PROPOSER’S QUESTIONS AND GOVERNMENT REPLY

Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only” and do not revise the solicitation, plans or specifications.

1. With reference to document: W912DS24R0004 “Solicitation, offer and Award” special requirements clause 72 “Other applicable Pituffik regulation to follow”. Is it correct understood, that all companies under this contract must follow Inatsisartutlov nr. 11 of 1 December 2021 under Greenlandic law, requiring that companies entering agreements with foreign defense authorities (with U.S Government) on Pituffik Space Base, must be registered as a limited company or private limited company domiciled in Greenland, and its management must have its seat in Greenland? Registration required for tax purpose, so that companies must pay taxes for the contractual work related to projects on Pituffik Space Base, and income tax for personal working on Pituffik Space Base, according to govern regulations.

RESPONSE: No, only Sub-Contractors must be Danish or Greenlandic Origin. The Prime Contractor must be a US-Based Firm.

2. Text states, “The Firm shall confirm that it understands and that it shall perform the amount of work required to be self-performed, in accordance with the appropriate clause in Section 00 70 00 that applies to the contract performance.” Section 00 70 00 doesn’t seem to be the appropriate section for defining self-work requirements. Is the relevant section and clause Section 00 72 00 and clause 52.236-1 only, or are there other references that need to be considered?

RESPONSE: FAR clause 52.236-1 found in Section 00 72 00 is the only reference to be considered.

3. In several areas of the specification, a warranty for other than manufacturer warranty is required that exceeds the 1-year warranty stated in the solicitation, FAR Clause 52.246-21. Please confirm that the 1-year warranty stated in the FAR Clause is the intended requirement for installation and construction as detailed within the RFP.

RESPONSE: The FAR Clause FAR 52.246-21 warranty starts from the time the Government accepts the work and continues for 1 year. The 1-year warranty is the Prime contractor’s warranty. Any other required manufacturer’s warranty is in addition to the 1-year warranty stated or provided as a standard manufacturer’s warranty.

4. In the solicitation, FAR Clause 52.228-15 is included as a requirement. In response to this requirement, will the Government accept a fixed bond amount that will be renewed annually for the entire period of performance inclusive of the required installation warranty period. RESPONSE: The bond would need to be adjusted based on any modifications that would increase or decrease the contract during the PoP of the contract. Therefore, an annual bond would not be acceptable.

5. “All Offerors will sign the attached NDA and submit with their proposal.” Does the Government require all personnel in contact with the solicitation to sign the NDA or only those in contact with the controlled information. RESPONSE: All those in contact with the HEMP controlled information must sign the

NDA.

6. “All Offerors will sign the attached NDA and submit with their proposal.” Would the Government clarify in which volume and tab Offeror should submit signed NDAs? RESPONSE: NDAs are required for all individuals that need access to the HEMP controlled information. NDAs need to be submitted to the Contracting Specialist or Contracting Officer prior to submission of proposal. NDAs are not intended to be included with the proposal.

7. Is there a specific reason this contract has no DPAS rating? Critical materials are being quoted with extremely long lead times. Requesting the Government add a DPAS rating of DX or DO to allow for Contractors to request expedited delivery that this rating will enforce. RESPONSE: The Government will include the appropriate DO rating to the successful awardee in the awarded contract. The rating is not provided as part of the solicitation. FAR clauses 52.211-14 and 52.211-15 have been included as part of this amendment. In addition, the successful awardee will submit DD Form 691

– Department of Defense Application for Priority Rating for Production or Construction Equipment as part of the award requirement prior to NTP issuance.

8. Section 00 21 16 - Instructions to Proposers; Section 00 72 00 - General Conditions. The RFP includes 52.232-16 PROGRESS PAYMENTS and 52.232-5 Payments under Fixed-Price Construction Contracts.

Please clarify which Payment Clause applies.

RESPONSE: Both Clauses are applicable.

9. Please confirm that Insurance requirements will be aligned with Danish Law for Danish and Greenlandic contractors.

RESPONSE: As the contract will be a US contract, the insurance such as General Liability, etc. will be under US law. Workers comp would be under Danish/Greenlandic law for their work.

10. The RFP doesn’t clearly delineate excusable delays beyond the section entitled “Extensions for Severe Weather”. Please add FAR 52.249-14 entitled “Excusable Delay” to the RFP. Post award this will allow for the clear delineation of excusable delays between the Government and Prime contractor.

RESPONSE: FAR 52.249-14 deals with cost reimbursement contracts and therefore would not apply as this is a Firm Fixed Price contract.

11. With reference to Amendment no.1 (Q/A: 24): Offer to be submitted latest 4. December 2023 (extended from 20 November 2023). If this is a contract opportunity for several bidders, where teaming is required between US Firms and Danish/Greenlandic Firms, and it is expected to receive competitive and binding bids, a much longer tender period is required. We request (again) date of offer changed to earliest 20th February 2024.

RESPONSE: Please refer to the revised proposal due date as noted on SF1442 of this amendment.

12. With reference to document: W912DS24R0004 “Solicitation, offer and Award” special requirements clause 4 “Insurance”. Please clarify who shall insure the works / parts not covered by the required third-party insurance – will US Government take out contractors all risk (CAR) or shall the Contractor include this - if required at all?

RESPONSE: The contractor shall include this in their proposal.

13. With reference to document: W912DS24R0004 “Solicitation, offer and Award” – Limitations of liability.

The contract /amendment 1, defines that liquidated delay damages will not be capped. Please clarify for this contract, if there are any contract (total) limitations / cap of the liability towards US Government, considering consequential damages, indemnification etc. or shall the General/ Prime Contractor alternative JV/Consortium bidder hold US Government harmless, unlimited?

RESPONSE: There is no requirement that the Government is held harmless and there is no cap on the contractor’s liability to the Government.

14. With reference to document: W912DS24R0004 “Solicitation, offer and Award” – FAR 52.232-16 Progress Payments. Allowing us to evaluate cash-flow. Is it correct understood, that the definition of work progress which will be accepted as pay activities, is limited to mobilization/demobilization and works executed on site? Meaning planning and preparation works as submittals, design and similar will not be approved as pay activities?

RESPONSE: Progress payments will be based on agreed to percentages for pay activities completed work that is in compliance with the contract. Administrative tasks supporting the installation activities will not be approved as separate pay activities. They will be compensated for as the installation pay activity is completed. The Government may consider, as part of the installation pay activity, compensation for materials delivered to the site as indicated in the payment clause.

15. With reference to document: W912DS24R0004 “Solicitation, offer and Award” – “Bonds”. Is it correct understood, that the General/Prime Contractor or if a JV/Consortium as bidder, must provide a performance and payment bond for 100% of the contract amount according to FAR 52.228-15? Further, if this performance/payment bond is not furnished within due time as stated in FAR 52.228-1, Contracting Officer can terminate the contract and cash the 3.000.0000 USD bid bond - correct?

RESPONSE: Yes, the P&P bonds must be provided in the amount according to FAR 52.228-15 upon award of the contract. The bid guarantee is pre award and if not furnished at the time of the bid opening, the bid will be rejected. Please review items (d) and (e) of FAR 52.2258-1 which clarifies a failure to execute all contractual documents or furnish execute bonds. Also, the bonds are only required for the General Contract which for this procurement would be the U.S. Firm.

16. Spec section 01 11 00 ppg 1.8 describes GFE. POL products are listed as “at cost”. Will the contractor be required to purchase diesel fuel for the temporary power generators? RESPONSE: No, as noted on the drawings there is a fuel line being connected from the existing tanks. Thus, the fuel for temporary power generators will not be contractors’ responsibility. Paragraph 1.8 applies to contractors’ equipment (cars, trucks, other fuel running equipment) used for construction activities.

17. With reference to Package 2: Section 01 11 00 1.8 GOVERMENT-FURNISHED MATERIAL AND EQUIPMENT: Re. item b. the table, Item No. 1, “POL Products (at a cost)” Please confirm that the following will be furnished by the Government at no cost for the Contractor: Fuel (JP-8) for the temporary backup power generators throughout the construction period and for the new generators during the test and commissioning. Lubricant oil SAE 10W30. Antifreeze.

RESPONSE: Yes, JP-8 will be available for the temporary and permanent power generators at no cost to the contractor, all other consumable liquids (oil, coolant) for temporary generators will be contractors’ responsibility. All other uses of POL products for the use of contractor owned equipment used for construction will be contractors’ responsibility.

18. With reference to document: W912DS24R0004 “Solicitation, offer and Award” – Section 01 00 00 Special Requirements – Clause 36 - Lunch. Contractor depends on to the food supply to Pituffik Space Base by others. Contractor personnel can buy meals at the dining hall at Main Base; however, J-Plant is located at J-Site, with a transport duration of up to 30-40 minutes each direction. Will Government – to same rate – instead provide this lunch meal at Contractors site facilities at J-Plant?

RESPONSE: The base will not provide special deliveries of meals for contractors at J-Plant, also the contractors will NOT be able to use the facilities at 12SWS. Contractors may coordinate with the Base Maintenance Contractor (BMC) kitchen staff for other possible pickup options, there may be a fee.

19. "Hazardous Materials. The Specification states that ""Contract documents identify materials such as PCB, lead paint, and friable and non-friable asbestos and other OSHA regulated chemicals"". Please specify which "Contract documents"" identifies the Hazardous Materials."

RESPONSE: For Hazardous materials please refer to Appendix M as issued in this solicitation.

20. "Contaminated soil. The specification states that "If petroleum-contaminated soil, or suspected hazardous waste is found during construction that was not identified in the Contract documents, immediately notify the Contracting Officer. "Please specify which "Contract documents" identify petroleum-contaminated soil."

RESPONSE: This statement is meant to provide instructions as to what to do if contaminated soil is encountered. There are no identified contaminated soils in this project.

21. Division 08 34 49.00 20, page 11, paragraph 2.9 requires factory testing of the HEMP shielded door. In the past, the Government has accepted a factory test result from a previous project and product with the same manufacturer. This course of action applied to the current program could eliminate significant cost and schedule impact. Would the Government accept a factory test report from a previous project?

RESPONSE: Yes, the government will accept previously performed tests for the SAME shielded doors. Please refer to revised section par 2.9 in 08 34 49.00 20.

22. In several areas of the specification, the manufacturer of a component (e.g., HEMP shielded door manufacturer) is required to install the component and be present to witness field testing. In past projects, it has been acceptable for the construction contractor or HEMP contractor to install IAW the manufacturer’s installation plan. Will the Government allow members of the Offeror’s team to install and test devices and components IAW the manufacturer’s installation plan in lieu of having the manufacturer’s representative(s) on site, if such an installation plan or instruction is available?

RESPONSE: Yes, the Government will allow the installation of HEMP components, as long as its performed by a HEMP qualified contractor and IAW manufacturers installation plan, please refer to revised sections of 08 34 49.00 20 as noted in this amendment.

23. “Submission of Danish or Greenlandic Subcontracting Plan for all non-HEMP work is required.” Medium Voltage (MV) equipment such as the generators and 5-KV switchgear must be purchased from US suppliers to meet the project specifications, and the MV power feed to building 4002 is mission critical.

Therefore, its recommended that MV equipment purchasing and installation be performed by US firms and personnel.

RESPONSE: It is correct that the power requirements must meet US specifications, however, this would not preclude Danish/Greenlandic contractors from sourcing the materials from US suppliers and performing the installation. Utilization of Danish/Greenlandic contractors must be maximized for non-HEMP work.

24. “Each page of text shall be minimally single spaced with a minimum 12-point font and one-inch margins all around.” Would the Government allow a smaller font size of no smaller than 10 point for drawings and graphics as a 12 point font may distort the presentation and flow of information within the graphic and make it difficult to understand.

RESPONSE: Yes, drawings and graphics can use 10-point font size.

25. Project Specs (08 34 49.00 20; 13 27 54) refer to MIL-STD-188-125-1 in multiple locations. Solicitation document refers to MIL-STD-188-125-1A as the preferred specification for past performance. Should the specification references to MIL-STD-188-125-1 be interpreted as referring to MIL-STD-188-125-1A RESPONSE: This project was designed to MIL-STD-188-125-1 since the revised version was not available in time, thus MIL-STD-188-125-1 is the standard to comply. However, the government is open to taking advantages, if any, from the latest revisions to MIL-STD-188-125-1A during shop drawing submittal process, as applicable.

26. With reference to Amendment no.1 (Q/A: 2+4+21): Tender drawings. HEMP drawings (only available for incorporated companies with their headquarter in the US) is as well including needed information about the works to be priced by Danish/Greenlandic firms. We request, all not available drawings in the drawing package, to be provided additional without HEMP details to all on SAM.gov.

RESPONSE: Please refer to additional cleared drawings as issued under this amendment.

27. With reference to Amendment no.1 (Q/A: 26): Permanent generators. Answers seems not responding question: Is it correct understood that all new permanent generators including accessories shall be delivered / installed by Danish/Greenlandic firm? Under which item is the new permanent power generators to be priced?

RESPONSE: It is the PRIME CONTRACTOR’s responsibility to complete and submit the bid schedule with maximum participation of Danish/Greenlandic subcontractors for any non-HEMP work. It is correct that Danish/Greenlandic subcontractors have the opportunity to provide and install the generators, except for connections of HEMP components. The permanent generators should be included in CLIN 0001. ONLY ONE comprehensive bid schedule will be accepted.

28. With reference to Amendment no.1 (Q/A: 34): Eligible bids. The answer state, that it is the intention to maximize work performed by Danish/Greenlandic contractors. Please clarify if shall be understood that it is a requirement that all other works except the HEMP enclosure priced under Item 2, must be subcontracted to Greenlandic/Danish firms?

RESPONSE: It is correct that the US PRIME CONTRCTOR must subcontract as much of the NON- HEMP work to Danish/Greenlandic subcontractors, i.e. all work except for CLIN 0002.

29. With reference to document: W912DS24R0004 “Solicitation, offer and Award” – Section 01 00 00 Special Requirements – Clause 22 – Storm Conditions. Please clarify if all reference to “storm conditions”, is the actual storm condition at J-Site and not at Main Base? Please clarify if it will be permitted to work at J- Plant / J-Site at storm conditions “Bravo” – since non-essential travels are restricted to Main Base?

Clause 22 specify that time extension will be granted if more than 10 days per year with storm condition “Charlie” or “Delta” (assume then based on that it will be allowed to work at J-Site at storm Condition “Bravo”). Please clarify when it is determined that it is possible to start work again – when storm condition is downgraded or when workforce actual is back to construction site at J-Plant from Main Base?

RESPONSE: The storm conditions are triggered if the requirements are met and classifications are made by the base Command for particular area, i.e. it is possible that main base be in Alpha condition and J-Plant site be in Bravo condition at the same time. Per par 22 of 01 00 00 – Bravo storm condition only restricts travel, work within J-plant would be able to continue.

30. With reference to document: W912DS24R0004 “Solicitation, offer and Award” – Section 01 00 00 Special Requirements – Clause 36 - Quarters. Government will provide free of charge – quarters for contractor work force / personnel - 36 (1). It is a project with a duration of 4 years. Initial estimates indicate manning up to 90 persons. For such a long period at this location, it is essential that Contractor can provide reasonable living facilities for the work force. Will it possible for the Contractor to get 6-7 flattops for the solo use at this project during the contract period – so that each person can get own room (single occupancy) and Contractor can establish reasonable living conditions for the long period?

RESPONSE: At this moment this request cannot be promised, depending on the time of mobilization and activities at the base this will be revisited. This will be discussed in detail at the preconstruction meeting.

31. With reference to document: W912DS24R0004 “Solicitation, offer and Award” – Section 01 00 00 Special Requirements – Clause 36 - Transportation. Is it correct understood, that the mentioned bus service is only a service provided on main base, and all transportation of workforce between J-Plant and main base shall be part Contractor’s responsibility and cost? RESPONSE: Correct, contractor is responsible for their own transportation to/from site.

32. With reference to document: W912DS24R0004 “Solicitation, offer and Award” special requirements clause 72 “Other applicable Pituffik regulation to follow”. Clause 72 refers to many documents incl. 10 management plans from 2015. It seems like a mismatch with the documents provided within package 4 “Appendices”. Examples: Package 4 incl. Drinking Water Analysis Plan, but this plan is not mentioned under clause 72. Clause 72 mentioned a Conservation Management Plan however not found within package 4. Clause 72 refers to Asbestos Management Plan from 2015 – but the included plan in package 4 is from 2017 (and further not to a valid later version then 2017). Please clarify which documents/plans incl. valid versions to be considered under this contract (offer) and forward them / update package 4?
