About this file
This memorandum from a Naval Facilities Engineering Command regional forester discusses the removal of marketable standing timber as part of the Repair Taxiway Pavements project at Naval Air Station Oceana in Virginia Beach, Virginia. The memorandum determines the fair market value of the timber to be cleared is $5,215 based on current stumpage prices and local market research. It recommends incorporating language into the construction contract requiring the contractor to pay this amount to the Government for the value of the standing timber within the clearing limits, with payment due no less than five days before land clearing begins. Once received, the payment would be deposited into the Navy's Forestry Program account.

Memorandum
From: Bryan Alexander, NAVFAC Midlant Regional Forester, Naval Station Norfolk EV22 To: Doug Shultz, Natural Resources Manager Via: ENV. Planning and Conservation EV22
Subj: Timber removal for Taxiway Repair project at NASO in Virginia Beach, Virginia.
Encl: (1) Standing Timber Appraisal
1. It has been brought to my attention that there is marketable standing timber to be cleared for the taxiway repair project at NASO in Virginia Beach, VA. Based on current stumpage prices and local South Eastern Virginia market research, I determined that the timber to be removed has a fair market value of $5,215.00. The fair market value is subject to change should the footprint of the limit of clearing/disturbance also change.
2. DoDINST 4715.3, DoDINST 7310.5, and OPNAVINST 5090.1E require that forest products shall not be given away, carelessly destroyed, or used to offset contract costs, but rather sold at their fair market value and the proceeds credited to the Navy’s Forestry Program account. The basis for this procedure is the fact that standing timber is considered real property, and real property must be disposed of at its fair market value.
3. To comply with real property regulations, I recommend that the contract incorporate language whereby the
Contractor is required to pay the Government for the value of the standing timber within the limit of clearing/disturbance. NAVFAC P-73, Vol. 2, requires that construction contracts with marketable standing timber contain the following clause:
• Salable Timber – All timber removed from the project site shall become the property of the Contractor. The
Contractor shall reimburse the Government for the value of the timber. The Contractor shall submit payment to the Contracting Officer by cashier’s or certified check in the amount of $5,215.00 made payable to the U.S.
Treasury. Payment shall be made no less than five (5) days prior to the start of land clearing operations.
1. Once the Contracting Officer receives the check, it should be forwarded to my office for deposit into the Navy’s Forestry Program account.
2. If you have any questions concerning this matter, please contact Bryan Alexander, NAVFAC Midlant Regional
Forester at 757-341-1656.
