About this file
This document is a justification for limiting sources for micro-purchase threshold up to the simplified acquisition threshold for Viking Sprinkler Heads. The Department of Veterans Affairs seeks to limit competition for sprinkler head purchases up to $250,000 to ensure standardization of replacement parts for its fire protection systems. The justification cites the benefits of maintaining a single manufacturer for sprinkler heads, including reducing maintenance and inventory costs, ensuring reliable system operation, and facilitating training and certification of staff. The related federal contract opportunity is a solicitation from the Department of Veterans Affairs Veterans Health Administration for replacing the steam system at its medical center in Northport, New York, with bids due by January 24, 2023 and work expected to be completed by September 2024.

DEPARTMENT OF VETERANS AFFAIRS
FAR 8 – Justification for Limiting Sources (LSJ) For
Limiting Sources (<SAT)
Acquisition Plan Action ID:__________503-23-4-5071-0019___________
1. Contracting Activity: Department of Veterans Affairs, VISN 4, James E. Van Zandt VA
Medical Center, Altoona PA. Station 503. “Justification for Limiting Sources.” Construction Project Number 503-19-112 – Replace Steam System.
2. Description of Action:
This facility has a requirement to expand the outpatient clinics to meet the VA’s Patient Alinged Care Team (PACT) model. As part of the expansion, new sprinkler heads will be installed in the clinic. The solicitation for this procurement shall be advertised for a minimum of 30 calendar days in order to obtain competition from qualified Service Disabled Veteran Owned Small Business (SDVOSB) concerns.
This Sole Source Product is for the Sprinkler Heads “Viking”, this action will be awarded as part of the new contract requirement as described above “Replace Steam Systems.”
Name of Proposed Contractor: Viking Group Street Address: 5150 Beltway Dr. SE City, State, Zip: Caledonia, Michigan 49316 Phone: (800) 968-9501
3. Description of Supplies or Services: Fire Alarm System currently installed throughout the hospital is provided and maintained by Bettwy Systems which is considered “Sole Proprietor” and any other installer would void all current warranties. Therefore any other installer would not work as a substitute and be substantial duplication of cost.
4. Authority:
Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:

An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);
Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;
(FAR 8.405-6(a)(1)(i)(B));
In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405- 6(a)(1)(i)(C)); or
Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).
5. Rationale/explanation to support cited authority: The head manufactured by Viking is currently the hospitals standard. The quality of this valve has exceeded others in the past when used in the facility and has provided a savings to the hospital in material replacement, labor hours to remove failed sprinkler heads as well as operation down time to the hospital.
The “duplication of cost” is a factor when required to replace failed sprinkler heads and lost operation time to the hospital which would not be recovered by the government.
6. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
