About this file
This is a federal contracting provision template titled 52.225-2 Buy American Certificate (October 2022), prescribed under FAR 25.1101(a)(2).
The provision requires offerors to certify the country of origin and domestic content status of all end products included in their proposals. Offerors must certify that each end product is a domestic end product unless specifically listed as a foreign end product in the required section. For foreign end products that do not consist wholly or predominantly of iron or steel, offerors must indicate whether the product exceeds 55 percent domestic content, with the exception of commercially available off-the-shelf (COTS) items. Additionally, offerors must separately identify all domestic end products that contain critical components. The provision defines key terms—COTS item, critical component, domestic end product, end product, and foreign end product—by reference to the "Buy American-Supplies" clause contained elsewhere in the solicitation. The Government will evaluate offers in accordance with the policies and procedures of Federal Acquisition Regulation Part 25.
The template includes a certification section requiring an authorized company representative to sign and affirm compliance with the subcontracting limitations specified in the clause and resulting contract. The signatory must provide printed name, title, signature, date, and complete company name and address information.
