About this file
This is an eligibility inquiry response document regarding subcontractor participation in RFP MCA260003 issued by the Maryland Cannabis Administration for the Cannabis Care Line (CCL) Pilot Program. The solicitation seeks staffing to operate a free-to-caller Cannabis Care Line that provides professional information on medical cannabis use and health-related questions concerning cannabis consumption. The inquiry addresses whether an individual who is both a state employee with the Maryland Small Business Development Center (under UMD) and owner of Main Point Business Solutions LLC, a certified MBE/SBE/DBE in Maryland, may participate as a subcontractor on the proposal.
The Maryland Cannabis Administration's response clarifies that eligibility determinations regarding state employee participation as a subcontractor are subject to applicable Maryland ethics laws, the employing agency's policies, and outside employment or conflict-of-interest requirements. The agency explicitly states it cannot make eligibility determinations on employment or ethics matters and directs the inquirer to consult their agency's Ethics Officer or legal counsel. The response confirms that, assuming no ethics or conflict-of-interest restrictions apply, subcontractors must otherwise satisfy all requirements specified in the solicitation. The inquirer's company is noted as being in good standing and eligible to subcontract with the State of Maryland, with no involvement in RFP preparation or the Maryland Cannabis Administration's evaluation process.

Text version
I am reaching out to inquire about eligibility to subcontract on RFP MCA260003.
I am a certified MBE/SBE/DBE in the state of Maryland.
I hold a FT job with the Maryland SBDC (Under UMD) so technically, I am a state employee.
I work Main Point Business Solutions LLC primarily in the evenings and have a team that works for me.
Although I am a state employee, neither I nor my team have been involved in preparing this RFP or assisting the Maryland Cannabis Administration in any capacity. I do not have any financial or personal relationships with anyone involved in evaluating the proposal.
My company is in good standing and eligible to sub contract with the State of Maryland.
Before the prime submits, I want to ensure I am eligible to submit as a sub.
A: Eligibility to participate as a subcontractor while employed by the State is subject to applicable State ethics laws, your employing agency’s policies, and any outside employment or conflict-of-interest requirements.
The Maryland Cannabis Administration cannot make eligibility determinations regarding an individual’s employment or ethics obligations. You should consult your agency’s Ethics Officer or legal counsel to determine whether you may participate as a subcontractor under this solicitation.
Assuming there are no applicable ethics or conflict-of-interest restrictions, subcontractors must otherwise meet the solicitation’s requirements.
