About this file
This is a Request for Information (RFI) submitted by Dash Technologies Inc. regarding bonding requirements for the renovation of Building 16 at the Department of Veterans Affairs facility in Marion, Indiana (Project #610-20-103). The RFI seeks clarification on three specific points related to bonding requirements: whether the Miller Act applies requiring prime contractor performance and payment bonds, if first-tier subcontractor bonds are permissible under VAAR 852.228-72, and what provisions/limitations apply if subcontractor bonds are allowed.
The VA's response, directed to contractor Manuel Prieto of Dash Technologies Inc. in Eden, Utah, clearly states that bid/bonding requirements will only be accepted from Prime Contractors. The RFI was submitted on January 6, 2025, with a requested response date of June 10, 2024. The project is associated with Solicitation #36C25025B0005 and will be overseen by Contracting Officer Christopher C. Lee at the Department of Veterans Affairs office in Indianapolis.

RE: Sol #36C25025B0005 - Renovate Building 16 Marion IN We respectfully request clarification regarding the bonding requirements specified within the solicitation documents.
Specifically, we request clarification on the following points:
1. Does the Miller Act apply to this procurement, thereby requiring the prime contractor to furnish performance and payment bonds directly to the government, as outlined under FAR 28.102 and FAR Clause 52.228-15?
2. Alternatively, is it permissible for the bonding requirements outlined in the solicitation to be satisfied, either partially or fully, through the use of first-tier subcontractor bonds in accordance with VAAR 852.228-72?
3. If subcontractor bonds are allowable, are there specific provisions or limitations that the prime contractor must comply with to ensure full adherence to the solicitation's bonding requirements?
We appreciate your time and assistance in clarifying these points. Please let us know if additional information is needed to process this inquiry. We look forward to your response.
