MULTIPLE AWARD CONSTRUCTION CONTRACT (MACC)

1. DEFINITIONS:

a. Beneficial Occupancy - FAR 52.236-11, Use and Possession Prior to Completion, allows for the occupation of a building prior to final acceptance. The Contracting Officer must notify the contractor of the intent of the Government to take Beneficial Occupancy (BO) in writing. If the Air Force occupies the facility they must ensure there is no alteration, repair or change in any way to the facility, or any equipment therein prior to the government taking final acceptance. Changes of this nature could alter the

Government’s rights under the contract clauses for warranty and inspection.

b. Design-Build – The process by which the same contractor provides both the design and construction services for a project, completing the design before construction activity begins.

c. Design Costs – Those costs identified by the contractor, on the Bid Schedule, as part of the TOPR process which represent the portion of the overall project cost attributed to preparation of the design and construction documents (level of design to be determined per TO).

d. Designer of Record (DOR) - The individual accountable for specific portions of the design documents.

Where professional certification is required for the design, the Designer of Record would be the individual providing certification for that portion of the design. Where professional certification is not required, the

Designer of Record would typically be the individual who provided the design or specifications for a particular aspect of the project (i.e.: architectural, civil, structural, mechanical or electrical).

e. Fast Track Design-Build – The process by which the same contractor provides both the design and construction services for a project, beginning construction at a mutually agreed point prior to completion of the design and construction drawings.

f. Government Furnished Equipment (GFE) / Government Furnished Material (GFM) – Items of equipment or material which the government will supply to the contractor for use in the construction of a project.

g. Investigative Costs – Those costs identified by the contractor, on the Bid Schedule, as part of the TOPR process which represents the portion of the overall project cost attributed to all investigative services necessary to prepare the design and construction documents (level of design to be determined per TO).

h. Investigative Services – For exterior work / new facilities, the investigative services will typically include performing a survey of the project site including topography, cross sections, drainage survey, and bench level circuit. In addition, it may include verification and documentation of the location and size of all existing utilities and pertinent surface features for inclusion on the topographic survey map. For interior work, the investigative services will typically include verification of all existing conditions affecting the design and execution of the work as described in the TO.

i. Professional Certification – The process of affixing a seal or statement to a drawing or design document to indicate that the work to which it is affixed has been performed by a person licensed as a professional, in that area of expertise, in the state of South Carolina.

j. Statement of Work (SOW) – File(s) prepared by the Government and issued to the contractor as part of the Task Order. Included in the Statement of Work are the specific project requirements. For Design Build

Task Orders, this will include but is not limited to a description of the salient project requirements and references required to be incorporated in the design. For Design Bid Build Task Orders, this will include but is not limited to Drawings and Specifications.

k. Task Order (TO) – A document prepared by the Government and issued to the contractor which contains the general requirements and parameters of the proposed project. Included in the Task Order is the

Statement of Work defining specific technical requirements for the project. Also included is information such as budget limitations, type of solicitation, and design certifications and drawings required to be prepared by the contractor.

l. Task Order Proposal Request (TOPR) – A package of documents issued to the contractor requesting an itemized cost proposal for construction and/or design documents for a project based on the TO. Following submittal of the proposal, the Government may request clarifications from the contractor.

2. DESCRIPTION OF WORK:

a. Contract Scope:

Multiple Award Construction Contract (MACC) to support the construction program at Offutt AFB

(OAFB). Here, OAFB encompasses the following locations: OAFB main base, Elkhorn (35 NW of

OAFB) and Scribner (70 NW of OAFB) communication sites, Ehrling Bergquist Clinic (located off OAFB on Capehart Rd), Chapel (located off OAFB on Capehart Rd.), and Willow Lakes Golf Course and surrounding areas.

The type of work vendors can expect will include, but is not limited to, new construction, renovation/modernization, and repair/maintenance and/or demolition of buildings and structures, roads, grounds, and utilities. Work may also include design/build from concept to full 100% design. Vendors will furnish all materials, equipment, transportation, and personnel necessary for project requirements and to manage and accomplish multiple, simultaneous projects.

(i). New Construction:

▪ Building Construction: Erection of new facilities such as administrative offices, maintenance hangars, barracks, and dining facilities.

▪ Infrastructure Development: Construction of essential infrastructure including roads, runways, parking areas, and utility systems (water, sewer, electrical, and telecommunications).

▪ Specialty Structures: Construction of specialized structures including radar systems, communication towers, and security installations.

(ii). Renovation and Modernization:

▪ Interior Renovations/Alterations: Upgrades to existing interior spaces, including layout reconfiguration, fixture installations, and aesthetic improvements.

▪ Exterior Renovations/Alterations: Restoration or enhancements of building exteriors, including façade updates, roof replacements, and window/door installations.

▪ Systems Modernizations: Upgrading or replacing outdated systems such as HVAC, electrical, plumbing, and fire protections.

(iii). Repair and Maintenance

▪ Preventive Maintenance: Routine maintenance tasks to prevent deteriorations, including inspections, cleaning, and minor repairs (such as painting or stucco)

▪ Emergency Repairs: Urgent repairs required due to unforeseen incidents such as natural disasters or equipment failures.

▪ Corrective Repairs: Repairs needed to fix deficiencies or malfunctions in existing facilities and systems.

(iv). Demolition and Site Preparation

▪ Selective Demolition: Removal of specific sections of existing structures for renovations or new construction.

▪ Complete Demolition: Full dismantling and disposal of structures as necessary for new projects or site redevelopment.

▪ Site Preparation: Land clearing, grading, and preparation for new construction, including debris removal and hazardous material handling.

(v). Environmental and Safety Compliance

▪ Environmental Management: Compliance with environmental regulations, including waste management, erosion control, and natural resource protection.

▪ Safety Compliance: Adherence to safety standards and regulations, including PPE usage, safety training, and hazard assessments.

(vi). Utility and Infrastructure Upgrades

▪ Utility Installation: Installation of new utility connections for water, sewer, electricity, and telecommunications

▪ Infrastructure Enhancements: Upgrades to existing infrastructure to support new construction or improve functionality, including strengthening structures and improving drainage systems.

b. Initial Contract Issue, Seed Project, Post Award Orientation:

Initial contract will be awarded in accordance with Section M and solicitation requirements. The

Government intends to award the Seed project to the Offutt MACC awardee providing the overall Best

Value to the Government. The award of the seed project will meet the awardees minimum contract guarantee. All other Offutt MACC awardees will receive a $1,000 Post-Award Orientation Task Order to satisfy guaranteed minimums. If the seed project is not awarded, then the awardee would receive the

$1,000 Post-Award Task Order. All awardees will be required to attend the Post-Award Orientation. The

Seed project Task Order and Post-Award Orientation Task Orders are contingent on availability of funds.

c. Task Order Proposal Preparation

A Task Order Proposal Request (TOPR) will be issued to solicit all Task Orders (TO) under the MACC subsequent to initial contract issue, the Seed Project Task Order, and Post Award Orientation Task Orders.

All costs for preparation of task order proposals, whether funded or unfunded, shall be the contractor’s responsibility. At no time shall the Government provide reimbursement for the preparation of proposals. If awarded a TO for a design-build project requiring design, the successful contractor will complete the design, up to the 100% level, unless otherwise specified in the TOPR. This will include participating in design reviews, conducted at OAFB, at each design milestone (35%, 65%, etc) described in the TOPR. To be considered responsive for a design-build TOPR, offerors may be required to submit a conceptual design as part of the proposal.

Design milestones would include the following:

• 15% Concept Design:

o Description: Initial conceptual design to establish the general layout, scope, and approach of the project.

o Documents: Conceptual drawings, preliminary project description, basic design narratives, and initial cost estimates.

o Completion Level: High-level overview of design intent and feasibility.

• 35% Preliminary Design:

o Description: More detailed design that includes basic layout, major systems, and key design elements.

o Documents: Preliminary design drawings, design criteria, preliminary engineering calculations, and updated cost estimates.

o Completion Level: Refined design with essential features, including space planning and functional layout.

• 65% Design:

o Description: Advanced design development with detailed plans and specifications.

o Documents: Detailed design drawings, specifications, updated engineering calculations, and cost estimates.

o Completion Level: Comprehensive design showing most of the project’s details, including materials, systems, and construction methods.

• 90% Design:

o Description: Near-complete design with final revisions pending.

o Documents: Near-final design drawings, final specifications, complete engineering calculations, and updated cost estimates.

o Completion Level: Almost complete design, with minor adjustments needed before final submission.

• 100% Design (Issue for Construction):

o Description: Final design ready for construction.

o Documents: Complete design drawings, final specifications, final engineering calculations, and final cost estimates.

o Completion Level: Fully detailed design with all necessary information for construction, including contractor instructions and technical requirements.

Estimation of Task Order Proposals in Advance of Funding: During the course of the contract, the

Contractor may be required to provide proposals on TOPRs in advance of funding. These TOs may not have funding available and there is no guarantee that funds will become available for award of the Task

Order. No separate compensation for any pre-order costs including proposal preparation and attendance during negotiations or site visits will be due to the contractor for TOs that are negotiated and funding is not provided.

Fiscal Year-End Procedures: The Contractor may be given a list of TOs that OAFB reasonably expects to receive funding. The list may be revised for both additions and deletions based on the Government’s requirements. The Government shall incur no obligation until such time as funding become available and a

TO is executed.

d. Task Order Proposal Evaluation Criteria:

Proposals received in response to a TOPR will be evaluated based on compliance with the TOPR requirements and the proposed price. Price evaluations will determine reasonableness of an offeror’s price and balance of an offeror’s CLIN structure. To that end, the Government may use various techniques, including but not limited to those defined in FAR 15.404.

e. Competition: MACC awardees will compete for subsequent task orders. Contractors are required to submit responsive proposals on 75% of TOPRs over a twelve (12) month period of performance. Contractors are encouraged to participate in all site visits and submit proposals.

3. CONTRACTOR OPERATIONS: The Contractor shall conduct all operations in accordance with the MACC contractual documents and TOPR Requirements.

4. COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK: The contractor shall commence work and complete the project in accordance with the time frames established in the TO and Notice to Proceed (NTP).

5. PROGRESS OF WORK: Once awarded Notice to Proceed for Construction, the successful contractor shall submit for approval all schedules to the Contracting Officer in accordance with TOPR Specification Section 01

10 00.

6. MATERIAL APPROVAL SUBMITTALS

a. Technical Data, Samples, and Color Boards:

All equipment, products, material, and articles requiring approval, shall be submitted by the contractor using the AF 3000. All wall covering, carpet and other fabric type submittals will show the full pattern of material as a minimum. When required by the TO, all applicable product samples shall be submitted on a color board grouped to correspond with the anticipated installation. i.e.: floor covering, paint, paneling, chair-rail, wall covering and ceiling tile. The contractor shall include technical data with the products presented on the color board so that the items may be approved for technical compliance as well as architectural compatibility. Contractor is responsible for identifying and locating required materials for submittals to include matching any existing materials.

b. Designer of Record Approval:

When required by the TO, the DOR shall review and approve equipment, product, or material submittals and indicate compliance with the design documents prior to the submittal being forwarded to the government for review. Those submittals requiring DOR approval shall be included on the Form 4288-R.

7. AS-BUILT FILES:

a. Drawings:

During the progress of the work, the contractor shall keep a careful record at the job site of all changes and deviations to the layouts shown on the drawings. The contractor shall manually enter such changes and corrections on record drawings promptly. At the completion of the project, the contractor shall provide the government with draft and final as-built drawings in accordance with the TO requirements.

b. GPS Data:

The contractor shall furnish survey data showing the horizontal/vertical location of all site improvements constructed under the Task Order to include, but not limited to, topography, buildings, pavements, utilities, and all similar construction. Site improvements such as buried utility lines require one survey shot every

50’ of straight line, at each turn or bend in the line, hydrants, fittings, valves, valve boxes, curb stops, relocations and crossings of existing utilities, structures, or other appurtenances relocated or affected by the construction. Also provide elevations for the topmost point of visible appurtenances such as fire hydrants and valve boxes, and provide rim and invert elevations for all manholes in the project area. The contractor shall use conventional surveying methods such as total stations, automatic levels, or Global Positioning

System (GPS) for field data collection at an accuracy of +/-2cm. A copy of all survey data deliverables shall be a submittal item. All survey work shall be tie to existing grid through use of on base monuments as published by World Geodetic System (WGS) 84, UTM 12N. Assumed elevations with temporary benchmarks will not be acceptable. Survey deliverables include field notes, field book data, and/or data collector files compatible with Trimble software. Drawing data shall delivered in an AutoCAD format

(UTM 12N, units set to unitless, one AutoCAD drawing unit = 1.0’, decimal unit format), and ESRI geodatabase must have an external spatial reference (.prj) file attached that specifies the parameters of the coordinate system in standard ERSI format. All electronic data deliverables shall be a CD-ROM in format that conforms to the latest version of both the CADD/GIS Technology Center’s Spatial Data Standards and

A/E/C CAD Standards. These standards can be found at:

All AutoCAD files shall conform to the USACE CAD Standards v 4.0. AutoCAD survey drawings layering conventions shall conform to USACE CAD standard for the “V” survey drawings.

c. Close-out Documents:

The contractor shall provide to the government all project close-out documentation in accordance with the

TO. Close-out documentation shall include, but is not limited to, a final copy of all submittals, shop drawings, As-Built Schedules IAW TOPR Specification Section 01 10 00, the final comprehensive construction inspection record and the DD Form 1354.

8. OPERATION AND MAINTENANCE MANUALS: For those projects which include mechanical / electrical

/ fire protection/specialty systems requiring periodic or routine maintenance, the contractor shall prepare and submit operation and maintenance manuals in accordance with the TO requirements. As a minimum, the manuals shall contain technical data, diagrams, parts listings, maintenance instructions, and the name, address, and phone number of the manufacturer and servicing / replacement parts source. These manuals shall be submitted prior to the final inspection and in accordance with paragraph 7 above.

9. WARRANTY OF CONSTRUCTION:

a. Listing of Warranty Items:

The contractor shall prepare a listing of all equipment or material subject to a manufacturer’s warranty or extended warranty as required by the TO. The listing shall include a description of the item, the expiration date of the warranty, and the point of contact for warranty service. All warranty items shall be submitted in accordance with TOPR Specification Section 01 10 00.

b. Scope of Coverage:

In addition to any other warranties in this contract, the contractor warrants that work performed under this

Attachment 5 https://cadbim.usace.army.mil/CAD https://cadbim.usace.army.mil/GIS contract conforms to the contract requirements and is free of any defect in equipment, material or design furnished, or workmanship performed by the contractor or any subcontractor or supplier at any tier. This warranty shall not limit the Government’s rights under the Inspection and Acceptance clause of this contract with respect to latent defects, gross mistakes or fraud.

c. Period of Coverage:

This warranty shall continue for a period of one (1) year from the date of final acceptance of the work, unless otherwise specified in the individual TO. If the Government takes possession of any part of the work before final acceptance, this warranty shall continue for a period of one year from the date of beneficial occupancy. In the event the contractor’s warranty of this clause has expired, the Government may bring suit, at its expense, to enforce a subcontractor’s, manufacturer’s, or supplier’s warranty.

d. Remedies of Defects:

The contractor shall remedy, at the contractor’s expense, any failure to conform to contract requirements or any equipment/material/workmanship defect. In addition, the contractor shall remedy, at the contractor’s expense, any damage to Government-owned or controlled real or personal property when that damage is the result of:

(1) The contractor’s failure to conform to contract requirements or;

(2) Any defect of equipment, material, workmanship, or design furnished.

The contractor shall restore any work damaged in fulfilling the terms and conditions of this clause. The contractor’s warranty with respect to work repaired or replaced will run for one year from the date of repair or replacement.

e. Notification to Contractor:

The Contracting Officer shall notify the contractor, in writing, within a reasonable time after the discovery of any failure, defect, or damage. If the contractor fails to remedy any failure, defect, or damage within a reasonable time after receipt of notice, the Government shall have the right to replace, repair, or otherwise remedy the failure, defect, or damage at the contractor’s expense.

f. Subcontractor and Supplier Warranties:

With respect to all warranties, express or implied, from subcontractors, manufacturers or suppliers for work performed and materials furnished under this contract, the contractor shall:

(1) Obtain all warranties that would be given in normal commercial practice

(2) Require all warranties to be executed, in writing, for the benefit of the Government if directed by the

Contracting Officer, and;

(3) Enforce all warranties for the benefit of the Government if directed by the Contracting Officer.

Emergency warranty calls shall not exceed a 4-hour response time, while routine warranty response time shall not exceed 3 workdays. The warranty enumerated herein does not preclude any manufacturer warranties in excess of one year as noted in the individual specification sections. The contractor should read each section carefully to ensure that he/she is aware of all warranties called for in each project.

g. GFE / GFM:

Unless a defect is caused by the negligence of the contractor, subcontractor, or supplier at any tier, the contractor shall not be liable for the repair of any defects of material or design furnished by the

Government or the repair of any damage that results from any defect in Government-furnished material or design.

10. PROGRAM MANAGEMENT: Contractor shall provide a single point of contact (POC) for the duration of the contract. The POC shall have full authority to act on contractual behalf of the offeror throughout the duration of the MACC. The POC shall be available via phone and electronic communication throughout the duration of all ongoing TO’s and his / her phone number shall be provided to the government immediately following award of any TO. POC changes are required to be submitted in writing to the Contracting Officer

within seven (7) Calendar Days of the change.

11. QUALITY CONTROL PLAN: Contractor’s Quality Control Plan shall be developed and submitted to the contracting officer in accordance with TOPR Specification Section 01 10 00. The contractor shall designate on-staff personnel as project superintendents to document and resolve all quality control problems and accomplish daily quality control inspections. The contractor shall establish a method to identify poor performance and specify appropriate corrective action. The quality control plan will become a compliance document. Project personnel will interface with Government personnel to ensure that the quality control plan functions properly.

12. DAILY CONSTRUCTION ACTIVITY REPORTS: Contractor shall monitor all aspects of work accomplished throughout the construction phase of the project to include work performed by subcontractors and make documented record of activity and observations. The Construction Inspection Record will be submitted at the completion of work or as specified by Contracting Officer. Under all circumstances, a final and comprehensive Construction Inspection Record with all entries completed shall be included with the project close out documents as required under the paragraph “As-Built Documents”.

13. SUBCONTRACTING SUPPORT CAPABILITY: Contractor shall provide subcontractor management including, but not limited to, surveillance, quality control, and scheduling. Subcontractors must be available to ensure quick response times. The contractor must have the ability to manage and control multiple subcontracts at multiple job locations. The contractor must ensure subcontractors are competent and capable of handling all tasks assigned to them and shall ensure that each subcontractor is not assigned more work than they can accomplish satisfactorily.

14. PROJECT EXECUTION AND TECHNICAL CAPABILITY: Contractor shall have a support staff as necessary that includes clerical, quality control, project superintendent, drafting and design personnel to prepare bids/proposals and execute the construction phase of all TOs.

15. FIELD SURVEY REQUIREMENTS: Contractor shall provide all field survey requirements necessary for the efficient and acceptable planning, execution and completion of all work required under the TO to include but not limited to survey defined under investigative services, construction staking and as-built verification.

16. GOVERNMENT FURNISHED EQUIPMENT/MATERIALS: The Government reserves the right to provide Government furnished equipment/materials (GFE/GFM) that is on hand if it can be used by the contractor to complete a TO. The GFE/GFM shall be transported by the Contractor, from the Government storage area, to the work site indicated on the TO. The contractor assumes the risk and responsibility for the loss or damage to GFE/GFM once the contractor receives possession of the GFE/GFM. The contractor shall follow the instructions of the Contracting Officer or his/her representative regarding the disposition of all GFE/GFM not consumed in performance of a delivery order.

17. GOVERNMENT EQUIPMENT ON THE SITE: All government equipment and material on each project is the property of the Government unless specifically noted otherwise. Contractor shall relocate all property that the Government retains title to on the installation as specified in the TO or follow the instructions of the

Contracting Officer or his/her representative. Contractor is required to cover equipment that is to remain in place within the area of contract operations and protect it against damage or loss and store equipment that is removed in performance of work where directed or reuse in work as required by drawings and specifications.

Equipment temporarily removed shall be protected and returned equal to its condition prior to starting work at no additional expense to the Government. Security for equipment or material that is to be reused and is removed for temporary storage shall be the sole responsibility of the contractor.

18. DISPOSAL OF WASTE: Loose debris on trucks leaving the site shall be loaded in a manner that will prevent spillage from the vehicle. Fasten suitable cover, such as a tarpaulin, over the load before entering surrounding streets. The contractor shall be responsible for cleaning up any materials that fall from trucks and held liable for any resulting damages. Contractor shall submit, upon request, all trip tickets from the landfill facility to show all debris is being disposed of in accordance with all Federal requirements and in an approved location.

19. CONSTRUCTION SITE MAINTENANCE: The Contractor shall store all supplies and equipment on project site so as to preclude theft or damage. Maintain site in a neat and orderly manner at all times.

Protection and security for materials and equipment on site is the sole responsibility of the contractor. The contractor may be required to install temporary fencing to protect the site as indicated in the TO.

20. SECURITY: For entry to the base, the Contractor shall comply with the installation security requirements.

(a) Security Requirements: The Contractor shall comply with security regulations imposed by the Installation

Commander and the agency occupying the space where work is to be performed, including any necessary security clearances.

(b) All Contractor and subcontractor’s employees entering Offutt AFB to perform work on this contract will be required to obtain and display employee identification badges as prescribed by local and Air Force

Instructions.

(c) Identification badges may be issued for the performance period of the Task Order only, not to exceed one (1) year.

(d) Contractor personnel will be made aware by the CO the necessity for safeguarding identification cards issued and the requirement for reporting any identification cards lost.

(e) The contractor may be required to work within controlled or restricted areas that have heightened security requirements from the installation in general. The Government shall provide all escorts required for contractor access to restricted/controlled areas.

21. FLIGHTLINE ACCESS:

a. General:

Any work conducted within the flightline fenced area will require the Contractor to check in and check out with the Base Operations Dispatcher daily. During check-in, the Contractor shall advise the dispatcher of intended work areas and type of work scheduled, and receive a flightline pass. While on any runway, taxiway, or aircraft parking apron, the Contractor shall immediately remove any dirt, debris, or other material spilled or caused by the Contractor's operations. During check-out, the Contractor shall brief the dispatcher on completed work and status of any airfield facilities affected by the work. If contractor equipment is crossing a path on the airfield that is being actively utilized by aircraft, the Contractor shall station a flagman at the intersection and ensure that all taxiing aircraft are granted the right of way over contractor equipment.

22. DELAYS IN ENTERING AND LEAVING WORK AREA: If the work site is located in a restricted or controlled area, the Contractor may experience delays due to compliance with entrance/exit requirements of restricted/controlled areas. The Contractor shall not be compensated for delays in accessing the site. Also, due to the nature of restricted areas, the Contractor may be requested to leave the restricted area at any given time.

The Contracting Officer may extend the contract performance time when area designations change while the

Contractor is working.

23. SAFETY AND HEALTH:

a. General:

(1) In order to provide safety controls for protection to the life and health of employees and other persons, for prevention of damage to property, materials, supplies, and equipment, and for avoidance of work interruptions in the performance of this contract, the contractor shall comply with all pertinent provisions of the Corps of Engineers Manual, EM 385-1-1, (current version), entitled “Safety and

Health Requirements Manual,” as amended, and will also take or cause to be taken such additional measures as the Contracting Officer, or his/her designated representative may determine to be reasonably necessary for the purpose. (2) The contractor will maintain an accurate record of, and will report to the Contracting Officer or his/her designated representative in the manner and on the forms prescribed by the Contracting Officer or his/her designated representative, exposure data and all accidents resulting in death, traumatic injury, occupational disease, and damage to property, materials, supplies, and equipment incident to work performed under this contract.

(3) The Contracting Officer or his/her designated representative will notify the contractor of any noncompliance with the foregoing provisions and the action to be taken. The Contractor shall, after receipt of such notice, immediately take corrective action. Such notice, when delivered to the site of the work, shall be deemed sufficient for the purpose. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop orders shall be made the subject of claim for extension of time or for excess costs or damages by the contractor.

(4) Compliance with the provisions of this clause by subcontractors will be the responsibility of the

Contractor.

b. Standards:

(1) Applicable Publications: The publications listed below form a part of this specification to the extent referenced. The publications are referred to in the text by basic designation only.

(2) Code of Federal Regulations (CFR): Occupational Safety and Health Administration (OSHA) General

Industry Safety and Health Standards (29 CFR 1910), Publication V2206, OSHA Construction

Industry Standards (29 CFR 1926). One source of these regulations is OSHA Publication 2207, which includes a combination of both Parts 1910 and 1926 as they relate to construction safety and health.

(3) National Emission Standards for Hazardous Air Pollutants (40 CFR, Part 61).

c. Federal Standard (Fed. Std.):

(1) FED-STD-313 Safety Data Sheets, Safety and Health Requirements Manual, EM 385-1-1.

(2) Use of Asbestos Containing Material or any Class 1 ozone depleting chemical compounds are prohibited, DA Circular 40-83-4.

(3) Work covered by this section: This section is applicable to all work covered by this contract.

(4) Definition of Hazardous Materials: Refer to hazardous and toxic materials/substances included in

Subparts H and Z of 29 CFR 1910 and to others as additionally defined in Fed. Std. 313. Those most commonly encountered include asbestos, lead paint, polychlorinated biphenyls (PCBs), explosives, and radioactive material, but may include others. The most likely products to contain asbestos are sprayed-on fire proofing, insulation, boiler lagging, floor tile and mastic, roofing materials, and pipe covering.

24. PROHIBITION ON USE OF ASBESTOS CONTAINING MATERIALS: Asbestos containing materials are not permitted by current criteria and shall not be used in new construction or modification projects (STL

1110-1-118, 27 May 1983). The contractor shall review plans and specifications for all new construction and modification projects to insure that asbestos-containing materials are not used. Any asbestos material installed by the contractor will be removed and disposed of by the Government at the contractor's expense.

25. USE OF TOBACCO PRODUCTS IN AIR FORCE FACILITIES: The Air Force has banned use of all tobacco products in all Air Force facilities. Contractor employees and visitors are subject to the same restrictions as are Government personnel. Smoking is permitted only in designated smoking areas.

26. RECORDING AND PRESERVING HISTORICAL & ARCHEOLOGICAL FINDS: All items having any apparent historical or archeological interest, which are discovered in the course of any construction activities shall be carefully preserved. The Contractor shall leave the archeological find undisturbed and shall

immediately report the find to the Contracting Officer or his/her designated representative so that the proper authorities may be notified.

27. PARENT MACC CONTRACT AND TOPR CONFLICTS: In the event of a conflict between the requirements of the MACC parent contract and individual TOPR requirements, the more stringent requirement shall apply unless otherwise specified.
