66. Reference: RFP Document – Page 26 last paragraph of Item 8 - Note: states “In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)0.
Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability “unknown” shall be considered “acceptable”. Is this statement correct? As past performance is one of the criteria for being awarded one of the MACC contracts should this be unacceptable in lieu of acceptable. It seems unfair that a company with no experience can submit a low cost and be awarded a contract when a company with outstanding past performance could be eliminated for having a slightly higher cost.
GOVERNMENT RESPONSE: This is a requirement per FAR 15.305(2)(iv). The requirement remains unchanged.
67. Reference: Drawing G-101 – General Note 2 - This note refers to the existing soils potentially containing POL (Petroleum Oil Lubricants) and chemicals associated with the fire suppressant AFFF.

GOVERNMENT RESPONSE: The pipes are abandoned. Cut and cap pipes below grade. Abandon in place. Contractor shall document them on redlines in accordance with 01 78 00 Part 3.
69. Reference: Drawing C-104 – Construction Note C8 - Construction Note C8 states “Provide Concrete Bollards (Eight Total) see detail 4/C-104. The plan only indicates 6 bollards. If we are to provide 8 bollards in lieu of the 6 shown, where are these other 2 bollards to be installed?
GOVERNMENT RESPONSE: There are only 6 bollards. Contractor will only be required to provide 6 total bollards.
70. Reference: Superintendent and QCM/SSHO - Do the Superintendent and CQM/SSHO have to be direct employees of the General Contractor?
GOVERNMENT RESPONSE: Yes.
71. Reference: Specification Section 013217 – Paragraph 1.4 Software - This Specification Section calls for the schedule for this project to be done in Primavera P6. As this is a small project would NAVFAC consider allowing the use of Microsoft project for the schedule?
GOVERNMENT RESPONSE: The Government will consider the use of MS Project by the contractor as a variation submittal in accordance with section 01 33 00 after award. Under no circumstances will the data, content, analysis, or information products required by 01 32 17 be lowered if MS Project variation is deemed acceptable after award.
72. Reference: Specification Section 014500 – Paragraph 1.5.2 Commissioning Authority - Is the Commissioning Authority for this project to be provided by NAVFAC or is this person to be hired by the General Contractor?
GOVERNMENT RESPONSE: General Contractor shall provide the Commissioning Authority.
73. Reference: Site Visit - Please advise if there will an additional Site Visit, and if we can have another RFI period to submit questions.
GOVERNMENT RESPONSE: A 2nd site visit has been scheduled for 13 January 2020 at 10:00 AM.
Please see Amendment 0004 for details. The RFI cut off date was extended via Amendment 0003 to COB 3 January 2020.
74. is it possible to do a second site visit? We have some subcontractors that would like to view the site.
GOVERNMENT RESPONSE: A 2nd site visit has been scheduled for 13 January 2020 at 10:00 AM.
Please see Amendment 0004 for details.
75. Reference: Factor 1 – Construction Experience (page 20) states: Use of the attached Construction Experience Project Data Sheet is MANDATORY and SHALL be used to submit project information.
Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page [or two (2) single-sided pages]. Please confirm the first page of the Construction Experience Project Data Sheet is excluded from the “one (1) double-sided page [or two (2) single-sided pages]” page limit.
GOVERNMENT RESPONSE: The first page of the Construction Experience Data Sheet is not excluded from the page limit.
76. Supervision: Please confirm the quality control manager position may be dual hatted by the superintendent or project manager.
GOVERNMENT RESPONSE: No, this is specifically rejected and not in compliance with the contract. Read sections 01 30 00, 01 35 26, and 01 45 00 and comply with the contract.
77. Phasing: Please confirm the project must be completed in two phases, phase 1 being the removal and new work for the 7 fuel tanks, and phase 2 being the removal of the two sprinkler system tanks.
GOVERNMENT RESPONSE: Confirmed. The work must be completed in two separate and sequential phases.
78. Reference: There seems to be inconsistency between self performance limitations per FAR 52.219- 3(d)(3) and the more recently issued SBA’s regulations concerning HubZone firms —namely, 13 C.F.R. § 126.616(d), 13 C.F.R. § 125.6(a)(3), and 13 C.F.R. § 126.700. Is compliance with the SBA's regulations sufficient for this solicitation given its under the broad general contracting NAICS 236220?
GOVERNMENT RESPONSE: CFR would take precedence over the FAR as the small business contracting program fall under SBA’s authority to provide regulatory guidance.
