The Solicitation
Note: The Inflation Reduction Act of 2022 (IRA), Pub. L. No. 117-169, enacted in August 2022, provided GSA with significant funding for (a) measures necessary to convert facilities to high-performance green buildings, (b) acquisition and installation of construction materials and products with substantially lower levels of embodied greenhouse gas emissions, and (c) emerging and sustainable technologies. The Contract resulting from this Solicitation will be funded in part by IRA appropriations, and it contains numerous IRA-specific requirements. Requirements include, but are not limited to, requirements regarding pricing, invoicing, submittals, materials and construction. In addition, please note that this Solicitation contains an evaluation factor favoring certain construction materials with the lowest possible levels of embodied carbon. Offerors shall carefully review this Solicitation, the Agreement, the Statement of Work, the Specifications and the Drawings. Offerors are responsible for accurately pricing and, if successful, fully performing all Contract requirements.

II.D. Technical Proposal
FACTOR 1 – EXPERIENCE ON SIMILAR PROJECTS ( 30%):
Document: C201-GC/SEPTEMBER 2023
This factor will measure the breadth, depth and relevance of an offeror’s prior experience in performing projects similar in size, scope and complexity to the one described in this solicitation.
I. The offeror shall demonstrate experience as a prime contractor on contracts currently being performed or completed within the past ten (10) years. If submitting information for current contracts, the contract must provide the percentage completed by the time of the closing date of this solicitation in order for those contracts to be considered. The offeror shall submit three (3) projects for evaluation. Projects of similar size, scope, and complexity will be determined more relevant and rated more favorably than projects that are less similar. Complexity includes schedule constraints, management and administrative requirements, security requirements, applicable design criteria, coordination requirements, local conditions, and technical complexity. More recent performance may be deemed to have greater importance than less recent performance.
A single project identical in all aspects to this project may not exist, and therefore the Government will consider the totality of experience demonstrated by the submitted projects. The totality of experience should include all of the characteristics of relevant experience, identified above. Significantly more weight will be given to individual projects meeting all characteristics.
Note for Joint-Venture Offerors: If relying on past experience and performance of the individual firms, at least one (1) relevant project must be presented for each joint-venture partner. All members of the joint-venture will be required to be signatory to the contract. Greater weight will be given to projects that demonstrate prior teaming of the joint-venture partners.
A Joint-Venture and Teaming Arrangement are NOT synonymous. If a teaming arrangement is proposed, only the offeror (prime contractor) will be evaluated against this factor. It should be noted that if an offeror demonstrates a strong reliance on the experience of subcontractors, the absence of a formal joint venture agreement with such subcontractor(s) may result in an unfavorable evaluation. Offerors shall provide a copy of the agreement as part of their proposal for this factor. Please note the copy of this agreement is excluded from the stated page limitation.
II. Offerors are encouraged to identify projects involving any of the following characteristics. Projects involving such characteristics may be rated more favorably under this factor. The characteristics, in no order of preference, are as follows:
Document: C201-GC/SEPTEMBER 2023
● Construction projects valued at fifteen million dollars ($15 million) or higher;
● New construction on an undeveloped site.
● Projects performed in a regulated wetlands;
● Projects performed on / around railroads;
● Previous Land Port of Entry experience or Federal construction contracting experience;
● Projects that involved working on a New York State Department of
Transportation Right of Way;
● Projects that require or achieved a LEED certification (Projects that are currently undergoing LEED certification review process may be considered).
III. Experience Form - The offeror shall complete an Experience Form (Attachment
1) for each reference contract submitted.
FACTOR 2 - PROJECT EXECUTION (20%):
I. Project Execution Narrative
The offeror must submit a written narrative demonstrating its project execution plan. The offeror shall include in its narrative all factors and conditions it deems relevant to the successful completion of the work under this contract. At a minimum, the offeror must address its procurement and teaming approach for all major subcontracts. The narrative must also address the offeror’s plan to mitigate schedule delays including (but limited
to) differing or unforeseen conditions, supply chain and adequate labor resources.
The offerors will also be required to submit an organization chart, which details the relationships between the proposed project team. The chart should graphically present the relationships between the General Contractor; major subcontractors, GSA, Army Corps of Engineers, NYSDEC, New York State Department of Transportation, local utility service providers, affected local private railroad companies, the Construction Manager-as-Agent and Architect and Engineer.
This narrative shall not exceed more than five (5) pages. If the information submitted for the narrative exceeds the page limitations, only the first five (5) pages will be evaluated.
The organization chart will not count against the page limit.
Document: C201-GC/SEPTEMBER 2023
Note for Joint-Venture Offerors: Joint-venture participant’s contribution to the organization should be commensurate with their skills and background and should be described in the project execution plan.
II. Staffing Plan
The offeror’s staffing plan should include a detailed description of how it intends to accomplish the requirements of the contract using in-house and subcontracted resources. The staffing plan should include:
a. General description of the overall staffing that will be provided to successfully meet the requirements of the specifications, including a breakdown/ratio of where the key personnel will perform their duties (home/field);

If the offeror has no record of relevant past performance or information on its past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance. The rating shall be characterized as “neutral.”
If proposing a joint-venture or teaming arrangement, offerors should first submit past performance records they have performed together as these experiences will receive more consideration than experiences performed separately. A Joint-Venture and Teaming Arrangement are NOT synonymous. If a teaming arrangement is proposed, the offeror (prime contractor) will be evaluated against this factor.
FACTOR 4 - SUBCONTRACTING METHODOLOGY (10%):
GSA is committed to providing, to the maximum extent practicable, for socio-economic businesses to receive Federal contracting opportunities. This factor is designed to ensure that this GSA commitment is brought to the attention of the prospective offerors.
This factor measures the extent to which the offeror will perform contract requirements utilizing small business concerns.
All business concerns (to include small businesses) shall address the extent of participation of small business concerns (SB) in performance of this contract. The offeror must provide its SB participation targets with its offer expressed as percentages of the total contract. Offerors shall submit the following to demonstrate the above:
1. Attachment 3, Small Business Utilization Form
Note: In accordance with FAR 19.702(a)(1), , the apparent successful offeror shall be required to submit an acceptable small business subcontracting plan prior to award.
Subcontracting plans are not required from small business concerns. Please see the row for GSA’s FY2024 Small Business Subcontracting Goals for reference here:

FACTOR 5 - SUSTAINABILITY (15%)
Background and Overview This project is funded in part by Section 60503 of the Inflation Reduction Act of 2022 (IRA), which provides funding for purchase of construction materials with substantially lower levels of embodied greenhouse gas emissions.
Document: C201-GC/SEPTEMBER 2023 (The Solicitation) https://www.sba.gov/sites/default/files/2024-01/FY24_Final_Goals_508.pdf
GSA’s IRA Low Embodied Carbon asphalt, concrete (and cement), glass and steel requirements establish numeric global warming potential (GWP) limits for certain EPA-approved construction materials: concrete (and cement), asphalt, steel, and glass (IRA-Eligible Materials). For each material, GWP limits have been established for the best performing 20% of materials in terms of embodied carbon (Top 20% Limits), the best performing 40% of materials in terms of embodied carbon (Top 40% Limits), and better than industry average (Better Than Average Limit).
This Evaluation Factor calls for offeror commitments to furnishing IRA-Eligible Materials with the lowest possible GWP values. IRA Limit commitments proposed under this evaluation factor will be incorporated into the successful offeror’s resultant contract.
Individual materials’ GWP values may be found on individual manufacturers’ environmental product declarations (EPDs). EPDs must meet the standards reflected in GSA’s IRA Low Embodied Carbon asphalt, concrete (and cement), glass and steel requirements (see Compliance Documentation criteria listed for each IRA-Eligible Material).
Technical Acceptability and Scoring Offerors will only meet the standard for technical acceptability under this Factor if they commit to furnish all required IRA-Eligible Materials with a GWP better (lower) than each IRA-Eligible Material’s Better Than Average Limit.
Offerors meeting the standard for technical acceptability will receive a number of Raw Scores, one for each IRA-Eligible Material required by the Contract:
● Offerors will receive a Raw Score of 100 for each IRA-Eligible Material commitment that is better (lower) than GSA’s Top 20% Limits.
● Offerors will receive a Raw Score of 40 for each IRA-Eligible Material commitment that is only better (lower) than GSA’s Top 40% Limits.
● Offerors will receive a Raw Score of 20 for each IRA-Eligible Material commitment that is only better (lower) than GSA’s Better Than Average Limit.
Offerors shall self-score* this Factor by filling out the table below with: the applicable IRA Limit they commit to meet for each IRA-Eligible Material; the associated Raw Score; and the Weighted Score.

Total Weighted Score (sum of Weighted Scores)
* The Weighted Score for each material must be rounded to the nearest hundredth decimal (i.e., two decimal places to the right of the whole number).
The Total Weighted Score (sum of Weighted Scores) must be rounded to the nearest whole number in accordance with generally accepted rounding methods (i.e., numbers 5 through 9 are rounded up to the next whole number; numbers 1 through 4 are rounded down to the next whole number).
** Required construction product assemblies (such as window assemblies) are included in IRA-Eligible Materials categories and will be bound by IRA Limit Commitments. At least 80% of the assembly’s total cost or total weight must be composed of compliant IRA-Eligible Materials.
*** Where provision of concrete that qualifies under these GSA IRA Limits is impractical, GSA’s IRA limits for cement may be applied to the cement being used in the concrete mix.
In addition, for each IRA-Eligible Material identified in the table above, offerors shall submit compliant EPDs listing that material’s GWP.
Note: By submitting an offer, offerors consent to GSA sharing supplier names and the GWP values associated with supplier materials with the successful offeror. Technical solutions, supplier pricing and supplier-offeror terms and conditions will not be shared.
