SECTION III
SOLICITATION PROVISIONS
A. BASIS FOR AWARD
Proposals must meet the criteria stated in the request for proposal (RFP) to be eligible for award, to include responsiveness, technical acceptability and responsibility.
This acquisition will utilize the Lowest Priced Technically Acceptable (LPTA) procedure to make an award. The award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. For the offeror determined to be technically acceptable, award will be made to that vendor with the lowest overall price.
While the Government will strive for maximum objectivity, the technical go/no go process, by its nature, is subjective; therefore, professional judgment is implicit throughout the evaluation process. The Government intends to make an award based on the initial proposals. If further information is required, the contracting officer may contact the offeror or offerors. Award will be made to the responsible offeror whose proposal conforms to all solicitation requirements, such as terms and conditions, representations and certifications, technical requirements, and provides the lowest price to the Government based on the results of the evaluation.
Basis of award for the contract:
Factor 1 Technical Approach and Experience
Factor 2 Past Performance on Relevant Projects
Factor 3 Price
The lowest evaluated price exceeds all non-price factors. All non-price factors are approximately equal. After all the evaluations have been completed by the Source Selection Evaluation Board (SSEB), a component of the Source Selection Team (SST), the SSEB Chair will brief the SSA.
The Government reserves the right to reject all offers.
The Source Selection Decision shall represent the Source Selection Authority's (SSA) independent judgment.
The decision shall be documented, and the documentation shall include the rationale for any business judgments relied on by the SSA. In accordance with FAR 15.305 past performance will be evaluated.
NOTE: The government intends to award without discussion IAW FAR 52.215-1(f)(4) and promote an efficient and streamlined process as possible due to needs of the government. Therefore we will limit our initial evaluation of offerors to the three (3) lowest priced proposals initially and we will follow this process until we have a technically acceptable and responsible offeror, competing independently, whose priced offer satisfies the Government’s expressed requirement. Award will then be made on an LPTA basis.
B. EVALUATION PROCEDURE
1. FACTORS TO BE EVALUATED:
The LPTA evaluation process will be accomplished as follows:
Factor 1: Technical Approach: Evaluation of the offeror's proposal shall address each element as it applies to the evaluation criteria. During evaluations of each proposal, the Government will assign an overall adjectival rating to the factor and write a narrative evaluation reflecting the identified findings.
Factor 2: Past Performance on Relevant Projects: Each offeror's past performance will be reviewed to determine relevancy and confidence assessment.
Factor 3: Price: The resulting award will be a firm-fixed-price contract. Price reasonableness will be utilized in the evaluation of the firm-fixed-price effort.
2. EVALUATION RATINGS
a. Proposal Ratings: Factors 1 and 2 will be adjectivally rated. Offerors submitting proposals for this project should limit submissions to data essential for the evaluation of proposals.
See Section 4. "Evaluation Criteria," below for a discussion of the evaluation criteria applicable to these factors.
b. Technical Rating Definitions.
The following combined technical/risk rating definitions will be utilized in the evaluation of
Factor 1. RATING DESCRIPTION
Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. There is a very low risk of unsuccessful performance.
Unacceptable Proposal does not meet requirements and contains one or more deficiencies.
Proposal is not awardable.
c. Past Performance Assessment Definitions. Factor 2 will be evaluated using the following Performance Assessments:
RATING DESCRIPTION
Acceptable Based on the offeror's recent/relevant performance record, the
Government has a reasonable expectation that the offeror will successfully perform the required effort.
Unacceptable Based on the offeror's recent/relevant performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
No Past Performance No recent/relevant performance record is available or the offeror's (Neutral) performance record is so sparse that no confidence assessment rating can be reasonably assigned.
See Section 4. "Evaluation Criteria," for guidance on the Unknown Confidence (Neutral) rating.
Past Performance shall also be rated in accordance with the relevancy of the past performance. The following will be used for Factor 2:
RATING DESCRIPTION
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
3. EVALUATION APPROACH
3.1 FACTOR 1: TECHNICAL APPROACH AND EXPERIENCE:
The Government will evaluate the extent of recent and relevant project experience as it relates to the size, scope, and magnitude of this requirement. The Offeror must demonstrate relevant experience with at least three (3) project experience summaries that provide recent and relevant experience as it relates to the size, scope and magnitude of this requirement. The projects must be related to renovation and/or restoration on Government Historical Building. For the purpose of this solicitation, recent will be defined as either a project completed within the last (7) seven years or a project which is underway with construction at least 50% complete. The Government may place higher value on recent and relevant projects in which the Offeror performed as a prime contractor than as a subcontractor.
Project Management Plan:
The Offeror shall describe the approach for managing the project schedule, cost, deliverable, and personnel.
The proposal shall address how the Offeror will staff the project and manage all resources as assigned in support of the Scope of Work.
Schedule:
The offeror shall provide a detailed schedule showing how the work will be performed in order to meet the completion date. The offeror must discuss its scheduling capabilities and procedures to be used for this contract, which must include schedule updates and incorporating modifications into the schedule. The schedule shall demonstrate a reasonable and realistic sequence of activities which represent all work through the entire contract performance period.
Project Team:
The offeror shall demonstrate their qualifications to construct the solicited facility by describing the organizational structure and project team to be used for this project. All disciplines shall be led by an experienced professional registered in the discipline (if professional registration is recognized). The offeror shall submit documentation as to the availability of Key Personnel that indicates each individual's current assignment and the offeror's plan to ensure that the named personnel will be used on this contract. If the named person isn't available upon award, a person with the same or better qualifications shall be proposed for approval by the Contracting Officer.
Key Personnel shall include at minimum: Construction Project Manager, Construction Superintendent, and Contract Safety Manager. A five year minimum experience is required by each key personnel submitted in Historic Restoration in government buildings. All OSHA training requirements must be up to date. Resumes shall be provided and should include the following:
1. Employee's title for this project
2. Number of years with current firm and with other firms
3. Number of years in the proposed role or position
4. Specialization
5. Professional Registration (Type and State Registration) and/or certification
6. Personnel's specific experience and qualifications relevant to this project to include their role on this project. Relevant experience should include Historic Restoration in Government Buildings.
The offeror shall submit an organizational chart identifying the proposed team that will execute this project.
The organizational chart shall include the offeror's key personnel and key subcontractors. Specific subcontractors are not required to be named in the organizational chart but should be identified by type.
Please note: Construction and design of SCIFs shall be performed by U.S. companies using U.S. persons (an individual who has been lawfully admitted for permanent residence as defined in 8 U.S.C. 1101(a)(2) or who is a protected individual as defined by U.S.C.1324b(a) (3)).
Factor 1 will be evaluated to determine the following:
a. Does the offeror’s proposal demonstrate having the required minimum five years’ experience in historic government office renovation and remodeling.
b. Does the project team have a minimum of five years’ experience with historic government office renovation and remodeling.
c. Does the technical approach demonstrate that the project teams have executed similar complexity or work and have previously worked together on successful projects.
d. Does the technical approach demonstrate flexibility to address differing site conditions with minimal impact to cost and schedule.
e. Does the technical approach, scheduled sequence of work and management approach ensure a safe on time completion of the project?
3.2 FACTOR 2: PAST PERFORMANCE ON RELEVANT PROJECTS
The offeror shall provide information that demonstrates the offeror's past performance on relevant projects similar in nature and scope of the solicitation. The offeror shall submit information on a minimum of three projects that have had a performance period within the past seven years from the date of the original issuance of this solicitation. In the case of contractor team arrangements involving a prime contractor and subcontractor(s), where the prime contractor submits the proposal in response to this RFP, the prime contractor must have completed at least one of the projects submitted for Factor 2 for consideration in response to the past performance requirements of this RFP.
In addition to the construction elements discussed above, the submitted projects must clearly identify the following criteria: (A sample form is included at Attachment A, "Contractors Past Performance.")
a. Contractor's Name
b. Project Name & Location
c. Project Owner with Point of Contact Information ( If Government contract, provide contract number and contracting office)
d. Detailed Description
e. Explanation of Relevancy
f. Problems Encountered and Solutions
g. Lost Time Accidents
h. Schedule (original start, actual start, original finish, actual finish)
i. Costs (original project cost, final project cost)
j. Offeror' s Role and Work Self-Performed
k. Subcontracted Work (extent and type of work subcontracted by percentage)
l. Number of Request for Equitable Adjustments (REA's) submitted
m. Safety and DART rating
The offeror shall provide the performance evaluations for the submitted projects that demonstrate the offeror's performance on recent and relevant projects. The offeror shall provide formal performance evaluation if available. The Government's preference is the formal evaluation. If the formal evaluation is included, a Past Performance Questionnaire (PPQ) is NOT required or desired.
If a formal evaluation is unavailable, the offeror shall obtain the information using the form entitled, "Past Performance Questionnaire" included (Attachment B). The Past Performance Questionnaire included in the solicitation is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for Factor 2, Past Performance of Relevant Projects. Ensure correct phone numbers and email addresses are provided for the client point of contact. Completed Past Performance Questionnaires should be submitted with your proposal.
If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, Nancy Kebe via email at Nancy.p.Kebe@irs.gov prior to proposal closing date. Offerors may include performance recognition documents received within the last six years such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.
In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror' s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the offeror.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the offeror.
3.3 FACTOR 3: PRICE:
The offeror shall submit a firm fixed price.
4. EVALUATION CRITERIA
a. FACTOR 1: TECHNICAL APPROACH AND EXPERIENCE: The offeror will be rated on an adjectival basis of acceptable or unacceptable. To achieve an "acceptable" the offeror will submit the information listed in section 5.1.
b. FACTOR 2: PAST PERFORMANCE ON RELEVANT PROJECTS: Past performance will be rated in terms of how likely there is a performance risk to the Government; that is, acceptable risk or unacceptable risk that the offeror will succeed performing the work. The more relevant a proposed project is, the more weight it will be given in the overall confidence assessment rating. If an offeror has no record of relevant past performance, or if information on the offeror's past performance is not available, the offeror must state that fact. That offeror may be rated as Unknown Confidence/ Neutral. As stated in FAR 15.305(a)(2)(iv), an offeror without a record of relevant past performance or for whom information on past performance is not available will not be evaluated favorably or unfavorably on past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered 'acceptable.'
c. FACTOR 3: PRICE: Price Analysis: The process of examining and evaluating an Offeror's proposed price to determine if it is fair and reasonable, without evaluating its separate cost elements and proposed profit/fee will be conducted in accordance with FAR Part 15. Price analysis may involve comparison with other prices; e.g., comparing an Offeror's proposed prices of competing Offerors or with previously proposed prices for the same or similar items, and/or any of the price analysis techniques specified in FAR 15.404-l(b)(2).
5. EVALUATION PROVISION
a. Technical Evaluation Board and Price Evaluation Board will review the lowest price proposals against the approved evaluation criteria to ensure an equitable, impartial, and comprehensive evaluation against the solicitation requirements. Evaluation Board Chairs (Technical and Price) will prepared and present the report with all supporting documentation to the Source Selection Authority.
b. The Source Selection Authority, independently exercising prudent business judgment, will determine the offeror that proposed the lowest evaluated priced technically acceptable proposal.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT
YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE
RATING DEFINITION NOTE
(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
