BIDDER'S QUESTIONS AND GOVERNMENT REPLY
(Questions that may be of general interest to all Bidders and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s).
Questions and answers are issued to the bidders "For Information Only" and do not revise the solicitation, plans or specifications.)
Question 1: Please consider awarding options at the time of base award rather than 90 days. The option quantity is significantly more than the base quantity. The Contractor cannot wait until the project is almost complete to know if they have double the work.
Response 1: Please see amendment #2. No revisions will be made.
Question 2: The Contractor is required to complete the Base within 250 days of NTP. The estimated timeline for this project would be mid-July for required completion, which is past the
March 15 requirement of being off the beach. The required time and environmental beach requirement do not align. This assumes the Contractor will be granted the beach environmental extension. If this is not guaranteed, then the required Contractor completion should be the following season, with the inclusion of a new CLIN for 2nd season remobilization.
Response 2: Please see amendment #0002 and responses listed.
Question 3 : Please explain the difference between First Tier LD's and Second Tier LD's. Both state, "For each calendar day of delay until the work is complete or accepted."
Response 3: The first Tier LD's are daily costs incurred by the Government if the contractor does not substantially complete the entire project by the Legal Contract Completion Date.
The Second Tier LD's is for damages incurred if the contractor does not complete 100% of the contract requirements within 30 calendar days of the Official Final Inspection. Meaning any punch list or remaining work that was not accepted at the final inspection.
Question 4: Please confirm LD's will not be assessed during the environmental window.
Response 4: LD's first and second tier, will only be assessed if the contractor does not complete by the legal contract completion date, independent of any environmental window.
Question 5: Section 01 11 00, 1.1 Commencement, Prosecution and Completion of Work states "The Contractor must be required to commence work under this contract within 10 calendar days after the date the Contractor receives the Notice to Proceed. "Section 00 72 00 - General Conditions states "The Contractor shall be required to commence work under this contract within 5 calendar days after the date the Contractor receives the notice to proceed." These two sections contradict each other. Please confirm when the contractor should commence work under this contract.
Response 5: Please see amendment #0002 and responses listed.
Question 6: SF 1442 states the magnitude of the contract is from $50 to $100 million.
Section 01 11 00, 1.3 Disclosure of the Magnitude of Construction Projects states the magnitude is $25 to $100 million. These two contradict each other. Please confirm the magnitude of the contract.
Response 6: Estimated magnitude of construction is between $50,000,000 and $100,000,000
Question 7: Section 01 14 00, 1.2.2 Working Hours states, "Working hours for dredging are 24 hours a day including Sunday and Government Holidays." 1.2 Exclusionary Period states, "No work may be performed during Government Holidays, without written approval of the Contracting Officer." These two contradict each other. Please confirm the Contractor can work 24 hours a day 7 days a week 365 days a year.
Response 7: Please see amendment #0002 and responses listed
Question 8: 1.2.4 Environmental Restrictions mentions nesting areas are defined as areas that have been occupied by plovers demonstrating breeding behavior or nesting at any point within the past three breeding seasons. Please provide a map of these locations on the beach.
Response 8: Nesting areas and non-nesting areas are defined in Environmental Monitoring Plan issued in Amendment 0002. These areas are subject to change based on the 2027 nesting activities if additional options and time are awarded.
Nesting areas for the 2027 season are north of Cottage Rd and are subject to expand during the 2027 nesting year.
If additional options are awarded the protocol and monitoring plan in the Amendment shall be followed. Under no circumstances will work or equipment storage north of Cottage Rd. be permissible beyond March 15 for 2027 or 2028. Work beginning March 1 or beyond requires monitoring as specified in the plan.
Piping plovers can arrive to the NJ Coast as early as March of each year. If piping plovers were to arrive, nest, or demonstrate breeding activities in areas south of Cottage Rd. in the 2027 season, the area within 1 km will be designated as a nesting area for the following 3 breeding seasons.
The monitor will be a biologist with at least 40 hours of field experience observing piping plovers and documented experience locating, identifying, and monitoring them. The biologist's name, address, telephone number, and anticipated work schedule on the project will be submitted to the Corps for review and approval, in consultation with the Service, and New Jersey Department of Environmental Protection Endangered and Nongame Species Program (ENSP) at least 10 working days before the start of the seasonal windows.
The monitors shall maintain daily field notes and report findings on a daily basis to the Corps biologist beginning March 1, 2027. The Corps will ensure prompt transmission of the monitoring reports to the Service.
Before the start of work each day, a piping plover survey will be conducted of the entire current construction area, as well as any areas where work will commence within the next 4 days. In addition, the monitor will conduct daily observation of all piping plovers anywhere in the Project footprint while work is in progress. With Service concurrence, the Corps may modify survey and monitoring specifications based on site-specific considerations.
For areas south of Cottage Rd work will not be conducted within the following buffers until the monitor and the Corps can determine whether the plovers are migrants or may establish breeding territories.
March 1-14: buffer will be 300 meters around the bird
March 15-31: buffer will be 500 meters around the bird
April 1 and beyond: buffer will be 1,000 meters around the bird
Any sightings must be immediately reported to Katherine Amirr (Katherine.Amirr@usace.army.mil) along with location and behavior.
Question 9: Is the Contractor required to perform pre and post surveys of the all the borrow areas provided in the contract or only the ones that are actually used during this contract?
Response 9: Pre- and post-dredge surveys of only the used borrow areas are required.
Question 10: Section 01 56 10, 3.1.2 Endangered Species Protection states "2. Starting immediately upon project commencement, all project vessels will have on deck observers to monitor for Atlantic Sturgeon, sea turtles and whales." Please confirm that this is intended for hopper dredges only and the Contractor's crew boat, tugs, etc. are not required to have an approved Endangered Species Observer on them.
Response 10: NMFS Approved Endangered Species Observers are only required on the project dredges and not for each project vessel. It is required that all vessels have LOOKOUTS for ESA (not certified ESA Observers, just crew with knowledge of whale species) to address concerns about whale strikes.
Question 11: Section 01 57 19 3.5.1 Preconstruction Air Permits states " Notify Air Program Manager, through the Contracting Officer, at least 6 months prior to bringing equipment, assembled or unassembled, onto the Installation, so that air permits can be secured. Confirm that these permits have been obtained." Please confirm that these permits are obtained. Please confirm that the Air Program Manager has been notified. The required dredging schedule cannot meet this required notice.
Response 11: The mentioned section will be revised.
Question 12: Is the contractor allowed to disturb material below the Maximum Allowable Cut Depth?
Response12: The contractor cannot exceed the maximum allowable cut depth.
Question 13: Please specify the permitted depths in each borrow area.
Response 13: Please refer to sheet C-113.
Question 14: Some of the provided borrow areas contain cobbles and MEC and do not contain quality beach material. Will Government release other sections of the Borrow Area that are not currently included in the contract? How long will it take the Government to make such change?
Please include a stand-by CLIN for borrow area delays.
Response 14: The borrows areas designated for this project are shown on C-113. The successful contractor is to choose and use whichever of the released borrow areas are most productive to achieve the beach renourishment design templates.
Question 15: Large MEC's have been encountered in the borrow areas provided. Please provide a stand-by CLIN to cover delays for agency removal of MEC's.
Response 15: Contractors should account for the potential of MEC being caught in the draghead into their unit price. MEC discovered in the screening baskets on the beach should not result in production delays on the dredges.
Question 16: 1.6.2.2 Qualifications state that the QC Manager is required to have a current professional engineer registration in the state of New York. This is not consistent with other districts or New York district past requirements and unnecessary, and unavailable. Please consider removing this requirement.
Response 16: Please see amendment #0002 and responses listed.
Question 17: Will the Contractor be allowed to traverse along the beach when moving between the different beaches?
Response 17:: Traversing along the beach is permissible, the contractor must avoid areas of seabeach amaranth. The contractor shall stake these areas out prior to mobilization with string and post fencing (sand and snow fencing is not permissible). USACE will provide these areas to the contractor, which will become available to the successful contractor, once access areas, staging areas, and traverse routes are proposed. All plover buffers remain in effect during the nesting season and traversing north of Cottage Rd. after March 15 is not permitted.
Any lanes required to traverse the beach from the staging and defined access locations to the work areas, shall be included as part of the successful contractor's submitted site and work plan.
This will be reviewed and accepted by the Government in coordination with NJDEP and the local Township Government.
Question 18: Note #1 on G-101 states the Surveys are from 06 Oct 2025 to 05 Dec 2025. Does this include the beach surveys and the borrow area surveys?
Response 18: The mentioned Note will be updated on the plan sheet. Borrow Area Survey was conducted between 10 Feb 2025 to 24 Feb 2025. Beach Surveys were conducted 06 Oct 2025 to 05 Dec 2025. See amendment 2 for additional comments on beach surveys.
Question 19: The Contractor understands Monmouth Beach is required first, followed by Sea Bright (base). If awarded, will the Contractor be allowed to pump part of Sea Bright North or South while they are working on completing Sea Bright (base)?
Response 19: Specification section 01 14 00 was revised, Monmouth Beach will not be required to be first. Yes, if awarded, the Contractor will be allowed to pump part of Sea Bright options while working on completing the base.
Question 20: Will the Contractor be allowed to traverse the beach between the various beach locations?
Response 20: See Response 17.
Question 21: Please consider changing the Bid Validity to 60 days. Due to the current bid market, the Contractor cannot wait 120 days to know if they have a project.
Response 21: Bid Validity will change to 60 days.
Question 22: How should the contractor submit pre bid questions?
Response 22: Please see amendment 0001
Question 23: What is the last day to submit pre bid questions?
Response 23: Last day will be 1200PM 19 August 2026
