repair Airfield Lighting System project
4. Authority Cited: 10 United States Code 3204(a)(1) (as implemented by 10 U.S.C. 3204(b)(B) and RFO FAR FAR 6.302-1(a)(2)(iii)(A)), Substantial duplication of cost to the Government that is not expected to be recovered through competition.
5. Reason for Authority Cited: The Volk Field CRTC mainly operates with Cummins, Inc power generation equipment and mechanics to provide backup power for a vast majority of our back up diesel generators on base that are integrated into the power grid. Cummins, Inc's equipment/systems are unique in the fact that our younger Airmen train on these units in Tech School and are trained to work on them from the start of their military careers. To install another manufacturer's equipment/systems would require substantial duplication of cost to the Government not expected to be recovered through completion. Not using Cummins equipment and technicians will result in airfield down time and unacceptable delays in fulfilling the agency's requirements with expensive additional training or third party repairs
6. Efforts to Obtain Competition: The government is aware of several Cummins resellers on GSA Advantage and Open Market. This document will be made public after award through the Government Point of Entry in accordance with FAR 6.305.
7. Actions to Increase Competition: If future backup diesel generator system requirements arise, the Government will continue to seek out vendors proposing cost-effective solutions that meet the Government's needs. For this requirement however, Cummins, Inc. is the only manufacturer that can meet the Governments requirement.
8. Market Research: Market Research was conducted to determine commercial availability of the required items. Market research was conducted by querying GSA Advantage, recent local purchases as well as SAM.gov for previous contracts and historical purchases. Additionally, market research was conducted via commercial websites to gain additional information on commercial availably. Market Research indicated that the WI ANG and the US Air Force have awarded several contracts utilizing subcontractors of Cummins equipment.
9.
9. Interested Sources: A sources sought was not posted for this specific requirement because it is part of a much larger project specification. A Sources Sought was posted to sam.gov for this project and four responses were received.
10. Other Facts: Cummins Inc. manufactured power generation equipment is already standardized at the installation.
11. Technical and Requirements Certification: I certify that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
Typed Name: Maj. Nicholas Crovetti Title: Deputy Base Civil Engineer

12. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.
Determination of Price Fair and Reasonable will be made using a competitive range as well as comparative analysis to the Independent Government Estimate (IGE).
