Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.

2. DETAILED DESCRIPTION OF WORK
2.1. SURVEYS AND LAYOUT
2.1.1. The Government shall furnish the Contractor documents showing property lines and the location of existing buildings and improvements. The Contractor shall provide competent surveying and engineering services to execute the work in accordance with the contract and shall be responsible for the accuracy of these surveying and engineering services.
2.1.2. The Government shall provide general reference points and benchmarks on the site. If the Contractor finds that any previously established reference points have been lost or destroyed, he shall promptly notify the COR. Points that require shifting because of necessary changes in grades or locations shall, with prior written approval of the COR, be replaced and accurately located by the Contractor.
2.2. PLANS AND SPECIFICATIONS
2.2.1. The general character and scope of the work are illustrated by the plans and the specifications. If the Contractor deems additional detail or information to be needed, he shall request information in writing from the COR. His request shall state the detail or information needed and shall explain why it is needed. The Contractor shall carry out the work in accordance with the additional detail drawings and instructions at no additional cost or time to the owner.
2.2.2. If the Contractor finds a conflict, error, omission, or other discrepancy in the plans or specifications, he shall notify the COR and KO in writing as soon as possible, but before proceeding with the affected work. If such conflict, error, omission or other discrepancy in plans or specifications was reasonably apparent or with reasonable diligence should have been apparent to the Contractor prior to submitting its bid or proposal, and the Contractor failed to submit questions in the time and manner required, then any claims shall be deemed waived and the Contractor shall not be entitled to additional compensation or time, or entitled to sue the owner.
2.2.3. In case of differences between small and large scale drawings, the large scale drawings shall govern. Where on any of the drawings a portion of the work is drawn out and the remainder is indicated in outlines, the parts drawn out shall apply also to all other like portions of the work.
2.2.4. Where the word “similar” appears on the drawings, it shall be interpreted in its general sense and not as meaning identical, and all details shall be worked out in relation to their location and their connection with other parts of the work.
2.2.5. The specifications are divided into several parts, or sections, for convenience only, since the entire specifications shall be considered as a whole. The divisions of the specifications are not intended to control the Contractor in dividing the work among subcontractors or to limit the work performed by any trade. The Contractor shall be solely responsible for the coordination of the trades, subcontractors and vendors engaged in the work and for the compensation of the trades, subcontractors and vendors for the work performed.
2.2.6. Measurements or dimensions shown on the drawings for site features, utilities and structures shall be verified at the site by the Contractor before commencing the work. The Contractor shall not scale measurements or dimensions from the drawings. If there are discrepancies, the COR and KO shall be consulted. If new work is to connect to, match with or be provided in existing work, the Contractor shall verify the actual existing conditions and necessary dimensions prior to ordering or fabrication.
2.2.7. The plans and/or specifications may indicate that the Architect/Engineer (A/E) designed or detailed a portion of the plans around a particular product (most commonly a piece of equipment). Should a different product be proposed by the Contractor and accepted, all modifications, rerouting, relocations and variations required for proper installation and coordination to comply with the design concept and requirements of the contract documents shall be the responsibility of the Contractor and shall be made at no extra cost to the Government. If the plans were noted as designed or detailed around a particular product and/or if a product is named when a “brand name or equal” specification has been used, this is not intended to favor or preclude the use of other products pursuant to Section 2.3 of this SOW.
Rather such design merely acknowledges the reality that in many instances the A/E must have a basis to design and detail around for dimensions and characteristics of a product or system.
2.2.8. Additional submittal requirements are shown in the specifications.
2.3. EQUALS
2.3.1. Brand names: Unless otherwise stated in the specifications, the name of a certain brand, make or manufacturer denotes the characteristics, quality, workmanship, economy of operation and suitability for the intended purpose of the article desired, but does not restrict the Contractor to the specific brand, make or manufacturer; it is set forth to convey to the Contractor the general style, type, character and quality of the article specified.
2.3.2. Equal materials, equipment or assemblies: Whenever in these contract documents, a particular brand, make of material, device or equipment is shown or specified, such brand, make of material, device or equipment shall be regarded merely as a standard. Any other brand, make or manufacturer of a product, assembly or equipment which in the opinion of the A/E is the equal of that specified, considering quality, capabilities, workmanship, configuration, economy of operation, useful life, compatibility with design of the work, and suitability for the intended purpose, will be accepted unless rejected by the KO as not being equal.
2.3.3. Substitute materials, equipment or assemblies: The Contractor may propose to substitute a material, product, equipment, or assembly which deviates from the requirements of the contract but which the Contractor deems will perform the same function and have equal capabilities, service life, economy of operations, and suitability for the intended purpose. The proposal shall include ay cost differentials proposed. The COR will have the A/E provide an initial evaluation of such proposed substitutes and provide a recommendation on acceptability and indicate the A/E’s redesign fee to incorporate the substitution in the design. If the proposed substitute is acceptable to the COR, a change order will be proposed to the Contractor to accept the substitute and to deduct the cost of the A/E redesign fee and the proposed cost savings from the contract price. The Contractor shall be responsible for making all changes in the work necessary to adapt and accommodate any equal or substitute product which it uses. The necessary changes shall be made at the Contractor’s expense.
2.4. AVAILABILITY OF MATERIALS
2.4.1. If a brand name, product, or model number included in the contract documents is not available on the present market, alternate equal products or model numbers shall be proposed by the Contractor through the COR for approval by the KO.
2.5. STANDARDS FOR MATERIALS INSTALLATION & WORKMANSHIP
2.5.1. Unless otherwise specifically provided in the contract, all equipment, material, and accessories incorporated in the work shall be new and in…
