TASK ORDER PROCEDURES

(a) Minimum/Maximum Contract Amounts: The contract minimum guarantee will be satisfied with award of the seed project or payment of $500 after contractor attendance of the post-award orientation conducted by Scott AFB 375th CONS and 375th CES. The orientation is an open forum discussion on the MAPC program. Some of the topics covered in the orientation may include identification of base security requirements, a tour of base facilities, relationship/partnering, bid-build specific requirements and expectations, and construction management. The government makes no representation as to the number of task orders or actual amount of work to be ordered in excess of the minimum guarantee specified herein. The maximum aggregate amount of the MAPC program, inclusive of all awarded MAPC contracts, task orders, and option periods, shall not exceed $45,000,000.

(b) On / Off Ramp Procedures:

(1) This provision prescribes the process by which the government will ensure an adequate number of contractors are available at all times to achieve effective competition on all task orders. The government intends to maintain a pool of small business contractors with proven track records to compete and deliver quality construction projects.

(2) Contract holders are expected, in good faith, to participate in task order competitions, and if successful, to deliver quality projects on time and on cost, to include management and supervision of subcontractors. If for any reason, a contractor cannot participate in a competition, the contractor shall provide written notice of the reason(s) for non-participation prior to the proposal due date. Before the exercise of any option period(s), the government will evaluate participation rates, reason(s) for non-participation, and performance evaluations for task orders completed or in effect. Failure to participate in good faith and/or an overall performance assessment rating of Marginal or Unsatisfactory may result in the contractor being off ramped from the multiple award program. An off-ramp decision results in contract expiration on the anniversary date of the basic contract and no remaining option period(s) being exercised. Any outstanding task orders must be worked to completion.

(3) In the event contractor(s) are off-ramped, the government will reserve the right to on-ramp contractor(s) to maintain a pool of small business contractors. On-ramp contractors will be selected based on initial evaluation results from the basic multiple award solicitation in order of ranking. Selected on-ramp contractors will be subject to a performance validation review. Contractor(s) must be active in SAM and otherwise in compliance with the original multiple award solicitation. If found in compliance, on-ramp contractors may be offered a bilateral IDIQ contract with original guaranteed minimum and allowed to compete on task order projects.

(4) The government reserves the right to utilize on-ramp and off ramp procedures throughout the basic contract lifecycle. The original performance period for contract holders is one (1) two-year base period plus three (3) two-year option periods and a six (6) month extension; no contract will extend beyond this limitation regardless of when a basic contract is awarded.

(c) Proposal Preparation Costs: All costs for preparation of task order proposals, whether funded or unfunded, shall be the contractor’s responsibility. At no time shall the government provide reimbursement for the preparation of proposals.

(d) Required Insurance: In accordance with FAR 28.306(b)(1) and clause 52.228-5, the contractor shall, at its own expense, procure and maintain the insurance types and in the amounts specified in FAR 28.307-2(a) through (c).

(e) Competition: Contractors awarded IDIQ contracts as a result of solicitation number FA440725R0001 will compete for subsequent task orders. Contractors are encouraged to participate in all site visits and submit proposals.

The government reserves the right to set-aside task orders for competition among Section 8(a) awardees only in accordance with FAR 16.505(b)(2)(i)(F). In the event the Government determines that there is insufficient competition based on the proposals received, a new Request for Proposals (RFP) may be issued to all MAPC contractors.

(f) Subsequent Task Orders: Task orders will typically range from $2,000 to $3,000,000. Task order projects may require single discipline or multi-disciplined construction services to deliver general building construction for sustainment, renovation, and maintenance-type projects. Projects may also require interior design, lead and asbestos abatement, and incorporation of sustainable features.

(g) Task Order Evaluation Criteria: Each RFP will state the evaluation process and factors and subfactors to be used in evaluating proposals. In addition to price or cost, the following factors may be evaluated:

(1) Technical Factors:

(A) The contractor’s technical understanding of the work

(B) The most efficient and effective plan to accomplish the work

(C) Rationale for proposed materials, type and quantities

(D) Quality of Deliverables

(E) Ability to Meet Schedule Requirements

(2) Performance Factors:

(A) Past Performance (performance on task orders under this contract or on other contracts)

(B) Relevant Experience

(C) Potential impact on other orders placed with the contractor

(D) Current workload

(h) Proposal Guarantee (Bid Bond): Proposal guarantees in an amount not less than 20 percent of the proposed price up to $3,000,000 will be required for all RFPs issued unless otherwise stated in the RFP.

(i) Performance and Payment Bonds: Contractor shall furnish Performance and Payment Bonds (Standard Form 25/25A) from authorized sureties only. A notice to proceed shall not be issued and no work shall begin until good and sufficient surety has been received and accepted by the contracting officer. The sureties list can be obtained at https://www.fiscal.treasury.gov/surety-bonds/list-certified-companies.html.

(1) Task Orders Greater Than $35,000 up to $150,000: The Contracting Officer shall select two or more payment protections listed in accordance with FAR 28.102-1(b). The contractor shall submit to the government one of the payment protections selected by the contracting officer.

(2) Task Orders Greater than $150,000: Payment and performance bonds will be required for all task orders over $150,000 in accordance with FAR 28.102-1(a) and FAR 52.228-15.

(j) Installation Rules and Regulations: The rules and regulations of the installation where services are performed shall apply to the contractor and their employees while on the premises of such installation. These regulations included but are not limited to presenting valid identification for base entrances, state registration, covered insurance for contractor-owned and/or privately-owned vehicles, obeying all posted directives, and providing strict adherence to security police direction in instances where security police have been dispatched to a particular location.

(k) Utility Services: In accordance with FAR 36.514 the contractor will be required to participate in Air Force energy and water conservation programs. Utility services are normally furnished to the contractor at no cost;

however, see contract clause titled FAR 52.236-14, Availability and Use of Utility Services. All connections are the responsibility of the contractor. At construction sites where utilities are not available, the contractor is responsible for furnishing temporary utilities (portable generators, etc.).

(l) Designation of Government Inspector: The Base Civil Engineer or their authorized representative is designated as the representative of the contracting officer for the purpose of performing construction contract quality assurance for the government, which includes performing technical surveillance, monitoring workmanship, verifying compliance with plans and specifications, and tracking progress. This provision in no way authorizes anyone other than the contracting officer to commit the government to changes in the terms of this contract.

(m) Green Procurement Program (GPP): Green Procurement is a federal acquisition policy that promotes preferred purchasing of environmentally sound products and services that have a reduced effect on human health https://www.fiscal.treasury.gov/surety-bonds/list-certified-companies.html and the environment. To comply with the affirmative procurement requirements of Section 6007 of the Resource Conservation and Recovery Act (RCRA) and Executive Orders 13101 and 13148 (Green Procurement Program (GPP)), the Contractor shall use recycled and recovered materials and products identified in the USEPA's Comprehensive Procurement Guidelines (CPG).

(1) The latest CPG product list, and the specific recycled content requirements for each product, can be found on the USEPA’s website (https://www.epa.gov/smm/comprehensive-procurement-guideline-cpg-program).

(2) The Contractor shall provide EPA designated products containing recovered material unless the item cannot be acquired:

(i) Competitively within a reasonable time frame.

(ii) Meeting the appropriate performance standards.

(iii) At a reasonable price.

(3) Items identified in the USEPA's CPG shall be viewed as the minimum that can be considered when evaluating recycled/reused materials. Other materials and products not listed, but commonly used in industry outside of the government, shall also be considered.

(4) Material and product submittals for all recycled content items shall list the recycled and recovered materials used and the percentage content listed.

(5) Additional program elements include:

(i) Energy Star products and energy-efficient standby power devices

(ii) Bio-based products as defined by USDA

(iii) Non-ozone-depleting substances
