52.215-20 REQUIREMENTS FOR COST OR PRICING DATA OR INFORMATION OTHER THAN COST
OR PRICING DATA (OCT 2010)—ALTERNATE II (OCT 1997)
(a) Exceptions from cost or pricing data. (1) In lieu of submitting cost or pricing data, offerors may submit a written request for exception by submitting the information described in the following subparagraphs. The Contracting Officer may require additional supporting information, but only to the extent necessary to determine whether an exception should be granted, and whether the price is fair and reasonable.
(i) Identification of the law or regulation establishing the price offered. If the price is controlled under law by periodic rulings, reviews, or similar actions of a governmental body, attach a copy of the controlling document, unless it was previously submitted to the contracting office.
(ii) Commercial item exception. For a commercial item exception, the offeror shall submit, at a minimum, information on prices at which the same item or similar items have previously been sold in the commercial market that is adequate for evaluating the reasonableness of the price for this acquisition. Such information may include--
(A) For catalog items, a copy of or identification of the catalog and its date, or the appropriate pages for the offered items, or a statement that the catalog is on file in the buying office to which the proposal is being submitted. Provide a copy or describe current discount policies and price lists (published or unpublished), e.g., wholesale, original equipment manufacturer, or reseller. Also explain the basis of each offered price and its relationship to the established catalog price, including how the proposed price relates to the price of recent sales in quantities similar to the proposed quantities;
(B) For market-priced items, the source and date or period of the market quotation or other basis for market price, the base amount, and applicable discounts. In addition, describe the nature of the market;
(C) For items included on an active Federal Supply Service Multiple Award Schedule contract, proof that an exception has been granted for the schedule item.
(2) The offeror grants the Contracting Officer or an authorized representative the right to examine, at any time before award, books, records, documents, or other directly pertinent records to verify any request for an exception under this provision, and the reasonableness of price. For items priced using catalog or market prices, or law or regulation , access does not extend to cost or profit information or other data relevant solely to the offeror's determination of the prices to be offered in the catalog or marketplace.
(b) Requirements for cost or pricing data. If the offeror is not granted an exception from the requirement to submit cost or pricing data, the following applies:
(1) The offeror shall prepare and submit cost or pricing data and supporting attachments in accordance with Table 15-2 of FAR 15.408.
(2) As soon as practicable after agreement on price, but before contract award (except for unpriced actions such as letter contracts), the offeror shall submit a Certificate of Current Cost or Pricing Data, as prescribed by FAR 15.406- 2.
(c) When the proposal is submitted, also submit one copy each to: (1) the Administrative Contracting Officer, and
(2) the Contract Auditor.

(d) Alternate offers. (1) When an offer includes foreign construction material, other than designated country construction material, that is not listed by the Government in this solicitation in paragraph (b)(3) of FAR clause 52.225-11, the offeror also may submit an alternate offer based on use of equivalent domestic or designated country construction material.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of FAR clause 52.225-11 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic or designated country construction material, and the offeror shall be required to furnish such domestic or designated country construction material. Section 00 22 00 - Supplementary Instructions
INSTRUCTIONS AND EVALUATION CR
SECTION 00 22 00 - PROCEDURES FOR SUBMITTAL OF OFFERS AND PROPOSAL EVALUATION
CRITERIA
1. Overview.
1.1 The intent of this solicitation is to select one contractor for construction of an aviation fuel pump house and appurtenances at Hill Air Force Base, UT. The Government will evaluate the proposals in accordance with the criteria described herein, and award a firm fixed price contract to the responsible offeror, whose proposal conforms with all the terms and conditions of the solicitation and whose proposal is determined to represent the overall best value to the Government, all factors considered.
1.2 The basis of award is the Tradeoff Process. The Contracting Officer will award a firm fixed price contract to the responsible offeror whom the Source Selection Authority determines conforms to the solicitation, is fair and reasonable and offers the best overall value to the Government, all factors considered. The Government reserves the right to accept other than the lowest priced offer or to reject all offers.
2. Submittal of offers.
2.1 Offerors submitting proposals for this project should limit submissions to data essential for evaluation of proposals so that a minimum of time and monies will have been expended in preparing information required herein. However, in order to be effectively and equitably evaluated, the proposals must include information sufficiently detailed to clearly describe the offeror's past performance, technical approach and management capabilities necessary for successful completion of the project. Requirements stated in this RFP are minimums.
2.2 Offerors shall submit their proposals to the US Army Corps of Engineers, Sacramento, Contracting Division, 1325 J Street, Sacramento, CA 9 5 8 1 4 - no later than the time and date specified in Block 13 of Standard Form 1442.
2.3 Offerors are required to submit a proposal made up of Past Performance, Specialized Experience (Key Subcontractor Experience), Technical Approach (Management Plan and Schedule), and Price and Pro Forma. All proposal materials shall be submitted in binders with a table of contents and tabbed section dividers. The sections should parallel the submission requirements identified below. Volume 1 shall be submitted in original and six
(6) paper copies and one electronic copy via AMRDEC SAFE. Volume 2 shall be submitted in original only and one electronic copy via AMRDEC SAFE. The original Volume 2 shall be placed in a separate envelope from Volume 1. Failure to place the required submission information under the appropriate tab (factor or sub-factor) may result in a lower rating if the evaluators cannot readily find the appropriate information.
*NOTE: Provide the complete Volume 1 & Volume 2 proposal submittal including text, renderings, drawings, photographs, etc on one PDF file to be submitted via AMRDEC SAFE.
The paper copy of the proposal shall be used for evaluation and will control any conflicts or discrepancies between the two media. Offeror is responsible for ensuring the paper copy is consistent with the electronic copy of the proposal.
3. Proposal Evaluation Process.
3.1. A Source Selection Evaluation Board (SSEB) comprised of representatives of the Corps of Engineers, User/Customer, and other required personnel will evaluate the proposals. Offerors are advised that the technical evaluation and rating of proposals will be conducted in strict confidence. Technical/quality proposals will be reviewed and rated without knowledge of the price offered. The identities of offerors are not revealed to anyone who is not involved in the evaluation and award process or to other offerors. Proposals will be evaluated based on the factors described herein, and the basis of award is the Tradeoff Process.
3.2 The evaluation process essentially consists of four parts: proposal compliance review and responsibility determination, technical/quality evaluation, price evaluation, and cost/technical trade-off analysis.
3.2.1 Proposal Compliance Review: This is an initial review to ensure that all required forms and certifications are complete and that both a technical and price proposal were received.
3.2.2 Technical/Quality Evaluation: The SSEB will evaluate and rate the proposals against the RFP requirements. Technical factors will be rated using an adjectival-based system.
Past Performance will be rated based on relevancy and confidence.
3.2.3 Price Evaluation: The SSEB, using price advisors as necessary, will evaluate the price proposals received in response to the solicitation. Prices will be evaluated for unbalancing of line items, for determining fair and reasonableness and realism. Price will not be evaluated with a rating system, but will be evaluated through the use of cost/price analysis. To determine price reasonableness and affordability, the SSEB may use any of the price analysis techniques described at FAR 15.404-1(b)(2). Prices will not be revealed to any SSEB members until completion of the technical/quality evaluations, including consensus.
3.2.4 Price/Technical Trade-off Analysis: After all above evaluations are complete, the Contracting Officer/Source Selection Authority (SSA) will compare the relative advantages and disadvantages of technical proposals and compare prices. The SSA will then consider all factors to select the proposal offering the best value to the Government.
4. Proposal Information and Related Evaluation Factors.
4.1 Proposals will be evaluated in accordance with the factors and sub-factors below, listed in relative order of importance. Offerors are reminded to include their best technical and price terms in their initial offer and not to automatically assume that they will have an opportunity to participate in discussions or be asked to submit a revised offer. The Government may make award of a conforming proposal without discussions, if deemed to be within the best interest of the Government.
All evaluation factors, other than cost or price, when combined are approximately equal to cost or price.
4.2 The factors below are listed in order of importance; however, Subfactor 2 – Network Analysis Schedule under Factor 3 – Technical Approach is significantly more important than Subfactor 1 – Technical Approach Narrative.

5. Volume 1 – Factor 1 – Experience and Capability
5.1 Preface – Prime Contractor/Key Subcontractor Introduction
5.1.1 The Offeror is required to propose a specific project team including key subcontractors for evaluation in response to this Request for Proposals.
For purposes of this procurement, the terms “key subcontractors” are used to refer only to the prospective subcontractors whose qualifications, experience, and past performance will be evaluated by the Government as part of the source selection process. For reasons of efficiency, not all of the subcontractors critical to successful post-award contract performance have been included in this group. In order to streamline the proposal submission and evaluation process, please limit your submission to the information specifically requested. Information pertaining to other subcontractors not designated as “key” by the Government will be considered excess and may not be evaluated.
5.1.2 For the purposes of this procurement, a key subcontractor is defined as any subcontractor performing “key” major work elements for which capability information is required to be submitted for evaluation as part of the Offeror’s technical proposal. The Government has designated the following major work elements as “key”:
• Mechanical
• System Supplier/Installer
5.1.3 The Offeror’s attention is directed to Paragraph 3, “Subcontractors and Outside

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT
YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE
RATING DEFINITION NOTE
(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
