REVISE Phasing Plan – Phase 1 Duration to “DURATION: CONTRACT AWARD TO DECEMBER 23, 2022”.
REVISE Phase 1 Note 1:
1. During this phase all work elements are available to be performed. All work on berth 6A and 6B within Milestone 1 limits shall be complete NLT December 23, 2022. Perform work elements within milestone 2 limits to the maximum extent possible in order to limit outages and interruptions to berth 6A and 6B after December 23, 2022, prioritizing work on substation 6 electrical expansion and associated power distribution pathways supporting Milestone 1 completion.
ADD Phase 1 Note 6:
6. Installation, testing, and commissioning of VFI switches #1 and #2, and 3-In-1 Voltage Regulators #1 and #2 are to be completed in Phase 3. Refer to G-106. Associated cable and incidental scope items shall be completed in phase 1 to allow for final connection of the specific components listed above during Phase 3.

Contract Plan Sheet G- 103 Note 2 states, “Electrical distribution components are expected to have significant lead times.
Coordinate expedited submission of products post award in an effort to maintain milestone deadlines.” Milestone 1 has a completion date of 12/2/2022 and includes commissioning the new Substation Yard.
We have reached out to multiple vendors of the components in the Substation and are getting lead times of over 60 weeks after approved submittals.
This would put delivery out passed the contract completion date and well passed Milestone 1. Even with expedited submittals this will not be completed within the milestone date.
Please extend Milestone 1 date.

Manfucturers of electrical equipment and other specialty materials have stated the lead times for the materials are too long to make the Phase 1 date achievable.
Please consider extending the milestone 1 date to 3/23/2023 in order to meet the Phase 1 requirements.

Bid Schedule 00 41 00
Reduction of the Period of Performance to 365 calendar days does not allow adequate time to procure materials and build the project. Due to the reduction in Period of Performance duration, Bidder will not be re-submitting our proposal for this project. Please consider increasing the Period of Performance up to a minimum of 18 months or 548 days.
The original submission Period of Performance was 486 days, which was appropriate at the time, however, lead times, supply chain issues, scarce labor availability and a glut of available work have

Amendment become insurmountable challenges in todays current market.
SECTION 00 10 00 - SOLICITATION
The contractor period of performance end date has increased by 223 days from 365 days to 588 days.
SECTION 00 70 00 - CONDITIONS OF THE CONTRACT
The following have been modified:
52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 15 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 588 days from award. The time stated should include final cleanup of the premises.

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amounts listed below for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
