SECTION 01 11 00
SUMMARY OF WORK
PART I DESCRIPTION OF WORK:
Provide all plant, labor, tools, equipment, and materials (except as indicated otherwise in the specifications) and perform all work in strict accordance with the specifications and plans required for the Job Order Contract (JOC) to include Joint Base Lewis-McChord (JBLM) technical specifications. The JOC is for a broad range of maintenance, repair and minor construction work on real property at JBLM and other supported organizations as listed below. The work is required in support of Public Works (PW) activities headquartered at Joint Base Lewis-McChord (JBLM). The contract will be an Indefinite Delivery Indefinite Quantity (IDIQ) type contract and will include a wide variety of individual construction tasks. During the contract period, the Government will identify construction tasks required to complete each specific job and will issue individual Task Orders (TOs) to the contractor to complete those jobs. The contractor shall be required to furnish all materials, equipment, and personnel necessary to manage and accomplish the TOs. The contractor shall be required to maintain a management office on JBLM in order to receive Requests for Proposal (RFPs), prepare and negotiate proposals, receive signed TOs and Notices-To- Proceed (NTPs), receive and initiate contract correspondence and provide other construction services to accomplish individual TOs. TOs will vary in size, with the majority expected to be of a small to medium size, and may include single or multiple disciplines. The TOs will include tasks in a variety of trades, such as civil work, road repair, carpentry, roofing, excavation, interior/exterior electrical, steam fitting, HVAC, plumbing, sheet metal, painting, fencing, asbestos and lead abatement (incidental to the work), demolition, environmental clean-up (incidental to the work), concrete, masonry, and welding.
1.1 AREA DESCRIPTION
The work will be performed on facilities at Joint Base Lewis-McChord (JLBM), Washington and Sub-Installations. The listing below is intended to be a comprehensive list, but the Government reserves the right to order work at other locations in WA if required. This contract does not involve work at Madigan Army Medical Clinic locations.
1.1.1 JBLM Sub-Installations:
1.1.1.1 Yakima Training Center, Yakima, WA
1.1.1.2 Fort Worden Cemetery, Port Townsend, WA
1.1.1.3 Fort Lawton Cemetery, Seattle, WA
1.2 PRINCIPAL ITEMS TO BE ACCOMPLISHED
1.2.1 Provide, remove and dispose of, replace, repair or modify architectural, structural, civil, mechanical or electrical features or system of a facility, range, landscaping or road work.
1.2.2 Provide exterior service systems for civil, mechanical or electrical systems of a building.

1.2.3 Provide all necessary requirements for the proposal support documents as specified in the TO.
1.2.4 Provide "as-built" drawings.
1.2.5 Provide operation and maintenance manuals for any installed equipment and supply at least 4 hours of training on any installed equipment as required.
1.2.6 Perform other work necessary as described in the TO.
1.2.7 The contractor shall be responsible for providing a complete and useable system and shall be responsible for accomplishing all tasks incidental to the completion of the task order requirements. Requirements for a complete and useable product which are not explicitly called out in the SOW but reasonably discernible via any method other than destructive testing shall be considered a requirement of the Task Order.
1.3 PERIOD OF PERFORMANCE
1.3.1 The period of performance is the period between TO NTP and the time all work under the TO is complete. The period of performance will be negotiated for each TO.
1.3.2 In the event the Government and contractor cannot agree upon a Period of Performance, the following formula shall be used to calculate the period of performance.
Period of Performance (Calendar Days) = 5 + 0.00028A + B + C + D + E + F + G
A = The TO price in dollars.
B = The number of Master Format Divisions from which the contractor has drawn line items in pricing the project. Divisions 2 through 44 (This variable would have maximum quantity of 26 if all divisions were utilized).
C = 14 days if the project requires new concrete or masonry construction or new plaster or drywall installation. If no such work is required then C = 0.
D = 10 days if an advance construction notice for family housing or an occupied facility is required. If no such advance notice is required then D = 0.
E = any number of extra days so determined by the Government to be necessary for the proper execution of the work when extraordinary circumstances are present. For example, extensive laboratory testing of materials, unavailability of materials, extensive utilities coordination, or the Contracting Officer (KO) has determined that allowing extra days will be in the best interest of the Government.
F = 10 days if Environmental Permits are required.
G = 15 days if the TO requires Government Approved Material Submittals.
1.4 DRAWINGS
01 11 00 - 3
Drawings applicable to all work performed under this contract will be provided with individual TOs. The Government does not guarantee the complete accuracy of these drawings.
1.4.1 Plans and Specifications: The contractor shall be provided one copy of the Statement of Work, specifications, drawings, and maps as applicable upon issuance of each TO. All further reproduction shall be at the contractor's expense.
1.5 CONSTRUCTION PHASING
The following construction phasing related issues shall affect the work:
1.5.1 Interface with Others: Government use of the facilities is anticipated while the work under this contract is being performed. The work shall be planned and accomplished so that there will be a minimum of interference and inconvenience to occupants in the building and agencies in the vicinity and to other craftsmen who may have to do work in the affected facilities. Any blockage of building exits or driveways must be coordinated in advance.
1.5.1.1 Furniture, portable office equipment and wall appurtenances not rigidly fastened to the walls shall be moved by the contractor, protected from damage and replaced to original position upon completion of the work. If the work required by the TO will not allow furniture and portable office equipment to be replaced to its original position, new locations will be designated by the KO or Contracting Officer’s Representative (COR). Incidental costs associated with moving one-piece furnishings up to approximately 150 pounds to perform such tasks as painting, carpet or tile replacement, etc., are considered a general cost of building renovation and shall be included in the contractor’s coefficient. Costs for large scale or wholesale removal and replacement of large quantities of desks or modular workstations, copiers, multiple full file cabinets, etc. to another location or storage outside the work space, or disassembly and reassembly of modular furniture is not considered part of the contractor’s coefficient and will be priced separately.
1.5.1.2 The work shall, so far as practicable, be done in definite sections or divisions and confined to limited areas which shall be completed before work in other sections or divisions begins.
1.5.2 Work Site Conflicts: In the event of a conflict between the contractor and others in an occupied facility or where other contractors are performing work on the same facility under other contracts, the KO shall attempt to resolve the conflict and the KO's decision shall be final.
1.5.3 Construction Restrictions: Construction restrictions shall be identified as required and indicated on individual TOs. Utility outages require 14 calendar day advanced notice.
1.6 CONTRACT COST BASIS FOR PRICING INDIVIDUAL TASK ORDERS
RSMeans construction cost data has been selected for use as the cost basis for all work under this contract. WinEst Pro Plus estimating software shall be the designated Computerized Pricing Guide (CPG). The CPG and the RSMeans hard copy books shall be used as the Total Cost Data for this contract.
1.6.1 Computerized Pricing Guide: The CPG contains unit price construction line items for the description of work to be accomplished and for the unit of
01 11 00 - 4 measure specified. Line items shall be selected that most accurately and completely represent the work being accomplished in a TO scope. Due to the vast variety of construction items and actions, it shall be understood that line items are considered representative of the work when the line item description meets the majority of the requirements and specifications;
pricing is not a factor when determining most accurate and complete line items. When an agreement cannot be made regarding the applicability of a line item, the contractor shall get a written determination from RS Means, routed through the Government Project Manager to ensure an accurate portrayal of the circumstances, stating the definition, correct use of, and/or any other direction necessary to establish the most accurate and applicable line item.
Line item costs shall be determined by multiplying the RSMeans “20XX Total Bare Costs” by the nearest available City Cost Index (CCI) to localize the costs. The localized costs are then multiplied by the appropriate contractor’s coefficient. Supplemental items priced by the contractor in the bid schedule, if accepted, shall be treated as pre-priced line items, added to the CPG, and shall receive the same CCI markup and then be multiplied by the appropriate contractor’s coefficient.
1.6.1.1 City Cost Index determination: This contract shall utilize the CCI corresponding to the quarter in which the contract is awarded and shall be applied to all TOs issued during the entire first year of the ordering period. The applicable RS Means City Cost Index in effect at the time will be incorporated annually on the contract award anniversary date and shall be applied to all TOs for the entire year.
1.6.2 The contractor shall obtain at its own expense the most recent version (at time of award) of “WinEst Pro Plus” estimating software with the following 2015 (or the latest version published at the time of award) RSMeans databases for its use during the initial year of the IDIQ ordering period of this contract and as many licensed copies as the contractor requires for performance of this contract: RS Means Facilities Construction Cost Data database, RS Means Electrical with Assemblies Cost Data database; RS Means Mechanical with Assemblies Cost Data database; Plumbing with Assemblies Cost Data database; Concrete with Assemblies Cost Data database; RS Means Site & Landscape with Assemblies Cost Data database; and RS Means Commercial Renovation Cost Data database. No later than 30 days after the start of the contract period of performance, the contractor shall also obtain and provide to the Government five (5) annually licensed concurrent user licenses of the same WinEst estimating software and RS Means Facilities Construction Cost Data database to run on Government computer networks and five database licenses for the other databases listed above. The contractor shall also obtain two sets of the following 2015 (or the latest version published at the time of award) RSMeans database books in hard copy form: Facilities Construction Cost Data, Building Construction Cost Data, Heavy Construction Cost Data, Mechanical Cost Data, Electrical Cost Data, Plumbing Cost Data, Site Work and Landscape Cost Data, Concrete and Masonry Cost Data, Interior Cost Data, and RS Means Commercial Renovation Cost Data. Three sets of the hard copy books shall be provided to DPW. The 2015 (or the latest version published at the time of award) Cost Data databases and RSMeans hard copy books shall be used for the initial annual ordering period of the contract.
In addition to the sets of RSMeans books, the contractor shall provide three
(3) additional copies of the Facilities Construction Cost Data database book.
No later than 30 days after the start of the contract period of performance, the contractor shall provide an RSMeans certified training/partnering class for its own personnel, if required. All software and book support requirements shall be provided before TOs will be written.
01 11 00 - 5
1.6.3 Annually on the contract award anniversary date, the contractor shall update, at its own expense, the versions of the WinEst Pro Plus databases in effect at the time for both its use and the Government’s use throughout the year, for the same number of licenses and copies as listed in paragraph
1.6.2. This requirement applies to all software and books listed above.
1.7 CONTRACTOR’S PRICING
Contractor’s pricing shall consist of the contractor’s coefficient as listed in the Bid Schedule as described below.
1.7.1 Contractor’s Coefficient: The contractor’s coefficient is a numerical factor that represents contractor costs (indirect and direct costs, sales tax, profit, etc.) not considered to be included in the Total Cost Data. The contractor’s coefficient shall encompass all allowable contractor costs not included in the pre-priced line item cost. Examples of such costs include:
state taxes and payroll taxes, such as FICA, workmen’s compensation, state and federal unemployment taxes for direct payroll employees, superintendent salaries, builders risk insurance, contract mobilization and demobilization expenses and bond premiums; and various overhead expenses such as project estimating, site office overhead, field office buildings, furniture and equipment, on-site office staff salaries, vehicle and construction equipment maintenance, office administrative expenses and a proportional share of home office overhead. The contractor’s coefficient shall also include all insurance, additional supervision, paperwork fees associated with a particular TO (i.e. digging, environmental or PSCAA permits, estimates, reports, etc.), consultant fees, on- and off-site storage (except storage containers where required for property security by the TO), etc. The contractor’s coefficient shall encompass all costs other than the pre-priced unit prices and shall include all adjustments to the Total Cost Data to compensate for any difference between these costs and actual market conditions in the applicable locality. The contractor’s coefficient shall also include costs described as costs to provide submittals, interface with Government representatives, coordination with occupants and other contractors.
1.7.1.1 The contractor’s coefficient shall also include costs for, but not limited to:
1.7.1.1.1 All Waste and excess material
1.7.1.1.2 Mobilization and close out for the basic contract and each task order
1.7.1.1.3 Lean up on each TO
1.7.1.1.4 Safety (i.e.; Safety Rails, Safety Nets, tethers, hardhats and safety glasses, personal protective equipment, etc.)
1.7.1.1.5 Project management and supervision
1.7.1.1.6 Quality Control
1.7.1.1.7 Office management and supervision
1.7.1.1.8 Depreciation of mobile office(s)
01 11 00 - 6
1.7.1.1.9 Subcontractor overhead and profit
1.7.1.1.10 As-built drawings, submittals, permits, and licenses
1.7.1.1.11 Risks of doing business (i.e., risk of lower than expected contract dollar value; risk of a high inflation cost; risk of poor subcontractor performance and re-performance.
1.7.1.1.12 Site Security
1.7.1.1.13 Acceptance Testing
1.7.1.1.14 Costs associated with complying with Environmental and Safety Laws
1.7.1.1.15 Any and all costs incurred and associated with preparing a proposal and the corresponding proposal support documents as described in the individual TOs.
1.7.1.1.16 Pre-Scoping Meeting
1.7.1.2 The contractor’s coefficient shall not include costs for work performed per specification 23 05 93 Testing, Adjusting and Balancing of HVAC systems or 23 08 00.00 10 Commissioning of HVAC Systems.
1.7.1.3 The following Subdivisions, as contained in the Total Cost data, shall not be used as line items when pricing TOs issued under this contract.
These costs shall be included in the contractor’s coefficient:
01 11 31 – Professional Consultants 01 21 – Allowances 01 31 – Project Management and Coordination 01 32 – Construction Progress Documentation 01 41 26 – Permits 01 45 – Quality Control 01 52 – Construction Facilities 01 54 39.70 – Small Tools 01 55 – Vehicular Access & Parking 01 71 – Examination and Preparation 01 74 – Cleaning and Waste Management (Rubbish removal shall be covered in Div. 02 41 19).
1.7.1.4 Provisions have been made in Bid Schedule A for allowing different contractor’s coefficients for differing geographical locations. It also provides for separate contractor’s coefficients for work during normal working hours and work during other than normal working hours as well as escort and non-escort required work.
1.7.2 Annual Adjustments
1.7.2.1 The Bid Schedule, Part A. Contractor’s coefficients are proposed as a percentage increase, (e.g. 1.10) or decrease (e.g. 0.95) to the Total Cost Data. The coefficients, as proposed, are accepted and incorporated into the contract and are used in establishing the price for TOs. Coefficients shall remain the same for the entire ordering period. Annual increases or decreases in line item unit prices will be made by the incorporation of the current
01 11 00 - 7
RSMeans Bare Cost databases on the annual anniversary date of award.
Coefficients will not be adjusted for any other changes or circumstances encountered during the life of the contract. When it is determined that a TO requires modification, the contractor shall calculate his proposal using the same Total Cost Data that was used in calculating the basic TO, regardless of the date of the modification.
1.7.2.2 The Bid Schedule, Part B: Supplemental Items. These shall be adjusted annually on the contract award anniversary date. The contractor’s prices for the Supplemental Items are proposed as total base costs. The rates that are accepted and incorporated into the contract are used solely in establishing the price for the items as listed. The coefficients in paragraph
1.7.1 above will be applied to the prices accepted in Part B of the Bid Schedule. These rates as accepted into the contract will be in effect for all TOs and all modifications thereto.
1.7.2.2.1 Adjustments to the base Supplemental Item rates shall be in accordance with the following formula:
pl = p x f where:
pl = New rate p = Price Initial Period of Contract f = Index Factor
1.7.2.2.2 The Index Factor f, shall be computed according to the following equation:
CCI-C
f =CCI-B
Where: CCI-C is the Construction Cost Index for the month in which the annual adjustment takes place for which f is computed, as published by the ENR (formerly called the Engineering News Record), and CCI-B is the base reference and is the CCI for the month in which the IDIQ contract is awarded.
If the CCI-C ceases to be published the parties will agree on substitute indices to be used and the contract modified accordingly.
1.7.2.3 New Davis-Bacon wage rates will be incorporated annually on the contract award anniversary date.
1.7.3 Non-Pre-priced Work. Non-pre-priced work (i.e. Work not priced by the Total Cost Data including the Supplemental Items) shall not exceed 25% of the total TO pre-priced amount. Items of work not covered by Total Cost Data, including the Supplemental Items, but within the scope and general intent of this contract may be negotiated at any time during the contract term and added to the list of Supplemental Items by modification. Non-pre-priced work shall be noted on the contractor's TO proposal and shall include all direct and indirect costs and shall be accompanied by three independent quotes for the non-pre-priced items deemed necessary for the completion of the work under the TO. The contractor’s coefficient shall not be applied to non-pre-priced items.
1.8 ORDERING AND PROCESSING PROCEDURES FOR TOs:
01 11 00 - 8
When the Government requires work under this contract the Government will request a price from the contractor for “one job, lump sum” TO.
1.8.1 The Government will provide the contractor a Request for Proposal (RFP) containing a statement of work, drawings, sketches, a material submittal register, and/or other documents as deemed necessary to provide sufficient detail for the JOC contractor to discern the project requirements for the TO after attending a pre-proposal site visit. The contractor shall also research existing record drawings and independently conduct as many site visits as necessary to have a satisfactory knowledge of the site conditions that can affect the work or its cost. The contractor will not be reimbursed separately for any pre-TO award costs, including proposal preparation, attendance during pre-RFP visits, negotiations, or site visits as these costs are included in the coefficient.
1.8.2 The contractor shall respond within fourteen (14) calendar days of the RFP date or site visit, whichever is later, or as otherwise indicated on a case-by-case basis as determined by the KO, by submitting a proposal containing the following to the KO:
1.8.2.1 Contractor Line Item Proposal. A standard CPG printout, listing the contractor’s proposal by specific items and quantities multiplied by CPG price and then the appropriate CCI and appropriate contractor’s coefficient.
The contractor shall first attempt to price all work using the CPG system.
The CPG system shall include the items accepted in the Bid Schedule - Part B Supplemental Items. Items not contained in the CPG system Facilities Construction with Assemblies Cost Data database will first be searched for in the other databases, then in the hardcopy books and then, if not found, will be priced separately as non-pre-priced (NPP) items. Any items omitted from the Contractor’s proposal but ultimately required for completion of the TO are still requirements of the TO. It is the Contractor’s responsibility to ensure all required elements of work are captured in the proposal. This line item proposal shall be supplied in PDF and WinEst form.
1.8.2.1.1 Line Item Cost Adjustments: The only adjustment of price for the construction line items is the contractor’s coefficient. All prices in the CPG are for complete and in-place construction unless explicitly described otherwise. Incidental fasteners (nails, screws, weldments, adhesives or other connectors) and small tools required for a normal installation are included in the line item cost unless the line item description specifically states otherwise. Line item prices include all work required to provide a finished product specified in the line item unless the line item description specifically states otherwise. Installed line items shall include the testing, adjusting and initial start up of the specific line item, except for specifications 23 05 93 Testing, Adjusting and Balancing of HVAC systems and 23 08 00.00 10 Commissioning of HVAC Systems. Up to four hours of familiarization training for operation and maintenance of installed equipment, if required, is included unless the line item description specifically states otherwise.
1.8.2.1.2 Linear interpolation between line items shall be used when an item size is between two existing CPG line items, and the resulting item is a manufacturer's standard size. The price of the interpolated item shall be based on linear interpolation based on the prices and sizes of the two closest CPG line items (in size) above and below the interpolated item.
01 11 00 - 9
1.8.2.1.3 Linear extrapolation beyond line items shall be used when an item size is within 50 percent of existing CPG line items, and the resulting item is a manufacturer's standard size. The price of the extrapolated item shall be determined using linear extrapolation based on the bare costs and sizes of the two closest CPG line items (in size) either above or below the extrapolated item and then added to or subtracted from the closest CPG Line Item, depending upon whether the manufacturer's standard size is larger or smaller than the size in the CPG.
1.8.2.1.4 Non-Pre-priced Items. The value of NPP work under a TO shall not exceed 25 percent of the value of the pre-priced work unless otherwise authorized by the KO. Non-pre-priced work shall be noted on the contractor’s proposal as such and shall include all direct and indirect costs and shall be accompanied by three independent quotes for the non-pre-priced items deemed necessary for the completion of the work under the TO. The contractor’s coefficient shall not be applied to non-pre-priced items and shall be negotiated at full cost prices. Items of work not covered in the CPG or RSMeans pricing guides but within the scope and general intent of the contract may be negotiated and added to the list of Supplemental Items by modification at any time during the contract term.
1.8.2.1.5 Removal and Reinstallation Items. If an item is to be removed and reinstalled and a line item can be found in the Unit Price Book (UPB) for removal and reinstallation, that line item will be used. If there is no line item for removal and reinstallation, the contractor shall represent this work with two (2) line items; the demolition line item shall be used to represent the removal, and the installation line item with no material cost shall be used to represent the reinstallation. If this approach is not possible, the contractor shall locate the material line item in the UPB. Then the contractor will create an alternate pre-priced line item removing the cost for the material, and leaving the remaining amount in labor and equipment with a factor of 2; one for the removal and one for the reinstallation.
1.8.2.1.6 Equipment Items. Equipment costs include normal operating expendables and servicing including routine parts. Equipment operating expendables with highly variable wear patterns such as diamond bits and blades are not included. Mobilization and demobilization line items may be used, except where a CPG line item has a value stated for equipment cost as part of the unit price, when the only means of moving the equipment to and from a job site is by way of towing behind another piece of equipment.
Mobilization and demobilization costs will not be permitted for materials or pieces of equipment capable of being moved in the back of a standard pick-up truck. Operator costs shall not be added to equipment line items when a daily crew cost can be found in the UPB. Scaffolding and staging will be allowed only on a TO basis (per job), not per subcontractor or discipline.
1.8.2.2 Project Narrative. The contractor shall submit a project narrative speaking to the elements of work contained within the Government-provided SOW. This narrative shall be in sufficient detail to permit validation of the proposed pricing and demonstrate that the contractor understands of the Government’s requirement and intent. This project narrative shall support, clarify, or otherwise substantiate the contractor’s proposal.
1.8.2.3 Project Schedule. A project completion schedule showing all milestones, e.g., ordering materials, demolition, work phasing, and completion date. Contractor shall provide a project schedule which complies with the SOW-dictated period of performance. If the contractor believes the
01 11 00 - 10 period of performance dictated in the SOW is not feasible, supporting documentation (i.e. product lead times, WinEst Labor hours, extenuating circumstances, etc) shall be provided by the contractor to substantiate the newly proposed period of performance. The KO shall be the determining authority as to the final period of performance.
1.8.2.4 Proposal Support Documents. The contractor should expect to produce any supporting technical calculations or any other data required by the KO in order to allow the Government to verify the accuracy and validity of the contractor proposal. Examples of documentation that might reasonably be expected include but are not limited to sketches, drawings, calculations, specifications, and catalog cuts. The extent of these support documents will depend on the complexity of each TO. The KO shall be the determining authority as to what data is needed from the contractor on individual TOs.
The data required may vary with each TO.
1.8.2.4.1 Submittals at time of Proposal: At the KO’s discretion, the RFP may require specific submittals to be included in the contractor’s proposal that will then become part of the contract documents. These submittals may include material/product submittals, work plans, or any other submittal deemed necessary for validating the contractor’s proposal or expediting the submittal process of the Task Order
1.8.2.4.2 Technical Advisors for use with Proposal Support Documents.
Contractor shall have access to technical advisors for each discipline capable of physically visiting the job site within a reasonable amount of time as determined by the KO. These technical advisors are for use to assist in the creation of the proposal support documents. These advisors shall have a minimum education and/or experience in accordance with the experience matrix below:
Experience Matrix Area Qualifications Civil Graduate Civil Engineer with 3 years experience in the type of work being performed or person with 6 years experience with this type of work in the field with a construction company.
Mechanical Graduate Mechanical Engineer with 3 years experience in the type of work being performed or person with 6 years experience with this type of work in the field with a construction company.
Electrical Graduate Electrical Engineer with 3 years experience in the type of work being performed or person with 6 years experience with this type of work in the field with a construction company.
Structural Graduate Structural Engineer with 3 years experience in the type of work being performed or person with 6 years experience with this type of work in the field with a construction company.
Architectural Graduate Architect with 3 years experience in the type of work being performed or person with 6 years experience with this type of work in the field with a construction company.
Environmental Graduate Environmental Engineer with 3 years experience in the type of work being performed or person with 6 years experience with this type of work in the field with a construction company.
01 11 00 - 11
Contractor shall supply all documentation to validate the experience requirements above when required by the KO.
1.8.3 The KO (or authorized representative) will review the contractor’s proposal documents and proposed line items. The KO and/or the authorized representative shall accomplish a technical evaluation of the contractor’s proposal documents and provide comments for the contractor’s response. Upon receipt of the contractor’s rebuttal to comments and/or revised proposal, the KO and/or authorized representative shall arrange a meeting with the contractor, at which time contractor’s proposal will be discussed and negotiated. The Government reserves the right to proceed directly to discussions and negotiations without utilizing the review and comments stage.
1.8.3.1 In the event the contractor’s proposal does contain all the requirements or is submitted to an unsatisfactory level, as determined by the TO SOW and the KO, the contractor will be required to revise and resubmit the proposal. The contractor shall typically have 3 business days to resubmit an acceptable proposal or a timeframe as specified by the KO.
1.8.3.2 The Government reserves the right to adjust, amend, or otherwise alter the original SOW due to information acquired via the project site visit, contractor’s proposal, and/or TO negotiations. The contractor will have a chance to concur with these changes before acceptance of the SOW and therefore acceptance of contractor’s proposal by the Government.
1.8.4 The contractor will be responsible for accomplishing all items of work in accordance with the JOC specifications and contract requirements as outlined by the SOW, contractor’s proposal, and supplemental specifications and sketches/construction drawings that were issued with the TO. Line items agreed upon during negotiations of a TO or items essentially equal in function and quality shall be considered to be included in the scope of work for that TO, but the quantities agreed upon will be used only for pricing of the TO and will not be binding on either party unless otherwise specified in the TO SOW.
1.8.5 The price established for the TO as a result of the negotiation will be the actual price for the order and contractor shall receive payment on a one job, lump sum basis for that order in accordance with the terms and conditions of the contract. The contractor shall invoice only for the completed percentage of the lump sum price of the TO, not on the basis of quantities of items. Each TO will authorize and identify the location and description of the required work. Only the work designated in the TO is authorized to be performed.
1.8.6 Issuance of Orders. Upon award of a TO (DD Form 1155), the signed copy will be mailed or electronically forwarded to contractor. Failure to pick up or receive mailed or electronic orders shall not relieve contractor of completion in accordance with the TO. The KO may provide verbal NTP for the work in advance of issuing the TO, the NTP may be the date the TO was issued, or the NTP may be delayed and issued under separate cover. Each TO will identify the appropriate NTP date. The TO completion schedule shall be based on the issuance of NTP, verbal or written.
1.8.7 Priorities and Completion. Work shall be completed by the date indicated in the SOW. The KO may revise the completion dates of ongoing work or revise a sequence of priorities for completion of a series of TOs.
01 11 00 - 12
1.8.7.1 Contractor Inspection. Near the completion of all work or stated elsewhere in the specifications, the QC Manager shall conduct an internal inspection of all the work performed to ensure it meets all the requirements of the base contract as well as the specific requirements within each TO.
Once this is accomplished, contractor shall notify the Government that the facility is ready for the Government pre-final inspection. The contractor shall give 5 working days notice to the Government Quality Assurance Representative when requesting a pre-final inspection.
1.8.7.2 Pre-Final Inspection and Punch List Items. Upon request for a pre-final inspection, the Government will schedule a pre-final inspection to verify that the facility is complete and ready to be occupied. For this inspection to commence a representative from the contractor, DPW, and Contracting shall be present. A Government pre-final punch list may be developed as a result of this inspection which shall detail the items needing correction. The contractor’s QC Manager shall ensure that all any items noted on the pre-final inspection have been corrected within 7 calendar days. Once these items have been addressed, contractor shall notify the Government to request a final inspection, giving 5 working days notice.
1.8.7.3 Final Inspection and Acceptance. Upon request for a final inspection by the contractor, the Government will schedule a final inspection to verify that the facility is complete and ready to be occupied. For this inspection to commence a representative from contractor, DPW, and Contracting shall be present. If all items listed in the pre-final punch list have been corrected, and all work meets the requirements of the umbrella contract and TO specifications, the Government shall accept the work and take ownership of the site.
