About this file
This document is a solicitation for a Design Build Contract for the Kika De La Garza Land Port of Entry (LPOE) Border Roadway Improvement and Construction (BRIC) project in Pharr, Texas. The project is funded in part by the Inflation Reduction Act of 2022 and requires the use of low embodied carbon construction materials such as concrete, asphalt, and steel.
The project consists of repairing or replacing approximately 515,000 square feet of concrete pavement at 22 sites within the LPOE. The work includes complete reconstruction, surface reconstruction, milling and asphalt overlay, joint sealing, patching, and concrete replacement. Construction phasing will be required to maintain LPOE traffic flow during construction. The total construction cost is estimated between $20,000,000 and $30,000,000, and the period of performance is approximately 460 calendar days. This procurement is set-aside for small businesses under NAICS code 237310 (Concrete and Asphalt Paving).

(1) This Solicitation is set-aside for Small Business Concerns, in accordance with FAR 19. This Solicitation sets forth requirements for proposals for a Contract to construct the Project described in the attached Agreement. Proposals conforming to the Solicitation requirements will be evaluated in accordance with the Method of Award set forth herein. The Government will award the Contract to the selected Offeror, subject to the conditions set forth herein.
(2) Neither the Solicitation nor any part of an Offeror's proposal shall be part of the Contract except to the extent expressly incorporated therein by the Contracting Officer.
(3) The Offeror's proposal submitted in response to this Solicitation shall constitute a firm offer.
No contract shall be formed unless and until the Contracting Officer has countersigned the SF 1442 submitted by an Offeror, and delivered to the Contractor a copy of the SF 1442 with original signatures together with the Agreement reflecting the Offeror's proposed prices.
(4) The Inflation Reduction Act of 2022 (IRA), Pub. L. No. 117-169, enacted in August 2022, provided GSA with significant funding for (a) measures necessary to convert facilities to high-performance green buildings, (b) acquisition and installation of construction materials and products with substantially lower levels of embodied greenhouse gas emissions, and (c) emerging and sustainable technologies. The Contract resulting from this Solicitation will be funded in part by IRA appropriations, and it contains numerous IRA-specific requirements. Requirements include, but are not limited to, requirements regarding pricing, invoicing, submittals, materials, and construction. In addition, please note that this Solicitation contains an evaluation factor favoring certain construction materials with the lowest possible levels of embodied carbon. Offerors shall carefully review this Solicitation, the Agreement, the Statement of Work, the Specifications, and the Drawings. In addition, please note that this Solicitation contains an evaluation factor favoring certain construction materials with the lowest possible levels of embodied carbon. Offerors are responsible for accurately pricing and, if successful, fully performing all Contract requirements.

Electronic Submission of Proposals
Electronic Submission of Proposals: Offers must be received by the email address of the GSA Point of Contact (POC) listed herein on or before the date and time established for receipt of offers. The date and time of receipt will be established according to the Government computer system’s documentation showing the exact official time of receipt by the GSA POC listed herein and not by the time the electronic proposal was sent by the Offeror or received by the GSA server. It is the Offeror’s responsibility to ensure proposals are complete and submitted early enough to be received by the GSA POC before the deadline, and to confirm receipt before the deadline. Proposals or portions of proposals which are received by the GSA POC later than the time noted within will be rejected and will not be considered.
NOTE: The maximum file size is 25 MB. GSA has occasionally experienced delays in delivery of emails from the GSA server to an email account. Therefore contractors/offerors need to plan accordingly.
WARNING: Consistent with GAO case law on the issue of “late-is-late rule” related to electronically submitted proposals, GSA will strictly comply with and enforce FAR
52.215-1(c)(3)(ii)(A). Pursuant to GAO’s application of FAR 52.215-1(c)(3)(ii)(A), an electronically submitted proposal that is received late will not be considered unless (1) it is received before award is made, (2) the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition and (3) it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals. FAR 52.215-1 (c)(3)(ii)(A)(1).

(3) GSA is required to track spending for each of the three appropriations it received under the Inflation Reduction Act of 2022 (IRA) -- for low-embodied carbon (LEC) materials, emerging and sustainable technologies, and high-performance green building measures -- and has established “budget activities” for each of these appropriations. A contract line-item number (CLIN) for each of these budget activities has been included in the Agreement as necessary. In addition, sub-CLINs will be used to track spending on each of the LEC materials designated for IRA funding -- asphalt, concrete, glass, and steel. Offerors must include separate prices for IRA work under the corresponding IRA CLINs and sub-CLINs.
Amounts for each IRA CLIN should reflect all expenses necessary to accomplish acquisition and installation of IRA work elements. A list of possible expenses follows below; this list is not exhaustive.

The term "similar projects" shall be defined for evaluation purposes projects that meet all three elements of size, complexity, and type as further defined herein. The project requires the phased working of various aspects of the project as day-to-day functions of the Land Port of Entry are accommodated for the full duration of construction with minimal impact on operations.
Each project need not contain every element, but the combination of projects should demonstrate the ability to perform these services in a satisfactory manner.
Similar in size projects are:
● Exceed $5,000,000 in total construction costs, two (2) projects completed in the last eight (8) years from the date of the Solicitation. One (1) of the two (2) project submissions can be incomplete, however it must be 75% complete from the date of the proposal submission.
Similar in complexity projects are:
● Design and construction of roadway repair and replacement of 300,000 SF of concrete pavement 8” or more in depth
● Phasing and planning of work to include road/lane closures
● Project is occupied during normal business hours to allow traffic flow to continue during construction
Similar in type projects are:
● A project consisting of major modernization or renovation for road repair of a
Land Port of Entry (LPOE), complex, military base, commercial docks, or facility area, University Campuses, and highway road construction repair projects.
Additional examples include, but are not limited to, highways, airport runways, tarmacs, commercial dock areas, bridges, and distribution center projects.
● Projects involving POV and commercial primary inspection lanes with booths, secondary POV inspection area with inspection canopies, and road and paving site work that meet the minimum depth (8 inches thick) of concrete.
Projects NOT considered similar:
● Stand-alone parking lots, sidewalks, and driveways
GSA’s asphalt, concrete (and cement), glass and steel requirements establish numeric global warming potential (GWP) limits for each of the EPA-approved construction materials: concrete
(and cement), asphalt, steel, and glass (IRA-Eligible Materials). For each IRA-Eligible Material, GWP limits have been established for the best performing 20% of materials in terms of embodied carbon, as reported in terms global warming potential (Top 20% Limits), the best performing 40% of materials in terms of embodied carbon (Top 40% Limits) and better than industry average (Better Than Average Limit). In accordance with its proposal, Contractor shall provide all IRA-Eligible Materials required for performance of the Contract in compliance with the following IRA Limits.
