About this file

This is an Insurance Requirements Chart for the City of Fort Myers establishing mandatory insurance coverage standards for all service providers, contractors, consultants, and subcontractors conducting business with the municipality. The document outlines comprehensive insurance requirements applicable to the John Yarbrough Linear Park Trail Construction project, which involves construction services for the Phase IV Extension Shared Use Path and Bridge Improvements spanning approximately 1.83 miles from south of SR 884/Colonial Boulevard to Hanson Street. The project scope includes a 912-foot multi-span prestressed concrete bridge over SR 886/Colonial Boulevard and a 139-foot prefabricated steel bridge structure over 10-mile canal. Service providers must maintain all required insurance coverage throughout the entire agreement period and provide certificates of insurance demonstrating compliance prior to commencing work, with renewal certificates required no later than 30 days prior to expiration. Failure to provide renewal certificates is grounds for contract termination.

Standard coverage requirements include Commercial General Liability with minimum limits of $1,000,000 per occurrence and $2,000,000 aggregate; Comprehensive Automobile Liability with $1,000,000 combined single limit; and Workers' Compensation and Employers' Liability with statutory coverage and minimum employers' liability limits of $100,000 per accident, $500,000 policy limit for disease, and $100,000 per employee for disease. Additional coverages required for this construction project include Fire and Extended Coverage Insurance (Builder's Risk) equal to the total procurement document price, Professional Liability insurance with $1,000,000 per claim and $1,000,000 aggregate limits with a maximum $100,000 deductible per claim, and Pollution Liability Insurance with $1,000,000 per claim and $1,000,000 aggregate limits due to potential environmental factors. All insurance policies must be occurrence-based, name the City of Fort Myers and its officials and employees as additional insureds on a primary and non-contributory basis, include waiver of subrogation endorsements, and be issued by Florida-licensed insurers acceptable to the City. This project is funded through the Florida Shared-Use Nonmotorized Trail Network under the Department's FY-24/25 work program, which may require inclusion of Florida Department of Transportation or Lee County as additional insureds on all insurance certificates.
