The contract term is 24 months from the effective date with a potential state option to extend an additional 180 days under identical terms and conditions, and the project is evaluated on a lowest-cost responsive and responsible bidder basis meeting all ITB requirements.
No set-asides for disadvantaged enterprises, small businesses, or minority-owned firms are identified in the solicitation documents. The project is federally funded through a grant from the U.S. Department of Interior's Office of Surface Mining, which imposes Build America Domestic Procurement Preference requirements mandating that all iron, steel, manufactured products, and construction materials be produced in the United States; contractors must also comply with the Clean Air Act, Federal Water Pollution Control Act, and federal procurement transparency requirements. Respondents are subject to Iran Divestment Act compliance certification and may not have outstanding violations with the Office of Surface Mining or appear on the Applicant Violator System. No incumbent contractor information is referenced in the solicitation documents. The expected maximum contract liability is projected to exceed $1,500,000, with firm and fixed compensation covering all goods, services, deliverables, materials, equipment, overhead, and costs for the entire contract term; bidding is conducted primarily on unit price with lump sum bids required for mobilization, stream restoration, and road restoration components.
