a. PROPOSAL DUE DATE: Offerors must submit proposals with all required documentation via email to

Offerors are advised that delays can be experienced with the Government’s e-mail system, however, it’s the Offerors responsibility to ensure that proposals are submitted to the Government’s office by the proposal time above. If you do not receive a confirmation of receipt from the Contracting Officer within 24 hours of submission, it is the offeror’s responsibility to follow up with the points of contact indicated below to ensure receipt via phone and/or email.

3. Be advised the size limit per email is 10 MB. If the proposal volume exceeds 10 MB, additional emails must be submitted as necessary with the number of email submissions for each volume clearly labeled in the subject line.
4. All files must be provided in Portable Document Format (.pdf), except for Attachment ‘J-1 (Pricing Worksheet) which must be submitted in Microsoft Excel, unlocked. Zip Files are not accepted.
II. GENERAL REQUIREMENTS
1. REQUEST FOR PROPOSALS (RFP) COMPLIANCE: The Offeror must submit an adequately written proposal that includes all data and information required by this RFP and must be submitted in accordance with these instructions. The Government reserves the right to reject any proposal that does not comply with the proposal preparation/submission instructions herein. The proposal shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal shall not simply rephrase or restate the Government's requirements, but rather shall provide convincing rationale to address how the Offeror intends to meet these requirements. Offerors shall assume the Government has no prior knowledge of their experience and will base its evaluation on the information presented in the Offeror's proposal. All required documentation must be submitted in English or with a certified English translation.
This RFP does not authorize alternate proposals with respect to specific terms or conditions of this RFP.
Any proposal containing an objection to any of the terms and conditions of this RFP will make the offer unacceptable and not considered for award on initial offers.
2. CROSS-REFERENCING: The proposal volumes shall be written on a stand-alone basis so that its contents may be evaluated without cross referencing to another volume. Information required for proposal evaluation which is not found in its designated volume will be assumed to have been omitted from the proposal. In addition, no price information must be included in the VOLUME I – TECHNICAL or
VOLUME II – PAST PERFORMANCE.
3. DISCREPANCIES: If an Offeror believes that the requirements in these instructions contain an error, omission, inconsistency, or are otherwise unsound, the Offeror shall immediately notify the Contracting Officer/Contract Specialist in writing prior to its proposal submission and prior to the submission closing date.
4. PRE-PROPOSAL INQUIRIES: Offerors may submit questions regarding any WI or contractual term. No verbal requests for information will be accepted by the Contracting Officer/Contract Specialist. To ensure the Government is able to adequately address and respond to Offeror questions, any questions related to this solicitation must be submitted via email no later than 23 December 2024 at 12:00 p.m. Central European Time (CET). At the Government’s sole discretion, questions submitted after the deadline may or may not be answered by the Government. Questions must reference the solicitation number and specification page/paragraph and be submitted via email to Julian R. Thornton at Julian.R.Thornton.civ@us.navy.mil and Yarinee Tafur at Yarinee.Tafur.civ@us.navy.mil. At the Government’s discretion, questions and answers will be provided to all potential Offerors via European Navy Electronic Commerce Online (EuroNECO) website (https://euro.neco.navy.mil/ and System for Award Management (https:SAM.gov).
5. SHIP CHECK: A ship check will be conducted on the sister ship the USS HERSHEL “WOODY” WILLIAMS (USS HWW) on 21-22 November 2024 in Taranto, Italy, as per Special Notice under Solicitation N6817125R0001 posted in EuroNECO and SAM.gov. No further ship check opportunities will be provided.
6. ATTACHMENT J-3(a) & (b) (REFERENCES): Potential Offerors may submit a request for
Attachments J-3(a) and J-3(b) (References) via email to Julian R. Thornton at Julian.R.Thornton.civ@us.navy.mil and Yarinee Tafur at Yarinee.Tafur.civ@us.navy.mil, respectively, no later than 23 December 2024 at 12:00 p.m. (Central European Time).
NOTE: **Requests must be accompanied by a signed Attachment S-1 Non-Disclosure Agreement (NDA).
For all Offerors who have provided a signed Attachment S-1 (Non-Disclosure Agreement), references will be provided via Department of Defense (DOD) SAFE no later than 30 December 2024 at 3:00 p.m.
(Central European Time). Offerors who submit requests past the deadline will be responded to as time permits.
7. ALTERATION OF SOLICITATION: Offerors shall respond to the solicitation as posted. Offerors who alter the solicitation (except for completing appropriate “fill-in” blocks and certifications) may be considered non-responsive and ineligible for award.
8. AMENDMENTS: The Government may revise the solicitation at any time by means of amendment. It is an Offeror’s responsibility to ensure it is accessing the EuroNECO or SAM.gov websites to view potential amendments and procurement notifications for this solicitation.
9. PROPOSAL VALIDITY: The Offeror agrees to hold the prices in its proposal firm for 180 calendar days from the proposal due date.
10. BEST TERMS: Each Offeror must submit one (1) complete proposal in response to the solicitation requirements containing its best terms from a price and non-price standpoint. The Government intends to award without discussions but reserves the right to conduct discussions if necessary. Failure to submit any of the documentation or information required for proposals may cause the Offeror to be ineligible for award based on its initial proposal.
11. ONE PROPOSAL SITUATION: If the Government receives only one (1) technically acceptable proposal in response to this solicitation, the Government reserves the right to require certified cost or pricing data in accordance with DFARS 252.215-7008. As identified by the Contracting Officer, additional cost or pricing data will be required in order to determine whether proposed pricing is fair and reasonable or to comply with the statutory requirements of certified cost or pricing data in accordance with 10 USC 3702 and FAR 15.403-4.
12. Offerors are advised that the Government will use TD Solutions, and their personnel to assist during the source selection. The exclusive responsibility of the source selection will reside with the Government.
Proprietary information submitted in response to this solicitation will be protected from unauthorized disclosure as required by Subsection 27 of the Office of Procurement Policy Act as amended (41. U.S.C.
423) (hereinafter referred to as "the Act") as implemented by the FAR. These companies are bound by Organizational Conflict of Interest and disclosure clauses with respect to proprietary information.
Contractor personnel assisting in the proposal evaluation are procurement officials within the meaning of the Act, and will take all necessary action to preclude unauthorized use or disclosure of a competing Contractor's proprietary data.
III. PROPOSAL CONTENT:

FACTOR 1: Technical Capability

Technical Subfactor 1: Understanding the Work Package: The Offeror shall submit documentation that provides a separate response to each of the following elements:
Element 1.1: Time Phased Sequencing Network (TPSN – GANTT Chart):
Demonstrate in detail, an understanding of the overall scope of work and the plan to accomplish that work by providing a TPSN, including milestones for each WI including Category “B” items. Include all milestones listed in WI 0013. In addition, develop a Critical Path Analysis by WI. The analysis shall clearly identify the primary Critical Path at each point of the availability. In addition, a secondary Critical Path may be presented. Milestones for the primary Critical Path shall include:
a. MSC / FDRMC Onsite Management Team office start and end dates.
b. Start of contract/ship arrival date.
c. Crew move-off date
d. Dry-dock date
e. Completion of tanks gas-freeing date.
f. Machinery Space Turnover date.
g. Undock date from Dry-dock (if applicable)
h. Turnover of the Engine Room date
i. Habitability and Galley and Mess Turnover date.
j. Crew move aboard date
k. Pre start-up meeting.
l. Bridge turn-over.
m. Dock trial date.
n. Sea trial date.
o. Ship redelivery date.
List all awarded contracts and pending offers for the same or overlapping period(s) of performance as this availabilities (ROH & MTA). Explain the impact of those committed and pending projects to this availabilities (ROH & MTA) and how you plan to manage conflicts.
Identify whether it is achievable to complete all the Category “A” WIs within the period of performance of the ROH-DD and the MTA. If it is not possible, provide a timetable that is determined to realistically complete all category “A” WIs.
Identify any challenges or obstacles for the coordination of WIs. Describe possible solutions for any challenge or obstacle identified. If no challenges or obstacles are foreseen, state “No challenges or obstacles are foreseen.”
Element 1.2 Problem Areas:
Identify any foreseen potential problem areas in accomplishing the work requirements (e.g., LLTM, open and inspect items, potential labor disputes) within the allotted contract period and propose solutions to those problems. If no problems are foreseen, state, “No problems are foreseen.”
Element 1.3 Engineering:
The Offeror shall demonstrate its understanding of the engineering support requirements (e.g., working drawings, tech/system manuals, selected record plans, inclining requirements, Trim and Stability booklet, and docking and undocking calculation, if required) of the work package.
Identify completely the extent of engineering services that you plan to provide for this work package.
Describe the methodology to be used for resolving technical engineering problems, including engineering/production interfaces.
Describe the liaison between production and any engineering or design subcontractors (e.g., whether or not specifically dedicated in-house individuals will be assigned liaison).
Describe how regulatory approvals will be obtained for applicable engineering drawings (e.g. use of Professional Engineer review, use of American Bureau of Shipping (ABS) review for ABS approval).
Element 1.4 Material Availability:
Identify materials/sources of materials for any item whose material cost exceeds 25% of the total estimated WI cost.
Identify materials and sources for material costs that exceed $10,000.00 for any single item. Do not list normal stock materials (e.g., fasteners, gaskets, weld rod).
Provide a separate listing of all brand name or equal items pursuant to the Brand Name or Equal provision of this solicitation (FAR 52.211-6). List should identify the product or material by WI number.
Element 1.5 Material Control and Storage:
Provide information on the location and size of all storage areas including those available for the receipt and inspection of material. Provide supporting data to demonstrate capability for compliance with the storage requirements identified in the statement of work.
Describe the system to be used for Material Control, providing data for the following areas:
a. Advanced CFM material ordering.
b. Receipt, inspection, and identification of GFM and CFM, including rotatable pool items.
c. Control of pilferable and sensitive material.
d. Control of damage and reporting system.
e. Turn-in material, including equipment shipped to subcontractors for work.
f. Scrap material and relative accounting system.
g. Rip out material which is to be reinstalled.
h. Procedure for critical material decisions such as substitutions.
i. Temporary issue of storeroom repair parts to support overhaul/availability. Show how the proposed system satisfies production and QA Material Control requirements. Describe how material is distributed to the crafts.

Element 1.6 Heavy Weather Plans:
A Heavy Weather Plan shall be submitted IAW the WI 0006 on heavy weather. The heavy weather plan shall include a description of the protection arrangements available and the preventive measures that will be taken to ensure the safety of the ship from potential heavy weather conditions as required in WI 0006.
Element 1.7 Cold Weather Plan:
A Cold Weather Plan shall be submitted IAW the WI 0007 on Cold Weather. The Cold Weather Plan shall include a description of the protection arrangements available and the preventive measures that will be taken to ensure the safety of the ship from potential cold weather conditions as required in WI 0007.
Element 1.8 Fire and Flooding Protection Plans:
A Fire and Flooding Protection Plan shall be submitted IAW the WI 0016 on fire protection and ships safety program. For informational purposes only, attachment S-7 provides Fire and Flooding Protection Plans checklist. In case of any discrepancies between WI 0016 and attachment S-7, WI 0016 prevails. The plan shall include a description of the ship repair facility fire protection and flooding protection measures/procedures, agreements with local fire and rescue organizations, firefighting response plan, flooding response plan, rescue response plan, medical emergency response plan, dewatering equipment available, alternative firefighting provisions in the case of disabled fixed firefighting systems and preventive measures that will be taken to ensure ship's safety during fire or flooding emergencies.
Technical Subfactor 2: Ability to Perform the Statement of Work: The Offeror shall submit
Element 2.1 Man-hour Chart:
Provide the supervisor/worker ratio for each specification item. Submit man-hour estimates by Hull, Machinery, and Electrical departments, with totals for each specification item and grand totals for all specification items in the format outlined below. The man-hour estimates provided shall reflect the actual man-hours planned to accomplish the work in the specification items.

Provide one graphic presentation (i.e. pie chart) indicating each of the items below. The left side of graph must indicate “man-days” and the bottom of graph indicate time from award date to redelivery of vessel in daily intervals.
a. Total number of personnel required to accomplish all work projected during the period of performance required by the solicitation.
b. Total number of personnel required to accomplish all shipyard work, all other work currently scheduled, and all other work projected during the period of performance required by this solicitation.
c. Total number of subcontractor personnel expected to be expected to use to accomplish work projected during the period of performance required by this solicitation.
d. Projected number of contractor and subcontractor personnel required to accomplish the additional man-hours of growth work as outlined in this solicitation
Element 2.2 Growth Absorption:
For each of the three phases, provide an estimate of the amount of additional work that can be absorbed without impact on availability completion of the respective requirement. Assume that most of the additional work is identified during the first 50% of each phase, that the work per trade (Hull, Machinery, and Electrical) is proportional to the work in the basic specifications, and that all material for such additional work is available within a reasonable time.
Justify the estimate of the amount of additional work that can be absorbed beyond AGR and Category “B” items.
Element 2.3 Facilities:
Complete the enclosed MSC Ship Repair Facility Survey Form (MSC Form 4330/26). Forms must be signed and dated. (See section J for the form).
If towing is required, a Facilities form is required per location.
Note the following special instructions when completing the form.
a. On sheet 2 of 5, the “Services Available” block should include only those services which are permanently installed. Temporary service capability should be listed on sheet 5 of 5.
b. Photocopies of crane certification data shall be supplied.
c. The following instructions apply to the required submittals list located on sheet 5 of 5.
1. Submittal number 1: submit as instructed.
2. Submittal number 2: submit as instructed.
3. Submittal number 3: submit as instructed; list only capital equipment. Do not list portable hand-held tools.

d. The Offeror shall demonstrate that it has and will provide a clean reliable source of electrical shore power that meets the requirements set forth in Section 7.0 of WI 0011 (General Services for the Ship).
Element 2.4 Berth, Approach, and Mooring:
Provide the charts and information listed below. The charts must be current charts and adequately demonstrate that the route(s) provide safe vessel transit as set forth in NSP WI 0003 (Approach, Berth and Mooring). Current is defined as one (1) year from the request for proposal (RFP) posting. The Offeror shall submit the following:
a. A Berth Chart that complies with the requirements set forth in Work Item 0003 entitled “Approach, Berthing and Mooring Requirements.”
b. A Berth Chart that complies with the requirements set forth in Specification Package of Not Separately
Priced (NSP) WI 0003 “APPROACH BERTHING AND MOORING.”
c. An Approach Chart that complies with the requirements set forth in Specification Package NSP WI
0003 “APPROACH BERTHING AND MOORING.”
d. A Mooring Chart that complies with the requirements set forth in Specification Package NSP WI 0003
“APPROACH BERTHING AND MOORING”.
e. Mooring line details shall be presented with the Offeror’s proposal. A mooring calculation report shall be submitted based on UFC 4-159-3. The strength of mooring bitts, bollards, and fenders shall be provided. Ensure that the hydrographic’s chart clearly reflects water depth along with the units of measurement and has a date and signature.
For a dry docking and IAW WI 0901, submit the S-8 MSC Drydock Evaluation Form, provide photocopies of the dry dock certificate(s), and provide the proposed blocking arrangements, laid out in plan, profile and section views that shows the blocking arrangement and proposed dry dock.
Technical-Subfactor 3: Management Control and Quality Assurance
Element 3.1 Organization and Personnel:
Provide an organization chart of the lead and/or points of contract of the shipyard who will be assigned for these availabilities The org chart should include main government points of contact for the upper management, program managers, negotiators, estimators, scheduling personnel, engineering personnel, key production personnel by trade, the shipyard safety program organization, testing organization, the quality assurance organization, and contractor personnel responsible for each subcontractor being used. Identify if a 2nd and/or swing shift yard managers/supervisors if available. Include the title, percentage of time to be devoted to this availability, and years’ experience in the ship repair industry for each point of contact
(POC).
Element 3.2 Subcontractor Participation:
Identify all WIs where work required is planned to be accomplished outside of the contractor's primary repair facility. Identify the facility/subcontractor planned to accomplish this work, the location where work will be performed, and contractor intentions for accomplishing regulatory body and MSC/ FDRMC COR for inspections at the off-site location.
Where a Technical Representative is required, identify each Technical Representative by source and by WI number. If none, state so.
The offeror shall provide a signed Letter of Intent from each Original Equipment Manufacturer (OEM) vendor specified as mandatory in the pertinent WIs as reflected in Section 7 of the individual WIs. Letter of Intent shall be on the OEM letterhead and shall state that the vendor intends to support the statement of work as a subcontractor of the perspective prime contractor (shipyard) during the period of performance.
Element 3.3 Quality Control Plan:
The Offeror shall describe in detail the Quality Control (QC) Plan to be used for this availability. The description shall address the method in which you will comply with the WI 0004 (Testing and Quality Assurance).
Submit a Preliminary "Schedule for Key Inspection Events" for review; to show full understanding of all inspections criteria, call outs, and checkpoints specified within the WI package.
Identify the individuals who will perform the QC function. Discuss other duties, if any, to be performed by QC personnel and the percentage of time that they are to perform other duties. Discuss the documentation of QC activity (e.g., logs, notebooks, records). Present the test failure recovery plan.
The Offeror shall submit the Attachment S-2 “QA Checklist” along with all documents listed therein, Attachment S-3 Foreign Access Control Plan (“ACP Questionnaire”), and the Attachment S-4 Access Control Plan Certification, filled with all the required information.
Element 3.4 Hazardous Waste Management Plan:
The Offeror shall submit a Hazardous Waste Management and Control Plan, signed by the Offeror’s Environmental Manager, as part of the Offeror’s proposal submittal package to include the following.
a. Identify main point of contact of shipyard personnel associated with hazardous waste management including, but not limited to, personnel associated with employee training, hazardous waste identification, and manifest documentation.
b. Identify any subcontractors associated with removal, handling, and disposal of hazardous waste, including but not limited to, subcontractors responsible for removing, storing, transporting, recycling, reclaiming, or otherwise disposing of hazardous waste. All permits or other applicable credentials associated with safe and proper disposal of hazardous waste should be included. If a hazardous waste subcontractor is changed for any reason, the Hazardous Waste Management Plan shall be amended prior to the new subcontractor beginning work on the vessel.
c. Identify all applicable European Union (EU), Country and/or any other local agencies associated with the disposal of hazardous waste.
d. Outline procedures used by the facility to accomplish removal, handling, storage, and disposal of hazardous waste IAW applicable European Union (EU), Country and/or any other local requirements.
e. Describe all steps to be taken to reduce the volume and toxicity of hazardous waste generated during the performance of the contract. This is to include, but not be limited to a description of management of hazardous waste generation, process controls utilized to ensure that effective minimization techniques are maintained, and any technological resources available to reduce either the toxicity or the volume of hazardous waste.
f. Provide a copy of the facility’s Hazardous Waste Spill Response Plan
Technical Subfactor 4 – Lay berth
Element 4.1 Suitability of Proposed Lay berth pier location The Offeror shall identify the pier intended to support the vessel in lay berth IAW WI 0003, and shall describe how it will provide all support services IAW WI 0011. Further, the Contractor shall acknowledge it understands that US Government crew members will be living onboard the vessel and that adequate fire protection, safety and security will be provided IAW WI 0016 and 0019.
Element 4.2 Heavy Weather Plan for Lay berth location The Offeror shall submit a Heavy Weather Plan IAW WI 0006 for the proposed lay berth pier. The heavy weather plan shall include a description of the protection arrangements available and the preventive measures that will be taken to ensure the safety of the ship from potential heavy weather conditions as required in WI 0006.
Element 4.3 Cold Weather Plan for Lay berth location The Offeror shall submit a Cold Weather Plan IAW WI 0007 for the proposed lay berth pier. The Cold Weather Plan shall include a description of the protection arrangements available and the preventive measures that will be taken to ensure the safety of the ship from potential cold weather conditions as required in WI 0007.
Element 4.4 Fire and Flooding Protection Plans for Lay berth location The Offeror shall submit a Fire and Flooding Protection Plan IAW WI 0016 for the proposed lay berth pier.
Technical Subfactor 5: Understanding the U.S. Navy Work Package
Element 5.1 Critical Path Analysis by Work Item.
The Offeror shall develop a Critical Path Analysis by WI. The analysis shall include the following:
a. Clearly identify the primary Critical Path at each point of the availability.
b. Include the sequencing of WIs and independent tasks which depend on the milestones listed below.
c. Demonstrate clear understanding of the required sequencing, conflicting tasks, subcontractor and technical representative scheduling, and regulatory body required inspections.
d. For Phase 1 ROH-DD and Phase 3 MTA. The Offeror shall submit an Integrated Production Schedule (IPS) in accordance with NAVSEA SI 009-111, that integrates all work specification in the solicitation.
Element 5.2 Force Protection Plan:
Provide a force protection plan. The force protection plan shall include a description of the barriers, patrols, controlled entry point and measures that are available as required in WI 0024.
Element 5.3 Electrician Certification.
The Offeror shall submit the certifications for the electricians they plan to utilize for all electrical repairs/installations/ripouts.
Element 5.4 Spaces Approach:
The Offeror shall provide the approach to meet WIs 992-11-001, WI 992-11-002, WI 992-11-002, WI992- 11-003, WI 992-21-001 and WI 992-21-003 during Phase 1 ROH and Phase 3 MTA for office space, food storage, and transportation requirements for the ship’s personnel while the vessel is within the contractor’s facility. Explain the organization and the controls in place to verify that the services are performed according to the WIs. Provide a narrative identifying the following:
i. Facilities, including the type of structure used for each dwelling unit, location, distance to the shipyard accommodations.
ii. Office Space, including location, distance to the Shipyard, outfitting of all office spaces (e.g. equipment) and the services associated with the specific spaces (e.g.
cleaning and janitorial services.)
iii. Telephone Services, including equipment and provider and ability to meet the optimal requirements.
Element 5.5: Water Certification The Offeror shall provide documentation for potable water WI 0011 paragraph 7.1.4 that drinking water is intended for human consumption.
The offeror shall describe the functional system requirements and demonstrate its capability to provide the vessel with continuous flow seawater cooling that meets or exceeds the requirements of WI 0011 for the vessel main propulsion diesel engine (MPDE) and ship’s service diesel Generator (SSDG) engine cooling.
This water shall meet the requirements in Reference 2.1.1 from WI 0011.
Volume LBP-2 LBP Past Performance Volume
The Offeror shall provide past performance information for no more than three (3) past performance references from previous contracts relating to ship repair work for Government and/or commercial businesses, which are recent (are ongoing or were completed within three (3) years from the issue date of this solicitation). If more than three (3) past performance references are submitted, the Government will only evaluated the first three references. If any references includes multiple contracts as a single reference, the Government will not evaluate the references submitted. The past performance references shall consist of same or similar scope, magnitude, and complexity as the work package included on Attachment J-2(a), Attachment J-2(b) and Attachment J-2(c) (Work Specification Package). The information must be clear as to whether the work by the Offeror was completed as a prime contractor or a subcontractor. Offerors shall not reference an Indefinite Delivery/Indefinite Quantity contract without referencing the appropriate task/delivery orders containing the effort similar in nature to this requirement. List the contracts in order of relevancy from the most relevant to the least relevant using the definition of “relevancy” in Section M of this solicitation. In general, recent performance will be considered more relevant than older performance. An Offeror who describes similar contracts and subcontracts shall provide a detailed explanation demonstrating the similarity of the contracts to the requirements of this RFP. Specifically, Offerors shall complete Attachment S-5 (Past Performance/CPARS Information Sheet). If CPARS data is not available for a contract, Offerors shall provide Attachment S-6 (Past Performance Questionnaire).
Offerors shall demonstrate within either Attachment S-5 (Past Performance/CPARS Information Sheet) or S-6 (Past Performance Questionnaire) that the referenced contracts are recent and relevant to the efforts required by this solicitation. Offerors shall also address unfavorable reports of past performance and their response, or lack thereof, which will be taken into consideration. An Offeror that does not have recent and relevant past performance to provide for consideration shall affirmatively state it “does not have recent and relevant past performance for the
Government to consider.” Offerors with no prior US Navy experience, should submit to their customers S-6 (Past Performance Questionnaire and request that the questionnaire is submitted prior to 16 December 2024 via email directly to Contract Specialist, Julian R. Thornton at Julian.R.Thornton.civ@us.navy.mil and Contracting Officer, Yarinee Tafur at Yarinee.Tafur.civ@us.navy.mil.
It is the Offeror’s responsibility to ensure its customer(s) complete and return Attachment S-6 (Past Performance Questionnaire) in accordance with these instructions. Any questionnaires received after the proposal due date/time may be considered late and may not be considered in the Offeror’s past performance evaluation. The Government, at its discretion, will determine whether or not questionnaires received after the proposal due date will be considered.
Questionnaire reviews submitted directly by the Offeror will be disregarded. Instead, the Government may, but is not required to, reach out to the customers identified in Attachment S-6 (Past Performance Questionnaire) directly for a review.

Volume LBP-3 LBP Price Volume
I. PRICING:
a. The Offeror shall submit pricing information on all CLINs in Section B, Supplies or Services, and Price Prices must be submitted in U.S. Dollars.
b. Prices must include any costs associated with all resources required to accomplish the entire requirement, including light dues, tariffs, any agent fee(s), and/or customs fee(s). The Contractor’s price submittal must include any surcharge and/or premium for work done during weekends and holidays.
II. WORK ITEMS (CATEGORY A/Base or B/Optional) – ESTIMATED QUANTITIES / SCOPE:
a. Any WI (Category A/Base or B/Optional) priced based on or with an estimated quantity/scope shall be balanced at the completion of the availability via a contract modification.
III. EXTENSION TO THE DELIVERY DATE:
a. Continuation of Services: In the event of an extension to the Delivery Date, the prices proposed for individual services within WI 0030 (Continuation Services) will apply to the duration of the extension. WI 0030 will be priced in a 3 lots of 10 days each in accordance with Section B and Attachment J-1(a), Attachment J-1(b), and Attachment J-1(c). In the event the extension is greater or lesser than the 30 days as outlined in WI 0030, the Contractor’s proposed rates for each of the applicable services will be utilized to determine the price of continuation services for the duration of the extension up to three (3) months after the Delivery Date reflected at Contract Award.
The price proposal shall be comprised of the following documentation:
1. Standard Form 33/Completed Solicitation: Signed SF-33 with blocks 12 – 18 completed by the Offeror. If amendments to the solicitation are issued each Standard Form 30 “Amendment of Solicitation/Modification to the Contract” shall be submitted signed with blocks 8 and 15 (a) through (c) completed by the Offeror.
2. RFP Section B “Supplies/Services and Price”: Each Offeror is required to submit pricing information on all
CLINs in Section B - Supplies/Services as described in Section B, Pricing. Prices shall be submitted in US Dollars.
3. Completed Attachment J-1 (Pricing Worksheet): The Offeror shall submit a completed Attachment J-1, including all TABs. If there is a discrepancy between the pricing submitted in Section B and Attachment J-1(a), Attachment J-1(b), and Attachment J-1(c), all Attachment J-1 shall govern. Attachment J-1 will be incorporated into the contract award. Attachment J-1(a), Attachment J-1(b), and Attachment J-1(c), pricing shall be submitted as follows:
a. J-1 Pricing Summary Tab: Offerors shall fill in all yellow shaded cells for each individual WI as well as the AGR Labor Rate and Subcontractor/Material Burden Percentage. For the WIs which have been grayed out, the Offeror shall insert pricing on the individual pricing tab associated with that WI.
b. WI 0011 (General Services) Tab: Pricing must be submitted for two (2) categories of services:
1. Unit Price based on Estimated Quantity – The Offeror must provide a unit price for each service identified.
2. Daily Price Inclusive of the Following Services – The Offeror must provide a daily price, inclusive of all services listed in WI 0011.
c. WI 0012 (Information Technology) Tab. The Offeror must provide a unit price for each service identified.
d. WI 0015 (Integrated Logistics) Tab:
1. Logistics Support Requirement – Offerors must provide one (1) all-inclusive total price for compliance as required by the WI.
2. Contractor’s Support for Receiving, Storing, Handling and Reporting GFM – A unit price must be provided for each category based on parcel weight. Each unit price shall include all costs, any customs fees, light dues, agent fees, transportation, and any other port tariffs to be paid in accordance with the local regulations, not covered under any other WI.
e. WI 0023 (Hazardous Waste) Tab:
1. The Offeror shall propose a percentage for management and handling fee on the NTE amount of
$100,000 for hazardous waste disposal (including any other costs associated, such as laboratory tests).
f. WI 0030 (Continuation of Services) Tab: includes Category B WIs, requiring an extension if the Delivery Date and/or Undocking Date is extended.
1. WI 0011 A & B, 0012, 0015, and 0023 must be priced in WI 0030 Tab.
g. Subcontractor List Tab: The Offeror shall provide subcontractor information for each WI, where applicable. The following information must be provided for each subcontractor’s value higher than $5,000 at the WI level:
1. Subcontractor’s Name;
2. Number of Hours proposed;
3. Hourly Labor Rate; and
4. Whether the subcontractor is an ‘OEM Authorized Source.’ (An ‘OEM Authorized Source’ refers to when the terms of the WI require the use of source either authorized or certified by the Original Equipment Manufacturer for a portion of the work.)
5. The Offeror must provide the same information if a specific subcontractor is proposed for more than one WI and the total amount of the subcontractor’s effort for all WIs is equal or higher than $10,000.
h. Material List Tab: The Offeror shall provide subcontractor information for each WI, where applicable.
The following information must be provided for each material value higher than $10,000 at the WI level:
1. Material Value;
2. Subcontractor’s Name (if applicable); and
3. Whether the subcontractor is an OEM Authorized Source.
4. Zero Dollar Pricing: For any WI with a total value of zero dollars proposed in Attachment J-1 (Pricing
Worksheet), the Offeror shall provide a written explanation as to why and acknowledge the Offeror will not be entitled to any pricing adjustments, should it ultimately be awarded the contract.
5. Completed Representations and Certifications: Located in Section K of this solicitation. The Offeror shall fill and include them with his/her offer. Signed Representations and Certifications available through the SAM database are an acceptable form of documentation, but written notification must be provided to the Contracting Officer.
6. System for Award Management (SAM) Registration: Per FAR 52.204-7, the contractor must have an active registration in the SAM in order to be awarded a contract by the US Government.
SECTION M - EVALUATION FACTORS FOR AWARD

EVALUATION FACTORS FOR AWARD
I.GENERAL
a. The Government intends to award a single Firm-Fixed-Price (FFP) contract to the Offeror whose proposal represent the Best Value to the Government, utilizing trade off source selection procedures in accordance with FAR 15.101-1 and Section M of this solicitation.
b. The Government intends to make an award on the basis of initial proposals without conducting discussions, but reserves the right to conduct discussions if determined by the Contracting Officer to be necessary.
Therefore, each initial proposal should contain the Offeror’s best terms from a Price and Technical.
c. The Government reserves the right to determine which proposals show the capability to meet the requirements of this solicitation. The Government reserves the right to eliminate from further consideration those proposals which are considered ‘unacceptable’ and not capable of being made ‘acceptable’ without major rewrite or revisions.
d. Offerors are advised that the Government will not evaluate any proposal information not contained within the body of the proposal for the Technical and Price Volumes. The Government reserves the right to consider any other sources of information reasonably available for evaluation of Past Performance.
e. If the Government receives proposals from multiple offerors and the Government believes any of the offerors are owned or controlled by the same company, the Government reserves the right to request additional information to determine the ownership and control of the offerors. The Government, in its sole discretion, will use this information and any other information available to the Government to determine if it will treat such proposals as individual proposals from the different offerors or alternative proposals from a single offeror.
II.BASIS OF AWARD
a. A contract will be awarded to the Offeror who is deemed responsible in accordance with FAR 9.104, whose proposal conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by Section L of this solicitation) and represents the Best Value to the Government in accordance with FAR 15.101-1 and the evaluation criteria.
b. "Best Value" means the expected outcome of an acquisition that, in the Government's estimation, provides the greatest overall benefit(s) in response to the requirement. The Offeror is advised that the Government reserves the right to make an award to other than the lowest priced offeror or to the offeror with the highest past performance confidence assessment, if the Government determines that to do so would result in the Best Value in accordance with FAR 15.101-1.
c. The Government will select the best overall proposal, based on an assessment of the following evaluation factors:
I. Factor 1: Technical Capability
II. Factor 2: Past Performance III. Factor 3: Price
d. The Government will evaluate Factor 1 (Technical Capability) on an Acceptable/Unacceptable basis.
However, if an Offeror is found to be ‘unacceptable’ for Factor 1, then the Government reserves the right not to conduct additional evaluation of that Offeror’s proposal. If an Offeror is found to be ‘acceptable’ for Factor 1, the Government will then perform a Trade Off evaluation between Past Performance (Factor 2) and Price (Factor 3). Past Performance is more important than Price. The importance of price as an evaluation factor will increase with the degree of equality of the proposals in relation to the evaluation results for the Past Performance factor. The Government will base its award decision on an assessment of proposals against all evaluation criteria in the solicitation.
III.EVALUATION METHODOLOGY
a. FACTOR 1: TECHNICAL CAPABILITY. The Government will evaluate the Offeror’s proposal to determine the Offeror’s understanding of, approach to, and ability to meet the solicitation requirements. The Government will assess the Offeror’s Technical proposal with respect to its compliance with the solicitation requirements and the risk associated with the Offeror’s approach. The Technical Capacity factor is comprised of five equally important technical factors. A rating of ‘unacceptable’ in any of the sub-factors will render the entire Technical Capability proposal factor ‘unacceptable’ and, therefore, ineligible for award. Technical Capability evaluation is comprised of the following five (5) sub-factors. Within sub-factors 1 to 5, there are multiple elements that their overall acceptability will be roll up to the subfactor.
Technical Subfactor 1: Understanding the Work Package: The Government will evaluate the Offeror’s understanding of the work based on the information required by Section L of the solicitation. The Government will evaluate the clarity and completeness of the information for the Offeror’s understanding of the work for the following elements:
i. Element 1.1: Time Phased Sequencing Network (TPSN – GANTT Chart)
ii. Element 1.2 Problem Areas
iii. Element 1.3 Engineering
iv. Element 1.4 Material Availability
v. Element 1.5 Material Control and Storage
vi. Element 1.6 Heavy Weather Plans
vii. Element 1.7 Cold Weather Plan
viii. Element 1.8 Fire and Flooding Protection Plans
Technical Subfactor 2: Ability to Perform the Statement of Work: The Government will evaluate the Offeror’s ability to perform the requisite work based on the information required by Section L of the solicitation for the following elements
i. Element 2.1 Man-hour Chart
ii. Element 2.2 Growth Absorption
iii. Element 2.3 Facilities
iv. Element 2.4 Berth, Approach, and Mooring
