This is a Determination of No Hazard to Air Navigation letter issued by the Federal Aviation Administration (FAA) Southwest Regional Office on February 12, 2022, concerning a temporary construction crane for the City of Fort Myers. The crane, to be used for bridge construction as part of the John Yarbrough Linear Park trail project, is proposed at a height of 120 feet above ground level (139 feet above mean sea level) and will be located approximately 0.66 nautical miles northeast of Page Field Airport (FMY) in Fort Myers, Florida. The determination establishes that while the temporary crane structure exceeds Federal Aviation Regulation Part 77 obstruction standards, it does not constitute a hazard to air navigation provided all specified conditions are met. The determination expires on August 12, 2023, unless extended by the issuing office, with requests for extension required to be e-filed at least 15 days prior to expiration.

The conditions imposed on crane operations include marking and lighting in accordance with FAA Advisory Circular 70/7460-1M, mandatory notification to the FAA and affected airport facilities (Page Field Airport Manager at 239-590-6601 and ATCT Manager at 239-936-7867) at minimum five business days prior to crane erection and upon removal, maintenance of direct two-way communications with onsite operators, daily notification while the crane is raised, and lowering of the crane to ground level during non-VFR conditions or as directed by air traffic control. The sponsor must file a Notice to Airmen (NOTAM) request through the FAA's e-filing system (oeaaa.faa.gov) at least five business days in advance and cancel it upon project completion. Any failure of marking or lighting lasting more than 30 minutes must be reported immediately to (877) 487-6867 to trigger NOTAM issuance.

**DETERMINATION OF NO HAZARD TO AIR NAVIGATION FOR TEMPORARY STRUCTURE**

The Federal Aviation Administration has conducted an aeronautical study under the provisions of 49 U.S.C., Section 44718 and if applicable Title 14 of the Code of Federal Regulations, part 77, concerning:

Structure: Crane Construction Crane Location: Fort Myers, FL Latitude: 26-35-42.77N NAD 83 Longitude: 81-51-19.60W Heights: 19 feet site elevation (SE)

120 feet above ground level (AGL) 139 feet above mean sea level (AMSL)

This aeronautical study revealed that the temporary structure does exceed obstruction standards but would not be a hazard to air navigation provided the condition(s), if any, in this letter is (are) met:

**SEE ATTACHMENT FOR ADDITIONAL CONDITION(S) OR INFORMATION**

This determination is based, in part, on the foregoing description which includes specific coordinates, heights, frequency(ies) and power. Any changes in coordinates, heights and frequencies or use of greater power, except those frequencies specified in the Colo Void Clause Coalition; Antenna System Co-Location; Voluntary Best Practices, effective 21 Nov 2007, will void this determination. Any future construction or alteration, including increase to heights, power or the addition of other transmitters, requires separate notice to the FAA. This determination includes all previously filed frequencies and power for this structure.

This determination does include temporary construction equipment such as cranes, derricks, etc., which may be used during actual construction of a structure. However, this equipment shall not exceed the overall heights as indicated above. Equipment which has a height greater than the studied structure requires separate notice to the

FAA.

This determination concerns the effect of this temporary structure on the safe and efficient use of navigable airspace by aircraft and does not relieve the sponsor of compliance responsibilities relating to any law, ordinance, or regulation of any Federal, State, or local government body.

A copy of this determination will be forwarded to the Federal Aviation Administration Flight Procedures Office if the structure is subject to the issuance of a Notice To Airman (NOTAM).

If you have any questions, please contact our office at (404) 305-6462, or mike.blaich@faa.gov. On any future correspondence concerning this matter, please refer to Aeronautical Study Number 2021-ASO-37239-OE

Section 77.17(a)(3) - a height that increases minimum instrument flight altitudes within a terminal area (TERPS criteria).

Obstacle penetrates RWY 05 40:1 Departure Surface by 95 feet. Qualifies as low, close-in penetration with climb gradient termination altitude 200 feet or less above DER, requiring TAKE-OFF MINIMUM AND (OBSTACLE) DEPARTURE PROCEDURES, NOTE: RWY 05, crane 1094 feet from DER, 666 feet left of centerline.

RNAV (GPS) RWY 23, (missed approach penetration) LPV DA from 274 to 344.

Section 77.17 (a) (5): The surface of a takeoff and landing area of an airport or any imaginary surface established under 77.19, 77.21, or 77.23. However, no part of the takeoff or landing area itself will be considered an obstruction.

Section 77.19 (e) FMY: Transition Surface. These surfaces extend outward and upward at right angles to the runway centerline and the runway centerline extended at a slope of 7 to 1 from the sides of the primary surface and from the sides of the approach surfaces. Transitional surfaces for those portions of the precision approach surface which project through and beyond the limits of the conical surface extend a distance of 5,000 feet measured horizontally from the edge of the approach surface and at right angles to the runway centerline. The proposal will exceed Runway 05/23 Transition Surface by 91 feet.

The proposals would also be located within the traffic pattern airspace (TPA) for all categories of aircraft using FMY. The proposals would exceed the RWY 05/23 Transitional Surface by 31 feet.

The temporary crane does not constitute substantial adverse effect because the equipment would be temporary and would not be a hazard to air navigation provided the conditions are strictly met.
