About this file

This document contains questions and answers pertaining to a draft request for proposal (RFP) for the Lake City Army Ammunition Plant (LCAAP) acquisition. The RFP will require the production and delivery of various small caliber ammunition products for the Department of the Army Materiel Command Joint Munitions Command. Key details include that the small business subcontracting goal has been revised from 42% to 32% of total contract value. The cybersecurity requirements have been updated to include DFARS clause 252.204-7012 in place of the draft cybersecurity plan. Inspection methods are compliant with MSE requirements and critical characteristics are defined in the specifications rather than sharing historical noncompliance rates. Measurement systems will not require gauge R&R on individual components unless systems change.

LCAAP Draft RFP Questions & Answers

24 August 2018

No. DRFP Section Question Answer

Section A, page 3-4, Narrative A0001, para 3(c) – (f) thru (f)

Please confirm DFARS clause 252.204-7012 Safeguarding Covered Defense Information and Cyber Incident Reporting replaces the draft PWS Cybersecurity dated 29 March 2018.

Clause 252.204-7012 will be included in the solicitation. The requirements of the DRAFT Cybersecurity PWS will not be included with the solicitation.

Section A, page 4, Narrative A0001

In the Draft RFP, the Small Business Goal of 42% is a significant increase in Small Business Goal of 21% vs.

prior competition. Please confirm that the increased Small Business Goal of 42% is correct.

The Small Business goal will be revised to 32%.

Section A, Narrative A0001, paragraph (p), Section M, subsection F, paragraph 1, page 215

The last LCAAP acquisition had small business subcontracting goals of 21% of total contract value. DoD small business subcontracting goals are set to 33% of total subcontracted dollars for 2018. The current DRFP lists a small business subcontracting goal of 42% of total contract value. Did the Government intend this to be 42% of total subcontracted dollars? If not, will the government provide it’s rational for a 100% increase in the small business subcontracting goal?

The Small Business goal will be revised to 32% of the total contract value.

Section A, Narrative A0000, page 2 and Narrative A0001, subsection 2, item (g) Page 2;

Section L, Provision L-8, 52.215-22 – Limitation on Pass-Through Charges – Identification of Subcontract Effort, page

FAR 15.408(n)(2)(i)(B)(2)(ii) states that this clause is not applicable to a fixed-price contract with economic price adjustment awarded on the basis of adequate price competition. We recommend removal of this clause in accordance with this FAR provision.

FAR 52.215-22, Limitations on Pass-Through Charges – Identification of Subcontract Effort will remain in the solicitation as it will be applicable to project work awarded on a sole source basis.

5 Section E, page 108

DODIC AB76 indicates “Cartridges, Linked Magazine Pack – 5.56mm, M855 Ball, M856 Tracer” but the Drawings show the M856A1 tracer drawing. Is this correct?

M856 will be revised to reflect M856A1

6 Section E, page 91 Will the Government provide a listing of Inspection Method by applicable characteristic and if the current

Inspection methods are called out in the specifications listed on the TDPL. Inspection methods are MSE compliant.

submissions for that Inspection Method are MSE Compliant?

7 Section E, page 91

To properly understand the risks and or opportunities associated with a process generating a critical characteristic, would the Government share the characteristics covered under the existing CPOAs and the history on the creation rate?

Critical characteristics are called out in the specifications. The Government will not provide the characteristics covered under the existing CPOAs.

8 Section E, page 91 Will the Government share approved CCCP’s and CPOA’s with offerors?

The Government will not provide the CCCPs or CPOAs.

9 Section E, page 91 As applicable, will the Government allow the continuation (roll-over) of CCCPs and CPOAs?

No. New CCCPs and CPOAs must be submitted.

10 Section E, page 91

Will the Government share how many times an operation was shut down due to critical characteristic being found in the production process either without a CPOA or exceeding a CPOA allowable rate?

No.

Section E, Narrative

E0002, MIL-STD-1916,

Does the Government intend for the Contractor to flow down MIL-STD-1916 to all suppliers to include cardboard and other packing filler materials?

MIL-STD-1916 shall be flowed down to all suppliers unless an alternate inspection method is approved by the Government on a case by case basis. For informational purposes, the list of current exceptions will be posted to the VTL, however, there is no guarantee these exceptions will be approved under the new contract.

12 Section E, page 93 Have all Acceptance Plans in LCAAP been converted to the MIL-STD-1916 requirements, as applicable?

Yes, with the exception of the items referenced in question 11, all other acceptance plans have been converted to MIL-STD-1916.

13 Section E, page 93

Within this section the Government states, “Verification Levels (VL) shall replace AQLs and shall be VL IV for major characteristics and VL II for minor Characteristics.” However, we noticed some existing quality documents indicate AQL’s are still being used.

Will AQL’s no longer be an option for the successful bidder?

Verification Levels shall replace all AQL references for MIL-STD-1916 requirements.

14 Section E, page 93

Within the Statistical Process Control (SPC) requirements, will the incumbent be allowed to transfer SPC plans from the old contract to the new contract? If so, will other offerors have the same option?

SPC requirement will be removed from the solicitation.

15 Section E, page 97

Will the Government participate with a potential bidder in a conference with major suppliers to detail the requirements of the MSE Clause and to ensure a consistent application of the MIL-STD-1916 and Critical Characteristic Clause?

No.

16 Section E, page 98 Will the Government provide AAIE reliability and confidence levels for each AAIE?

No.

17 Section E, page 98

If AAIE reliability and Confidence Levels are below the 99.8% and 90% respectively; can it be assumed they will be at that required level for Measurement System Evaluation (MSE) prior to the conclusion of the existing contract?

No.

18 Section E, page 99

Pursuant to (k) Non-Destructive Testing, does the Government consider an operator who is monitoring in-process NDT apparatus a technician and does that person need to be a certified NDT-technician in accordance with the MSE clause? (i.e., operator monitoring the propellant level isotopic AAIE).

An operator who is monitoring in-process NDT apparatus does not need to be NDT certified.

19 Section E, page 99

Will Measurement System Analysis (MSA) at the serial number level apply to individual EPVAT pressure gauges and Mann barrels? Reference corrections should ensure test system validity without a gage R&R on these items.

No, unless there are changes to the system.

20 Section E, page 102

The Government Furnished Ammunition includes a requirement for Reference Rounds to be submitted within 30 days of contract award. Since the need for reference ammunition is dependent upon actual orders by caliber, is this correct or should it be within 30 days of agreed delivery schedule?

The solicitation will be revised to “….shall be submitted by the contractor on an as needed basis but no later than 15 days prior to required delivery.”

21 Section E, page 103

Are there any products or subcomponents that currently require an RFV (request for variation) for acceptance? If so will the issues be resolved prior to completion of the current contract?

Offerors shall price in accordance with the TDPs. No RFVs will be extended to the resultant contract.

22 Section E, page 103 Are there currently any alternate inspection plans required to accept product? If so, will the USG provide a listing and the status on these plans?

There are no alternate inspection plans for accepting product.

23 Section E, page 105 Would the Government consider propellant reassessment by the Contractor, in lieu of reassessment at ARDEC?

No. The solicitation will be revised to eliminate Narrative E0013 for propellant reassessment.

Section H, Narrative H0003, Paragraph (a), Will the Government please define the term “third party orders” as used in the DRFP and does this include other USG organizations and agencies? Will 20mm support be considered commercial or third party?

The definition of third party under the ARMS PWS will be revised as follows: “Third party refers to the Contractor’s sale of products or services where the end product will be delivered to the U.S. Government.”

Government is inclusive of other organizations and agencies. 20mm support would be considered third party so long as the U.S. Government is the ultimate customer.

Section H, Narrative H0003, (H0015) With the potential development and production of additional calibers within the scope of the contract, H0003 will be revised to clarify that facility use will be granted for those items awarded under the base contract. The contractor will be required to

Paragraph (a), will blanket facility use be expanded to those new caliber families?

submit a facility use request for any other items added after award of the base contract.

Section H, page 135, Facility Use Requirements, para (e)

Bidder would like to clarify that the Government can revoke the use of LCAAP facilities and equipment for commercial orders with 30 days notice, without any justification required.

This understanding is accurate.

27 Section H, page 136

“Ownership of Property,” paragraph (b), entitled “Technical Data Rights,” requires “nothing less than Government purpose rights in all technical data” in all data used in the execution of the contract “as well as third party contracts under the contract.” It goes on to say “[i]n clarification” that the requirement for nothing less than Government purpose rights “applies only to the technical data . . . of the Contractor . . .” Please confirm that, in accordance with the referenced “clarification,” subcontractor technical data is not subject to the requirement for “nothing less than Government purpose rights in all technical data.” If not, please explain the clarification better to identify the technical data that is not subject to that requirement for “nothing less than Government purpose rights.”

The language of this section will be rewritten as follows: “In clarification, this grant (of nothing less than Government purpose rights) applies only to the technical data of the Contractor; it does not apply to the technical data of the Contractor’s subcontractors or ARMS tenants, or technical data associated solely with Commercial Production with the exception of technical data of a subcontractor(s) or ARMS tenant(s) associated with operation and maintenance of Government Property (GP), modifications to GP, or property title to which will vest in the Government under the provisions of the preceding paragraph. In this instance the Government will receive no less than Government purpose rights to that technical data.” The Government’s intent in Narrative H0005, paragraph b, is to avoid a future circumstance where “mixed” Government and contractor rights in technical data hinder a free and open competition for a successor LCAAP contract. The Government will have rights in subcontractor or tenant technical data in any case where the successful offeror opts to subcontract or lease LCAAP operations.

Section H, Narrative H0005, Ownership of Property, pages 136-137

The Government has made significant changes to H0005 compared to the last LCAAP acquisition (H0008).

Will the government please describe how it intends to operationalize these changes? Specifically, there is no CDRL associated with an inventory of Software (COTS and non-commercial) tools and associated intellectual property ownership rights nor is there a Data Assertion List (DAL) CDRL. Additionally, some of these changes could drive accounting and finance policies and procedures such that the cost of acquired property (including material) would have to be recognized at the point of acquisition vs at the point of use or having the cost amortized over the life of the contract. Will the Government please clarify its objectives with respect to Narrative H0005?

The Government does not view the changes to Narrative H0005 to be significant compared to the previous acquisition. The previous/existing narrative specifically includes software and software applications within the definition of technical data to which the Government secured not less than Government purpose rights. Clarification has been added to better describe and distinguish the nature of technical data encompassed in non-commercial versus commercial software; as the Government acknowledges the contractor cannot convey rights in commercial software that it does not possess. It is not clear to the Government how the revised language could drive accounting and finance policies and procedures or property amortization schedules. The Government’s intent in securing rights to technical data, software and other forms, is to facilitate a seamless transition of LCAAP operations.

Section H, page 139, Commercial Utilization & Investment, para (c)

Please provide an example with numbers for the impact of sales above the threshold amount in a given year.

For clarification, the guaranteed minimum and variable

Delivery Order: 03 Annual USG Order: 645M-<917M Fixed: $3 million rate are based on the previous year DO. If commercial sales exceed the threshold in a given year, does that increase the investment level in that year or in the following year?

$ / Threshold: 5% / $5 million DO 03 Commercial Sales: $20 million

Delivery Order: 04 Annual USG Order: 645M-<917M Fixed: $4 million $ / Threshold: 5% / $5 million DO 04 Commercial Sales: $25 million

Delivery Order: 05 Annual USG Order: 645M-<917M Fixed: $5 million $ / Threshold: 5% / $5 million DO 05 Commercial Sales: $30 million

Within each delivery order, the contractor will be required to invest the minimum guarantee, plus the variable investment amount from the previous year’s DO.

For example, in DO 04, the contractor will be required to invest the fixed amount of $3 million from DO 0003 within the current period (i.e., DO 0004), plus the variable amount of $750,000 from DO 03 ($15 million in commercial above threshold x 5% = $750,000).

In DO 05, the contractor will be required to invest the fixed amount of $4 million from DO 0004 within the current period (i.e., DO 0005), plus the variable amount of $1 million from DO 04 ($20 million in commercial above threshold x 5% = $1 million).

30 Section H, page 139

Recommend the Not-to-Exceed clause contained in Section H0009 narrative, paragraph C.3., page 139 be deleted. Based on current wording, there is not benefit to the offeror when prices are underrun and no available fee amount that can be applied to projects that overrun projections. This may drive offerors to propose low risk projects at the expense of higher priority, complicated projects that better serve the facility.

The Government has considered this recommendation but will maintain paragraph C.3 of Narrative H0009.

Section H, Narrative H0016, paragraph (a), item (4), page 140

Given the current volatility in the metals markets and unknown impacts of new tariffs, we recommend adding an EPA and a baseline price for steel.

The Government has considered the information provided and will not include a steel EPA in the solicitation. The proposed EPA clause addresses the most significant material price risks; copper, zinc, and nitrocellulose.

32 Section I

Due to political and economic events which have and will continue to create volatility in the steel market, will the Government consider adding an EPA clause for steel in Section I, page 181? Benefits to the Government would include an assurance that offerors will not have to include price coverage for select raw materials that are significantly influenced by the steel market. This is of particular importance due to the metal ammo cans now considered as Contractor Furnished Material. This will allow the offerors confidence in providing firm long term contract pricing, thus providing value to the Government.

Reference answer to question 31.

33 Section I, page 181 Due to the volatility with the steel industry and prices that are associated with it, is it possible to have an Economic Price Adjustment added for steel?

Reference answer to question 31.

Section H, Narrative H0016, paragraph (a) and item (3), page 140

How will the Government determine that the quantity of NC purchased from within the US or Canada is the full amount of NC needed to meet the propellant requirements set forth in the contract?

It is the contractor’s obligation to adhere to all terms and conditions of the contract. The Government reserves the right to conduct an audit at any time to ensure compliance.

35 Section H, page 140

Narrative H0015, paragraph (a) states, “Components listed in this paragraph must be obtained from sources within the United States or its outlying areas”, is the USG’s intent for these components to be manufactured or obtained within the United States?

For clarification purposes the Government will update the narrative to specify manufacture.

Section I, page 161, Warranty of Services, para (b)

Please clarify the final sentence regarding notice. It seems to be incomplete –lacks a reference to the 60 day period.

The solicitation will be revised to reflect ”within 60 days of discovery of the defect”

Section I, Narrative I0001, first paragraph, Please confirm that baseline pricing for copper, zinc, and nitrocellulose (NC) will be provided in U.S. pounds.

Please confirm that the NC baseline will be in pounds of

NC.

The baseline pricing in the EPA narrative will be provided on a U.S. per pound basis.

Section I, page 185, Currency Fluctuation Provision, para (b)(2)

Industry Day #2 Q&A response stated that all load and pack operations, other than .22 cal are to be performed at Lake City. Is the MK263 cartridge an exception to the requirement, or should the currency fluctuation provision refer to MK 263 projectile rather than cartridge?

The currency fluctuation provision will be revised to eliminate an adjustment for the Canadian Dollar and MK263. LAP of the MK263 shall be performed at LCAAP.

Section I, Narrative I0002, item (a), page 185

Will the USG consider implementing the same currency adjustment provided for the Kroner to the Euro?

The Government does not intend to include a currency adjustment for the Euro.

Section I – Contract Clauses

Please confirm that 52.222-6 Construction Wage Rate Requirements and associated wage determinations will

Applicability of this clause will be determined on a case by case basis as individual projects are negotiated and awarded.

be provided with modifications for construction-related project work?

Section I – Contract Clauses

Will FAR 52.236-2 Differing Site Conditions be incorporated when FFP construction and/or demolition projects are contemplated?

Applicability of this clause will be determined on a case by case basis as individual projects are negotiated and awarded.

42 Section I

FAR 52.243-7 Notification of Changes is not included in the draft RFP. We recommend addition of this clause to allow prompt reporting of Government conduct that the Contractor considers to constitute a change to this contract.

The solicitation will be revised to include FAR 52.243-7.

Section L, Subsection A, Item 6, The first sentence of the reference indicates that the Price proposal is the only volume where 11x17 pages are allowed, and only where selective use of 10-point or 12-point Arial font is allowed. Such a limitation prevents compliance with large graphics requirements, such as the process maps required by Section L.B, Subfactor 1,

1. Production Processes. We recommend revising Section L.A.6 to read as follows:

6. Each volume shall not exceed the limitations set forth below. The proposal shall use standard letter size paper, contain 12-point Times New Roman font and contain margins of at least one inch. The Price proposal may contain 10-point Arial font. All pages shall be numbered. Pages printed on both sides will count as two

(2) pages. Graphs and spreadsheets may be included and may use paper size 8 1/2 x 14 or 11 x 17 (each considered an oversized sheet). Pages of either of those sizes shall still be counted as one page per printed side.

For any graphs, flowcharts, diagrams, spreadsheets, etc. submitted on paper size 8 1/2 x 11, 8 1/2 x 14, or 11 x 17, where letters, numbers, or characters are embedded into the image, these letters, numbers or characters may be of any font size or type as long as they are clearly readable without magnification. All other narrative or numbers not embedded into the image that are added to any oversized sheet or standard size paper, such as the figure number and title, shall be 10-point or 12-point Arial font.

Production Process Maps/Schedules can be submitted on 11X17 and will not be counted towards the page limit restriction.

Section L, page 195, para L.A.6 – Proposal Submission

For definition purposes are we correct that tables in the document are considered the same as spreadsheet and graphics and may be completed with header bars in a font that is readable without magnification and 10-point Arial for the text in the table?

That is correct.

Section L, page 195, para L.A.6 – Proposal Submission

If all text in proposal is the same font section headings and text blends in together making section divisions more difficult for the reviewer to find (see examples below). May the text in L.A.6 be changed to read:

“Contain paragraph and heading text no smaller than 12 point Times New Roman or Arial font.

The Government will consider incorporating the suggested revision.

46 Section L, page 196

Based on Revision 1 to the Draft RFP, will the Government consider increasing the page count total for Volume 2 from 150 to 200 pages? The current reference is located in Section L, paragraph 7 on page

196. This request is based on the revision requirement to provide detailed information related to a hypothetical modernization project.

The Government will increase the page limit for Volume 2 from 150 to 175 pages.

47 Section L, page 196

We would like to confirm it is the Government’s preference to receive offeror’s hard copy submission as a Microsoft Word file single spaced. If so, is there any particular version of Microsoft the Government prefers?

Is it the Government’s preference to receive offeror’s electronic submission as a PDF?

The Government will clarify that proposal submissions shall be in .pdf version. MS Excel files shall be compatible with Microsoft (MS) Office

48 Section L, page 196

Given the issuance of Revision 1 to the DRFP adding a requirement to provide detailed information pertaining to a hypothetical modernization project, can the Government please revise the page count total for Volume 2 from 150 to 175 pages?

The Government will increase the page limit for Volume 2 from 150 to 175 pages.

49 Section L, page 197

Within Volume I (Material Control) the last line states, “will perform Raw Material Inspections on product, and/or test assets, as received.” Do “test assets” refer to each individual ballistic test gauge and barrel?

Test assets refers to items such as, but not limited to, weapons, weapon components, gauges, and material standards.

Section L, Subsection B – Subfactor 2, paragraph 2, item b.

IMS, page 198

Recommend revising the requirement to make the example orders potentially awardable. For example, the requirement could additionally state that the Government reserves the right to award the delivery orders as proposed. The level of Offeror analysis required to propose an awardable delivery orders provides the Government significantly greater insights

The Government will take this recommendation under consideration.

on each offeror's depth and breadth of understanding of the requirements, and enhances the Government's risk assessment during the evaluation process.

Section L, subsection D, paragraph Section A, item 2, page 200 & Paragraph Section C, item 1, Page 200

Does the requirement to report adverse contract performance for “any contract under which any performance, delivery or corrective action has occurred within three (3) years of this final RFP issuance” extend to all of the contract performance period (its entire duration), or just that portion that was being produced or “delivered” within the defined 3 years?

Offeror shall identify adverse contract performance which occurred during any portion of the contract performance period for all recent and relevant contracts.

Section L, page 202, para L.E.1 – Price Factor

“The Offeror must propose firm-fixed unit prices for all PWSs and CLINs from the minimum quantity range…”

Should “PWSs” be included in this sentence? This sentence would seem to be contradicted by Section L.E.4.g.ii which states, “The prices provided for the Indirect PWSs may be used to confirm understanding of the effort involved but will NOT be included in the evaluated price

The solicitation will be revised to remove “PWSs” from the referenced sentence.

Section L, subsection D, paragraph Section H, Should accident data be provided for the entire period of performance for the contract being cited? In the case of a long-standing contract, would it be acceptable to report a fixed period of time such as 5 years?

Offeror shall identify accident data which occurred during any portion of the contract performance period for all recent and relevant contracts.

Section M, subsection D, Paragraph 6, FAR Part 15.305(iv) reads, "In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance." By ranking the Neutral Confidence rating above Limited Confidence, is it the Government's intent to place higher confidence in the performance of an Offeror with no experience than an Offeror with limited experience?

The Performance Confidence Assessments provided in Section M are in accordance with the DoD Source Selection Procedures. Although the Government may not rate an offeror that lacks recent and relevant past performance favorably or unfavorably with regard to past performance, it may determine that a “Substantial Confidence” or “Satisfactory Confidence” past performance rating is worth more than a “Neutral Confidence” past performance in a best value tradeoff. Conversely, the Government may determine that a “Neutral Confidence” past performance rating is worth more than a “Limited Confidence” past performance rating in a best value tradeoff.

Technical Library, TDP related to the M80A1

We recommend modifying the M80A1 TDPs to waive the 48-hour Salt Fog Lot Acceptance Test.

An ECP is in process to remove the 48-hour Salt Fog Lot Acceptance Test requirement.

Technical Library, TDP related to the M80A1

The M80A1 TDPs call out (.000”) gaps in the bullet. We recommend modifying the TDP to include gap tolerances.

The M80A1 bullet drawing allows a base gap up to 0.002" and also allows slug-to-penetrator gaps.

Technical Library, CBA, Will the USG provide the Health and Welfare Benefits referenced on Page 48 of the Collective Bargaining Agreement?

The information will not be provided. A new operating contractor will negotiate its own benefits and ensure those benefits provided to eligible bargaining unit employees are generally the same as it offers non-bargaining unit employees.

Technical Library, CBA, Will the USG provide the Retirement Benefits referenced on Page 49 of the Collective Bargaining Agreement?

The information will not be provided. A new operating contractor will negotiate its own benefits and ensure those benefits provided to eligible bargaining unit employees are generally the same as it offers non-bargaining unit employees.

Attachment 0001 - PWS

The Maintenance PWS requires The Contractor shall use the Government’s General Fund Enterprise Business System (GFEBS) for managing all maintenance activities. This includes all descriptions, costs, and schedules for all inspections, preventive/scheduled/unscheduled maintenance, all work orders, all normal maintenance, and all abnormal maintenance. It also includes the results of all maintenance activities. Is the database complete and will it be available for data entry or there additional work required? Does the USG have ownership of the descriptions, costs, schedules, etc. residing in this system?

THE GFEBS requirement is under review.
