About this file
This document is a Justification and Approval (J&A) for Use of Other Than Full and Open Competition, issued by the Naval Facilities Engineering Systems Command (NAVFACSYSCOM) Atlantic. The J&A seeks to procure HSQ remote terminal units (RTU) for control and integration of industrial control systems for the Dry Dock 3 Modernization project at Norfolk Naval Shipyard, with a total value under $1 million. The procurement is being pursued under 10 U.S.C. 3204(a)(1), which allows sole-source procurement when only one responsible source can satisfy agency requirements.
Market research was conducted via a SAM website synopsis on February 27, 2025, which elicited only one response from Arayna Technologies. Their proposal to replace the entire SCADA system was deemed out of project scope, and they were not a certified distributor or installer of HSQ Technologies. The contracting officer determined that no additional market research was practicable, as HSQ Technologies remains the only viable source for the specific hardware and integration services needed. NAVFACSYSCOM Atlantic has no immediate plans to compete future contracts for these supplies/services but will reassess if another potential source emerges.

DEPARTMENT OF THE NAVY
NAVAL FACILITIES ENGINEERING SYSTEMS COMMAND, ATLANTIC
6506 HAMPTON BLVD
NORFOLK VA 23508-1278
IN REPLY REFER TO:
J&A No. 25-03
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Facilities Engineering Systems Command (NAVFACSYSCOM), Atlantic.
2. Description of the Action Being Approved.
Request utilizing brand name and exclusive licensing agreements for the procurement of Supervisory Control and Data Acquisition (SCADA) products under solicitation N62470-24-R- 0062 MILCON P1062 DBB, Dry Dock 3 Modernization.
3. Description of Supplies/Services.
Provide HSQ remote terminal units (RTU) for control and integration of the industrial control systems to be procured under the above solicitation.
The equipment and services to be rendered are valued less than $1M.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The proposed action was synopsized on the SAM website on February 27, 2025 and only one corporation expressed an interest in this requirement; Arayna Technologies. Reviewing the response to the sources sought, Arayna Technologies is proposing to replace the entire SCADA system with a vendor specific solution they are a distributor for; Ignition by Inductive Automation and VTScada by Trihedra. Replacing the entire SCADA system in lieu of procuring HSQ hardware is not in the project scope. Lastly, while Arayna Technologies indicated they can perform the labor required for SCADA integration and system support, they did not indicate they could provide the necessary vendor specific hardware required for SCADA integration and they are not a certified distribution or installer of HSQ Technologies. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than HSQ to provide the required supplies and services.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVFACSYSCOM Atlantic has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, an assessment to determine whether competition for future requirements is feasible will be completed.
