About this file

This Request for Proposal solicits construction services for flood protection improvements at Norfolk Naval Shipyard. The scope of work includes constructing a permanent cast-in-place concrete flood wall, modifying existing dry dock caisson gunwales and constructing caisson seat extensions. The solicitation is structured as a request for both price and non-price proposals, with the latter including evaluation of experience, safety, past performance, and small business participation factors. Offerors must submit proposals by June 16, 2020. The award will be a firm fixed-price contract. Liquidated damages are assigned to various construction phases, ranging from $2,800 to $75,000 per calendar day of delay. The Navy seeks a 20% small business participation rate across 12 separate construction phases scheduled through mid-2023. Evaluation will consider corporate experience on relevant projects over $15 million in the past 15 years or currently 75% complete.

Reference Question Response

Page Section Paragraph

1 Page 37-38 of 54

Solicitation Based on tight scheduling time frames for each phase and high liquidated damages for the work phases included in the contract documents,(5 of 12 at $75,000/calendar day) the financial risk associated with this project is high. For example, a project of this size takes at least a minimum of 2-3 months for adminstrative & safety related submittals prior to starting construction due to the required 20 working days for Government review/approval allowed in the specifications. Similar to all projects bid this time of the year, the project will be awarded at the end of September. If the contractor is unable to start the project until the end of the 2020 calendar year on the first phase of work, we will be limited to only 3-4 months out of the alloted 6 months to execute the first phase of work. In addition, this does not account for any potential delay of:

long lead procurement items (flood gates), weather days, and government holidays. Additionally, a delay in the first phase of work affects all subsequent phases.

Please re-evaluate and provide your detailed schedule for each phase of work because at this time, it is uncertain any phase can be properly accomplished within the specified time frames. In addition, please reconsider the current use of specific timelines for all 12 phases and eliminating liquidated damages for each specific phase.

UPDATED REPONSE: See revisions to the Milestones and Liquidated values. Dates are planned to work around Dry Dock and Berth Projects, as well as other construction projects within NNSY.

If the contractor needs to plan to work 2 or 3 shifts, or weekends during the begining of the project, or any phases to complete the dates, it's their responsbility. The intent of the early start is to incentavise the contractor to start work as soon as possible. LD's have been removed from Phase 1, but time period and LD's remain for Phase 2.

2 Page 37-38 of 54

Solicitation Please consider allowing the contractor to work in multiple areas at once. This gives the contractor (and their respective subcontractors) the flexibility to share resources between the different phases and does not limit them to single areas. Any flexibility that can be provided will lower the bid price and the overall project becomes more manageable.

We suggest: Eliminating the phased liquidated damages and have definitive timelines for the work around the dry docks/waterfront but allow the other phases to be fill in work with no definitive time lines.

See revisions to the Milestones and Liquidated values. The phasing is planned around Dry Dock and Berth Projects, as well as other construction projects within NNSY.

The phasing is also spaced out to minimize the contractor work areas to become excessive and impact NNSY activities.

3 Page 37-38 of 54

Solicitation Due to the inherent risk associated with this project's phase work approach, and the tight timelines and substantial liquidated damages associated with 5 of 12 of them, we request 3 additional weeks to prepare our proposals and bidding package.

Please see Amendment 0002.

4 Page 37-38 of 54

Solicitation Why are the liquidated damages for Phases 4-8 $75,000 per calendar day delay? This seems high. As you know, the liquidated damaged values should be reflective of the actual potential damages the Navy could incur due to this delay. In accordance with published Naval Facilities Acquistion Standards (NFAS), has this analysis been accomplished and approved by the Echelon II/IV Chief of the Contracting Office (CCO)?

See revisions to the Milestones and Liquidated values. These are estimated cost in damages to the NAVY, if the work is not completed by those dates.

5 Page 8 of

Solicitation Due to the rare occurrence of $20M construction contracts related to this type of work in the past 10 years, since this overall solicitation has 12 separate smaller phases, (in an effort to promote more qualified competition), please consider reducing the relevant construction projects to a minimum of $15M or greater construction costs within the past 15 years.

Please see Amendment 0002.

6 Page 1 of

Solicitation Due to the tight timelines for the phases work and and substantial liquidated damages, please consider reducing the bid acceptance period of 120 days to 60 days.

Bid acceptance period remains unchanged.

7 Is it possible for the caissons to be taken out of Norfolk Naval Shipyard, to an off site facility, to be repaired in accordance with the design documents?

UPDATED RESPONSE: See revisions to the Milestones and Liquidated values. There are two time slots for Phase 6. From 3APR21 to 3OCT21 the contractor can remove the Caisson #3 to an offsite location to be worked on.

The contractor needs to complete the wing walls and flood wall work from STA 9+05 to STA 10+95 by 3OCT21. Caisson #3 needs to be installed for government inspection by 16SEP21. Any remaining work on only the flood wall can be completed in the second window of time 19JUL22 to 28NOV22.

8 14 of 54 4 4.1 Is this site visit mandatory for all bidding contractors to attend?

The site visit is not mandatory.

However, this will be the only government sponsored site visit for this project.

9 14 of 54 4 4.1 Does the site visit include walking into Controlled Industrial Area’s that we will need to request access via CVS-CIA spreadsheet? Or is Controlled Access something we DO NOT need to request for this site visit?

The site visit includes walking into the Controlled Industrial Area. The request is needed for CIA access.

10 SWBS- 37 622 d.1 This section includes, but is not limited to NEW fiberglass reinforced plastic (FRP) grating, and its framing for ballast tank sump grating, stair landings and catwalks. Is it the intention to replace ?

Please see Amendment 0002.

Schedule in RFP governs. Drawing revision forthcoming.

16 37 52.211-11 (b) Phasing schedule allows for early completion of Phases 1,2,3,9,10,11 & 12 and early start of subsequent phases. Please confirm that the acceptance date of subsequent Phases stays the same.

Yes, acceptance date of subsequent phases stays the same.

17 Solicitation

3.3 In section 3.3, (1) Factor 1, Experience, it states “Projects submitted for the offeror shall be completed within the past ten (10) years from the date of issuance of this RFP.” Due to the limited amount of similar types of projects completed in the past ten (10) years, will the Government consider changing this requirement to the following language to increase the breadth of submitted project experience:

“Projects submitted for the offeror shall meet one of the following requirements in relationship to recent experience

1. Completed project within in the past ten (10) years from the date of issuance of the RFP or;

2. Current project under construction that shall be at least 75% complete by the date of issuance of the RFP.”

Please see Amendment 0002.

18 Drawing G-106

Drawing G-106 Phase 6 notes to base bids for ongoing submarine repairs in Drydock 3 starting in September 2022. The liquidated damages schedule notes that Phase 6 starts on July 19, 2022. This only leaves less than 6 weeks complete caisson rework and other associated work.

This timeframe is not feasible. Please revise the timeframes to provide adequate time to complete this work

There is a separate window for the upgrade of caisson #3 and raising the wing walls at DD3 caisson seat.

(3 April 2021 - 3 October 2021) The intent of phase 6 is to build and tie-in new flood wall to newly raised wing walls at caisson seat.

The two phases should allow enough time to finish all caisson, caisson wing wall and new flood wall work without impacting ship avaliability work in DD3.

19 8 of 54 Solicitation Factor 1, Experience

1. The Solicitation Submittal Requirement for Factor 1 Experience requires that projects submitted for the offeror shall be completed within the past (10) years from the date of issuance of this RFP. Please consider changing the requirement to the project shall be completed within the past (20) years.

Please see Amendment 0002.

20 Due to detailed sequencing requirements within each phase (utility relocations, cutoff wall installation, flood wall installation), please remove the 240’ work restriction within each phase. This restriction increases the number of mobilizations for multiple specialty subs – i.e. utility crew, cutoff wall crew, concrete crews, etc. With this restriction, crew mobilizations will be upwards of 30 mobilizations, increasing the cost, and making the schedule virtually impossible to meet.

See revisions to the Milestones and Liquidated values. The 240 LF Construction Work Area Limit was emphasized to help the contractor manage safety requirements, and damage to subgrade. Per the specifications the contractor is responsible for these items. The government has removed this requirement. If the contractor does not demonstrate good practices, non-compliances are written, then they will be at risk for the requirement to be enforced. It is acceptable for the contractor to pave and pavement mark the project in one mobilization, as long as it is compelted before the milestone date.

21 33 00700 Can NAVFAC provide any clarity how they will address the contract execution of this project relative to the current COVID-19 outbreak in relationship to Guidelines and Orders that currently exist at the shipyard or potentially be modified due to this ongoing unprecedented event;

particularly working within tight and restricted barricaded areas? Is NAVFAC considering to adjust any current contract language during this pandemic relative schedule and/or cost relief?

Response forthcoming.

22 37 52.211-11 (b) Phase 1 duration in Amendment 0001 was lengthened to 235 calendar days and the duration for Phase 2 was shortened to 57 calendar days. Please confirm this is the intent and that the Government requires Phase 2 to be completed within this time frame at a rate 10.70 lf per calendar day while all other phases are required to be performed at an average rate of 3.83 lf per calendar day . This duration doesn’t seem reasonable or consistent when compared to the other durations

Please see Amendment 0002.

on the project.

23 37 52.211-11 (b) The phasing schedule shows Phase 10 ending at station 31+15 and plan sheet G-111 shows 32+15. Please confirm which is correct.

31+25 is correct. See revisions to the Milestones and Liquidated values. Drawing revision forthcoming.

24 37 52.211-11 (b) The phasing schedule shows Phase 1 ending at station 47+10 and Phase starting at 46+50. Please confirm which is correct.

See revisions to the Milestones and Liquidated values. 47+10 is correct.

Phase 1 also includes Area 114 STA 10+00 to 12+61

25 37 52.211-11 (b) The phasing schedule shows Phase 8 ending at station 21+20 and Phase 9 starting at 21+00. Please confirm which is correct.

21+20 is correct.

26 Can the Navy furnish a detailed construction schedule per phase?

This could be beneficial to help estimate the project. There remains a scheduling concern regarding the tight timlines to perform some of these phases of work with the multitude of government approved submittals and outages that will be required for this project that are required to allow the government at least 20 working days for review of submittals and at least 28 days for processing utility outages.

The work has been planned around the requirements of NNSY. The governemnt recommends applying for outages, surveying existing conditions and other items well in advance of the Div 1 timelines.

27 SWBS It is our understanding that Dry Dock #3 will have a boat in it (as a part of Phase 6) when the caisson is supposed to be removed, taken off-site, and repaired. Please confirm the schedule when Caisson #3 is required to be repaired off-site.

See revisions to the Milestones and Liquidated values. There are two time slots for Phase 6. From 3APR21 to 3OCT21 the contractor can remove the Caisson #3 to an offsite location be worked on. The contractor needs to complete the wing walls and flood wall work from STA 9+05 to STA 10+95 by 3OCT21. Caisson #3 needs to be installed for government inspection by 16SEP21. Any remaining work on only the flood wall can can be completed in the second window of time 19JUL22 to 28NOV22.

28 34 Solicitation 52.228-5 FAR 52.228-5 is included in this solicitation, but there are no insurance requirements or minimum limits listed. Please clarify the Minimum Insurance Requirements for this project.

Refer to spec section 01 30 00.00 22, Part 1, 1.4 Minimum Insurance Requirements.

29 14/54 4.1 1 Are photos available of the work area for those estimators that are not able to travel due to government restrictions in place brought on by the Novel Coronavirus?

We have a limited number of pictures that have been approved for publication. However, the pictures are outdated and shall not be used. Recommend bidders use Google Earth to zoom in and view the site.

30 16/54 4.2.3 1 Due to the local and regional travel restrictions as well as health and safety measures how is the contractor to submit their bid?

Response forthcoming.

31 16/54 4.2.3 1 May the contractor submit their bids electronically, similarly to the bids that were received for the recent bid at Camp Lejeune?

Response forthcoming.

32 16/54 4.2.3 1 If electronic bid is not allowed, may contractor allowed to meet a NAVFAC representative outside the secured perimeter to submit the bid, Similar to the Dry Dock 4 Bid?

Response forthcoming.

33 1 01 11 00 1.2.1.i Line 1.2.1.i notes "Remove terracotta duct banks and provide with split casing conduit and concrete encasement." Split casing conduit is normally used when existing wires must not be maintained rather than removed and replaced. If this will require the existing ductbanks will have to be removed by hand demolition in small pieces rather than larger sections. Can the existing wiring be removed and replaced?

Refer to the manhole survey (Appendix F1) for the labeling of wires. In most cases, the conductors are not specifically identified. It will be extremely difficult for anyone in the Government to identify all conductors (power and/or comm);

therefore the wires will be protected by the split casings and the duct will be encased in concrete. No wires will be removed/replaced.

34 1 01 11 00 1.2.1.i Please confirm the existing duct banks are not to be considered a contaminated or hazardous material.

With the duct bank being required to be demolished by hand will all the contaminated and hazardous requirements for removal be required such as the use of a licensed contractor performing that work, tenting the work and all the appropriate personal protective equipment?

The existing ductbanks are either vitreous clay ducts or fibrous ducts;

both encased in concrete. The fibrous material is not a hazardous material and is a non-conductive fiber (wood) mixed with coal tar.

The duct bank can be demolished without special requirements.

35 1 01 11 00 1.2.1.i The hand demotion and special handling of the duct banks will have a major impact on the schedule in each phase, please allow the duct bank work to be completed prior Phase work beginning.

special handling is not required.

36 6 32 17 23 3.2 Within this paragraph it notes to "Allow new pavement surfaces to cure for a period of not less than 21 days before application of (pavement) marking materials.

Please confirm the completion of the final striping in each Phase does not have to be done by the Acceptance Date and is not subject to the noted Liquidated Damages.

Contractor should plan to use Thermoplastic. Thermoplastic is to be required for all traffic markings.

Thermoplastic Alkyd pavement markings may be applied directly after paving operations provided all other conditions in specification section 32 17 23 paragraph 3.2 are met.

37 7 32 10 00.00

3.2.7 Within this paragraph it notes to

"Allow bituminous pavement to cure for at least 21 days before paint is applied." Please confirm the completion of the final striping in each Phase does not have to be done by the Acceptance Date and is not subject to the noted Liquidated Damages.

Contractor should plan to use Thermoplastic. Thermoplastic is to be required for all traffic markings.

Thermoplastic Alkyd pavement markings may be applied directly after paving operations provided all other conditions in specification section 32 17 23 paragraph 3.2 are met.

38 1 Solicitation Block 13 A Additional time is requested due to the strict schedule requirements, high liquidated damages and technical planning required to prepare this bid.

It would be in the best interest of the government to all this extra time for bidders to prepare a thorough bid.

We request an additional two weeks to prepare our proposal.

Please see Amendment 0002.

39 SF-30 Block 14 Continuatio n

Per amendment 0001, first PPI response, it is allowed for phase 1 and phase 2 to “overlap”. Is it the government's intent to allow phase 1 and phase 2 to run concurrently and maintain each phase respective completion date milestone? if so, will there be a duration constraint on phase 2, as currently the phase constraint is 57 days. Also, should the phase 1 'Phasing-Comment' language be revised to address the allowable "overlap" work. Please clarify.

40 37 52.211-11 (b) Prospective bidder is extremely concerned with the significant Liquidated Damages contained in section 52.211-12 assigned to the various phases of this project. The damages assigned to phase 4 through 7, appear to be unprecedented when considering the potential compounding and stacking effect (Compounded LD’s could be as high as $11,250,000.00 per month just for Phases 4 through 8) of large LD’s for this project size, scope and aggressive interim phasing durations.

Following are some key challenges that further shift significant schedule risk to the prime contractor which amplify the concern even further:

1. Impacts arising from the Coronavirus, especially the supply chain impacts that have impacted the industry thus far along with the social distancing requirement that present themselves in the confined small interim work phases inherent to this project.

2. Modifications of ship work required to Dry Dock Caissons 1 and 3, has raised some significant concerns from Shipyards citing that the short interim phase durations where caisson work occurs present significant challenges to shipyard availability and operations coupled with large LD’s that shipyards will not support. These conditions present concerning schedule issues and a significant transfer of risk to prospective prime bidders who rely on the shipyards availability and acceptance of prime contract flow down terms since the prime contractors have no way to remedy these delays.

3. The completion of site investigations, shop drawings and submittals for this project is significantly impacted by the inherent phasing plan which affects the prospective bidder’s ability to perform investigations and submittals early in the project for all phases, and effectively reduces the working time in each phase.

Prospective bidder requests

Liquidated Damages have been revised due to changed conditions at NNSY. Item 1 Response:

Understood, but this contract makes it the responsibility of the contractor to work thru those challenges. Item 2 Response: See revisions ot the Milestones and Liquidated values. Item 3 Response: Investigation work, exisiting conditions documentation will be allowed to take place in advance of the actual phased work to advance the work successfully.

See revisions to the Milestones and Liquidated values.

NAVFAC consider the following to allow to mitigate significant risk transfer to prospective bidder:

A. Reduce the significant LD’s in the interim phases 4 through 8.

B. Allow bidders to work in select multiple locations at once with access and coordination provisions for shipyard operations and other contracts.

C. Consider allowing some of the shipwork modifications to caissons in place which may support longer overall durations.

41 37 52.211-11 (b) Can NAVFAC provide more clarity/definition to the phase '240 Linear Foot Construction Work Area Limit' when working within a phase?

Does this mean that all construction must be fully complete for any 240' section within any given phase? Or is the intent not to have, say, an open trench greater than 240' for any given phase?

See revisions to the Milestones and Liquidated values. The 240 LF Construction Work Area Limit was emphasized to help the contractor manage safety requirements, and damage to subgrade. Per the specifications the contractor is responsible for these items. The government has removed this requirement. If the contractor does not demonstrate good practices, non-compliances are written, then they will be at risk for the requirement to be enforced. It is acceptable for the contractor to pave and pavement mark the project in one mobilization, as long as it is compelted before the milestone date.

1.1.3 NAICS Code: 237990 and the Size Standard is $39,500,000.

1.1.4 This solicitation is formatted as a Request for Proposal according to FAR Part 15. This method permits evaluation of proposals based on price competition, technical merit and other factors; permits impartial and comprehensive evaluation of offerors' proposals; permits discussions if necessary; and ensures selection of the source whose performance provides the best value to the Government.

1.1.5 Contractor Performance Information: Contractor’s performance will be evaluated using the respective contractor performance evaluation report entry system located on the website http://www.cpars.gov/. Prior to commencement of work, the contractor is required to provide the government with the name, phone number and email address of the “Contractor’s Representative” that will be responsible for receipt and review of draft performance evaluations prepared by the government in the appropriated system. It is the contractor’s responsibility to keep this contract information current.

1.2 GENERAL OVERVIEW OF CONTRACT

1.2.1 This acquisition will result in the award of a Firm Fixed Price (FFP) contract for construction services.

1.2.2 This design-bid-build project includes but is not limited to constructing a permanent flood wall to protect Dry Docks 1, 2, 3, and 4, associated facilities, infrastructure and equipment from flooding from the Elizabeth River.

Flood wall shall be cast-in-place reinforced concrete wall on shallow foundation and it shall be supported on soil treated with subsurface grout injection. The project will modify existing Dry Docks 1 and 3 caisson gunwales, construct caisson seat extensions for Dry Docks 1, 2, and 3, and remove existing capstans and construct removable capstans on new foundations.

It is the offeror’s responsibility to check beta.SAM.gov periodically to see if additional postings have been made.

2: BASIS OF AWARD

2.1 The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the proposal determined to represent the best value—the proposal most advantageous to the Government, price and other factors considered.

2.2 As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

2.3 The tradeoff process is selected as appropriate for this acquisition. The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced offeror or other than the highest technically rated offeror.

2.4 As stated in the solicitation, all technical factors are of equal importance to each other and, when combined, are of equal importance to the performance confidence assessment (past performance) rating; and all technical factors and the performance confidence assessment (past performance) rating, when combined are approximately equal to price.

2.5 Any proposal found to have a deficiency in meeting the stated solicitation requirements or performance objectives will be considered ineligible for award, unless the deficiency is corrected through discussions. Proposals may be found to have either a significant weakness or multiple weaknesses that impact either the individual factor rating or the overall rating for the proposal. The evaluation report must document the evaluation board’s assessment of the identified weakness(s) and the associated risk to successful contract performance resulting from the weakness(s). This assessment must provide the rationale for proceeding to award without discussions.

3: EVALUATION FACTORS FOR AWARD

3.1 The solicitation requires the evaluation of price and the following non-cost/price factors.

Factor 1 – Experience Factor 2 – Safety Factor 3 – Past Performance Factor 4 – Small Business Utilization

The distinction between Experience and Past Performance is that Experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work described under the definition of recent, relevant projects, in terms of size, scope, and complexity. Past Performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

3.2 The relative order of importance of the non-cost/price evaluation factors is the technical factors (Factors 1, 2, and 4) are of equal importance to each other, respectively, and, when combined are equal in importance to the past performance evaluation/performance confidence assessment factor, Factor 3. When the proposal is evaluated as a whole, the technical factors and past performance/performance confidence assessment factor combined (i.e., the non-cost/price evaluation factors) are approximately equal to price. The importance of price will increase if the Offerors’ non-cost/price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a non-cost/price proposal’s superiority to the Government. Award will be made to the responsible Offeror(s) whose offer conforms to the solicitation and represents the best value to the Government, price and non-price factors considered.

3.3 Basis of Evaluation and Submittal Requirements for Each Factor.

(2) Basis of Evaluation:

The Government will evaluate price based on the total price. Total price consists of the basic requirements and all option items (all CLINs). The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in the solicitation. In accordance with FAR 52.217-5, evaluation of options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

(i) Comparison of proposed prices received in response to the RFP.

(ii) Comparison of proposed prices with the IGCE.

(iii) Comparison of proposed prices with available historical information.

(iv) Comparison of market survey results.

(b) Non-cost/price Factors:

Solicitation Submittal Requirements: The offeror shall submit one original, marked “Original”, five copies marked “copy”, each in a separate three-ring binder (1 ½ inch. maximum), and one electronic copy on CD with the following characteristics:

• Text pages 8 ½ x 11 format

• Drawings 11x17 inches and folded down to 8 ½ x 11 inches

• 12 point font, Times New Roman

• One complete electronic copy of the technical proposal factors as a single .pdf searchable file on a CD-ROM (include with the “Original” technical submission). If there are any conflicts between hard copies and/or electronic copies, the “Original” hard copy will govern.

• Include a cover page with Solicitation Number, Solicitation Title, Prime Contractor Name, Address, Phone Number, Fax Number, DUNS, Cage Code, Point of Contact, Title, phone number, and email address.

(1) Factor 1, Experience

(i) Solicitation Submittal Requirements:

Submit a minimum of two (2) up to a maximum of five (5) construction projects for your firm that best demonstrate your relevant experience (projects that are similar in size, scope, and complexity to this project). For purposes of this procurement, relevant projects are further defined as:

Size: Final construction cost of $15M or greater.

Scope/Complexity:

1. Work involving construction of approximately 1000 linear feet of cast-in-place reinforced concrete wall.

2. Installation of underground utilities including pipe casings and underground structures in active heavy industrial environment.

3. Soil stabilization using subsurface grouting.

4. Experience with heavy marine concrete, waterfront construction, and/or drydock experience.

5. Experience with phasing of projects to coordinate with and not impact ongoing operations of facilities.

Offerors must demonstrate experience with all of the work elements set forth above. This experience may be demonstrated cumulatively through all relevant projects submitted by an offeror. In order for a project to be determined relevant, it must meet the size requirement and at least one of the scope/complexity items.

Projects submitted for the offeror shall be completed within the past fifteen (15) years from the date of issuance of this RFP or be at least 75% complete by the date of issuance of the RFP. Projects which are not at least 75% complete as of the date of issuance of this RFP will be considered “Not Relevant”. Additionally, Projects completed prior to the past fifteen (15) years from the date of issuance of this RFP will be considered “Not Relevant”.

Experience of proposed subcontractors will not be considered. Furthermore, the offeror’s experience as a subcontractor will not be considered.

A project is defined as a construction project performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project;

rather offerors shall submit the work performed under a task order as a project.

The attached Construction Experience Project Data Sheet (Attachment C) is MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided pages (or two (2) single-sided pages).

For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e., unique features, area, construction methods).

If the offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, projects may be submitted for the Joint Venture partners. Experience submitted for one of the Offeror’s Joint Venture partners in which the Joint Venture partner was a partner in a different Joint Venture entity may be submitted to demonstrate relevant project experience. Offerors who fail to submit experience for all Joint Venture members may be rated lower. Offerors are still limited to a total of five (5) projects combined.

If the Offeror is proposing as a single corporate entity (i.e. not as a Joint Venture), the Offeror may submit relevant project experience it performed as a partner in a previous Joint Venture. Offerors are still limited to a total of five

(5) projects.

(ii) Basis of Evaluation:

The basis of evaluation will include the offeror’s demonstrated experience and depth of experience in performing relevant construction projects as defined in the solicitation submittal requirements. The assessment of the offeror’s relevant experience will be used as a means of evaluating the capability of the offeror to successfully meet the requirements of the RFP. The Government will only review five (5) projects total. Any projects submitted in excess of the five (5) for Corporate Experience will not be considered. An offeror that does not submit a minimum of two

(2) relevant projects as defined above will receive a rating of “Unacceptable” and will not be eligible for award

Offerors that demonstrate the following may be considered more favorably than those that do not:

- Relevant projects completed within the past five (5) years of the date of issuance of this RFP.

- Relevant projects performed inside a Navy Shipyard Controlled Industrial Area (CIA)

(2) Factor 2, Safety

The offeror shall submit the following information: (For a partnership or joint venture, the following submittal requirements are required for each contractor who is part of the partnership or joint venture; however, only one safety narrative is required. EMR, DART and TRC Rates shall not be submitted for subcontractors.)

(a) Experience Modification Rate (EMR): Include three previous complete calendar years’ (2017, 2018, and 2019) worth of data. This rate compares company’s annual losses in insurance claims against its policy premiums. The offeror may submit an insurance company-provided equivalent rate if no EMR exists. If the offeror has no EMR or premium, for any year, affirmatively state so and explain why. Any extenuating circumstances that affect the EMR and negative trends should be addressed as part of the factor submission.

(b) OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate: Submit three previous complete calendar years’ worth of data (2017, 2018, and 2019). If an offeror cannot submit an OSHA DART rate, for any year, affirmatively state so and an explanation must be provided. Any extenuating circumstances that affected the OSHA DART rate data negatively must be addressed as part of this factor submission.

(c) Total Recordable Case (TRC) Rate: Submit three previous complete calendar years’ (2017, 2018, and 2019) worth of data. If an offeror cannot submit TRC rates, for any year, affirmatively state so and an explanation must be provided. Any extenuating circumstances that affected the TRC rate data negatively must be addressed as part of this factor submission.

(d) Technical Approach for Safety: The technical approach to safety narrative shall be limited to one (1) double-sided page (or two (2) singled-sided pages), and must address all items below.

1. The offeror shall describe the plan for safety that will be implemented to evaluate safety performance of potential subcontractors as part of the selection process for all levels of subcontractors.

2. The offeror shall describe the safety management system that will be used to oversee the safety compliance and performance of self-performed and subcontractor performed work.

3. The offeror shall describe any innovative methods that will be employed to ensure and monitor safe work practices at self-performed and/or all subcontractor levels.

4. The offeror shall describe the methodology to execute an effective program that facilitates sound mishap prevention techniques and processes, employee reporting of unsafe conditions, unsafe activities, and near-miss mishaps.

Note: The narrative shall be limited to two pages. For a partnership or joint venture, the submittal requirements are required for each contractor who is part of the partnership or joint venture; however, only one safety narrative is required. Safety narratives for joint ventures may be up to four pages in length.

(ii) Basis of Evaluation:

The evaluation will collectively consider the following:

- Experience Modification Rate (EMR)

- OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART)

- Total Recordable Case (TRC) Rates

- Offeror Technical Approach to Safety

- Other sources of information available to the Government

(a) Experience Modification Rate (EMR): For the three previous complete calendar years the offeror will submit EMR. If no EMR exists, the offeror may submit an insurance company-provided equivalent rate explaining why not. If an insurance company-provided equivalent rate is provided, it will be treated the same as an EMR. Any extenuating circumstances that affected the EMR and negative trends should be addressed as part of this selection factor. The board will evaluate the EMR to determine if the Offeror has demonstrated a history of safe work practices taking into account any negative trends and extenuating circumstances that impact the rating.

(b) OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rates: For the three previous complete calendar years (2017, 2018, and 2019), the offeror will submit their OSHA DART, as defined by the U.S. Department of Labor, Occupational Safety and Health Administration. If unable to submit OSHA DART rates, affirmatively state so, and an explanation must be provided. Any extenuating circumstances that affected the OSHA DART rate data and negative trends should be addressed as part of this element.

The board will evaluate the OSHA DART rates to determine if the Offeror has demonstrated a history of safe work practices taking into account any upward trends and extenuating circumstances that impact rates.
