About this file
This is Amendment 2 to solicitation #47PH0825R0001 for the Kika De La Garza Land Port of Entry Border Roadway Improvement and Construction (BRIC) project in Pharr, TX. The amendment includes updated pre-proposal/site visit sign-in sheets from December 10-11, 2024, pre-proposal conference meeting minutes, updated bid sheets with corrected CLIN numbers, revised Factor 1 and Factor 2 questionnaires, and government responses to contractor questions.
The amendment provides details about the pre-proposal conference where GSA officials outlined the design-build project involving approximately 565,700 square feet of concrete pavement repair/replacement using Low Embodied Carbon (LEC) materials including asphalt, concrete and steel. The project consists of 22 sites within the LPOE and has a 460-calendar day period of performance. Technical proposals are due by 2:00 p.m. CST on January 6, 2024. The solicitation remains a small business set-aside with evaluation based on best value considering four factors: Past Experience (35%), Key Personnel (30%), Management Plan (20%), and Sustainability-LEC Materials (15%). Updated questionnaires were provided to properly evaluate contractor past performance and key personnel qualifications.

IV. PROJECT OVERVIEW (PM)
A. Background
The Kika De La Garza LPOE is the facility that provides controlled entry into or departure from the United States (U.S.) for persons and cargo arriving as commercial, non-commercial, or pedestrian traffic. The LPOE houses the U.S. Customs and Border Protection (CBP) and other federal inspection services (FIS) agencies responsible for the enforcement of federal laws pertaining to immigration, drugs, agriculture, wildlife, smuggling, and commerce. Note, CBP is primary customer agency for this project.
B. Description of Project
This design-build project involves roadway repair and replacement of approximately 565,700 square feet (sf) of concrete pavement, using Low Embodied Carbon (LEC) materials, to include LEC asphalt, concrete and steel. The repairs consist of complete reconstruction, surface reconstruction, mill and 2” asphalt overlay, joint sealing, patching, and the select replacement of 8” – 13” thick reinforced concrete. Construction phasing will be required to allow for continued LPOE traffic flow and operation during construction. This project consists of twenty-two (22) sites within the LPOE.
C. Inflation Reduction Act (IRA)
The Inflation Reduction Act (IRA) of 2022, Pub. L. No. 117-169, enacted in August 2022, provided GSA with significant funding for (a) measures necessary to convert facilities to high-performance green buildings, (b) acquisition and installation of construction materials and products with substantially lower levels of embodied greenhouse gas emissions, and (c) emerging and sustainable technologies. The Contract resulting from this Solicitation will be funded in part by IRA appropriations, and it contains numerous IRA-specific requirements. Requirements include, but are not limited to, requirements regarding pricing, invoicing, submittals, materials, and construction. In addition, please note that this Solicitation contains an evaluation factor favoring certain construction materials with the lowest possible levels of embodied carbon. Offerors shall carefully review this Solicitation, the Agreement, the Statement of Work, the Specifications, and the Drawings. Offerors are responsible for accurately pricing and, if successful, fully performing all Contract requirements.

PLEASE SEE THE BELOW QUESTIONS AND RESPONSES RECEIVED AS OF THE DATE OF
THIS AMENDMENT.
Q1: Would GSA consider alternative means of construction? Primarily by reconsidering all areas calling for HMAC overlay or reconstruction to instead be replaced with concrete pavement, and for the HMAC base under proposed areas of CRCP replacement to either be a pre-engineered geogrid material or any other possible base layer which could act in the same capacity.
A1: No, not at this time.
Q2: If CBP or port authority activity directly impacts the construction schedule, causing delays, will contractors be entitled to claims for time extensions or general conditions?
A2: As referenced in The Agreement, please refer to GSAR Clause 552.211-13, Time Extensions.
Q3: The contractor is bidding on several Border Roadway Improvement and construction (BRIC) projects, with bids scheduled just a few days apart. For Factor 1:
Past Experience and Performance of the Company, the same projects will be used to demonstrate past experience.
Would it be acceptable to submit the same questionnaire completed once by the end user, instead of asking them to fill out the same form multiple times?
A3: It is up to the Offeror to submit the questionnaire or Final CPARs with their technical proposal by the due date and time set forth in the Solicitation. Each response should annotate the solicitation # and project title. See updated Questionnaires for Factor 1 & 2.
Q4: According to the Solicitation Document, Section II.B "Proposal Format," paragraph 2, the technical proposal is limited to 40 pages in 8.5" x 11" vertical (portrait) format.
Can the contractor include some pages in horizontal (landscape) format for specific items, such as past performance project resumes, the project organizational chart, and/or the proposed/planned schedule?
A4: The schedule is not included in the Factor or proposal page count limit; therefore it can be submitted in horizontal (landscape) format. All other proposal contents shall be submitted in accordance with the solicitation requirements.
Q5: According to the solicitation documents, the contractor must submit three specific attachments (pricing, technical, and LEC - PDF & Excel) as part of their proposal. As an instance, the technical section of the proposal is limited to 40 pages, with additional information such as experience questionnaires and other relevant details not counting toward the 40-page limit.
Can the contractor include additional information, such as past experience questionnaires (for the technical proposal), GSA Form 527, and financial statements, as appendices in a separate attachment? Additionally, is it permissible to submit an additional attachment with the proposal overview, including a cover page and other relevant information not covered in all other sections?
A5: The GSA Form 527, Bid Bond, Representations and Certifications do not count towards the page limit and shall be submitted with the Price Proposal. Past experience questionnaires or Final CPARS, and Environmental Product Declarations (EPD’s) required will not count toward the page number limit. The solicitation describes what is included in the cover page; the cover page will not count towards the page limit.
Q6: To confirm what was mentioned during the World Trade Bridge pre-proposal meeting on 12/10/2024:
Under attachment 4 "LEC Material IRA Sustainability Factor Table", for the "Cement" data input, if contractors are able to procure concrete which meets the GSA IRA Limits, they are to assign the GWP value for that concrete to the cement as well. Could you please verify this is correct?
