Special Contract Requirements Project: MT FLAP BOR 2980(1), Sun River Bridge Replacement
Management Agency responsible for the land. Attach evidence of compliance, including correspondence with the U.S. Fish and Wildlife Service and National Marine Fisheries Service.
(4) Wetlands and Waters. Submit written documentation satisfactory to the CO, that the proposed action will comply with Sections 404 and 401 of the Clean Water Act, Executive Order 11990, and will not affect any wetlands or waters under Federal, State, or local jurisdiction. Documentation must be prepared by a wetland specialist with a minimum of 3 years of experience in wetland and ordinary high water mark delineation.
(5) Federal lands. Before use of sites on Federal lands, submit a copy of the Letter of Approval or Special Use Permit from the applicable Federal agency allowing use of the site for intended purposes.
(6) Tribal, state and local approvals. Comply with applicable laws regarding the proposed activities. Submit copies of required clearances, including hazardous waste compliance, tribal, State and local permits and approvals.
Add the following:
(e) Other requirements. Comply with the following requirements:
(1) Do not perform in water work prior to June 15, 2025. Remove Ttemporary diversion and temporary bridge structures below contour-elevation 4365.48 by October 1, 2025.
Temporary diversions and temporary bridge structures above contour-elevation 4365.48 must be removed prior to October 1April 1, 2026., and all tTemporary diversion and temporary bridge structures can be reinstalled as necessary after June 15th, 2026, and removed by October 1, 2026. must be removed prior to winter shutdown.
(2) Use biodegradable vegetable-based oil in any equipment that operates below the ordinary high-water line (OHW) of the Sun River or reaches into wetlands or waters.
(3) Conduct construction activities between April 15 and November 15 (dates inclusive), unless otherwise approved by the CO.
(43) Conduct construction activities between 6:00 a.m. and 9:00 p.m.
(54) Do not conduct blasting operations between March 1 and May 15 or November 1 and November 15 (dates inclusive).
(65) Do not conduct clearing operations between April 1 and July 15 (dates inclusive) to avoid impacting nesting birds, unless approved by the CO.
(76) If active bird nests are identified during clearing operations; immediately suspend operations within 500 feet of the nest and notify the CO within 1 hour. Obtain approval from the CO before restarting operations.
(87) Notify CO within 24 hours of locating a dead, injured, or sick endangered or threatened species. Listed wildlife species include Grizzly bear, Canada lynx, and North American wolverine. Provide CO date, time, precise location of the injured animal or carcass, and any other pertinent information. Do not disturb any evidence associated with the specimen.

(98) Store all food, toiletries, and other potential attractants (e.g., petroleum products, antifreeze, personal hygiene items) in wildlife-proof containers, within wildlife-proof fencing, or enclosed construction equipment, except during actual use.
(109) Remove all garbage and food trash from the project site daily.
(1110) Do not disturb, feed, and/or approach any wildlife species (e.g., reptiles, birds, raptors, or bats) found nesting, hibernating, or otherwise living in, or immediately nearby, worksites.
(1211) Conduct machinery maintenance and refueling at a distance of 200 feet or greater from any wetlands or waters. Refueling of equipment may occur within 200 feet of waterbodies if approved by the CO and spill prevention measures are in place.
(1312) Inspect equipment for fluid leaks daily and address all fluid leaks according to Subsection 107.10(b).
(1413) Report Grizzly bear sightings or incidents to the CO as soon as possible.
(1514) Tribal Monitoring During Construction Operations. Provide two-week advanced notice to both the Blackfeet and Little Shell THPO liaisons of ground distributing activities for on-site monitoring services. If inadvertent discoveries are made during construction, follow Inadvertent Discovery Plan in Physical Data.

(1716) Meet with the CO on site, before moving equipment on site or beginning any work, to ensure all parties understand the location of the sensitive sites near abutment 4 and the staging area on the east side of the Sun River and the measures that are required to be taken to protect them.
Ensure protection for sensitive sites according to the following:
(a) Except as authorized by the CO for the purpose of installing or maintaining approved sensitive cultural site protective measures, keep all persons, equipment, and materials off known sensitive cultural sites on the east side of the Sun River.
(b) Prior to staging equipment or starting work, identify cultural “No Work Zones” by installing temporary traffic control plastic fencing around the known sensitive sites on the east side of the Sun River as approved by the CO.
(c) Instruct all Contractor and subcontractor personnel to regard the locations of the known sensitive sites on the east side of the Sun River and their contents as confidential.
(d) Provide two-week written notice to the CO before beginning work at the known sensitive cultural sites on the east side of the Sun River.
(e) The CO has the authority to bar from the Project any person entering a protected site other than for the purpose of installing or maintaining protective measures.
(1817) Do not conduct bridge demolitions operations between May 1 and July 31 (dates inclusive) to avoid impacting nesting bats, unless approved by the CO.
(1918) Remove all wildlife carcasses from the project area within 24 hours except for those listed in Subsection 107.10(e)(8).

Section 108. — PROSECUTION AND PROGRESS

108.01 Commencement, Prosecution, and Completion of Work. Amend as follows:
Delete the text of the second paragraph and substitute the following:
A preconstruction conference will be held after the contract is awarded and before beginning work.
A baseline schedule submittal meeting is also required according to Subsection 155.10. The schedule manager, project manager, and project superintendent are required to attend the preconstruction conference and the schedule submittal meeting unless otherwise approved by the
CO.
Do not begin on-site ground disturbing activities or Section 151 mobilization within the construction limits prior to approval of the baseline schedule submittal. Only construction surveying and staking, temporary traffic control, and work under Section 637 is allowed before approval of the baseline schedule submittal.
Add the following:
Furnish at least a 48-hour advanced notice before changing the current work schedule. Work schedule changes that include additional shifts require a 14-day advanced notice.
Perform work under this contract by limiting work as provided for in Sections 105, 107, 156, and 157.
Do not perform work, except as indicated below, between November 16 and April 14 (dates inclusive):
(a) Mobilization to and from the project;
(b) Survey and staking;
(c) Production of materials at Contractor-located sources; and
(d) Installation of temporary traffic control.
108.01A Labor. (Added Subsection).
Follow the requirements of FAR Clause 52.222-6 Construction Wage Rate Requirements.
Adjacent or virtually adjacent work sites, as used in FAR Clause 52.222-6, are defined to be work sites within ½ mile of the project. Application of Construction Wage Rate Requirements (Davis- Bacon Act) for work sites beyond ½ mile of the project will be determined by the CO.
Pay rates and zone pay used in the General Wage Decision are based on the “Center of the job.”
