About this file
This is a Bid Price Schedule for a Design-Bid-Build construction project for a Weapons Magazine facility at Naval Submarine Base, New London, Connecticut. The contract encompasses demolition of 18 existing arch-type magazines built between 1968-1974, and construction of replacement magazine facilities including six containerized long weapons storage (CLWS) magazines, two Type G magazines, one Type H magazine, an Ordnance Operations Building, a Sentry Building, associated cranes, site work, and incidental related work. The base price (Line Item 0001) is subdivided into component line items: Ordnance Operations Building (0001A), Sentry Building (0001B), CLWS magazines (0001C, quantity 6), Type G magazines (0001D, quantity 2), Type H magazine (0001E), general site work (0001F), mass rock excavation (0001G, estimated 10 cubic yards), and trench rock excavation (0001H, estimated 10 cubic yards). Unit prices for rock excavation assume non-rippable material and include surveying, handling, crushing, processing, and reuse. Rock excavation volumes will be calculated based on field surveys on a maximum 5-foot grid pattern with payment limited to planned excavation limits.
The schedule includes eight optional line items available for exercise within 365 days of contract award: demolition of Building 524 (0002), reinforced EPDM membrane installation over earth-covered magazines (0003), Electronic Security System equipment and installation (0004), Audio Visual System equipment with a government estimate of $176,688 plus contractor's Handling and Administration Rate not to exceed five percent (0005), Certified Technology Specialist services (0006), Furniture, Fixtures, and Equipment with a government estimate of $969,362 plus HAR up to five percent (0007), PFAS laboratory analysis and disposal for groundwater dewatering at 93,600 gallons (0008), and work shutdown compensation at estimated 64 hours (0009). Award will be evaluated on total proposed price for all line items combining base and option costs. Failure to enter prices for any line item will result in proposal rejection. For unit-priced items marked with asterisks, FAR 52.211-18 variations apply, allowing equitable adjustment if actual quantities vary more than 15 percent from estimates. The government reserves the right to reject materially unbalanced offers and requires 100 percent performance bonding reflecting aggregate amounts of all items if options are exercised.

GENERAL BID NOTES
a. Award will be evaluated on the total proposed price for Line Items 0001-0009; Base Bid Price and the sum of all options.
b. The Government reserves the unilateral right to award Line Items 0002, 0003, 0008 and 0009 to the Contractor at the proposed price within 365 calendar days after the contract award and in accordance with all bid notes. No provision is made for economic price adjustment.
c. Quantities on the bid schedule that are followed by an asterisk (*) are estimated quantities and FAR 52.211- 18, Variations in Estimated Quantity shall apply to these Line Items. In accordance with FAR 52.211-18;
If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.
d. Evaluation of Options (JUL 1990). Except when it is determined in accordance with FAR 17.206 (b) not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the price for the Option(s), Line Items 0002-0009 to the total price for the Base Bid, Line Item 0001.
Evaluation of options will not obligate the Government to exercise the Option(s). (FAR 52.217-5).
e. In accordance with FAR 52.217-7; Option for Increased Quantity-Separately Priced Line Item (Mar 1989), the Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.
Government activities where the Contractor is unable to shift manpower and equipment to other Contract work. The Contractor shall notify the Contracting Officer immediately of a pending shutdown if directed by any other Government official so that the Contracting Officer has the opportunity to avoid or mitigate the down time, complete in accordance with the drawings and specifications, but excluding work provided in another Priced line item.
TOTAL AMOUNT FOR LINE ITEMS 0001-0009: $__________
f. The Government may reject an offer as non-responsive if it is materially unbalanced as to prices for the basic requirement and the option quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.
g. Failure to enter a price for any Line Item will result in a proposal being rejected.
h. For bid items where unit prices are indicated as required, bidders shall enter unit prices and extended totals in spaces provided. If there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid and the total recomputed accordingly. If an Offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.
i. If Line Items 0002-0009 are exercised, additional bonding and consent of surety is required. Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all items.
BID NOTES FOR AV AND FF&E (LINE ITEMS 0005, 0006 AND 0007)
a. The estimated amounts for AV and FF&E have been supplied by the Government, to provide Offerors with the projected magnitude of effort. The estimated amounts include the actual cost of the AV and FF&E including freight and installation charges. The Government AV and FF&E Estimates are only an estimated amount.
b. If awarded, line items will be funded separately after completion of AV and FF&E design package reviews by the Government, and receipt of appropriate funding by the Government. Requirements and details are provided in 01 30 02.00 22 for AV and 12 00 01.00 20 for FF&E.
c. Bonding
1. Bonding is not required for the design, procurement and installation of AV and FF&E equipment at time of Construction Contract Award.
FAR 28.102-1(a) requires that performance and payment bonds be included in all construction contracts exceeding the SAT, except under the conditions listed. Since the AV and FF&E Option Items are not part of the original contract award, the Construction Contractor must not be required to secure bonds for the AV and FF&E at the time the basic contract is awarded.
2. Additional Bond at AV and FF&E Option Items Award
FAR 28.102-2(d) requires the Government to secure additional bond from the Construction Contractor for any contract price increases. Therefore, an increase to the original contract bond is required at the time of the AV and FF&E Option Items award, to protect the Government against the Construction Contractor not providing AV and FF&E ordered and to ensure that the AV and FF&E vendors receive payment if the Construction Contractor goes out of business. The increased cost of the bond must come from the AV and FF&E funding sources and is not a part of the Construction Contractor’s HAR.
3. Bonds Required by the Construction Contractor
If the Construction Contractor requires bonding from the AV and FF&E subcontractor(s), the cost must be covered in the Construction Contractor’s HAR.
d. Offerors may propose a Handling and Administration Rate (HAR) for AV and FF&E not to exceed 5 percent. This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of AV and FF&E. The proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the AV and FF&E. The proposed HAR is a fixed rate.
e. The Government is not obligated to award the Option line items. Should the Government choose to award the AV and FF&E, the line items will be awarded as a negotiated option to the contract/task order. The Contractor's proposed HAR will be applied to all vendor/supplier costs for the AV and FF&E.
f. If awarded, the ESS, FF&E and AV modification will be awarded at least six months prior to the contract completion date. A minimum of six months is required for the Contractor to purchase, deliver and install the ESS, FF&E and AV without impacting the overall completion date of the project. The Contractor's schedule must assume the award of the ESS, FF&E and AV as an option. No schedule extensions will be granted if the option is awarded at least six months prior to the contract completion date. If the Government decides to negotiate and award the furniture modification with less than six months prior to the contact completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor demonstrates that an accepted Final ESS, FF&E and AV packages were submitted within the approved schedule deadlines and sufficient lead time for the ESS, FF&E and AV is not available and the Government's award of the option is in the last six months of the contract.
