TOTAL BASE (CLINS 0001 thru 0017)
TOTAL OPTIONS (CLINS 0018 thru 0033)
TOTAL BASE PLUS OPTIONS (CLINS 0001 thu 0033)
NOTES:
1. Tapering for hydraulic beach fill is included in the items and exact locations are on the plan sheets
2. Low bidder for the purpose of award will be the conforming bidder offering the lowest amount for the total base bid and optional bid items.
3. Any bid which is materially unbalanced may be rejected. An unbalanced bid is one, which is based on the prices significantly less than cost for some work and prices, which are significantly overstated for other work.
4. Bidders are required to bid on all items or their bids will be rejected.
5. Bidders are reminded that they must bid on the issued plans and specifications as amended. Any deviations, conditions, or attachments made by the bidder himself thereto may render the bid non‐responsive and may be caused for its rejection.
6. Optional Items CLINS 0018 - 0033 may be exercised as needed on or before 01 March 2017. These items at the discretion of the Contracting Officer are reserve for a pile damaged during proper installation by buried obstructions and at the direction and approval of the Contracting Officer needs to be replaced in accordance with the specifications. Price includes removal and proper disposal of damaged pile, treatment of new pile as per specification, and installation of new pile in place with steel shoe as per specification. No additional time will be added to the duration of the contract.
Question and Answer
1) Question: Our previous request for additional 6 months was insufficient and we are now requesting an additional 365 calendar days to be added to the contract.
RESPONSE: IN AMENDMENT 0005, the specifications have been revised to reflect a longer duration for all other work besides Hydraulic Beach Fill.
2) Question: Due to the magnitude of the scope of work for the groin and outfalls, as well as the level of interface required between contractors, a substantial amount of coordination with proposed subcontractors is required prior to bid.
RESPONSE: IN AMENDMENT 0005, the specifications have been revised to reflect a longer duration for all other work besides Hydraulic Beach Fill.
3) As we endeavor to provide the government with our most competitive pricing, we respectively request a two week extension to the bid date to August 18th 2015.
RESPONSE: IN AMENDMENT 0006, the bid opening date has been extended to 11 August 2015.
4) Question: Amendment 0005 requires completion of sand placement by August 1, 2016 and completion of all other work by March 17, 2017. The sand placement work must be closely coordinated with the other construction work on this project and cannot be completed eight months prior to the construction work without significant cost impact to the project. Will the Corps please consider changing the completion of all work required on this contract to March 17, 2017?
RESPONSE: Due to the emergency nature of this work and the importance of constructing a coastal storm risk management project in this project area as soon as possible, USACE will not change the completion of all work BEYOND March 1, 2017.
As stated in the previous amendment, the contractor shall be required to commence work under this contract within 5 calendar days after the date the contractor receives the Notice to Proceed, complete Hydraulic Beach Fill work by 11 August 2016, complete all other work, including optional bid items (if awarded) and remove all of his equipment from the contract area by 1 March 2017.
5) Question: In addition, with the extension to the contract duration granted by Amendment 0005, subcontractors will now be revising their proposals and our coordination efforts are still ongoing. In light of this, we respectfully request an extension of the bid date to August 18th, 2015.
RESPONSE: IN AMENDMENT 0006, the bid opening date has been extended to 11 August 2015.
6) Question: Concrete pipe manufacturers are stating that elliptical pipe is only available in Class B wall thickness per ASTM C507. Please confirm that this will acceptable.
RESPONSE: Class B will be acceptable.
7) Question: Is the bent spacing based on horizontal distance or along the profile of the pipe?
RESPONSE: Bent spacing is along the profile of the pipe.
8) Question: The 96" RCP comes in 20' lengths. Can the joints be set mid-span between the bents?
RESPONSE: All pipe joints must be centered on pile bents. We have identified pipe manufacturers who normally produce 96 inch dia RCP in 16 foot long sections. Most manufacturer can produce 16 foot lengths upon order.
9) Question: "Answer 12. The pile must be driven to a minimum length as well as achieve the minimum bearing capacity. If refusal is reached prior to the specified embedment being obtained, the pile will not be accepted. It will be presumed that an obstruction has been encountered and suitable measures shall be taken to ensure that both criteria are met." Are you expecting the contractor to remove an obstruction that is 30 feet below grade?
RESPONSE: No, the Government is not expecting the contractor to remove an obstruction in this instance.
10) Question: Is galvanized or uncoated reinforcement for RCP acceptable in lieu of epoxy?
Suppliers have informed us that epoxy coating of this diameter is not feasible.
RESPONSE: Galvanizing of the reinforcement is acceptable.
11) Question: Section 02 32 00 SUBSURFACE DRILLING, SAMPLING, AND TESTING.
How deep are the borings required to be drilled and sampled?
RESPONSE: As per Section 02 32 00 1.4.4.1 of the Specifications, the borings are to be advanced and sampling shall be performed to an elevation equal to or greater than 5 feet below the minimum tip elevation of the piles in that area.
12) Question: Will the soil boring information be used to determine pile length?
RESPONSE: The subsurface information will be used to supplement the existing subsurface information and evaluate any potential conditions that might require the USACE to reevaluate the pile designs and the specified installation methods in a given area.
13) Question: Section 31 62 19.13 WOOD MARINE PILES: What is the order length of the test pile?
RESPONSE: The contractor shall order test piles that are at least 50 feet in length.
14) Question: What are the exact locations of the 15 test piles?
RESPONSE: A plan showing the locations of all test piles shall be made available; however, the absence of their precise location is not expected to have any effect on the bid price or schedule.
It only states minimum 2 representative test piles per outfall. What is defined as landside vs.
waterside? The "landside" designation is used for bents where the cut-off elevations of the piles is above 0.0 Feet NAVD 88 - these would be the bents west of the shoreline at MSL.
Conversely, the "waterside" designation is used for bents where the cut-off elevations of the piles is below 0.0 Feet NAVD 88; these bents are east of the MSL line.
15) Question: What is the procedure for a pile which do not meet the require load? Will an additional test pile be needed? Will the Contractor be compensated for additional test piles?
RESPONSE: The Contracting Officer will determine the need for an additional test pile, should a test pile fail to meet its required load capacity. The pile failing the test may require extraction.
The Contractor shall be compensated using the unit rate for the actual number of test piles driven and tested.
16) Question: If the test piles determine that longer piles are needed than originally specified how will the Contractor be compensated?
RESPONSE: It is highly unlikely that the piles would need to be longer than those shown on the contract documents. If the piles are longer than specified, Contractor shall be compensated using unit rates for the actual extra lengths driven.
17) Question: What is the latest date the Contractor can receive Notice to Proceed to require a completion by March 1, 2017.
RSEPONSE: The government will provide the Notice to Proceed as soon as possible, after all required submissions from the Contractor.
18) Question: The amended borings and test pile requirement adds an obvious substantial additional duration to the project as it delays both procurement of materials and construction of the outfalls. Please add an additional 400 calendar days to the previous completion date of March 31, 2017 which was already insufficient for the work to be performed.
RSEPONSE: The previous extension of the outfall work to March 1, 2017 (in Amendment #5) takes into account the additional time required to perform the required borings and test piles.
USACE will not add an additional 400 calendar days to completion date of March 1, 2017.
19) Question: What is defined as landside vs. waterside?
RSEPONSE: The "landside" designation is used for bents where the cut-off elevations of the piles is above 0.0 Feet NAVD 88 - these would be the bents west of the shoreline at MSL.
Conversely, the "waterside" designation is used for bents where the cut-off elevations of the piles is below 0.0 Feet NAVD 88; these bents are east of the MSL line.
20) Question: We have a concern regarding the sand placement completion date in that the construction subcontractors will be coordinating their activities with the sand placement. In addition, the bid acceptance period for this project is 120 days, so award of the project could be as late as December 2015, leaving only 7 months to August 1, 2016 for completion when 12 to 18 months is actually needed to construct this project safely and efficiently. Please consider changing the completion date for the sand placement to within 480 days of Notice To Proceed.
Response: USACE expects a quick Award and Notice to Proceed for this contract. It is up to the contractor to expedite the submissions needed for the NTP and for the NTP acceptance to ensure this schedule is met. There will be 17 months between 1 October 2015 and 1 March 2017, which is over 480 days (16 Months) to construct the project.

WELDERS ‐ Receive rate prescribed for craft performing operation to which welding is incidental.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198‐005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non‐union rates. Example: SULA2012‐007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG‐OH‐0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis‐Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
