JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command (NAVSEA), Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT), Code 02, Newport, RI.

2. Description of the Action Being Approved

Thellllllllllllllllllllllllllllllllllllllllllllllllllll portion of the anticipated indefinite delivery/indefinite quantity (ID/IQ) multiple-award contract (MAC), to be issued on a limited source basis to prime contractors authorized to perform work in accordance with NAVSEA Notice .... ,

3. Description of Supplies/Services

The NUWCDIVNPT Platform and Payload Integration Department, lllllllllllconducts and oversees programs involving research and development, concept development and testing, analysis and evaluation, modernization and improvements on current commissioned, as well as new, submarines and surface ship systems of the United States and foreign navies. is also responsible for designing and fabricating future prototype systems for submarines and surface ships.

Various programs are in critical stages of development, while others are being restructured to meet the current growth of the Navy's submarine force and the ever increasingly competitive environment. At the same time, the operational characteristics of the fleet systems are being modified, modernized, and

J&A Number: 18040.1 improved. The problems that arise from these programs demand expeditious means of satisfying them with a high quality level of effort. In addition, these programs often involve work within the oundary, requiring an added level of qualified administrative and technical controls to ensure conformance to technical specifications during maintenance and testing.

The contractor shall fabricate and receipt inspect hardware, and provide services to perform ship checks, develop concepts, conduct design activities, develop, test, perform controlled material handling, perform installation activities, perform removal activities on items, perform repairs and develop life cycle support plans for software and hardware which include cradles, stowage and handling equipment, and electronic control systems. The contractor shall develop Technical Data Packages (TDPs) in support of llllllllTemporary Modifications (TEMPMODs), Field Changes (FCs), Carry-On Hardware (COH), Temporary Alterations (TEMPALTs), and Ship Alterations (SHIPALTs).

Materiel solution sets sought by sponsors for demonstration and fielding will be defined as a function of capability gaps identified and emerging technology maturity. This procurement includes hardware, software, and services. The services required are defined in the statement of work and are consistent with those executed throughout the scope of concept exploration, prototype design and development process, and low rate production including:

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304 (c) (1), the property or services needed by the agency are available only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency.

5. Rationale Justifying Use of Cited Statutory Authority

Only contractors listed on the NAVSEA Note are qualified to perform ork, as they have been vetted and approved through the NAVSEA approval process. As such, there are a limited number of sources qualified to perform the required 11111111 work. The several contractors listed on the NAVSEA Notice are considered capable of meeting the requirements of this acquisition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Enclosure (3) of the NAVSEA Notice states, "The activities listed ... are the only qualified activities authorized to perform

. work." As a result, the contractors listed in the NAVSEA Notice Enclosure (3) will be solicited to provide the NUWCDIVNPT required hardware and services.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will make a determination of fair and reasonable pricing at the delivery or task order level, at which time proposals will be evaluated in accordance with Federal Acquisition Regulation (FAR) 15.404-1.

8. Actions to Remove Barriers to Competition

Additional activities are in the process of gaining NAVSEA Notice approval to perform work. This MAC will provide on-ramp potential for newly approved NAVSEA Notice companies. Adding additional contractors authorized to perform
