Amendment 01
Q: Does the 15% self‐perform criterion include management?
A: Yes
Q: Are the performance bonds required to be 100% bonds?
A: Yes.
Q: Is Emerging Small Business a classification for awards?
A: Yes, Emerging Small Businesses will be a classification for Task Orders. If the project amount is under the ESB reserve (currently $30,000.00), then it is required the Government set aside for Emerging Small Businesses under contract.
Q: Will the attendees be receiving a sign‐in sheet for the meeting?
A: Yes, it is attached.
Q: Does the 15% self‐perform only pertain to construction or the entire project?
A: Construction only
Q: Is Design‐Build included in the 15% self‐perform criterion?
A: Yes, for the construction element only.
Q: Will a contractor that proposes on the design‐build option have a preference over a contractor only proposes without the design‐build option?
A: No. Design‐build is an option and will be evaluated separately.
Q: Can any contractor not in attendance propose on the MATOC?
A: No, any proposal received from a contractor not in attendance of the pre‐ proposal conference will be eliminated.
Q: Pertaining to the 15% self‐performance criterion, will a contractor be evaluated based on how much they can self‐perform?
A: No, the 15% is a required minimum only.
Q: Is this contract replacing an “old” MATOC? And did it include Emerging Small Businesses or replace an 8(a) set‐aside?
A: Yes, it is replacing the current MATOC. The current MATOC was a full and open competition.
Q: Will the prototypical project ever be awarded?
A: No.
Q: If prototypical project won’t ever be awarded, then how does the pricing for it play a role in the evaluation process?
A: Pricing will be evaluated against IGE to ensure offerors have an adequate understanding the magnitude of the prototypical project, as well as the various contractual requirements (Davis Bacon Act, etc)
Q: Could there be Task Orders placed off this award in 2010?
A: Yes. If there are projects to be awarded, then Task Orders could be placed using the new award.
Q: What percentage of work will be design‐build?
A: It varies from year to year. There is no way to predetermine a percentage.
Q: Will LEED certification be required for every project?
A: No. It depends on the size and scope of the project.
Q: When will this contract be awarded?
A: 9 August is the projected date
Q: Is this a joint project (Army and Air Guard)?
A: This is an Alaska National Guard contract. Any Army or Air National Guard Contracting Officer in the State of Alaska may write a Task Order under this contract.
Q: Are any bonds required for the prototypical project?
A: No; however, a letter of reference from the bonding company may be submitted, but is not required, to demonstrate bonding capability.
Q: After award, is a contractor eligible to compete in more than one task order set‐ aside category (e.g., WOSB and 8(a))?
A: Yes, as long as that contractor is SBA certified in those categories.
Q: Is it acceptable for a firm that is a member of two distinct joint ventures (but is not the prime venture in either joint venture) to be part of two separate offers?
A: There is a potential for the appearance of collusion (see FAR 3.101). We are currently awaiting a legal perspective and will post the results when provided to us.
Q: If the application to be certified as a socio‐economic group has been submitted to the SBA during the proposal process, can the contractor still compete for Task Orders set‐aside for that socio‐economic group after receipt of their certification?
A: Yes, as long as the contractor is certified prior to competing for the task order.
Q: Could you please provide an electronic copy of the Past Performance Evaluation questionnaire and transmittal letter?
A: Please look at the solicitation documents. These documents have been posted in pdf and word formats.
Q: Could you please provide an electronic copy of the SF 330 for those wanted to propose with the design‐build option?
A: It is now posted on the website.
Amendment 02
Q: On the front of the 1442 in box 13, it states that we should turn in 1 original and 4 copies. Then on page 15 of 140, section 00110, item 1.4, it states for Volume 1 is 1 original and 1 copy and Volume 2&3 is 1 original and 3 copies. Again in Exhibit F, it states the same as page 15. I just need clarification on exactly how many binders for each of the Volumes are to be turned in and does Volume 1 need to go in a separate sealed envelope with the rest of the stuff?
A: Please submit 1 original and 3 copies for all the volumes. And volume 1 does not need to be in a separate envelope.
Q: The SF1442 states “ The total of the contract shall not exceed $30,000,000.00.”
Section 00010, CONTRACT MINIMUM/MAXIMUM QUANTITY AND CONTRACT VALUE states “The maximum quantity and contract value for all orders issued against this contract shall not exceed the maximum quantity and contract value stated in the following table.” The maximum amount shown on this table is $30 Million.
However, Section 00100, paragraph 1.3 states “The maximum value of each contract will not exceed $30 million over the life of the contract.”
Please clarify if the entire MATOC contract will not exceed $30M or if each contract awarded under the MATOC contract will not exceed $30M.
A: The total of each contract will not exceed $30,000,000.00.
Q: Can the superintendant also act as safety and QC? Or does the QC need to be a dedicated position held by one individual?
A: Yes, depending on the complexity of the Task Order.
Q: Plan page T1.0 General Note 11 states “contractor to remove and dispose of ACM…” Should we include a cost for HazMat testing in our bid? Also, should we assume that if ACM was found that the cost to abate would be a change order?
A: Per Exhibit E, QUESTIONS AND ANSWERS, no questions will be addressed for the prototypical project.
Q: Realistically this job would not take 120 days. May a shorter schedule be proposed?
Q: Are source separated dumpsters required?
Q: In addition to the contractors CQC, is a 3rd party roofing QC required? If so, must the roofing QC be present at all times?
Q: In addition to the contractors CQC, is a 3rd party EIFS QC required? If so, must the EIFS QC be present at all times?
Q: Please confirm per section 00110, 2.1.2. The bid schedule is not to be turned in with proposal.
A: Section 00110, 2.1.2. does not address the bid schedule. Please resubmit question with correct reference.
Q: Please reference Section 01001, 1.26, b. Will a desk and chair inside the contractor’s temporary office be acceptable office space for government inspectors?
A: Yes.
Q: Can you make sure the e‐mails with personal information (provided information for pre‐proposal meeting) get permanently deleted?
A: All e‐mails containing personal information have been permanently deleted from our computers as of 16 Jun 2010.
Q: Has there been a clarification on the Joint Venture question discussed during the Pre‐Proposal Conference?
A: Only one (1) MATOC IDIQ will be made to one lead JV partner and the constituent junior JV partner in any combination. For example, the following example JVs will be allowed to compete for the MATOC IDIQ, but only one (1) will be awarded a contract. Joint Venture comprised of contractor A and contractor B; and Joint Venture comprised of contractor A and contractor C are acceptable to provide proposals;
however, only one MATOC IDIQ contract will be made with contractor A in the mix.
Q: The RFP states that a minimum of seven contractors will be chosen. That is a lot of contractors to bid on each task order. Do you have any projection for the amount of work, in total, to be performed each year? Will all contractors be invited to bid each task order? I am aware that one contractor cannot be awarded more than 30mm over the 5 years. If the work ended up evenly awarded, there could be potentially 7 x 30 or $210mm of work. Again, do you have any idea of the actual anticipated volume of work that would be performed? This is an important consideration in our deliberations regarding the commitment we would make to this program.
A: As stated in the pre‐proposal meeting, the Government cannot provide a projection of work for the upcoming years. However, the 2005 MATOC had a total of approximately 120 Task Orders totaling approximately $100M. This data is provided for information purposes only and SHALL NOT be considered a guarantee for future work.
Q: Section 00100, 2.2.1 page 17 states six general construction projects and two D/B.
Exhibit F states five general construction projects and two D/B. What is the correct number of projects for our reference questionnaires?
A: Please submit six (6) general construction project Performance Relevancy Questionnaires per Section 00100, 2.2.1.
Q: Exhibit C refers to “List of 10 other projects”. I can’t find this requirement in Section 00100.
A: This list is referencing the recommended additional projects referenced in Exhibit A, part 1. This has been changed in the amendment.
Q: Where are the instructions for filling out pages 3 thru 7 of the 140‐page solicitation?
A: Please refer to Section 00110, 2.1.1.
Q: How many project examples is the design team limited to for the SF330 form?
A: There is no limit.
Q: May subcontractors and A&E firms be listed with more than one Prime Contractor?
A: Yes. The Government cannot direct the prime contractor on subcontractor use.
Q: May a firm submitting a proposal as a Prime Contractor also be listed as a subcontractor on another Prime Contractor’s proposal?
A: Yes. The Government cannot direct the prime contractor on subcontractor use.
Q: Section 00110, 1.6.3 states proposals shall be prepared on standard 8.5 x 11 paper and charts may be landscaped on this size. Does the schedule required in Exhibit D for the prototypical project need to be prepared on 8.5 x 11 paper as well or is 11 x 17 paper as a foldout page acceptable for the schedule?
A: Please use 8.5 x 11 paper.
Q: With regard to the Past Performance for the Emerging Small Business classification that was brought up at the pre‐proposal conference, has the ANG made a determination on how many Past Performance projects will be required of firms in this classification?
A: The required number for Past Performance projects shall not differ regardless of classification types.
Q: The specification includes four Buy America Acts (starting on page 52 of the spec), some of which are in conflict with earlier iterations, e.g., the Buy America act including NAFTA would allow countries’ products which are precluded by the Buy America act (not including NAFTA). Do we rely on only the most recent iteration, or is there another interpretation?
A: The provisions and clauses in the current solicitation are applicable for this contract.
Q: Can an Offeror be considered if they are emerging and/or newly formed, but do not have direct experience but have an experienced team?
A: Yes. The source selection process will determine if each company will be able to meet the Government’s needs.
Q: In order to be considered for the Design Build portion, must the projects submitted be projects that were performed by the General Contract AND the Design Build Firm together? Or can the project submitted by projects completed by the design firm that are similar.
A: Six (6) construction projects and two (2) design build projects are required to be submitted. The design build projects need to performed by either the GC and/or the design‐build firm.
Q: The SF330 requires references for the Design build firm – which at time their client is the General Contractor including the Offeror – Do we need to submit past performance on the projects working with Contractors other than the Offeror or will past performance recommendations for the design firm from the Offeror be considered?
A: I do not understand this question. If it is similar to the question above it, please reference that answer. If that question is not similar, please resubmit.
Q: Reference Exhibit A, Item C.5.2. “Current Schedule if ongoing”, what information are you looking for in this blank? A progress percentage?
A: Yes, a progress percentage.
Q: Reference Exhibit B and SF330 AE Forms: Please clarify the teaming requirements for both Key Subcontractors and Design Firms in relation to the MATOC Contractor.
A: Exhibit B is required to be signed by subcontractors (including design firms) in order for the prime contractor to submit information about the subcontractor to the Government. Exhibit B does not address teaming requirements.
Q: Please confirm the Subcontractors and Design Team Members can sign agreements with more than one General Contractor.
A: Design firms are subcontractors to the General Contractor. The Government cannot direct the prime contractor on subcontractor use. Subcontractors can enter into agreements with as many of the General Contractors as they want.
Q: Is there a planed time extension for the MATOC Contract past the June 24th Deadline?
A: Yes, the proposal due date is extended to 1:00pm, 8 July 2010. Please see Amendment 02.
Q: Will further direction be given for the prototypical project?
A: No, please refer to Exhibit E and the CD. As previously stated in the pre‐ proposal conference, the prototypical project will not be awarded and is for evaluation purposes only. The Government needs to see if the proposal is valid, price is reasonable, and the contractor knows how to propose on a project.
