One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR 42.15.
b. The past performance evaluation process is a totally paperless process using CPARS.
CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.
c. We request that you furnish the Contracting Officer (CO) with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award.
Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, https://www.acquisition.gov/sites/default/files/current/far/html/Subpart%2042_15.html https://www.acquisition.gov/sites/default/files/current/far/html/Subpart%2042_15.html before returning the report to the Assessing Official (AO). Information in the report must be protected as source selection sensitive information not releasable to the public.
d. When your Contractor Representative(s) are registered in CPARS, they will receive an automatically generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at https://www.cpars.gov/.
e. Within 60 days after the end of a performance period, the AO will complete an interim or final past performance evaluation, and the report will be accessible at https://www.cpars.gov/.
1. Contractor Representatives may then provide comments in response to the evaluation or return the evaluation without comment.
2. Your comments should focus on objective facts in the AO's narrative and should provide your views on the causes and ramifications of the assessed performance.
3. All information provided should be reviewed for accuracy prior to submission.
4. If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating "No comment" in the space provided, and then selecting “Accept the Ratings and Close the Evaluation”.
5. Your response is due within 60 calendar days after receipt of the CPAR. On day 15, the evaluation will become available in PPIRS-RC marked as “Pending” with or without comments and whether or not it has been closed.
6. If you do not sign and submit the CPAR within 60 days, it will automatically be returned to the Government and will be annotated: "The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment."
f. The following guidelines apply concerning your use of the past performance evaluation:
1. Protect the evaluation as source selection information. After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the CO for instructions. Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.
2. Prohibit the use of or reference to evaluation data for advertising, promotional material, pre-award surveys, responsibility determinations, production readiness reviews, or other similar purposes.
If you wish to discuss a past performance evaluation, you should request a meeting in writing to the CO no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 60-day review period.
A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.

2.2 EVALUATION FACTORS FOR AWARD
This solicitation will use the Trade-off process in accordance with FAR Subpart 15.101-1 to obtain the best value. This process permits tradeoffs among cost or price and non-cost factors https://fiscal.treasury.gov/about-us/doing-business-with-fiscal-service/surety-bonds/list-certified-companies and allows the Government to accept proposals other than the lowest priced. The perceived benefits of the higher priced proposal, if selected, shall merit the additional cost, and the rationale for tradeoffs must be documented in the file in accordance with 15.308.
The Government intends to evaluate proposals and make award without discussions in accordance with FAR 15.306. However, the Government reserves the right to conduct discussions if determined to be in its best interest.
• Evaluation Factor 1 – Experience of the Prime Contractor: This factor considers the extent of the Offeror’s experience as a prime contractor on recent and relevant construction projects.
Recent and relevant are defined below:
o Recent – Prime contractor on projects that are in progress (at least 50% complete) or completed within 10 years of the proposal due date.
o Relevant – Projects that are comparable in nature to the solicitation project in complexity, scope, and magnitude. Similar in complexity is defined as construction projects that involve a variety of different trades. Similar in scope is defined as projects having some or all of the same work products as required for this project such as, but not limited to: cemetery renovation, raising and realignment of headstones, milling and paving, site work including extensive excavation and grading, site utilities, storm water infrastructure, historical preservation, turf replacing and maintenance, and site irrigation. Similar in magnitude is defined as construction projects totaling $2,000,000 or greater
Offerors’ recent and relevant experience will be assessed on the basis of its breadth and depth, schedule control, and cost control. Experience with VA National Cemetery renovation and improvement projects including shrine projects that include raising and realignment of headstones, turf renovation and maintenance, irrigation installation, and historical renovation and preservation work may result in higher evaluation ratings.
If the Offeror is a Joint Venture (JV), experience shall be submitted for projects completed by the Joint Venture entity and/or by the individual Joint Venture partners.
The Government will consider the experience of the Joint Venture and each partner, consistent with 13 C.F.R. §§ 125.8 and 128.402, to determine whether the JV demonstrates the experience necessary to perform this SDVOSB set-aside requirement.
• Evaluation Factor 2 – Past Performance: Past performance will be evaluated to assess the offeror’s probability of meeting the solicitation requirements. It considers each offeror has demonstrated recent and relevant record of performance in supplying services that met the contract requirements. One performance confidence assessment rating is assigned for each offeror after evaluating the offeror’s recent past performance, focusing on performance that is relevant to the contract requirements. There are two aspects to the past performance evaluation:
o Relevancy of contractual work performed; and o How well the contractual work was performed.
The first is to evaluate the offeror’s past performance to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through this solicitation.
Recent and relevant definitions for past performance evaluation are the same as for evaluation factor 1 of this solicitation.
The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts. Sources of Past Performance Information for Evaluation are as follows:
a) Past performance information can be obtained from any source available to the Government, to include, but not limited to, the Contractor Performance Assessment Reporting System (CPARS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, and Fee Determining Officials; and as appropriate, the Defense Contract Management Agency (DCMA) Acquisition Information Repository, accessible through the Defense Technical Information Center website.
b) Past performance information may be provided by the offeror, as solicited.
c) Past performance information may be obtained from questionnaires tailored to the circumstances of the acquisition.
• Evaluation Factor 3 – Technical Approach: The Government will evaluate the Offeror’s overall technical approach to successfully complete the project, including the feasibility, efficiency, and risk associated with the proposed solution. The evaluation will assess the Offeror’s understanding of the requirements and ability to manage and execute all aspects of the work.
The evaluation will consider the following areas:
a. Project Execution and Management: Adequacy of the proposed period of performance, project phasing, sequencing of work, critical path identification, and management of long-lead items. The Government will also evaluate the Offeror’s project management structure, quality control plan, submittal and RFI processes, communication approach, and subcontractor management.
b. Key Personnel and Technical Expertise: The Government will evaluate the qualifications and relevant experience of proposed key personnel, including project managers, superintendents, irrigation specialists, and personnel responsible for historical restoration activities. Greater consideration may be given to personnel demonstrating experience on similar projects of comparable scope and complexity.
c. Technical Approach to Specialized Work: The Government will evaluate the Offeror’s approach and demonstrated experience in performing key project components, including:
i. Installation and management of irrigation systems
ii. Raising, realignment, and resetting of veteran headstones, including both historic headstones and standard upright and flat markers
iii. Turf renovation and restoration associated with cemetery operations
iv. Work involving historic or preservation-sensitive features
Greater consideration may be given to Offerors demonstrating successful performance on similar cemetery or shrine projects involving these elements. The Government will evaluate both the technical merit of the proposed approach and the associated performance risk. Proposals demonstrating a clear, well-defined, and practical approach with qualified personnel and relevant experience may be rated more favorably.
• Evaluation Factor 4 – Price: The Government will evaluate the Offeror’s total evaluated price (base and all options) for price realism and price reasonableness. Price realism analysis will assess whether a proposed price is so low as to indicate a lack of understanding of the requirements or an unacceptable risk of performance. If the Government determines that an offeror’s price is unrealistically low, the proposal may be assessed as an unfavorable price-related risk rating or may be considered unacceptable and ineligible for award. Price reasonableness analysis will assess whether the total evaluated price is unreasonably high by comparing it to historical prices for similar efforts, the Independent Government Estimate (IGE), and price competition obtained from other offerors. A reasonable price is one that a prudent person would pay in a competitive business environment. An offeror’s price proposal must be found both realistic and reasonable to be eligible for award. Price realism is conducted solely for the purpose of assessing performance risk and will not be used to adjust an offeror’s evaluated price.
