L.2 GENERAL INFORMATION

All representations and certifications must be made by the Offeror and must be filled in as appropriate. The signature of the Offeror on the cover page of this Screening Information Request (SIR) (Standard Form-33) constitutes the making of the included representations and certifications, with the exception of the Business Declaration Form, Section J Attachment J.27, which is required to be completed, signed, and submitted with offer. Award of any contract to the Offeror will be considered to have incorporated the applicable representations and certifications and the proposal will be considered a part of the contract.

L.2.1 POINT OF CONTACT

The Contracting Officer (CO) is the sole point of contact for this acquisition. All questions or concerns must be addressed to the CO.

L.3 INFORMATION AND CONSIDERATIONS AFFECTING OFFEROR

PROPOSAL SUBMISSIONS

a. This is the only RFO/SIR the FAA intends to issue for this acquisition. Offerors’ proposals will be evaluated in accordance with this solicitation, AMS Policy and Guidance, and the Source Selection Plan.

b. This acquisition will involve the use of streamlined acquisition procedures employing best practices for competitive negotiated procurements as authorized by the Federal Aviation Administration Acquisition Management System (AMS).

c. The procurement process will involve the evaluation of the technical and price proposals.

Evaluations involved will permit the FAA to select an offer that is the best value to the FAA.

d. This document constitutes a formal SIR for which an award may be made without further discussions or negotiations. Offerors are to consider all terms and conditions contained in the formal SIR in preparation of their proposals as set forth herein.

e. The following is the projected schedule for this SIR:

L.4 INSTRUCTIONS FOR PREPARATION AND SUBMISSION OF PROPOSALS

Each Offeror will submit information identified in the volumes as set forth below. The data submitted should be complete, concise and relevant to the requirements of the SIR/RFO and are required to be submitted in the prescribed formats subsequently identified herein. **No reference must be made to price in Volumes 1 and 2.

L.5 PROPOSAL PRESENTATION, FORMAT, AND CONTENT

a. A cover sheet must be provided, clearly identifying each volume number, volume title, copy number, the solicitation number, and the Offeror's name. A footer identifying the volume number, page number, and total number of pages should be placed on the bottom of each page.

b. Page limitations will be treated as maximums. If exceeded, the excess pages beyond the stated page limit will be removed from the proposal and not be evaluated. Each page will be counted except cover pages, table of contents, list of tables or drawings, tabs, and glossaries.

c. The proposal pages must be numbered sequentially. Font size must be 12, in Times New Roman font, with top and bottom margins equal to 1.0 inch, and left and right margins equal to 1.0 inch. The FAA may make black-and-white copies of Offeror’s proposals for evaluation purposes.

d. Indexing must be used to identify all sections in a volume. Each volume should be organized in such a way that an extensive search of FAA-required documents is not necessary to review the proposal. Information not in its appropriate section and not appropriately referenced may be assumed to have been omitted.

e. The Offeror must submit proposals in electronic version, via email to leslie.fisher@faa.gov.

With the exception of the Price Proposal, Volume 3, all documents submitted in electronic format must be in .pdf. Any items embedded within a document should be objects only, not links. All files must be labeled with your firm's name, solicitation number, submission date, and the words “Source Selection Sensitive.”

f. Proposals must contain comprehensive, concise, factual information, and complete and substantiated price data. Submittals must provide documentation to substantiate any statement of fact. General statements indicating that the Offeror understands the requirements of the work to be performed, or rephrasing or restating of the FAA's requirements, will not be considered adequate.

Similarly, submittals containing omissions or incomplete responses to the requirements of this SIR, or that merely paraphrase the Statement of Work (SOW), or that use nonspecific phrases such as “in accordance with standard procedures” or “well-known techniques,” will also be considered inadequate. Deficiencies of this kind may be cause for rejection of the offer. Submissions that do not specifically address all specifications or requirements will not be evaluated. The information provided is assumed to be accurate and complete.

L.6 TIME, DATE, PLACE, AND SUBMISSION OF PROPOSALS

a. Proposals must be sent electronically to Leslie Fisher at leslie.fisher@faa.gov.

b. TIME AND DATE – Proposals must be received by the FAA at the above no later than 2:00 pm Eastern Time on Friday, March 27, 2020. All Amendments issued, if any, must be signed and submitted with the Offeror’s proposal.

c. SIGNED ORIGINALS – Offerors must provide one signed original and all required copies.

d. PROPOSAL SUBMISSION – Offerors assume full responsibility of ensuring that proposals are received at the place and by the date and time specified above and must ensure submissions accommodate the FAA’s size limit of 25MB per email.

L.7 VOLUME 1 – OFFER AND OTHER DOCUMENTS

Volume 1 must be submitted WITHOUT any reference to pricing information.

L.7.1 VOLUME 1, PART A - OFFER AND OTHER DOCUMENTS

Volume 1, Part A consists of the actual offer to enter into a contract to perform the desired work.

It also includes required representations, certifications, other statements of the Offeror, and any other administrative information. Each Offeror must provide within this volume a table of contents depicting what is contained in each of the volumes submitted in the Offeror's proposal, as well as a listing of all acronyms used and a glossary of terms.

L.7.1.1 VOLUME 1, PART A, SECTION 1 - SOLICITATION COVER PAGE

a. The Offeror must have an official who is legally authorized to bind the Offeror to a contract sign the cover page, block 16. If issued, all solicitation amendments must be signed and submitted here.

b. The cover page, titled “Solicitation, Offer, and Award,” blocks 11-17, are contractor fill-ins and are self-explanatory. In the block with its name and address, the Offeror should supply the Contractor Establishment Code applicable to that name and address. The number should be preceded by “CEC.” Offerors should take care to report the correct CEC and not a similar number assigned to the Offeror in a different system. The CEC is a 9 digit code assigned to a contractor establishment which contracts with a Federal executive agency. The CEC system is a contractor identification coding system which is currently the Dunn and Bradstreet Data Universal Numbering System (DUNS). The CEC system is distinct from the Federal Taxpayer Identification Number (TIN) system.

L.7.1.2 VOLUME 1, PART A, SECTION 2 - SIR SECTION I, CONTRACT CLAUSES

The Offeror must complete the required fill-in portions of Section I, Contract Clauses 3.1.7-6 Disclosure of Certain Employee Relationships and 3.10.2-2 Subcontracts (Cost-Reimbursement and Ceiling Priced Contracts) and include Section I in the offer.

L.7.1.3 VOLUME 1, PART A, SECTION 3 - SIR SECTION K, REPRESENTATION,

CERTIFICATIONS, AND OTHER STATEMENTS OF OFFEROR

The Offeror must complete Section K, Representations, Certifications, and Other Statements of Offeror, and include Section K in the offer.

L.7.1.4 VOLUME 1, PART A, SECTION 4 - BUSINESS DECLARATION FORM

The Offeror is required to completely fill out and sign the FAA Business Declaration Form FAA Template No. 61 (rev. 10/08), Section J, Attachment J.27, and include this form in the offer.

L.7.1.5 VOLUME 1, PART A, SECTION 5 – RESPONSIBLE PROSPECTIVE

CONTRACTORS

An Offeror must also be found responsible in accordance with FAA AMS Policy 3.2.2.2 prior to award of any contract. As a minimum, to be determined responsible a prospective Offeror must:

a. Have adequate financial resources to perform the contract and the ability to obtain resources;

b. Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all other business commitments;

c. Have a satisfactory record of integrity and proper business ethics;

d. Have a satisfactory performance history; and

e. Have the necessary organization, experience, accounting, and operational controls.

Offerors must submit the following information:

a. Sufficient information to demonstrate the financial capability to fund and perform a contract of this size and duration. This includes:

1. A Dun and Bradstreet Comprehensive Insight report;

2. Proof of any existing Line(s) of Credit by a U.S. Banking Institution; and

3. Certified Financial Statements that demonstrate the firm’s annual revenue for the last three

(3) completed company fiscal years.

b. A description of all current or pending legal action(s) under Federal Government contracts within the past three (3) years in excess of $5M, claims, equitable adjustments, pending or ongoing cure notices, Terminations for Convenience, and/or Terminations for Default.

c. Identify if any member on your team has been excluded under System for Award Management (SAM) due to being debarred, suspended, proposed for debarment, or otherwise declared ineligible from receiving Federal contracts, certain subcontracts, and certain Federal assistance and benefits within the last three (3) years. Describe the circumstances surrounding the company/individual being placed on the list.

L.8. VOLUME 2 - TECHNICAL APPROACH

a. Volume 2 must be submitted WITHOUT any reference to pricing information.

b. Volume 2 will address Technical and Key Personnel, Equipment, Logistics, and Training.

L.8.1. VOLUME 2, PART A – EXPERIENCE, PAST PERFORMANCE AND KEY

PERSONNEL

This section consists of information on the Offeror's relevant experience and past performance in addition to the review of Key Personnel.

For relevant experience, past performance, and key personnel, the Offeror must provide information that demonstrates the ability to perform and/or manage contracts that are same or similar in size (projects no less than $50,000,000), scope (Program Management, Logistics, Training, and Installation), and complexity (in this instance, performing design and/or installation of DC BUS equipment simultaneously at multiple facilities located CONUS and OCONUS, while maintaining CDLS operations) to this requirement. Relevant experience, past performance, and information captured on resume submittals can be on prior or present government and/or commercial sector contracts. Size, scope, and complexity may be represented on one contract or be represented on separate contract(s) providing same or similar services.

For experience and past performance, Offerors that are newly formed businesses, without prior contracts or that do not possess relevant experience and past performance, must clearly indicate this at the beginning of the Volume 2 submission. The FAA will not consider performance on a newly awarded contract without a performance history or on any effort completed more than five

(5) years prior to this contract’s solicitation date. However, the FAA reserves the right to review contract agreements and performance that are older than five (5) years. Volume 2 Part A must be limited to 40 pages.

The documentation provided by the Offeror, relative to past performance and experience, should evidence the distinction between past performance (how well the Offeror has performed) and experience (the Offeror has done it before).

L.8.1.1. VOLUME 2, PART A, SECTION 1 – RELEVANT EXPERIENCE

The Offeror must provide the Section J, Attachment J-26, Previous Contracts List, which identifies a minimum of three (3) recent (within the past five (5) years) contracts considered most relevant, that demonstrates the degree to which they performed work of the same or similar size, scope, and complexity as defined above.

The Offeror must include rationale supporting their assertion that the past experience is relevant to the tasks required in this contract’s SOW Section’s C.3.1 Program Management, Section C.3.5 Logistics, Section C.3.7 Training, and Section C.3.4 Installation.

If the Offeror has a teaming arrangement, or is in a joint venture, it is important they specifically describe their relationship and work performed by each member. In addition, a relevant contract does not have to contain all elements of a sub factor or all sub factors; Offerors may submit information on a contract that are relevant to one sub factor or one aspect of a sub factor.

L.8.1.2. VOLUME 2, PART A, SECTION 2 – PAST PERFORMANCE

QUESTIONNAIRES

The Offeror must provide the Section J, Attachment J-21, Past Performance Questionnaire to customers that can evaluate the Offerors past performance. The Past Performance Questionnaires are to be completed by the customer and returned to the FAA Contracting Officer, include in this section a list and contact information of the customers completing the questionnaires.

The Questionnaires submitted must be for the three (3) contracts provided in Section L.8.1.1 Volume 2. It is the Offeror's responsibility to follow-up with their customers to ensure that fully completed questionnaires are provided to the FAA by the deadline.

If the Offeror has a teaming arrangement, or is in a joint venture, it is important they specifically describe their relationship and work performed by each. In addition, a relevant contract does not have to contain all elements of a sub factor or all sub factors; Offerors may submit information on a contract that are relevant to one sub factor or one aspect of a sub factor. The Offeror must submit a Consent Letter, executed by each team partner, and joint venture partner, which authorizes release of adverse past performance information to the vendor to allow a response by the vendor.

L.8.1.3. VOLUME 2, PART A, SECTION 3 – KEY PERSONNEL

Offeror must submit a resume and letter of intent for the Key Personnel who will serve as the Program Manager and Alternative Program Manager and meet the requirements per Section C.3.1.

The Offeror must ensure that the resumes of key personnel demonstrate a minimum of five (5) years of program management experience (PM) and three (3) years of program management experience (APM) with contracts of same or similar size, scope, and complexity in a Government or corporate environment to the nature and extent required by Section C.3.1 of the SOW.

L.8.2 VOLUME 2, PART B – EQUIPMENT PROPOSAL

Equipment proposals must be submitted as separate and complete sections. The equipment proposal is limited to 125 pages while addressing the following:

a. DC BUS Module Performance. Complete Attachments J.22 and J.23.

b. DC BUS Equipment Characteristics. Offeror format and Complete Attachment J.24.

Based upon the Offeror’s submission for Sub-Factors 2.1 and 2.2 in Section M.6, any deviations or exceptions depicted for the system that do not meet the form, fit, and function of the Specifications, Attachment J. 1, may be given no further consideration.

L.8.2.1 VOLUME 2, PART B, SECTION 1 – DC BUS MODULE PERFORMANCE

The Offeror must provide information that demonstrates the proposed DC BUS equipment will support the specification requirements below as related to CLIN 0001 and CLIN 0002.

1. Environmental Requirements and System Operation, Normal System Operation

(J.1 Sections 1.4 and 2.6)

2. Electrical Input Requirements (J.1 Section 2.4)

3. Electrical Output Requirements (J.1 Section 2.5)

4. DC BUS Module Design (J.1 Section 2.7)

5. DC BUS Startup Service and Battery Testing (J.1 Section 3.1 and 3.2)

A compliance review is required as part of the Offeror’s module performance submittal. The Offeror is required to complete Attachments J.22 and J.23, which encompasses a paragraph-by-paragraph review of the Specification with the following information, “C”, “D,” or “E.”

i. “C”: Comply with no exceptions.

ii. “D“: Comply with deviations. For each and every deviation, provide reasons for the proposed deviation and how the intent of the Specification can be satisfied.

iii. “E”: Exception, do not comply. For each and every exception taken, provide reasons for such exception(s).

L.8.2.2 VOLUME 2, PART B, SECTION 2 – DC BUS EQUIPMENT

CHARACTERISTICS

a. DC BUS Module Physical Characteristics. Provide information on: physical attributes and physical interface requirements. Provide list of accessories, hardware, and software other than the basic DC BUS unit, which are needed, and included in CLIN 0001, to complete an operational DC BUS system. Complete proposal, including but not limited to the following:

1. Dimensioned plans, sections, one line, elevations, and all installed devices and material list.

2. Weights, plans, and elevations of all system components and locations of all required interfaces.

3. Catalog cuts showing physical and electrical characteristics of all equipment and devices.

b. DC BUS Remote Monitoring Capability. Provide information on DC BUS remote monitoring capability, software interface requirements, and how the DC BUS monitored data is accessed by the FAA’s remote monitoring network.

c. DC BUS Display and Controls. Provide information on DC BUS display and control functions.

System description including an overview of the system provided with detailed description of front panel screens and menus to be provided.

d. DC BUS Batteries. Provide information on the DC BUS battery rack, type batteries used, and warranty as described in the CLIN X002A, DC BUS SPEC, Attachment J.1, Section 2.10.

e. DC BUS Equipment Characteristics Specification Compliance Review. The Offeror must provide information that demonstrates the proposed DC BUS equipment will support the specification requirements below as related to CLIN 0001 and CLIN 0002.

1. Definition, Major Component List, and General (J.1 Sections 1.0, 1.1. and 2.0)

2. DC BUS Performance Rating, Continuous Output Capacity Rating, and Battery Capacity (J.1 Sections 2.1, 2.2, and 2.3)

3. Display and Controls (J.1. Section 2.8)

4. DC BUS Rack/Cabinet (J.1 Section 2.9)

5. Battery String and Ancillary Equipment (J.1 Section 2.10 and 2.11)

A compliance review is required as part of the Offeror’s equipment characteristics submittal. The Offeror is required to complete Attachment J.24, which encompasses a paragraph-by-paragraph review of the Specification with the following information, “C,” “D,” or “E.”

i. “C”: Comply with no exceptions.

ii. “D”: Comply with deviations. For each and every deviation, provide reasons for the proposed deviation and how the intent of the Specification can be satisfied.

iii. “E”: Exception — do not comply. For each and every exception taken, provide reasons for each exception taken.

L.8.3 VOLUME 2, PART C – LOGISTICS PROPOSAL

The logistics proposal must be detailed to enable the FAA to make a thorough evaluation and to arrive at a sound determination as to whether the Offeror’s proposal meets the requirements of Section C.3.5 of the SOW.

The Offeror’s proposal must demonstrate a fully integrated organizational approach with clear lines of authority. The Offeror must describe their approach to efficiently and effectively interface and communicate with the FAA. The Offeror must also demonstrate their ability to provide an integrated logistics system as specified in the SOW Section C.3.5. In the narrative, the Offeror must address their ability to provide spare parts, training, and 24/7 phone technical support and on-site technical support services. The Offeror must address their maintainability and ease of maintenance that is inherent in the proposed equipment and system design.

L.8.3.1 VOLUME 2, PART C, SECTION 1 – SOFTWARE

The Offeror must identify all software and firmware, including third party applications or operating systems if required. The Offeror must disclose all data rights or lack of open architecture that may restrict any subsequent FAA access and/or usage. The Offeror must demonstrate the ability that the proposed software and firmware can be reproduced, copied, altered, used, and modified. The Offeror must include a description of the vendor policy approach to the management of software changes and distribution of those changes that have an effect on deployed DC BUS equipment. See SOW Section 3.3.1.

L.8.3.2 VOLUME 2, PART C, SECTION 2 – MAINTENANCE

The Offeror must provide a narrative description of current commercial maintenance materials and address how these materials are developed, managed, and implemented into the field for use by non-factory personnel. The Offeror must also include a description of the Offeror’s approach to the control of technical changes in maintenance documentation and policy when design/changes are made to the unit that have an impact on field and shop maintenance (see SOW Section 3.5.3).

The organization, content, and level of detail of the manual must be such that DC BUS problems and issues concerning interfaces with external systems and devices can be diagnosed and corrected by trained maintenance personnel using these maintenance manuals as a reference. The level of detail must enable the technician to identify the failure as an equipment failure and will enable the technician to isolate the failure to one of the Lowest Replaceable units (LRU).

L.8.3.3 VOLUME 2, PART C, SECTION 3 - INTEGRATED SUPPORT PLAN

(ISP)

The Offeror must provide a copy of their ISP that meets the requirements of Section 3.5.1.1 of the SOW. If the vendor does not have an established ISP, the Offeror must provide a narrative describing how the requirements of Section 3.5.1.1 of the SOW are to be satisfied. At a minimum, the ISP or narrative must address the following:

a. Repair Parts Logistics Support Plan (RPLSP). If not included in the ISP, provide proposed Repair Parts Logistics Support Plan. This plan must detail the Offeror’s methodology for tracking repair parts as well as all parts and/or assemblies considered of such value as to warrant an exchange for turn-in value when their replacement is required. If the repair part is an expendable item and no repairs are made but instead the whole item is replaced, then indicate the methodology for replacement. The RPLSP must include a description of the means used to respond to parts requests within the contiguous United States, Alaska, Hawaii, Guam, and Puerto Rico. The Offeror must demonstrate the ability to: respond to parts orders on an immediate availability basis, including potential of “overnight” delivery and 1-800 telephone parts ordering system; their ability to support sites within the time constraints specified in SOW Section 3.5.3.8; as well as the Offeror’s ability to provide packaging, shipping, and handling of spare, repair parts, and equipment.

b. Contractor Depot Logistics Support (CDLS). The Offeror must demonstrate their capability to support in-plant and on-site preventive and emergency maintenance in support of warranty and out of warranty DC BUS equipment within the contiguous United States, Alaska, Hawaii, Guam, and Puerto Rico. The Offeror must also demonstrate their ability to support CDLS efforts by utilizing fully trained and experienced personnel within the time constraints specified in Section C.3.6.7 of the SOW, as well as maintain a secured warehouse space for exclusive use by the FAA.

c. The Offeror must demonstrate the ability to collect data on parts and/or equipment failures and provide meaningful feedback to the customer on expected or actual trends in parts failure rates.

They must also demonstrate an ability to correct high failure rate equipment components by providing feedback to the manufacturing source.

d. The Offeror must demonstrate an integrated approach to notifying equipment users of changes to equipment hardware, firmware, and software. The Offeror must describe the means Offeror’s would use to distribute the information and implement the manual and software changes. The Offeror must also provide the corporate configuration control methodology. This methodology must not rely on compliance with ISO standards, but actually describe how the configuration control is successfully implemented and provide documentation of the companies Configuration Management Plan.

L.8.4 VOLUME 2, PART D – TRAINING PROPOSAL

The training proposal must be detailed to enable the FAA to make a thorough evaluation and to arrive at a sound determination as to whether the proposed meets the requirements of the SOW.

The Offeror must demonstrate how their current factory training program is developed, managed, and implemented into an effective training program. The narrative must include a description of the Offeror’s approach to the training required for technical personnel in supporting fielded DC BUSs.

The narrative must also describe the Offeror’s factory training facilities and instructors’ qualifications (see SOW Section C.3.7). The Offeror must provide copies of their commercial training materials data, covering each configuration, for review. This training must include formal classroom activities, as well as technical documentation for use by the FAA for incorporation into existing FAA training programs. This training documentation must include in-depth theory of operation, troubleshooting, and adjustment of all subsystems of the items listed in Section B CLIN 0001 and CLIN 0002.

The Offeror’s factory training facility and course content must provide training that supports the FAA maintenance concept. The FAA maintenance concept is as follows: FAA technicians will perform all of the tasks that the Offeror’s Customer service Engineer or Field Service Engineer perform during an assistance visit to a customer site(s). To meet the FAA’s maintenance concept, training must include, but is not limited to, inspection of equipment, troubleshoot/diagnosis to fault, removal of failed parts/LRU(s), replacement of failed parts/LRU(s), and validation and certification (if applicable) that the system is operational and available for operation.

L.9 VOLUME 3 – PRICING

The Offerors’ Price Proposal must include all pricing data necessary for the FAA to evaluate each Offeror’s proposals for this contract. The Offeror must provide a complete Section B, inputting pricing for CLINS 0001 through 0014 in Section B and subsequent price exhibit tabs. Accessory items required for operable DC BUS vary with each Offeror; therefore, the DC BUS unit CLIN pricing should include these items and FOB shipping within the contiguous United States. Pricing for all CLINS should include the base period and all four (4) option periods.

Offerors are hereby advised that the manufacturer’s discount rate for CLINs X002C – X002S will not be evaluated as part of the Offerors price proposal.

Each Offeror’s completed Price Model must be submitted in a format compatible with Microsoft Excel 2016. The submitted Section B must not be read-only, must not contain any locked cells other than those already locked by the FAA, and must not be password-protected, in whole or in part. All formulas must remain as formulas, not set to values. The FAA reserves the right to reject proposals that do not comply with these requirements.

Offerors must propose a single fully burdened ceiling labor rate for each applicable LH CLIN type. The fully burdened rates should include direct labor and all indirect costs applicable to that direct labor (such as fringe benefits, overhead, G&A), and profit. The fully burdened rate will be applicable whether the work is performed by the prime contractor or a subcontractor.

Offerors must include a narrative that describes in detail the basis of the proposed prices, and provide any information and judgmental factors applied in order to arrive at the proposed prices.

This information must be provided by CLIN/SubClin. Offerors must provide a products/service price list or catalog on which Section B prices are based or vendor quotes as applicable. Part or model numbers in the price list or catalog must match with the part or model numbers identified in Section B. There is no page limit for the price proposal.

L.10 NUMBER OF AWARDS

The FAA will award one contract resulting from this solicitation, but reserves the right to make multiple awards, or no award at all, if doing so is determined to be in the best interests of the FAA.

L.11 EXPENSES RELATED TO OFFEROR SUBMISSIONS

The FAA will not pay any costs incurred in the preparation or submission of any response to this solicitation.

L.12 COMMUNICATION WITH OFFERORS

a. Communication with potential Offerors may take place throughout the source selection process. Information disclosed as a result of oral or written communication with an Offeror may be considered in the evaluation of the Offeror’s submittal.

b. Communications with one Offeror may not necessitate communications with other Offerors.

The FAA reserves the right to conduct Communications with all, some, or none of the Offeror(s) as circumstances warrant.

L.13 RELATIONSHIP BETWEEN L AND M

Your attention is directed to the functional relationship between Sections L and M of this SIR/RFO.

Section L provides information for the purpose of organizing the proposal and is not intended to be all-inclusive. Section M describes evaluation factors for award. Since the FAA evaluation of proposals will cover all areas identified in Section M, proposals should address all such areas for evaluation.

L.14 SUBMISSION OF SUPPORTING COST OR PRICING DATA

The FAA anticipates adequate price competition; therefore, Offerors are not required to submit certified cost or pricing data with its proposal. However, if the CO determines that the level of competition does not support the determination of price reasonableness, or the Offeror's price cannot be determined to be reasonable from price analysis, then the CO may require the Offeror to submit information other than certified cost or pricing data to the extent necessary to support a determination of a fair and reasonable price.

L.15 PROPOSAL ACCEPTANCE

a. Only one proposal from each Vendor will be considered.

b. The FAA reserves the right to consider as acceptable only those proposals submitted in accordance with the requirements set forth in the SIR/RFO, which demonstrate an understanding of the complexity, size, and scope of the requirements.

c. The FAA further reserves the right to reject, as unacceptable, proposals deleting or altering technical requirements.

L.16 AMS PROVISIONS INCORPORATED BY FULL TEXT

3.2.2.3-20 Offers (January 2018)

(a) The Offeror (you) must submit responses to this SIR by the following electronic means: see Section L.5. Your offer must arrive at the place and by the time specified in the SIR.

(b) Such offers must refer to this SIR and include, as applicable, the item or sub-items, quantities, unit prices, time and place of delivery, all representations and other information required and a statement specifying the extent of your agreement with all the FAA's (we) terms, conditions, and provisions.

(c) We may decline to consider offers that do not include required information, or that reject any of the terms, conditions and provisions of the SIR.

(d) Send your offer to the address listed in Section L.6 above.

(e) We will not be responsible for any failure attributable to transmitting or receiving the offer, unless it falls under section (a) of AMS provision 3.2.2.3-14 "Late Submissions, Modifications, and Withdrawals of Submittals".

3.2.2.3-22 Period for Acceptance of Offer (October 2014)

The Offeror (you) agrees if this offer is accepted within 180 calendar days from the date the SIR specifies for receiving offers, to provide all items for which you offer prices at the price set opposite each item, delivered at the designated point(s), within the time specified in the Schedule.

3.2.4-1 Type of Contract (April 1996)

The FAA contemplates award of an Indefinite Delivery/Indefinite Quantity (IDIQ) with Firm-Fixed- Price (FFP), Time-and-Materials (T&M) and Cost Reimbursement (CR) contract resulting from this Screening Information Request.

3.9.1-3 Protest (January 2020)

AS A CONDITION OF SUBMITTING AN OFFER OR RESPONSE TO THIS SIR (OR OTHER

SOLICITATION, IF APPROPRIATE), THE OFFEROR OR POTENTIAL OFFEROR AGREES

TO BE BOUND BY THE FOLLOWING PROVISIONS RELATING TO PROTESTS:

(a) Protests concerning Federal Aviation Administration Screening Information Requests (SIRs) or awards of contracts shall be resolved through the Federal Aviation Administration (FAA) dispute resolution system at the Office of Dispute Resolution for Acquisition (ODRA) and shall be governed by the procedures set forth in 14 C.F.R. Parts 14 and 17, which are hereby incorporated by reference. Judicial review, where available, will be in accordance with 49 U.S.C.

46110 and shall apply only to final agency decisions. A protestor may seek review of a final FAA decision only after its administrative remedies have been exhausted.

(b) Offerors initially should attempt to resolve any issues concerning potential protests with the Contracting Officer. The Contracting Officer should make reasonable efforts to answer questions promptly and completely, and, where possible, to resolve concerns or controversies. The protest time limitations, however, will not be extended by attempts to resolve a potential protest with the Contracting Officer.

(c) The filing of a protest with the ODRA may be accomplished by mail, overnight delivery, hand delivery, or by facsimile or if permitted by order of the ODRA, by electronic filing. A protest is considered to be filed on the date it is received by the ODRA during normal business hours. The ODRA's normal business hours are from 8:30 am to 5:00 pm Eastern Time.

(d) Only an interested party may file a protest. An interested party is one whose direct economic interest has been or would be affected by the award or failure to award an FAA contract. Proposed subcontractors are not "interested parties" within this definition.

(e) A written protest must be filed with the ODRA within the times set forth below, or the protest shall be dismissed as untimely:

(1) Protests based upon alleged improprieties in a solicitation or a SIR that are apparent prior to bid opening or the time set for receipt of initial proposals shall be filed prior to bid opening or the time set for the receipt of initial proposals.

(2) In procurements where proposals are requested, alleged improprieties that do not exist in the initial solicitation, but which are subsequently incorporated into the solicitation, must be protested not later than the next closing time for receipt of proposals following the incorporation.

(3) For protests other than those related to alleged solicitation improprieties, the protest must be filed on the later of the following two dates:

(i) Not later than seven (7) business days after the date the protester knew or should have known of the grounds for the protest; or

(ii) If the protester has requested a post-award debriefing from the FAA Product Team, not later than five (5) business days after the date on which the Product Team holds that debriefing.

(f) Protests shall be filed at:

The protest shall include a signed statement from the protester, certifying to the ODRA the manner of service, date, and time when a copy of the protest was served on the Contracting Officer and other designated official(s).
