Addendum to FAR 52.212-1 – Instructions to Offerors – Commercial Items and Commercial Services
Federal Acquisition Regulation (FAR) provision 52.212-1(b), “Submission of offers” and 52.212-1(f) “Late submissions, modifications, revisions and withdrawals of offers” are deleted in their entirety and replaced with FAR 52.215-1(c) “Submission, modification, revision and withdrawal of proposals” by reference.
FAR provision 52.212-1(c) “Period for acceptance of offers” is tailored as follows: “The offeror agrees to hold the prices firm for 180 calendar days from the date specified for receipt of offers”.
The following is inserted as new paragraph (m) to FAR provision 52.212-1:
I. Proposal Format
1.0. General.
1.1. The following instructions cover the preparation and submittal requirements for the offeror’s proposal for this solicitation. Offerors shall follow the instructions contained herein. Offerors are cautioned that any noncompliance with the terms and conditions of the RFP may cause their proposal to be ineligible for award. If a joint venture arrangement exists for this acquisition, the offeror shall provide a copy of the Joint Venture agreement that is signed and dated by all Joint Venture members as part of the proposal submission. Proposals received are subject to the requirements specified in FAR 52.212-1, unless otherwise tailored in this addendum to the solicitation. Proposals must be received by 325 CONS/PKB via the Solicitation Module within the Procurement Integrated Enterprise Environment (PIEE) at https://piee.eb.mil; no later than the date and time specified in Block 8 on the face page of the RFP. The Offeror shall be responsible for reviewing all training instructions and guidance, as necessary, and ensure completion of all registration requirements in the module in order to submit a timely proposal. If amendments are issued, written acknowledgement of all amendments shall be submitted via the Solicitation Module in PIEE prior to the due date. To permit efficient evaluation of the offerors Past Performance Information (PPI), it is requested that the offeror submits Volume III Past Performance, so that it is received 10 calendar days prior to the due date for the rest of the proposal. Failure to submit Volume III by the earlier date will not result in offeror disqualification.
1.2. The offerors proposal shall be clear, concise, and include sufficient detail to enable effective evaluation and for substantiating the validity of stated claims. It is the Offeror’s responsibility to provide a submission that enables the Government to effectively evaluate the Offeror’s proposal.
The Offeror has the burden to provide a proposal that demonstrates the Offeror has an accurate understanding of the requirements; the Offeror has viable solutions for the requirements; and the Offeror can meet the Government’s stated requirements. Proposals must identify the time and date specified for receipt, the solicitation number, and the name and address of the Offeror. It is the Offeror's responsibility to confirm the Government’s timely receipt of all correspondence.
The Government intends to evaluate proposals and award a contract without discussions.
Therefore, the offeror's initial proposal should contain the offeror's best terms with regard to price. However, the Government reserves the right to conduct discussions if the Contracting Officer determines them to be necessary.
1.3. Offerors shall not simply rephrase or restate the Government's requirements in their proposal, but rather provide convincing rationale to address how the Offeror intends to meet stated requirements. Where appropriate, specific examples of an Offeror’s processes may be used to demonstrate how the Offeror will meet the Government’s requirement. Offerors shall assume the Government has no prior knowledge of the Offeror’s experience or capability, as the Government’s evaluation of the offerors technical volume will rely exclusively on the information presented in the Offeror’s proposal. Statements that the Offeror will provide a particular feature or objective without explaining how the Offeror proposes to meet that feature or objective are generally inadequate and may adversely impact the Government’s evaluation of the Offeror. While not all inclusive, the following types of statements are also considered inadequate:
1.3.1. Unsupported statements that the Offeror allegedly understands the requirements.
1.3.2. Unsupported statements that the Offeror allegedly can or will comply with requirements.
1.3.3. Unsupported statements that simply paraphrase the requirements.
1.3.4. Undefined or unexplained statements such as “best commercial practices will be used.”
1.3.5. Undefined or unexplained statements such as “standard procedures will be used.”
1.3.6. Undefined or unexplained statements such as “well-known techniques will be employed.”
1.4. Offerors are strongly encouraged to carefully review all Government provided information and documents, to include, but not limited to submittal instructions (including attachments), the Performance Work Statement (PWS), the addendum to FAR 52.212-2 Evaluation-Commercial Products and Commercial Services, and the addendum to FAR 52.212-1 Instructions to Offerors- Commercial Products and Commercial Services.
1.5. Elaborate brochures, documentation, binding, detailed artwork, pictures or other embellishments are unnecessary and are not desired.
1.6. Oral presentations will not be accepted.
1.7. Inquiries by Offerors: The Government Points of Contact (POCs) for this acquisition are Karl Deffert, 325 CONS/PKB, and Matt Lahr, Contracting Officer. All questions or concerns regarding this request for proposal (RFP) must be directed in writing via e-mail to karl.deffert.1@us.af.mil and matthew.lahr.3@us.af.mil. Offerors are responsible for verifying timely Government receipt of all submitted questions or concerns.
1.8. Discrepancies: If an Offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the Offeror shall immediately notify the CO in writing, with supporting rationale as well as the remedies the Offeror is asking the CO to consider, as it relates to the perceived omission or error. The Offeror is reminded that the Government reserves the right to award this contract based on the initial proposal, as received, without discussions in accordance with FAR 52.212-1(g).
1.9. Exceptions to Terms and Conditions: Exceptions taken to any terms and conditions of this RFP, to include any of its attachments, or to any other parts of the solicitation shall be identified to the CO prior to the proposal due date. Each exception shall be specifically related to a paragraph and/or specific part of the solicitation to which the exception is taken. Provide rationale in support of the exception and fully explain its impact, if any, on the performance, schedule, cost, and specific requirements of the solicitation. Failure to comply with the terms and conditions of the solicitation may result in the Offeror being removed from consideration for award.
1.10. Price Competition: The Government anticipates obtaining adequate price competition.
Upon examination of the initial proposals received, the CO will review this determination and if, in the CO's opinion, adequate price competition exists, no additional cost information will be requested. However, if at any time during this evaluation, the CO determines that adequate price competition no longer exists, offerors may be required to submit other than certified cost or pricing data to the extent necessary for the CO to determine price reasonableness in accordance with FAR 15.403-3.
1.11. Site Visit: A pre-proposal site visit will be held at Tyndall AFB, FL on 3 October at 0800.
Health Protection Condition (HPCON) Levels may impact the site visit dates and requirements for base access. Attendance is limited to no more than two attendees per Offeror. Initial proposals shall be submitted via the Solicitation Module within the Procurement Integrated Enterprise Environment (PIEE) at https://piee.eb.mil. Email may be used to transmit information after submission of the initial proposal packages only if the email can be sent encrypted and must include “Source Selection Information – See FAR 2.101 and 3.104” in the subject line of the email. In order to facilitate the sending and receiving of encrypted emails, offerors must use MS Outlook email configured https://sam.gov/ to support encryption or a different email product that is S/MIME compatible and configured to support encryption. If Offerors intend to submit source selection information via encrypted email, you will need to contact the Buyer/Contracting Officer indicated on the face page of the solicitation prior to that first submittal in order to facilitate the exchange of certificates used for encryption. To ensure the process is working correctly, offerors are strongly encouraged to send a test encrypted message first (without including any source selection information). When submitting source selection information via email, file suppression utilities, to include but not limited to Zip files, will not be accepted.

The Government reserves the right to conduct follow-up discussions with any of the individuals identified in the PPI Worksheets or in the offeror’s Past Performance Volume. Pursuant to FAR 15.305(a)(2)(ii), the Government may obtain other information by sending out additional questionnaires and through other sources, other than those listed within the PPI Worksheets.
4.2.4. Tab 4 – Subcontractor Letters of Consent/Client Authorization Letters. In addition to the information provided in the PPI Worksheet (Attachment 10) for each entity as required above, the offeror must submit a consent letter executed by each of its proposed teaming member(s) and/or subcontractors authorizing release of past performance information to the prime offeror to allow the prime offeror an opportunity to respond.
A sample Subcontractor/Teaming Partner Consent Form is attached to this RFP (Attachment 12).
The consent form shall be completed by the team member(s) and/or subcontractors identified in your proposal. The completed consent forms shall be submitted as part of your Past Performance Volume III.
In the event that commercial contracts are presented as past performance sources of information, a client authorization letter shall be issued to those commercial POCs requesting/authorizing them to complete a Past Performance Questionnaire. A sample client authorization letter is attached to this RFP (Attachment 13). The offeror is required to send the client authorization letter(s) with the Past Performance Questionnaire(s) to each POC on commercial contracts. A separate copy of client authorization letter(s) for each commercial contract shall be included in the offeror’s Past Performance submission for the Government’s use in case additional questionnaires need to be sent by the Government after the RFP due date.
Tab 5 – Glossary of Abbreviations and Acronyms
5.0. Volume IV, Price
5.1. General. These instructions are to assist you in submitting information that is required to evaluate the price reasonableness, completeness, and balance of the proposal. Proposals shall be sufficiently detailed to demonstrate their price reasonableness, completeness, and balance. The government may not award a contract based on a proposal with unbalanced pricing. Compliance with these instructions is mandatory and failure to comply may render your proposal ineligible for award. The burden of proof for credibility of proposed prices rests with the offeror.
5.1.1. Price Reasonableness. A price is reasonable if, in its nature and amount does not exceed that which would be incurred by a prudent person in the conduct of competitive business. It is expected that price reasonableness will be determined based on the comparison of each offeror’s total evaluated price (TEP) to the TEPs of all evaluated technically acceptable proposals.
5.1.2. Unbalanced Pricing. Offerors are cautioned against submitting an unbalanced offer.
Unbalanced pricing exists when, despite a reasonable TEP, the price of one or more contract line items is significantly over or understated as indicated by the application of price analysis techniques. The government will analyze offers to determine whether they are unbalanced with respect to price. An example of an unbalanced offer would be proposed contract line items that are significantly less than or significantly overstated in relation to the other proposed contracted line items (either of the offeror’s proposal or the same contract line items as proposed by other offerors). The government may also consider an offer unbalanced if there is a significant difference between proposed contract line items in the same contract line items category between option periods or the proposed prices from year to year or above what would be considered a reasonable adjustment for inflation. An offer may be rejected if the CO determines that the lack of balance poses an unacceptable risk to the Government.
5.1.3. Price Competition. The government has determined there is a reasonable expectation of obtaining adequate price competition in this acquisition. However, IAW FAR 15.403-1(b) and FAR 15.403-3(a), data other than certified cost or pricing data may be required to support a determination of price reasonableness. If, after receipt of proposals, the CO determines that there is insufficient information available to determine price reasonableness and none of the exceptions in FAR 15.403-1 apply, the offeror may be required to submit other than certified cost or pricing data. All information relating to the proposed price including all required supporting documentation must be included in the Price Volume. Extreme care should be exercised to ensure that no price data of any kind are included in any other volume of the proposal.
5.2. Price Volume Format. The Price volume shall be provided in a separate volume labeled "Volume IV - Price" including the following information:
5.2.1 Tab 1 – Pricing Matrix. The offeror shall complete and submit the Price Matrix (Attachment 8). The offeror shall insert the proposed unit price(s) for each contract line item number (CLIN), with the exclusion of Not to Exceed CLINs. The extended amount must equal the unit price multiplied by the number of units; the formulas in the Pricing Matrix Worksheet will populate this amount. The unit prices and extended amounts are limited to two decimal places. The Offeror shall NOT propose a price on FFP Not to Exceed (NTE) CLINs referenced in the Schedule. The proposed prices must be based on the Offeror’s own technical approach submitted in the Technical Proposal (Volume II). The proposed prices for each FFP CLIN must demonstrate a logical correlation to the staffing (e.g., skill mix, grade, numbers, skill classification) proposed in the Technical Proposal as well as all support required to meet the requirements of that CLIN.
5.2.2 Tab 2 - Statements of Compliance with Applicable Labor Laws
An SCA Wage Determination (WD) (Attachment 3) is applicable to this requirement. The offeror shall provide a statement acknowledging:
1. Compliance with the requirements of the SCA WD;
2. The prices proposed for labor covered by the SCA WD were formulated in consideration of the rates specified in the document as required for covered contractor personnel;
3. The wage and benefit rates specified in the SCA WD are not escalated beyond the basic period of performance (FAR 52.222-43(a) and (b)) and likewise, the prices proposed for labor covered by the SCA WD were not escalated beyond the basic period of performance;
and
4. The proposed prices for each CLIN demonstrate a logical correlation to the staffing (e.g., Full-Time Employees’ man-years, man-hours, labor categories, skills mix) proposed in the Technical Proposal at Volume II.
A Collective Bargaining Agreement (Attachment 2) is applicable to this requirement. The Offeror shall provide a statement acknowledging:
1. Compliance with the requirements of the CBA;
2. The prices proposed for labor covered by the CBA were formulated in consideration of the rates specified in the document as required for covered contractor personnel;
3. The wage and benefit rates specified in the CBA are not escalated beyond the basic period of performance (FAR 52.222-43(a) and (b)) and likewise, the prices proposed for labor covered by the CBA were not escalated beyond the basic period of performance; and
4. The proposed prices for each CLIN demonstrate a logical correlation to the staffing (e.g., Full-Time Employees’ man-years, man-hours, labor categories, skill mix) proposed in the Technical Proposal at Volume II.
