SUMMARY OF CHANGES
SECTION A - SOLICITATION/CONTRACT FORM
The required response date/time has changed from 14-May-2020 03:00 PM to 12-Jun-2020 12:00 PM.
The following have been modified:
SECTION A
A1. This solicitation will result in an award of a non-commercial indefinite-delivery indefinite-quantity (IDIQ) contract. The contract ceiling for this requirement is $375,000,000.00. During the performance of the contract, the Government will use the dollar obligation value reported in the Federal Procurement Data System (FPDS) to calculate the contract’s movement towards the ceiling value.
A2. The “minimum” order quantity for this contract, as referenced in FAR 52.216-22, is €400,000.00. This minimum amount is the only guaranteed quantity to be awarded under the contract. The “maximum” ceiling order quantity for this contract, as referenced in FAR 52.216-22, is $375,000,000.00. “MAX” labels found in Section B (“the Schedule”) of this solicitation and the ensuing contract should read “ESTIMATED.” The incorrect “MAX” labels in the Schedule result from a limitation in the Government’s contract writing system and shall not constrain the Government’s ordering ability. There is no quantity or number limitation on the Government’s ordering ability, except the $375,000,000.00 contract ceiling and the applicable limitations found in FAR 52.216-19. The estimated quantities found in this solicitation and the ensuing contract, to include the Price Book, are estimates only and do not bind the Government in any way. These estimates are not intended as actual amounts, nor are they intended to be not-to-exceed amounts or to limit the scope. As a result, the Government will not grant an REA and/or a claim asserting entitlement from the Government ordering less or more than an estimated quantity identified in the contract.
A3. The U.S. Government takes no position with regards to the applicability of BGB 613a (German Civil Code) to this requirement or any part thereof. It is the sole responsibility of each offeror to determine the applicability of the BGB 613a as it relates to this requirement or any part thereof. The Government is not responsible for the validity of any information or data provided in the solicitation in regards to BGB 613a.
Offerors’ attention is directed to the terms of clause 252.222-7002 (Compliance with Local Laws (Overseas)), which is incorporated in Section I.
A4. Offerors shall place prices in the Price Book (Solicitation Attachment 04), NOT in Section B of the Solicitation document. The Total Evaluation Price (TEP) will be calculated as the sum of the offeror’s proposed prices for CLINS 0001-0023 and 1002-1022 of the base ordering period and the optional option period. All unit prices and rates that comprise the TEP are contractually binding except Material in CLINs 0003 and 1003, and thus prices must be populated in its respective field of the Price Book.
Offerors shall use their best business judgment in proposing staffing solutions for all contract services. Offerors are on notice that the awardee shall maintain a workforce at all times that is consistent with the contractual requirements and sufficient to perform the work in accordance with the contract’s standards.
A5. The unit prices and rates in the Price Book must be used in determining the pricing for DMOs, PWOs, and
PPWOs. The quantities stated in the Price Book are estimates only and are not guaranteed or purchased by the contract. Further, the Government may exceed these quantities during the contract. In light of those facts, the Contractor shall not be entitled to, and the Government will not grant an REA and/or a claim if the Government’s orders under the contract deviate from the estimated quantities in the Price Book.
A6. Prices in the contract are in Euro only. The Government will not consider any Request for Equitable Adjustment (REA) as result of exchange rate fluctuations.
