About this file
This document is a justification for other than full and open competition submitted by the Veterans Health Administration Program Contracting Activity Central for a construction project at the Tomah VA Medical Center in Wisconsin. The project scope involves expanding and renovating an outpatient mental health facility and requires certain standardized construction materials. These include a Hill-Rom nurse call system, Guldmann patient lifts, Fahrenheit fire alarm equipment, Johnson Controls HVAC and security systems, Best brand lock cylinders, Elkay water coolers, and Hilti fire caulk and sleeves. Using alternate manufacturers would negatively impact integration with existing standardized systems and training across the medical center. The solicitation for the project will be open to service-disabled veteran-owned small businesses, with the construction materials using the specified brands.

( ) (6) National Security per FAR 6.302-6;
( ) (7) Public Interest per FAR 6.302-7;
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
These items have been standardized throughout the Tomah VAMC. Installing a different manufacturers’ system will create significant duplication in cost for the facility, and in most cases the equipment will not function properly. The specific impact for not using the brand name items is listed below:
a. Nurse Call System
i. Hill-Rom
ii. Impact: Hill-Rom systems are currently operational at the Tomah VAMC which runs all Nurse Call throughout the campus. No other supplier could manufacture and install a nurse call system that would properly interface with the existing campus infrastructure. The medical and maintenance staffs are current and trained on Hill-Rom systems. The VA maintains parts and manuals for Hill-Rom on station. Installation of a nurse call system other than Hill-Rom will result in greater training requirements for nursing staff as they will need to be familiar with two different systems. The facilities staff who service and maintain the system will need to be trained and current on two types of nurse call systems, and the parts department will have to maintain spare parts for two different nurse call system.
ii. Impact: Station wide VA ME has standardized on Guldmann lifts to improve our safe patient handling and reduce staff training requirements as each lift manufacturer has specific training required for their lifts. By standardizing the staff does not have to be concerned with whether the proper sling is available decreasing the possibility of lifting errors. This equipment will be utilized as part of the standardized Patient Safe Handling Lift Program at the Tomah VAMC.
i. Fahrenheit, Silent Knight
ii. Impact: The fire alarm system in the existing facility is currently Fahrenheit, Silent Knight.
Choosing a vendor other than Fahrenheit would not allow the installed devices to communicate to Tomah VAMC dispatch on the existing fire alarm network, creating a safety issue. If a manufacturer other than Fahrenheit were utilized an entirely new backboard, annunciator etc.
would be required to be installed in both dispatch and the fire department. Currently those spaces cannot accommodate another fire alarm backboard which would result in a renovation project for both the fire department and dispatch incurring additional costs.
i. Johnson Controls, Inc.
ii. Impact: Tomah VAMC has an existing campus wide BMS system that was installed by Johnson Controls and is currently under a maintenance contract with Johnson Controls. The network is considered proprietary so other controls products could not be used. Therefore, the best value to the VA is to contract directly with Johnson Controls, Inc. provide and integrate the building automation and controls.
ii. Impact: Door cylinders have been standardized at the Tomah VAMC. Tomah has a proprietary keyway that only BEST Brand can provide. The keyway is specific to Tomah and no other manufacturer has access to the specific keyway configuration. It is unique to Tomah.
ii. Impact: The water coolers are a standard item across campus. Not using this device increases maintenance costs for spare parts, increases replacement costs for changes in plumbing and electrical retrofits to make a different item work. Maintenance training is impacted to ensure proper repair requirements. Increases the number of trips for maintenance to determine material requirements at a given location.
ii. Impact: The physical access security system is standardized across all Tomah VAMC buildings.
JCI security systems are proprietary and do not integrate with similar systems by different manufacturers. It is necessary that systems communicate as we have a centralized response center for all security breech notifications.
ii. Impact: Maintaining one brand assists in confirming fire safety compliance during periodic inspections. Tomah VAMC has standardized Hilti brand components.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small- Business (SDVOSB) Set-Aside.
7. Determination by the Contracting Officer (CO) that the Anticipated Cost to the Government will be Fair and Reasonable:
Government estimate was prepared and provided by the Contracting Officer’s Representative (COR). The anticipated price to the Government for the items requested to be brand name is approximately .
The items for which brand name approval is being requested are subsequent components to the overall construction project. This procurement will be competed and based on competition; the CO will make a determination of fair and reasonable pricing prior to award.
