FAR 52.212-1 Instructions to Offerors Addendum
This Request for Quote (RFQ) is issued to establish a firm fixed price contract for the renewal of the Microsoft 365 subscription for FY24.
The Government reserves the right to modify the Purchase Description as required. This may be in the form of general reductions or cancellation of services. Reductions or changes in quantities shall be negotiated with the contractor.
INSTRUCTIONS TO OFFERORS
Submittal and Inquiries.
1. Offers shall be submitted electronically prior to the closing date and time identified on the RFQ by email to: Jennifer Wohlford, Purchasing Agent, at jennifer.a.wohlford.civ@army.mil with a copy to Dahalia Trevenen, Contracting Officer, at dahalia.k.trevenen.civ@army.mil.
2. Electronic submissions by facsimile will not be accepted. Please note, the government contracting office building is closed on Holidays and Weekends.
3. Offers shall include Volume 1, Volume 2 and Volume 3.
a. Volume 1: Acknowledgement and All Other Information
b. Volume 2: Technical Quote
c. Volume 3: Price
4. The point of contact responsible for supplying additional information and answering all inquiries is the Contracting Specialist. Address all questions or concerns the Offeror may have to the points of contact listed in paragraph 1. All questions regarding this solicitation shall be submitted by 7:00 AM EST April 25th, 2024. Questions received after that date and time shall not receive a response. Contractor questions will be answered by attachment to modifications to the RFQ. Telephone calls regarding this solicitation will not be accepted.
5. If a quoter believes the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise deemed unsound, the quoter shall immediately notify the Contract Specialist and Contracting Officer via email with supporting rationale.
QUOTE SUBMISSION
Volume 1:
This section shall include all other information to include acknowledgment of RFQ Modifications, Representations & Certifications, Exceptions, and any other information not applicable to Volume 2 or 3. IAW Class Deviation 2023-O0001, A small business joint venture offeror must submit, with its offer, the representation required in paragraph (c) of FAR solicitation provision 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services, and paragraph (c) of FAR solicitation provision 52.219-1, Small Business Program Representations, in accordance with 52.204-8(d) and 52.212-3(b) for the following categories:
(A) Small business;
(B) Service-disabled veteran-owned small business (SDVOSB);
(C) Women-owned small business (WOSB) under the WOSB Program;
(D) Economically disadvantaged women-owned small business (EDWOSB) under the WOSB Program; or
(E) Historically underutilized business zone (HUBZone) small business.
Volume 2:
Technical:
Technical: Technical should discuss how the contractor proposes to satisfy the requirements of the Purchase Description in sufficient detail to evaluate the contractor’s understanding of the requirement. The Technical volume should NOT contain any pricing information.
Volume 3:
Price Quote - The goal of this solicitation is to obtain delivery on a firm-fixed price contract, with bottom line prices annotated on the CLIN structure. Unless indicated otherwise, all CLINS must be quoted. Quoter will submit total proposed price for delivering requested supplies inclusive of all costs associated with this requirement. Price shall be evaluated using price analysis techniques in accordance with FAR 13.106-3. Volume 3 shall be a separate PDF. It may not be combined with Volumes I & II. Failure to adhere to this may result in the quote being deemed non-compliant at the discretion of the government.
FAR 52.212-2 Evaluation-Commercial Items Addendum
The Government shall evaluate the offer in accordance with Lowest Price Technically Acceptable (LPTA) evaluation procedures in accordance with FAR 15.101-2.
EVALUATION CRITERIA
1. The quotes will be evaluated under two (2) evaluation factors: Technical and Price.
Factor 1: Technical Factor 2: Price
1. Factor 1 - Technical. The Technical evaluation will evaluate the product’s consistency with the requirements stated in the Purchase Description.
2. Factor 3 - Price. Price will not be scored or rated. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 13.106-3(a)(2). Through these techniques the Government will determine whether prices are reasonable, complete, and balanced. Unless indicated otherwise, all lines shall be quoted on.
Unbalanced Pricing may be evaluated in accordance with FAR 13.106-3(3), as applicable, to assess potential performance risk which could result in unreasonably high prices.
Reasonableness. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business.
Completeness/Accuracy. The offeror’s quote is in compliance with the Price Volume instructions in the RFQ if all line items are addressed.
