About this file

This is a HIPAA and HITECH Information Security Agreement (ISA) from the State of Alaska Department of Health that outlines the requirements and obligations between the Department (Covered Entity) and Business Associates regarding protected health information (PHI). The agreement details comprehensive requirements for handling, securing, and protecting PHI in accordance with HIPAA regulations, the HITECH Act, GINA, and the HIPAA Final Rule. It establishes protocols for breach reporting, security incident handling, data access controls, and employee training requirements. The agreement includes specific timeframes for breach notifications and incident reporting, with breaches needing to be reported according to 45 CFR 164.410 guidelines and corrective actions required within 5 calendar days of material breaches.

The agreement requires Business Associates to implement appropriate administrative, technical and physical safeguards for PHI protection, maintain documentation of security measures, and complete security risk assessments before systems enter production. Business Associates must return or destroy all PHI within 30 days of contract termination, with returned data provided in common, nonproprietary industry standard formats. The agreement prohibits offshoring of PHI outside the United States without prior written consent and requires subcontractors to agree to the same privacy and security obligations. Contact information is required for both privacy and security matters, with designated email addresses provided for the Department of Health's privacy official and security team.
