Section B, page 3 of 81.

The Period of Performance for CLIN 0008 is revised to read (1 February 2022 – 30 April 2022)

A revised RFP Pages 2 through 81 is provided as Attachment 6 to Amend 0002

The USG states that contractor provided items such as PPE, Uniforms, boots, etc should be included in indirect costs.

Allowable indirect costs and whether costs are treated as a direct cost or indirect cost is defined by a company's disclosure statement, if applicable, and cannot be adjusted or changed to comply with the terms of a specific RFP. Can the government reassess this guidance in light of the requirements of a company specific disclosure statement, which varies from offeror to offeror?

RFP

Reference G-6 Payment, Selected Items of Cost Reimbursement Contracts.

The Government does not consider “Contractor furnished items, including personal protective equipment (uniforms, steel toed and other work boots, safety glasses, etc.)” to be material as defined in CLIN X004 and is therefore, not directly reimbursable under this CLIN. If the contractor’s accounting system does not collect these costs as indirect costs, these costs shall be made part of CLIN X001 or X006; and defined in the cost proposal to enable separation of labor costs from direct costs associated with the effort when performing price analysis.

Reference H-8 Insurance. Is the offeror required to provide insurance for both Contractor Furnished Equipment (CFE) and Government Furnished Equipment (GFE), or CFE only?

RFP Reference H-8 Insurance.

The Service Provider will be responsible for damage it causes to both CFE and GFE. Reference RFP H-6 through H-8 for responsibilities and specifically H-6, Government-Furnished and Contractor Acquired Equipment/Vehicles, para b -motor vehicle liability insurance covering bodily injury and property damage, protecting the Contractor and the Government against third party claims arising from the ownership, maintenance or use of Government-furnished equipment/vehicle.

The government provides an overall FTE estimate to support the workload requirements at DDHU, but they do not provide an FTE estimate by work center. In order to properly assess the USG FTE estimate and any differences, will the government consider providing FTE estimates by work center, so the offeror can address any differences in our basis of estimate versus the USG's estimate?

RFP Reference J.29 Workload.

No. The Offeror shall provide total productive labor hours for each specific task listed by applying its proposed time standard to the projected workload provided.

Will the government provide a seniority roster so industry can assess the vacation and fringe impact related to the incumbent work forces's seniority date and related SCA obligations?

Reference I-59 52.222-41 Service Contract Labor Standards AUG 2018, paragraph n:

(n) Seniority list. Not less than 10 days prior to completion of any contract being performed at a Federal facility where service employees may be retained in the performance of the succeeding contract and subject to a wage determination which contains vacation or other benefit provisions based upon length of service with a Contractor (predecessor) or successor (29 CFR 4.173), the incumbent Prime Contractor shall furnish the Contracting Officer a certified list of the names of all service employees on the Contractor’s or subcontractor’s payroll during the last month of contract performance. Such list shall also contain anniversary dates of employment on the contract either with the current or predecessor Contractors of each such service employee. The Contracting Officer shall turn over such list to the successor Contractor at the commencement of the succeeding contract.

While the government provides the descending order of importance for each evaluation factor, the guidance on the evaluation of the subfactors and how they impact the evaluation of the overall factor is not clear. While we note the identification of importance by subfactor, how is the overall evaluation for the factor impacted by the ratings for each subfactor when the subfactors are of equal importance. For example, under Staffing Approach, where all subfactors are of equal importance, if one offeror receives a rating of Acceptable for all four subfactors and another offeror receives an acceptable rating for 3 subfactors and a Good or Outstanding for the fourth subfactor, how will overall rating for Evaluation Factor 3 be rated? Will the subcontractor with the higher rating in one of the subcontractors receive a better rating for the overall factor?

RFP

Reference Section M, Evaluation Factors for Award

The Government will evaluate proposal submissions in accordance with the DOD Source Selection Guide; and as specified in the RFP.

Related to the previous question, and again using Evaluation Factor 3, Staffing Approach as an example, what differences in the four subfactors will result in a different or higher rating of the overall Evaluation Factor. Does the offeror need to get a better rating in 1, 2 or 3 subfactors to get an overall higher Factor rating? Does the offeror need to get a Good or Exceptional rating in one or multiple subfactors, and if so in how many of the subfactors? Please explain exactly how the USG determines the overall Factor rating based on the assigned Subfactor ratings?

RFP

Reference Section M, Evaluation Factors for Award.

See Government response to Question #13

The government states that they will use a 10% margin as this basis for a request for equitable adjustment (REA). We interpret this to mean that the offeror is not allowed to submit a request for equitable adjustment for a 9% increase in the workload but an REA can be submitted if the workload increases by 11%? Please confirm.

RFP Reference X001/FFP fluctuations in workload.

It is the awardees responsibility to request an equitable adjustment in accordance with DFARS 252.243-7002. While the assessment would be a general rule of thumb, each individual request for equitable adjustment will be reviewed and evaluated in accordance with all applicable regulations.

The government states that they will use a 10% margin as this basis for a request for equitable adjustment. How will the government calculate the workload increase? Can the government provide the calculation they will use to measure the workload increase?

RFP Reference X001/FFP fluctuations in workload.

The difference between the projected workload and actual workload. The Government monitors fluctuations based upon overall workload contained in the projected workload and utilizes more than 10% fluctuation in the overall receipts and issues for more than six (6) months as the benchmark for recalculating current and projected workload.

Related to the previous question, will the Service Provider be afforded the opportunity to review and concur with the calculation of the workload difference? Or at a minimum verify and concur with workload numbers used in the government calculation are accurate?

Reference X001/FFP fluctuations in workload.

Yes – differences in workload beyond the limit provided in the RFP, will need to be supported and made part of the Service Provider’s Request for Equitable Adjustment REA for Government review and concurrence – reference DFARS 252.243-7002. Conversely the Government will provide its support for workload below the limit provided in the RFP for Service Provider review and concurrence.

Can the Government please clarify which set of historical workload is relevant and should be estimated? Attachment J.23 – TE

5.2 Projected Workload displays different

workload data than Attachment J.29, first tab.

N/A Attachment J.23 & Attachment J.29

N/A Attachment J.29

TE 3.4, TE 3.5. TE 4.2, TE 4.3, TE 4.5

provide historical MHE data. Offerors to determine hours based on technical approach and Historical workload provided, and types of equipment.

There appear to be several discrepancies in the periods of performance for CLINs 0001 and 0008. Specifically, Section B indicates on page 2of 86: ORDERING YEAR: ONE 1 February 2022 through 31 January 2023 However, under CLIN 0001 it states: PoP:

Nine Months ORDERING YEAR: ONE 1 February 2022 through 31 January 2023Under CLIN 0008 it states: PoP: 3 Months (1 April 2021 – 30 June 2021) Please confirm the correct period of performance for these CLINs.

Section B

Amendment 0002 corrects Section L, E-File II, paragraph (2) (b) to state the Government’s anticipated full performance level of ~280.14

DLA has historically released the Government estimated FTE count per functional task on the Staffing Matrix. Will the Government publish the estimated FTEs per functional task?

J.29 J.29 See Government response to Question #11

J.29 Instructions listed in Section L outlines “only one labor category shall be listed per row. The Offeror may add additional rows for specific tasks that will be performed by more than one labor category”. Does the Government require the offeror to calculate a composite time standard if additional rows are added for more than one labor category?

65 of 81 Section L, E-File III, paragraph (2) (b)

The Government does not require the offeror to calculate a composite time standard. The offeror may add an additional column to account for composite time standard, but it is not required. If a composite time standard column is added, this will alter the column designations included in Section L. Additional rows will require all information as delineated in Section L.

According to the abilityone.gov website, Frequently Asked Question #19:

Can the Government provide the historical number of contractor overtime hours worked in support of the DDHU operation?

No. Offerors can review TE 5.1 DDHU Historical Workload. Additionally, Offerors need to consider workload fluctuations in meeting APLs.

Does the Government require any specific dress code or uniforms for contractor personnel outside of requirements listed in C-1.3.B?

Attachment J.1 PWS C-1.3.B

No. A dress code or uniform is not a requirement for this RFP.

J.3 Wage Determination, under **Hazardous Pay Differential** states "These differentials are only applicable to work that has been specifically designated by the agency for ordnance explosives and incendiary material differential pay."

Has the Government designated any position(s) that require a hazardous pay differential? To properly estimate this requirement, would the Government specifically identify the projected workload data for Material Potentially Possessing Explosive Hazard (MPPEH) associated with Attachment J.1 DDDC PWS Paragraphs 5.2.5.1; 5.3.4.1; and 5.5.6.1?

Attachment J.3

The Government does not have designated positions that would fall under the Hazardous Pay Differential IAW J.3.

There is no projected workload data for Material Potentially Possessing Explosive Hazard (MPPEH) as this effort is not currently performed at DDHU.

Table 1 shows that there should be only 1 E- FILE via DOD SAFE for Volume V-Cost Proposal. Should any text, narrative, or further cost explanation be provided in the required Microsoft Excel Cost Proposal document as well?

RFP page 64 of 86 L-4

The RFP states “The Contractor agrees to assign to the contract those persons whose resumes, personnel data forms or personnel qualifications statements were submitted as required by SECTION L of the solicitation to fill the Key Personnel requirements of the contract. No substitutions or additions of Key Personnel shall be made except in accordance with this clause.” Will the Government consider removing this clause because it favors the incumbent since contractors cannot guarantee the availability of resources from proposal submission to contract award?

If the clause is not removed, will the Government allow for substitutions upon contract award to allow for those candidates who are no longer available or to allow for hiring the incumbent personnel?"

Section H-4 (b)

No. Removal of H-4 Substitution or Addition of Key will not be considered.

Substitution shall be made in accordance with H-4 (e).

H-4, paragraphs d and f are revised as follows:

(d) If the personnel for whatever reason become unavailable to work under the contract for a continuous period exceeding 30 workdays or are expected to devote substantially less effort to the work than indicated in the proposal, the Contractor shall propose a substitution of such personnel, in accordance with paragraph (e) below.

(f) In the event a requirement to increase the specified level of effort for a designated key personnel labor category, but not the overall level of effort of the contract occurs, the Contractor shall submit to the KO a written request for approval to add personnel to the designated key personnel labor category. The information required is the same as that required in paragraph (e) above. The additional personnel shall have qualifications greater than or equal to at least one (1) of the individuals proposed for the designated key personnel labor category.

A revised RFP SP330021R5005 pages 2 through 81 is provided as Attachment 6 to Amend 0002.

Will the Government consider adding a notification response time from the KO to Contractor of five (5) days to approve or disapprove requests for substitution? Will the Government change “personnel” to “key personnel” for consistency on the substitution as noted in (a)-(h)?

RFP Page 28 Section H-4 (g)

Yes. For consistency between H-4 and H-12 the limit incorporated is seven (7) days. H-4 Substitution or Addition of Key Personnel, paragraph (g) is revised to read as follows:

g. The KO shall evaluate requests for substitution and/or addition of key personnel and promptly notify the Contractor, in writing, of whether the request is approved or disapproved within seven (7) days of the Contractor’s initial request.

A revised RFP SP330022R5005 pages 2 through 81 is provided as Attachment 6 to Amend 0002.

Will the Government consider adding a notification response time from the KO to Contractor of seven (7) calendar days to approve or disapprove changes to key personnel?

RFP Page 33 Section H-12

Yes. H-12 DLA Procurement Note - Changes to Key Personnel (OCT 2016), “last” sentence is revised to read as follows:

The contracting officer will evaluate the request and notify the contractor whether the requested change is acceptable to the Government within seven (7) days of the Contractor’s request for change.

A revised RFP SP330022R5005 pages 2 through 81 is provided as Attachment 6 to Amend 0002.

Is this 500-employee size standard an average over five (5) years or is it the amount of employees at the time of proposal submission?

RFP Page 54 Section K-11

Size under employee-based size standards is not affected by the Runway Extension Act or the SBA’s implementation of it; thus, calculation of the number of employees will continue as before under 13 C.F.R. §

121.106 -How does SBA calculate number of employees?

In Part - (1) The average number of employees of the concern is used (including the employees of its domestic and foreign affiliates) based upon numbers of employees for each of the pay periods for the preceding completed 12 calendar months.
