Item Description

The bid documents for the Alter B140 Squad Ops Facility and F-35 Alter B140 Squad Ops Facility at VTANG in Burlington, Vermont, prepared by Smith- Alvarez-Sienkiewycz Architects, dated February 10, 2017 are modified as follows:

DRAWINGS:

A. A-1.0 (ALIS), E1.1 (ALIS)

1. Rm 021, ALIS Server Room: Ceiling; Replace Type C1 ceiling with C2. Replace light fixture type H1 with fixture type SL. Refer to Drawing E6.1 (Ops) for lighting schedule. Same fixture count and layout.

B. E1.2 (ALIS)

1. Rm 021, ALIS Server Room: Shift the 4DY on the west wall south, centering on wall between north wall and entry door.

C. E1.2 (ALIS)

2 Clarification of Aircrew Life Support Wood Locker Specification.

Response: The Aircrew Gear Cabinets (lockers) are custom. The 42 cabinet units are typical but they’re custom configured. Aircrew had very particular dimensions and specifications for those units. There is no spec. for wood lockers because they aren’t standard lockers, they need to be custom built as detailed on Drawing A-

10.2. These cabinets are covered by Section 062023 Interior Finish Carpentry.

3 The Solicitation Contract Form lists Items 0001 through 0007. It is clear that Items 0005, 0006 & 0007 correspond with the Bid Options as listed within section 012300 of the Project Manual. Provide additional scope clarification for the work that is to be included within items 001 through 0004 as it is not defined within section 012300 of the Project Manual and is not called out on the drawings.

Response: Solicitation item number 0001 is defined in the solicitation and is detailed in Project Manual “F-35 Alter B-140 Squad Ops Facility CURZ152807” for the ALIS portion of the work. Please note that there are two project manuals dated 10 February 2017 one referencing CURZ152807 and the other CURZ152813. The project manual referenced CURZ152813 is specific to line item 0002 of the solicitation. Line item 0003 includes the work associated with division 27 (each project manual) specific to the communications cabling. Line item 0004 is contractor manpower reporting and is addressed in division 1 and the solicitation. Please reference Solicitation Section 0010 item 13.

4 The Project Manual includes section 123216 Manufactured Plastic-Laminate- Faced Casework. Is this specification correct as the casework appears to be custom?

Response: The Plastic-Laminate-Faced Casework details are based on LSI Casework. LSI is a manufacturer that can provide custom cabinets. For example the LSI standard base cabinet has a 6” high drawer face but we prefer a 5” high drawer face. The cabinet sizes are standard. A manufacturer’s standard casework will be considered if they meet the specifications and do not differ from the details and dimensions significantly.

5 The Project Manual includes section 064200 Solid-Surface Wall Panels.

a. Does this specification also apply to the horizontal surfaces such as counters and benches?

b. Provide color Price Group for estimating purposes.

Response: No, Specification Section 064200 “Solid-Surface Wall Panels” applies only to the wall panels (in the Heritage Room, 153). Specification Section 062023 “Interior Finish Carpentry” includes all other solid-surface materials. Refer to 062023, 1.2, A. 2&3, “Solid surface counters and backsplashes.” (this would include the shower benches) and “Solid surface sliding doors and hardware.” The specifications call for colors to be selected from manufacturer’s full range so please carry Price Group D.

6 The project manual includes both section 072600 "Topical Moisture Vapor Mitigation System" and section 090561 "Moisture Vapor Emission Control".

a. The description for Option #3 within specification section 012300 Bid Options” references 090560 Moisture Vapor Mitigation Emission Control.

This specification section does not exist, I assume this should be 090651?

b. Part 1.2B of Specification section 072600 "Topical Moisture Vapor Mitigation System" states "The supply and installation of products in this section is a bid option.

c. Which specification section applies to Option #3? Are both specification sections used on this project? If not, where does the other occur?

Response: Specification Section 090561 is a duplicate, please omit. Please use Specification Section 072600 “Topical Moisture Vapor Mitigation System”. This Specification Section in for Bid Option #3.

7 Please confirm if who is responsible for the IDS/Card Access vendor.

Is it GFE-GI? We spoke with Advantor and it was their understanding that their contract was directly with the government.

Response: Correct. Perform work in the drawings only. The IDS/Card access system will be installed under separate contract.

8 It is clear that all windows shown in the schedule on drawing A-8.0 are to be blast resistant. It is not clear which doors are required to be blast resistant. Confirm that the only door openings that are required to be blast resistant are those that require 1" laminated insulated glass and/or those called out as blast resistant in the hardware schedule.

Response: The exterior doors and frames are all blast resistant and are noted as such on the exterior elevations; Drawings A-4.0, A-4.1 and A-4.2. The only exception is the door frame on door 140 into the existing parachute tower. This is an existing HM frame that is welded to the existing steel structure and may remain in place. Refer to Specification Section 083953 “Blast-Resistant Doors and Frames”.

9 ED1.0 Change Keynote 17 to read as follows:

“Disconnect and remove existing diesel fueled generator and all associated controls, disconnect switch and return to government (coordinate with COR) at the completion of the contract. Conduit and wiring complete. See drawing ED1.2 for additional information. See electrical demo general notes #18 and #19 on this sheet.”

10 ED1.0 Change Electrical Demolition General Note 19 to read as follows:

“The electrical contractor shall be responsible for keeping the existing generator available for stand by operations during construction including fuel and oil changes. Oil changes are required to be accomplished for every 300 hours of operation with full documentation. Upon turn in of generator at the completion of the contract all maintenance and operational records must be provided with the generator.”

11 Is this project subject to Buy American?

Response: Yes. Please reference solicitation W912LN-17-B-1000 page 14 which references FAR 42.225-12 Notice of Buy American Act Requirement – Construction Materials Under Trade Agreements (May 2014) Alternate II (June 2009). Review this clause for the specifics on the Buy American requirement.

12 Spec Section 263100-2.2C-1, the annual energy production minimum is 44,260kWh. Is that for the life of the system or just the first year?

Response: The annual KWH production stated is for the 1st year @ 97.5% of the panel listing. We expect 90% after 10 years and 80% after 25 years.

13 Who is the manufacturer of the existing roofing? Is the existing roof still under warranty?

Response: Yes, but not for the duration of the project. The existing warranty from Omnova Solutions/GenFlex Roofing System is effective from 1/1/2003 to 1/1/2018. Attachment 3 includes the certificate.

14 Section 220719/3.3/A/5 - calls for 1" thick glass fiber insulation on the roof drain bodies. Are we to insulate the existing roof drain bodies, and if so, will Armaflex Sheeting be allowed in lieu of glass fiber?

Response: Existing roof drain bodies are to be insulated. Armaflex Sheeting does not meet or exceed the k-value of the specified Rigid Glass Fiber insulation at 0.23 at 75 Degrees F and is not acceptable.

15 Unable to locate any P-1W or P-1WH plumbing fixtures on the drawings.

Please confirm the locations of these items.

Response: Wall Mounted toilets were removed from the project. Omit P-1W and P-1WH from the project.

16 Drawing M1.3, close to columns T/22, has a FCU tagged FC4-21? There is no FC4-21 on the equipment schedule. Please confirm that this is actually

FC4-19.

Response: Confirmed FC4-21 is actually FC4-19 for the SOF Desk.

17 Please confirm if sound attenuators are required at all SAPF/ STC wall penetrations as shown in detail 22, on drawing M5.2. If they are required, we will need additional information for pricing purposes.

Response: All SAPF wall duct penetrations requires a minimum of 2” thick acoustical lining for a minimum of 24” or an equivalent sound attenuator.

18 Please confirm that all insulated ductwork located inside mechanical rooms and/ or exposed to view will require aluminum jacketing.

Response: Canvas Jacket is acceptable within mechanical rooms.

19 Will any weather jacketing be required on the roof mounted ductwork?

Response: The only roof mounted ductwork in scope is the intake and exhaust goosenecks for the ERV and as such require no insulation or jacketing.

20 Please confirm the dryer venting is to be priced out of Galvanized and not Aluminum.

Response: Dryer venting is to be galvanized.

21 Type "C" diffusers do not appear on the drawings. Please confirm if they have been deleted from the project.

Response: Type C diffusers were removed from the project. Omit Type C diffusers from the schedule.

22 Does the existing VTANG BAS system referenced in Section 250923 ‐ Page 5, 1.8 section D have an existing ATO?

Response: No

23 Does the existing VTANG BAS reside on the Bases NIPR Net (NIPR)?

Response: No, resides on a separate, internal network.

24 If the existing VTANG BAS systems does not have an ATO, the intent of the New BAS system will be to obtain an ATO to meet the Cyber Security Requirements for Department of Defense Facilities as described in Section 250923 ‐ Page 6 – 2.4, with that said, the existing VTANG BAS system will not be able to reside on or interface to the New BAS. Is this the correct understanding as to not void the ATO for the New

BAS?

Response: No. Contractor does not need to obtain an ATO. Government will obtain that after installation. All other specifications for the hardware and software requirements must be met.

25 Is the VTANG responsible for obtaining the ATO? If not, will the VTANG be sponsoring the ATO effort?

Response: Yes

26 Will the BAS contractor be able to complete the network installation for commissioning purposes, without connecting the network to NIPR? NIPR connection of the system will only occur after issuance of ATO?

Response: Yes. Existing system not set up on NIPR. Installed and operating on a separate network. However, no off base connectivity is possible. The structure of the network requires on site connectivity for all programming and commissioning services.

27 In reference to Section 250923 ‐ Page 7, 2.5 Operator Workstation Requirements, is the VTANG or the ATC contractor responsible for supplying Server #1, Server #2, Workstation #1 with specified monitors and the associated operating system software?

Response: Yes. All requirements prescribed in paragraph 2.5 are to be included and supplied by the general contractor in the base bid.

28 The specification references a ground face CMU in the project.

Response: The reference to the ground face in the specification is an error. There is no ground face CMU in this project.

29 Supplemental Information regarding the solicitation page 36/37 specific to Availability and Use of Utility Services:

The Contracting Officer has determined that Government-operated utilities are adequate and will be furnished to the contractor without charge where existing outlets are available. The contractor is responsible for installing temporary service outlets, as necessary, at its expense in accordance with the clause entitled "Availability and Use of Utility Services" (FAR Clause 52.236-14). The following utilities will be available: Water and electricity are available for use by the contractor, however, electricity shall not be used as a heating source.

30 There is a problem with receiving a quote for the blast resistant Aluminum Framed Entrances and Curtainwalls specified in section 084413. Kawneer, EFCO and Tubelite are specified. Kawneer appears to be the only manufacturer interested in quoting the job and currently has this project in their estimating que. At this point, EFCO & Tubelite are not working on this project and are not intending to providing a quote. Kawneer will only fully engineer the blast resistant windows prior to providing pricing and due to their current work-load and engineering backlog, they are not able to provide a quote to our installer prior to Friday - June 16, 2017. Installed quotes would be available to General Contractors on Monday - June 19, 2017. A bid extension of one week is requested. If not, could a material and installation allowance be established for this scope of work?

Response: The bid opening date will not be extended. Please utilize all available resources in your proposal.

2. Offeror’s attention is invited to the insurance requirement contained in this solicitation (Contract Clause FAR 52.228-5). Certification of the required coverage for the prime contractor shall be furnished prior to beginning work on this contract, and the Contracting Officer may request evidence of the required insurance at any time during the life the contract.

The prices shown in the Bidding Schedule must reflect ALL costs involved in performing the work, as described in the plans and specifications.

52.203-13 CONTRACTOR CODE OF BUSINESS ETHICS AND CONDUCT (OCT 2015)

(a) Definitions. As used in this clause--

Agent means any individual, including a director, an officer, an employee, or an independent Contractor, authorized to act on behalf of the organization.

Full cooperation—

(1) Means disclosure to the Government of the information sufficient for law enforcement to identify the nature and extent of the offense and the individuals responsible for the conduct. It includes providing timely and complete response to Government auditors' and investigators' request for documents and access to employees with information;

(2) Does not foreclose any Contractor rights arising in law, the FAR, or the terms of the contract. It does not require-

(i) A Contractor to waive its attorney-client privilege or the protections afforded by the attorney work product doctrine; or

(ii) Any officer, director, owner, or employee of the Contractor, including a sole proprietor, to waive his or her attorney client privilege or Fifth Amendment rights; and

(3) Does not restrict a Contractor from--

(i) Conducting an internal investigation; or

(ii) Defending a proceeding or dispute arising under the contract or related to a potential or disclosed violation.

Principal means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

Subcontract means any contract entered into by a subcontractor to furnish supplies or services for performance of a prime contract or a subcontract.

Subcontractor means any supplier, distributor, vendor, or firm that furnished supplies or services to or for a prime contractor or another subcontractor.

United States means the 50 States, the District of Columbia, and outlying areas.

(b) Code of business ethics and conduct. (1) Within 30 days after contract award, unless the Contracting Officer establishes a longer time period, the Contractor shall--

(i) Have a written code of business ethics and conduct;

(ii) Make a copy of the code available to each employee engaged in performance of the contract.

(2) The Contractor shall--

(i) Exercise due diligence to prevent and detect criminal conduct; and

(ii) Otherwise promote an organizational culture that encourages ethical conduct and a commitment to compliance with the law.

(3)(i) The Contractor shall timely disclose, in writing, to the agency Office of the Inspector General (OIG), with a copy to the Contracting Officer, whenever, in connection with the award, performance, or closeout of this contract or any subcontract thereunder, the Contractor has credible evidence that a principal, employee, agent, or subcontractor of the Contractor has committed--

(A) A violation of Federal criminal law involving fraud, conflict of interest, bribery, or gratuity violations found in Title 18 of the United States Code; or

(B) A violation of the civil False Claims Act (31 U.S.C. 3729-3733).

(ii) The Government, to the extent permitted by law and regulation, will safeguard and treat information obtained pursuant to the Contractor's disclosure as confidential where the information has been marked “confidential” or “proprietary” by the company. To the extent permitted by law and regulation, such information will not be released by the Government to the public pursuant to a Freedom of Information Act request, 5 U.S.C. Section 552, without prior notification to the Contractor. The Government may transfer documents provided by the Contractor to any department or agency within the Executive Branch if the information relates to matters within the organization's jurisdiction.

(iii) If the violation relates to an order against a Governmentwide acquisition contract, a multi-agency contract, a multiple-award schedule contract such as the Federal Supply Schedule, or any other procurement instrument intended for use by multiple agencies, the Contractor shall notify the OIG of the ordering agency and the IG of the agency responsible for the basic contract.

(c) Business ethics awareness and compliance program and internal control system. This paragraph (c) does not apply if the Contractor has represented itself as a small business concern pursuant to the award of this contract or if this contract is for the acquisition of a commercial item as defined at FAR 2.101. The Contractor shall establish the following within 90 days after contract award, unless the Contracting Officer establishes a longer time period:

(1) An ongoing business ethics awareness and compliance program.

(i) This program shall include reasonable steps to communicate periodically and in a practical manner the Contractor's standards and procedures and other aspects of the Contractor's business ethics awareness and compliance program and internal control system, by conducting effective training programs and otherwise disseminating information appropriate to an individual's respective roles and responsibilities.

(ii) The training conducted under this program shall be provided to the Contractor's principals and employees, and as appropriate, the Contractor's agents and subcontractors.

(2) An internal control system.

(i) The Contractor's internal control system shall--

(A) Establish standards and procedures to facilitate timely discovery of improper conduct in connection with Government contracts; and

(B) Ensure corrective measures are promptly instituted and carried out.

(ii) At a minimum, the Contractor's internal control system shall provide for the following:

(A) Assignment of responsibility at a sufficiently high level and adequate resources to ensure effectiveness of the business ethics awareness and compliance program and internal control system.

(B) Reasonable efforts not to include an individual as a principal, whom due diligence would have exposed as having engaged in conduct that is in conflict with the Contractor's code of business ethics and conduct.

(C) Periodic reviews of company business practices, procedures, policies, and internal controls for compliance with the Contractor's code of business ethics and conduct and the special requirements of Government contracting, including--

(1) Monitoring and auditing to detect criminal conduct;

(2) Periodic evaluation of the effectiveness of the business ethics awareness and compliance program and internal control system, especially if criminal conduct has been detected; and

(3) Periodic assessment of the risk of criminal conduct, with appropriate steps to design, implement, or modify the business ethics awareness and compliance program and the internal control system as necessary to reduce the risk of criminal conduct identified through this process.

(D) An internal reporting mechanism, such as a hotline, which allows for anonymity or confidentiality, by which employees may report suspected instances of improper conduct, and instructions that encourage employees to make such reports.

(E) Disciplinary action for improper conduct or for failing to take reasonable steps to prevent or detect improper conduct.

(F) Timely disclosure, in writing, to the agency OIG, with a copy to the Contracting Officer, whenever, in connection with the award, performance, or closeout of any Government contract performed by the Contractor or a subcontractor thereunder, the Contractor has credible evidence that a principal, employee, agent, or subcontractor of the Contractor has committed a violation of Federal criminal law involving fraud, conflict of interest, bribery, or gratuity violations found in Title 18 U.S.C. or a violation of the civil False Claims Act (31 U.S.C. 3729-3733).

(1) If a violation relates to more than one Government contract, the Contractor may make the disclosure to the agency OIG and Contracting Officer responsible for the largest dollar value contract impacted by the violation.

(2) If the violation relates to an order against a Governmentwide acquisition contract, a multi-agency contract, a multiple-award schedule contract such as the Federal Supply Schedule, or any other procurement instrument intended for use by multiple agencies, the contractor shall notify the OIG of the ordering agency and the IG of the agency responsible for the basic contract, and the respective agencies' contracting officers.

(3) The disclosure requirement for an individual contract continues until at least 3 years after final payment on the contract.

(4) The Government will safeguard such disclosures in accordance with paragraph (b)(3)(ii) of this clause.

(G) Full cooperation with any Government agencies responsible for audits, investigations, or corrective actions.

(d) Subcontracts.

(1) The Contractor shall include the substance of this clause, including this paragraph (d), in subcontracts that have a value in excess of $5.5 million and a performance period of more than 120 days.

(2) In altering this clause to identify the appropriate parties, all disclosures of violation of the civil False Claims Act or of Federal criminal law shall be directed to the agency Office of the Inspector General, with a copy to the Contracting Officer.

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 30 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 365 days after the date the contractor receives Notice to Proceed.
