About this file
This amendment modifies an existing federal solicitation for maintenance dredging services. The solicitation seeks dredging of approximately 125,000 cubic yards of material from the Arthur Kill 50-foot Reach of the New York and New Jersey Harbor Federal Navigation Project. The amendment revises the plans and specifications, provides a new quality control system section, and replaces the bid schedule. Bidders must acknowledge the amendment by the date specified. The dredged material will be processed and transported to contractor-furnished upland placement sites permitted by the state. The apparent low bidder must submit permit and approval evidence within 35 days of notification. Bids are due in June 2023, with award anticipated in June/July and work from August to October. Liquidated damages of $2,540 per day will be assessed for delays.

NOTES TO BIDDERS:
TOTAL BASE BID (CLINs 0001 thru 0003)

NOTE 09:
Bidders must bid on all items. Failure to bid on all work will be cause for rejection of the bid as nonresponsive.
Award of contract will be based on the responsible and responsive bidder with the lowest total price for the total of the CLINs 0001 through 0008.
The unit prices for CLINs 0002, 0004, 0005, 0006, 0007, and 0008 represent the cost per cubic yard for the removal of the estimated quantities of dredged material (all material except ledge rock lying above the planes of -50 feet mean lower low water (MLLW), plus 1 foot allowable overdepth), in the Basic Work and Option areas of Arthur Kill. The dredged material from CLINs 0002, 0004, 0005, 0006, 0007, and 0008 must subsequently be transported, processed, and placed at a contractor furnished, state permitted, Government approved upland placement site(s).
All bidders are hereby advised that the execution of Options is subject to the availability of funds.
Execution of an Option is at the discretion of the Government. If exercised, Option(s) 1 through 4 (CLINS 0004, 0005, 0006 and 0007) must be awarded in numerical order and can be exercised within five (5) calendar days of receipt by the contractor of the Notice to Proceed. If exercised, Option 5 (CLIN 0008) can be awarded independent of Options 1 through 4 (CLINS 0004, 0005, 0006 and 0007) and can be exercised within thirty-six (36) calendar days of receipt by the contractor of the Notice to Proceed.
If an option(s) is exercised, its performance period will be consecutive to that of the Basic Work. If exercised, the time for contract completion of the option(s) will be based on the rate of one (1) additional calendar day for each 2,500 cubic yards in the option(s).
Options 1 through 4 (CLINS 0004, 0005, 0006, and 0007) represent the stated additional and incremental extension of the dredging area from the Basic Work limit line or preceeding option limit line as shown on the contract drawings. Estimated quantities for CLINS 0004, 0005, 0006, and 0007 account for the removal of slope material from the preceeding option(s) or Basic Work area.
All bidders are hereby advised that the estimated dredge quantities for placement in the price schedule are estimated and based on the survey data collected on 17, 21-22 November 2022.
The Government may reject a bid as non–responsive if the prices bid are materially unbalanced between line items and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Government even though it may be the low bid.
W912DS23B0004
NOTE 10: Bidders are reminded that they must bid on the issued plans and specifications as amended. Any deviations, conditions or attachments made by the bidder himself may render the proposal non-responsive and may be cause for its rejection.
NOTE 11: The apparent low bidder shall submit the documents specified in Section 01 30 00, Administrative Requirements, paragraph 1.4, Contractor-Identified Offloading, Processing and Disposal Site Compliance.
If the apparent low bidder does not submit the required information within 35 calendar days from the date the apparent low bidder is notified of being the low bidder, the bidder may be considered non-responsible and his bid will no longer be considered. Information provided by the apparent low bidder regarding the 35 day submittal will be the final version. If the apparent low bidder requests to make changes to the 35 day submittal, they can only be made with approval from the Government.
NOTE 12:
NOTE 13:
It is the contractor’s responsibility to comply with all conditions and requirements of the contractor furnished placement site(s).
All bidders are hereby advised that the contractor is to complete the entire work ready for use, not later than 56 calendar days after the date the Contractor receives the notice to proceed. Should any option(s) be exercised, an additional one (1) calendar day for each 2,500 cubic yards to be removed under the option(s) will be allowed. The time stated for completion shall include final cleanup of the premises.
