AMENDMENT 0015
The purpose of this post-proposal closing Amendment is to provide response to Offeror’s questions:
1. The due date for revised technical and price proposals remains unchanged at 15 October 2013 at 1500 CET:
2. Offeror’s Questions and Responses:
Question – 1: Based on the Discussion Items/Questions letter dated 21 September 2013, our understanding is that we are to respond to each question listed in Enclosures (1) and (2) with an “Offeror’s Response” section. If it is acceptable, we plan to replicate each of the USACE items/questions, followed by our company’s response as requested, in a separate document. We also intend to provide revised Volume I Technical Proposal and revised Volume II Price Proposal documents, with changes highlighted, in addition to a summary section listing additions, deletions and other changes made in Volumes I and II, as requested in the letter dated 21 September.
Please clarify if these planned submissions are acceptable.
Response: This approach is acceptable and the preferred method for submission.
Question – 2: We understand that electronic submissions will be accepted for our responses, and plan to electronically submit the above-mentioned documents by 15 October 2013 at 15:00 Central European time. In addition, should we follow up by sending in a new bid bond in hard copy original form?
Response: Electronic submissions are acceptable as stated in the Discussion Letter. Submission of hardcopy with CDs is also acceptable. In accordance with FAR Clause 52.228-1 Bid Guarantee, the amount of the bid guarantee shall be ten (10) percent of the bid price or $2,500,000.00, whichever is less. An Offeror who has submitted a bid bond with their initial proposal and is now “over bonded” with the submission of their revised price proposal does not need to submit another bid bond. However, if the original bid bond does not meet the criteria of FAR Clause 52.228-1 as a result of the revised proposal, additional bonding is required. Submission must be the original bid bond document and must be received no later than the due date and time of the submission of the revised proposals addressed in paragraph 1 above.
Question – 3: We have concerns over the open ended Phase 2 Construction NTP, and our ability to hold pricing for what could be an indefinite period of time. Could the government please define a timeframe for the contractors to hold their pricing in the event there is a substantial delay to the anticipated April 1, 2014 NTP date for construction. This will allow for a reasonable evaluation of any anticipated escalation in materials, and or labor pricing, in the event the government is not able to provide NTP for Phase 2 Construction within the approximate timeframe referenced.
Response: As stated in the Price Schedule provided with Amendment 00014 under the paragraph called Validity Period of Contractor’s Proposal, “Contractor’s are reminded to evaluate and submit prices giving consideration in the projected delay in the NTP for the Construction Phase as addressed in Amendment 00014.”
The Government’s projected dates of 15 November 2013 for the Administrative Notice to Proceed (NTP) for Site Inspections and Submittals and 1 April 2014 for NTP for Construction are the dates the Government
W912GB-13-R-0009
requires the Offeror to base their pricing when submitting their revised price proposal. The Government will not accept requests for equitable adjustments for escalation in materials and/or labor pricing costs after award.
Question – 4: With regard to Amendment 0014, we have the following question:
Attachment 4 („Revised Proposal Pricing Worksheet“) lists various “Major Divisions of Work” where prices can be filled in. The “Price Proposal”, however, consists of much more tasks that are not listed in the chart such as finishing works (windows, tiles, drywall construction, flooring, etc.). Do bidders have to submit quotes for the main divisions only (i.e. total amount on worksheet does not correspond with the overall proposal price) or shall the finishing works be allocated to the corresponding major divisions so that the total amount on the worksheet is equivalent to the proposal price? Could you please clarify?
Response: Submit the Revised Proposal Pricing Worksheet as provided, without including additional Divisions of Work (e.g., finishing works). Given the limited number of Major Divisions of Work included with the Worksheet, totals of the Price Schedule individual Base and Optional Line Items and the total of the Price Schedule would not be equivalent to the Worksheet totals.
3. All other requirements of the Solicitation and as amended remain unchanged.
